Exclusive Agreements in Real Estate

What are Exclusive Agreements?  These are the agreements that are signed by a Tenant, Buyer, Landlord, or Seller and their real estate Agent or Broker to identify the terms associated with agency in real estate transactions.

Why should I sign an Exclusive Agreement?  Exclusives have multiple benefits, one important benefit being protection for the Broker and Client in the real estate transaction(s).  The client is protected against a harmful transaction as their Broker will proactively research and identify properties that meet their requirements, but more importantly negotiate the best terms in that client’s interest by asking the right questions of the other side, adhering to time frames, and raising flags if necessary.  All efforts by the Broker are completed on the client’s behalf.  

The Broker is protected against outside elements effecting the good work they are doing and gives them the authority to act on the clients behalf in these real estate transactions.  These agreements allow Brokers to take care of the real estate transaction for you while you continue to complete your daily routines on all non-real estate activities.

Having real estate representation saves you time and money!  I SAID.... having real estate representation......saves you....time....and.....$$$$$.  No more driving around in circles, no more surfing multiple websites, turn multiple phone calls into 1, actually receive callbacks, consolidate site visits, professional real estate negotiation, and on, and on, and on...

You wouldn’t go into an a courtroom trial without a Lawyer would you?  Then don’t go into a Real Estate transaction without a Broker or Agent.

Why you should hire a tenant representative to handle your leasing needs…

Aside from the obvious advantage of having a specialized dedicated professional handling a service they can do much better than a time-straped executive, these are some of the advantages off the top of my head to consider in hiring a tenant-rep for your space search...

Leverage

Once you tell the landlord you want to renew directly, you are basically saying “I want to stay in your building and am not looking elsewhere”. This not only gives the landlord significantly more leverage in negotiating but it also gives them an invitation to your office and an opportunity to say “Wow, this space is worth much more than I thought!”

Market

How can you be assured of the best deal if there is nothing to compare it to? When you forgo the opportunity to use a broker you loose out on valuable information of what kind of deal you really deserve.

Concessions

Some tenants believe that all they are negotiating for is the price and do not realize that they are owed free rent and cash for build-outs and other purposes. They overlook the fact that the landlord will have to come out of pocket for a new tenant with downtime. These oversights can be extremely costly and can be worth significantly more than the extra dollar or two per square foot. The broker’s job is to determine and negotiate for the appropriate concession.

(This is perhaps the biggest mistake tenants can make)

Compensation

Sometimes tenants believe that the commission the broker receives will make their space more expensive. This is simply not true. On every leasing deal there is a commission that will be paid by the landlord - the only uncertainty is whether the leasing agent who represents the landlord exclusively is earning that commission in its entirety or splitting that commission with the tenant’s rep. Either way, this has no bearing on the price the tenant pays.

New Real Estate Laws

There might be a new law that could come up down the road that tenants do not know about. If they are not protected, it can cost them thousands or even tens of thousands of dollars. For example; by 2019 all office space must be sprinklered – this should be negotiated so that the landlord will cover the costs and not pass on these expenses to the tenant.

Changes in the Building

Over the course of a tenant’s occupancy a new owner could come on board and change aspects of the building for better or worse. For example – A midtown building used to bill rent escalations on a CPI (Consumer Pricing Index) with no cap and now it runs on a direct operating expenses escalations which is eons better. The tenant would most likely never even be aware or know to ask for this.

These are just some of the most compelling reasons for using a tenant rep broker.. Ultimately, it comes down to the undivided focus I can give to my customer in helping them secure the most suitable space with the best possible terms.

Could your Greatness be hidden behind your position or title? Ok, follow me...I was watching some football over the weekend, and I saw some coaches who in previous positions, let's say coordinator positions, contribute and help teams win championships because in the position as a coordinator, was able to express their talents in a way they produced great results. However, in transitioning into a new position, the Head Coach, they are not experiencing the same success. Now don't get me wrong, there are anomalies to this but not as a whole. So, as a coordinator, the greatest was expressed and made to contribute to the overall winning as a whole. .. .. So I thought about this in business. Whereas some are title seekers, maybe the greatest one possesses is not meant to be expressed in certain positions and titles. So yes, you maybe smart as a whole, but your greatest does not express itself in another position. Just like the coaches, you can be a great coordinator and a mediocre head coach. Yes, you can have your own business, but are you the best at running it, or could you compliment another situation, and you all win together, or is your ego too big, and will not allow you to feel like you are working for someone else, or something bigger than you. Don't get me wrong, if an opportunity presents itself to you that allows you to expand your capacity, by all means do it.
