UNSEALING COURT RECORDS ...

on july 22nd, the jury at the Adler, Dong-geun & Jix vs Anchorage trial returned with a hung jury, as their votes were perfectly split between innocent ( as voted by bhaskar chanda, nari yeon, nikolai xiang & alice pallas ) & guilty ( blue nataphon maes, bryn ravencroft, angelique jackson & NPC ). en result, the judge reviewed the case & the newly-submitted evidence of the mask & cryptic note that was presented a couple days before potential sentencing. the mask had been taken in for fingerprinting & subsequent DNA testing, revealing no match to any of the accused. the closest match was a half-print that held a 70% match to a catalina romanov. the only problem is that they've been missing for over a decade ... aside the inconclusive match of DNA, the testing of the mask revealed traces of accelerant that had been used to start the fire & failed to match the alcohol bottle found on the scene. one side of the mask was scorched. the note that was left with the mask could not be matched to the handwriting of any of the three defendants. in the early morning of july 22nd, the judge ruled the defendants as not guilty, & the case was dismissed. the defendants would have any charges dropped & removed from their records. as described in the judgement, "it is impossible to forget the tragedy of willow cho-iverson's homicide in the year of 2023, & it is without doubt that i believe the wearer of the mask is culpable for its prevalence in both cases. the note with which the evidence was admitted feels taunting & cryptically threatening to a community worn down mentally & financially by their amusement in depravity. the presented evidence to the court leaves me with plausible deniability that i cannot convict guilt of the defendants & uphold the law. it is with great heaviness, i caution the public that our criminal arsonist is still out there." the city council announced plans for a press conference on thursday, july 25th to introduce & encourage the community to embrace their newest security system, CLAPPY.

I found out everything about @mainapnifavouritehoon bad experience with that behenchod through my gc mates last night when everything was over. I feel little bad but not much of regret because "mahila mandali" you all girls slayed. Even if I was here at that time when everything was ongoing I wouldn't have participated and would have watched everything through sidelines while hyping you up because it was moment of female fam, it was to show that moongfali what does "wo stree hai kuch bhi kar sakti hai" means. Aspiration Legacy Challenge - Gen 1.4

Challenge rules

Cam and Cait discussed what to do now and both decided Cameron should stay in University so he started a new term right away. Thanks to Caitlin's freelance gigs they could easily afford the term and add stuff to the house.

Cameron decided he likes affection and Julia called to ask Cait's advice about her new crush. While Caitlin went to meet her new client, Cameron worked on his homework. He managed to buy his own robotics station so he could keep working on his skills and hoped his investments would be worth it in the end. Fortunately, the meeting went very well and Caitlin got paid quite the amount.

When Cam left for class, Kyle Kyleson texted Caitlin to tell her she and Cameron were a great couple and they should think about something long term. "Kyle, we're engaged and I'm pregnant. I'd say we have something pretty long term going on :p" She replied on which Kyle sent "Aaaaawesome dudes!". A few hours later, Cam came home from school and was completely stressed out so he went to watch some tv as his fiance finished up her gig. When she got paid, she also received the Supreme Freelance Award.

And then it was time, Caitlin went into labor. Cameron was in class so she went to the hospital by herself. 'I can do this' she nervously mumbled to herself. Since she had to wait, she bought a snack and before she knew it, she had to push and welcomed a baby boy. "Welcome baby Chanda." Cait whispered, stroking his cheek with her finger. "Let's go home and see daddy."

Cameron couldn't believe he wasn't there to support his fiancé and watch his son being born but he fell in love with Chanda the moment he laid eyes on him. It was hard to leave but he had to go to class. In between classes, term papers and presentations he did do his best to spend a lot of time with him.

On his first birthday, Chanda aged up into a cautious infant with his mum's eye color and his dad's hair color.

