me, listening to a podcast about a guy in prison based entirely on a coerced confession: what do you mean the members of the jury still think hes guilty now that they know about coerced confessions??? did you not hear four police officers interrogating and shouting at a 19-year-old while hes sobbing through a story inconsistent with the actual evidence???? there was no other evidence, how do you still think hes guilty???
me, ten minutes later: ...oh, right. if they say hes not guilty, that means they sent an innocent kid to prison. yeah, now that uh makes sense.
#kai rambles#i finally listened to bear brook season 2#and i spent pretty much the entirety of it internally screaming#because this guy has spent over three decades in prison because this ''hotshot detective with the best solved case record'' had a hunch#and then bullied his way into ''proving it'' whilst leveraging criminal charges over people and interrogating people for over 10 hours and#not fucking solving anything considering he got two confessions that were both a) recanted b) inconsistent with the evidence of the case and#c) inconsistent with each other. and then his main suspect who did not confess had to be released without charge because the other two#wouldnt testify to his supposed involvement and that was the entirety of the evidence and then one of the other suspects#a kid in his early 20s got acquitted partly because that detective broke courthouse rules so he and his partner could get their stories#correct and just told the prosecutor he was doing that as if the prosecutor wouldnt tell the judge like its his job on the line too#and then the guy STILL IN PRISON today was convicted because ''why would someone confess to a murder they didnt commit?''#and i get ''oh it was a different time'' but god the privellege of those jury members to have never been in a situation where you would say#ANYTHING to get someone to stop yelling at you or interrogating you or just hurting you in anyway. hes 19 years old and crying sylvia#also like if a detective has a very high success record#someone should check that because while maybe it is genuinely someone finding the people responsible but thats a blue moon situation#also also the guy in prison jason carroll's attorney recently found the original evidence from the case including fingernail clippings#with the blood of her presumed murdered on them and obviously the attorney cynthia wants them dna tested so she petitioned the coury#*court#and the prosecution objected saying ''there is no result from dna evidence that could exonerate jason carroll'' which is obviously a lie#because they want to keep their conviction record nice and shiny but god fuck that team so much#there was literally a serial killer who lived nearby around that time like if its his blood are you gonna argue jason was still involved??#im very angry about it#can you tell?#i was angry crying earlier. i put the season on while i played sims expecting it to be more like the first season but nope#i was in for an angry ride instead

A federal judge in Chicago has denied a motion seeking a temporary restraining order and preliminary injunction to block Illinois’ assault weapons ban and a similar ordinance in Naperville.
U.S. District Judge Virginia Kendall ruled Friday that the Illinois and Naperville bans on selling assault weapons are “constitutionally sound.”
Lawyers for the National Association for Gun Rights and Robert Bevis, who owns a gun store in Naperville, had sought the court orders in a lawsuit to stop the bans.
As is now common in such cases, they argued that it’s “impossible” for the new state gun law and a similar Naperville ordinance to meet the requirements for such laws that were set out in the landmark U.S. Supreme Court case last summer known as New York State Rifle & Pistol Association v. Bruen.
The Supreme Court ruled in that case that governments must show that gun regulations are “consistent with the nation’s historical tradition of firearm regulation.”
In her ruling, Kendall wrote that the Illinois and Naperville bans meet that burden: “Because assault weapons are particularly dangerous weapons and high-capacity magazines are particularly dangerous weapon accessories, their regulation accords with history and tradition. Naperville and Illinois lawfully exercised their authority to control their possession, transfer, sale, and manufacture by enacting a ban on commercial sales.”
While the lawsuit is one of a number of challenges facing Illinois’ ban, Kendall’s decision appears to be the first from a federal judge considering whether the ban meets the standard set out by the Supreme Court last year.
In that ruling, whose majority opinion was written by Justice Clarence Thomas, restrictions on weapons must be limited to dangerous and unusual arms that aren’t commonly used.
The weapons banned by the Illinois law are “unquestionably” in common use, the lawyers for the National Association for Gun Rights argued.
“An arm that is in common use for lawful purposes is, by definition, not unusual,” the lawyers wrote. “Such an arm therefore cannot be both dangerous and unusual and therefore cannot be … subjected to a blanket ban.”
Kendall ruled that the government can regulate highly dangerous arms, including assault weapons and large-capacity magazines, that pose an unusual risk that can cause greater harm and more deaths.
“The text of the Second Amendment is limited to only certain arms, and history and tradition demonstrate that particularly ‘dangerous’ weapons are unprotected,” the judge wrote.
Assault weapons are also not commonly used for self-defense, Kendall wrote, and gun owners have many other firearms they could use for protection. The judge said the request to block the bans didn’t demonstrate that failing to do so would cause irreparable harm to those suing.
“Bevis has not furnished any evidence that he will lose substantial sales, and he can still sell almost any other type of gun,” Kendall wrote. “While a high number of assault weapons are in circulation, only 5% of firearms are assault weapons.”
Kendall also ruled that the state and Naperville have a more compelling argument for protecting the public interest than Bevis and the National Association for Gun Rights.
“On the one hand, they suffer an alleged deprivation of a constitutional right,” the Judge wrote. “Again, though, the financial burden and loss of access to effective firearms would be minimal. On the other side, Illinois and Naperville compellingly argue their laws protect public safety by removing particularly dangerous weapons from circulation.”
The plaintiffs filed suit last year after Naperville passed its ban, then added the state to the case after Gov. J.B. Pritzker signed into law the statewide assault weapons ban.
The state law — which is now on hold in some parts of Illinois as a result of a separate lawsuit — bans the sale of assault weapons and caps the purchase of magazines at 10 rounds for long guns and 15 for handguns. It also makes rapid-fire devices known as switches illegal because they turn firearms into fully automatic weapons. Anyone who already owns the banned guns is allowed to keep them but required to register them with the Illinois State Police by Jan. 1.
Earlier this month, a state court judge in southern Illinois blocked enforcement of the assault-weapons ban against 865 gun owners and one firearms store owner who filed a lawsuit challenging the law.