A few days later, Julia came over for a visit. "Well, isn't he the most adorable baby?" She grinned as Caitlin handed Chanda over. She helped Cait put him down for a nap, before going outside for a chat. "I'm glad you came over. I wanted to ask you something. Will you be the sim of honor at my wedding?" Julia gasped, clapping her hands together as she nodded. "YES! I'd love to." She exclaimed excitedly, hugging her friend tightly.

Best Jupidad Moments #7 Nevermoor Ch 10 - Everyday Highs and Weak-Moment Lows

This chapter contains one of my favourite but underrated Jupidad moments and also the one where I think for the first time he properly gets it wrong and the fandom gasps in dismay…

(NB Altho this chapter also contains some excellent Jove one-liners, I’ll restrict myself to the parenting angle for this post and save the general Jupiter North fangirling for another day ;-) )

Kedgeree had fetched Jupiter and Morrigan from the Smoking Parlour, where they sat in a cloud of forest-green vapour (rosemary smoke: for sharpening the mind), playing a game of cards. Neither was certain of the rules, but Frank whispered advice in Morrigan’s ear, and Dame Chanda did the same for Jupiter, and every now and then someone would yell ‘Huzzah!’ and the others would scowl or throw something, and all things considered Morrigan thought it was a pleasant way to spend an afternoon. They both felt a bit put out when Kedgeree insisted they hurry to the foyer.

Although the dramatic moments are important, so much of the Jupiter-Mog relationship would have been built in the little everyday moments which wouldn’t normally make it into a novel. It’s awesome that Jess shoehorns this section in at this point because, although it doesn’t seem to add much to the ongoing plot, it gives so much more depth to the interactions between these 4 people who live together than such a short paragraph should. I’m so glad it survived the edit and would love to see more of these moments in future.

What’s special about it from a Jupidad angle?

First - they are equal parties here - this isn’t Jove in teaching mode, he’s as clueless about the card game as Morrigan and they are just having some nonsensical fun.

Second - remember that Nevermoor is written entirely from Morrigan’s POV - so how do we know they BOTH felt a bit put out unless he told her? I just love the fact that he’s either said or has otherwise made it clear from his expression or body language that he’s annoyed to be pulled away from that time they were having together. 

Hopefully to most children, the knowledge that their parents enjoy their presence wouldn’t be a surprise but to Morrigan who has been constantly told she is a burden by her parents and grow up accepting the fact that *everyone* avoids being around her… it’s a big deal.

I wonder if that is why this section is here? The biggest threat to her safety both physical (because she might literally be killed if deported) and mental (because her anxiety about it lurks in her mind disrupting her peace for the following 8 months or so) since she arrived in Nevermoor is about to intrude on her day. When a person looks back on life-changing moments like that, I think it’s quite common that they might hyper-focus on the ordinary moments that immediately precede the bombshell.

‘What’s the Stink doing here?’ Jupiter murmured to Kedgeree, who shrugged as he scooted off behind the concierge desk. ‘Who’s the Stink?’ whispered Morrigan. ‘Ooh – ah, I meant the Nevermoor City Police Force,’ Jupiter said under his breath. ‘We, er – probably shouldn’t call it the Stink. Not to his face. Actually, just let me do the talking.’

Another favourite moment because every parent has done this where they say or do something mildly inappropriate and then realise kiddo is paying rapt attention and they remember EVERYTHING… especially what you don’t want them to. That “Ooh - ah” is so familiar it cracks me up every time.

It happens again when Morrigan repeats his joke from a few weeks prior to the officer…

And where exactly are you from, Morrigan Crow?’ 

‘Nunya,’ replied Morrigan.

Jupiter tried to turn his snort of laughter into a cough. ‘She meant to say she’s from the Seventh Pocket of the Free State, Inspector. She just … pronounces it funny.’ 

The other thing to note about Jupiter’s conversation with Flintlock is that he is very polite, cool, “serene” when he is personally threatened with trouble and manages to remain calm and quiet even while pointing out the officer’s appalling lack of compassion. However, the icy voice appears as soon as Morrigan is insulted:

‘But I think you might find this scummy illegal of yours is more trouble than she’s worth.’ Jupiter looked him dead in the eye. ‘Don’t call her that.’

A chill crept up Morrigan’s spine. She recognised the cold wrath in Jupiter’s voice, the ice in his hard blue eyes. Flintlock, however, wasn’t so quick to catch on.

The staff of the Deucalion then intervene (hilariously) so we don’t know how things would have gone, but he takes the opportunity to pause and then come back with a well considered answer.

Jupiter was silent for some time, while Flintlock shot nervous looks in the Magnificat’s direction. When Jupiter finally spoke, it was in a quiet, measured voice. ‘You have no right to demand the papers of someone who falls under the jurisdiction of the Wundrous Society, Flintlock.’

But then he messes up big time, as we all do sometimes when really stressed or knocked off kilter…

Morrigan turned to Jupiter, who looked as tense as she’d ever seen him. ‘Can they really kick me out?’ she asked, a lump forming in her throat. She thought of the Hunt of Smoke and Shadow, of its black shapeless form looming in the darkness. The back of her neck felt prickly and cold. ‘What happens if I have to leave Nevermoor?’ ‘Don’t be silly, Mog,’ Jupiter said bracingly. ‘That’s never going to happen.’

He left the foyer without looking at her.

Argh, argh, argh. First, he calls her very-valid-and-legitimate concern “silly”… and then he leaves without looking at her - that last line is devastating. And it gets its own paragraph just to underline it.

This was a moment where she needed, if not detailed answers, then compassion, understanding, some of that Jupidad eye contact… she needed to know SHE wasn’t the problem and that even if he can’t tell her exactly what it is yet, he has a plan that will mean the threat won’t materialise and that she can trust him.

If this had gone differently, how would it have changed the rest of the book? Would her Fright Trial have been the same, Would she have made the decision she did on Christmas evening? Would Mr Jones have got under her skin and messed with her trust in Jupiter quite as much?

One of the things I find most anxiety-inducing about being a parent is that you can get things right 99% of the time and then say something stupid in a moment of weakness and… ugh what if they remember that more than the rest? What if that damages your relationship forever? What if after all that effort to try to do things right you still mess your kid up anyway? Personally I just apologise a lot and try to make sure that are so many more times she can remember feeling loved and trusted etc that the slip ups get crowded out. Thankfully, kids are usually better at being cool with the fact people make mistakes all the time and they get over it faster than us more introspective angst-ridden adults do.

It’s encouraging that our Jupidad doesn’t get it right all the time. If even fictional super-parents can get it wrong and bounce back, so can I. And it’s obviously way more interesting to read - even brilliant humans are human -and one of the great things about Jessica’s characters is that she shows over and over that they are really human, you feel like you know them, and that’s what makes this series so utterly compelling.

Omg so exciting, so maxi skirts are so good, idkby maybe try follow these rules. The fitted rule, so for a fitted maxi get a looser top and for a looser top get a fitted maxi, this helps you feel balanced. Second would be to look for the sort of maxi material, like a denim maxi is super structure so would look good with a band tee, or a silky maxi might look best with button ups. Ofc you can break these rules, anyway here's some inspo to give you an idea!

Whether denying maternity leave to surrogate mother amounts to violation of right to life under Article 21 of the Constitution of India? and

Whether the right to life includes the right to motherhood and also the right of every child to full development?

Facts:

Petitioner became the mother of twins via surrogacy process.

She applied for maternity leave for taking care of newborn.

Her request was not allowed vide order dt.23.06.2020 on the ground that there is no no provision under the Rajasthan Service Rules, 1951 for granting maternity leave to the mother who got children through the process of surrogacy.