Something about living in a society where we're all human and we have the death penalty. Like juries? Judges? Imagine. You believe in the death penalty because legally you have to, to be on this case. But you're just a person and you're alive and now another human's life is in your hands. You're not the executioner, no no, your hand isn't pressing the plunger or flipping a switch or pulling a lever, but you have to decide, really decide if this person deserves to die for what they've done.
I'm trying to imagine being responsible. I think maybe I could be convinced that someone was vile enough to deserve death. Or dangerous enough that their death would keep people safe. But also. I can imagine looking at the person on death row and just seeing a human being. Like what makes any of us think we know anything? Life is so complex, minds are straight up insane, things happen for reasons, and sure that reason could be because someone is pure evil or because their life circumstances didn't line up exactly right.
Idk. Thinking about the death penalty I guess

oh yes you were at court! i forgot that was at the start of that post lmao. i've been to court twice when i was super young for drinking underage and then smoking lool it was so boring and long and shit but thankfully you were just there for moral support, i hope it wasen't such a bad thing your friend had to deal with! I remember seeing you post about moving but i forget if it was TO or AWAY from your parents but that clears it up. I totally get you on that though, i'm living at home right now and i feel kind of similar about not feeling comfortable in your own home. Its a bit different for me, but similar enough. Hell my stepdad even sleeps in the living room too! hes always done that so ive always felt like i had to be on eggshells when night time hit. I used to sneak smoking in the backyard back in the day myself, i got caught once when i was in highschool he made me throw all my pieces out which sucked big time. ahhh i love that, art! you should totally show more stuff on here too, at least if you're comfortable and its not stuff you'd wanna sell, i would absolutely love to see any of it 🖤i've dabbled in writing poems and things i planned to make songs, although only recently. I've always wanted to be a musician but my attempts at learning guitar over the years have never ended up lasting long and i try to learn singing but i just dont really think i can. plus i was always afraid of self expression so i never wrote until a few years ago. i still do, because music is so important to me (which is why i did pick 🎤!) and it makes me so happy but yeah. i have 2 shows im headed to in a few months even so im so excited 🥰my day though has been so boring, i mostly played video games and watched youtube videos. watched another episode of a show i've been watching called Silo, which i absolutely love. im so surprised you had room in your tags still after myself lmao, but i do that same thing i always talk in the tags! also i'm giving you tons of hugs and kisses 😘🥰 - 🎤