Agreed by refusal of maternity leave present WP was filed praying direction to the respondents for sanctioning maternity leave for 180 days from 01.02.2020. Payment of leave salary equal to pay drawn by her preceeding maternity leave. Direction to the respondents for not debiting maternity leave availed by the petitioner from her leave account and a separate entry in this regard shall be made in the service book of the petitioner.

Submission of the Petitioner’s Counsel

Rajasthan Service Rules were enacted by the legislature in the year 1951 & at that time there was no such procedure of begetting children via surrogacy.

Now parents have option of having children via surrogacy if they don’t have issue from the wedlock.

Under these circumstances, the petitioner is entitled to get maternity leave of 180 days for taking care of children born through surrogacy process.

Though there is no such Rule under the Rajasthan Service Rules of 1958 and there exists no similar Rules in other States as well.

But the Delhi High Court in the case of ‘Rama Pandey vs. Union of India & Ors’ has interpreted the Rule regarding grant of maternity leave where the children were born through surrogacy process.

The Delhi High Court has not only granted medical leaves to the surrogative mother but also granted him other service benefits & the judgement was followed by Bombay High Court in several cases.

Submission of the counsel of the Respondents

Since there is no provision in the Rajasthan Service Rules for granting Maternity leave to the mother having children via surrogacy hence no illegality is caused by the Respondents.

In the absence of any rule the petitioner is not entitled to get any indulgence from this Court, hence the petition is liable to be rejected.

Observation of the Court

Maternity Leave s not defined under the Rajasthan Service Rules 1951

Provision of grant of maternity leave was substituted vide notification dt. 06.12.2004 by Department of Finance, Government of Rajasthan.

Mother & Child have nowhere been defined under the Rajasthan Service Rules 1951 & Maternity Beneit Act 1961.

Maternity leave in common parlance means where a female employee is given a certain amount of time off, after birth of the baby to take care of her newborn and to develop the bond of love, care and affection with the new little one on arrival in the family.

A female can become a mother by giving birth to a child or via surrogacy.

If maternity means motherhood, it would not be proper to distinguish between a natural and biological mother and a mother who has begotten a child through surrogacy.

The object of maternity leave is to protect the dignity of motherhood by providing for full and healthy maintenance of the woman and her child.

Surrogacy has been recognized by the Government & The Surrogacy (Regulation) Act, 2021 was enacted which deals with the provisions of regularization of surrogacy and surrogacy procedures.

Hence, surrogacy is an option for couples to have a child for whom it is not possible to carry a baby at their own. Now, one can have a child through surrogacy process and the same is recognized under the law.

Once the surrogacy has been recognized by the Legislature, by enacting the Act of 2021, the benefit of maternity benefit can’t be denied to the mother having children via surrogacy.

The provisions of maternity leave and its entitlement to surrogacy and commissioning mother, several High Courts have held that commissioning mother (biological mother) is entitled for grant of maternity leave and this issue is no more res integra (new and not dealt).

Right to life under Article 21 of the Constitution of India includes the right to motherhood and also the right of every child to full development.

No distinction can be made by the State Government to a natural mother, a biological mother and a mother who has begotten a child through surrogacy method.

The action of the State-Respondent is quite unjustified in denying maternity leave to the surrogate mother for taking care of her twins born through surrogacy method.

Making a difference between natural biological mother and surrogate/commissioning mother would amount to insult of motherhood.

This is high time, provisions are silent, for the Government to bring appropriate Legislation in this regard for grant of maternity leave to the surrogate mothers.

Order

Writ Petition stands allowed and the impugned order dt.23.06.2020 is hereby quashed and set aside. The respondents are directed to sanction 180 days of maternity leave to the petitioner, as per the request made by her.

This Court directs the Registry that copy of this order may be forwarded to the Ministry of Law and Justice, Union of India, New Delhi as well as to the Principal Secretary, Department of Law and Legal Affairs, Government of Rajasthan, Jaipur, for such action as, they may deem fit to take in this behalf.
