Lula promises to build controversial Amazon road

President Luiz Inácio Lula da Silva on Tuesday said he would discuss with Governor Wilson Lima of Amazonas the renovation of BR-319, a badly damaged federal road spanning 918 kilometers that connects state capital Manaus, the largest city in Brazil’s Amazon, to Porto Velho, the capital of Rondônia state.

“We need to stop this story of thinking that [Environment Minister] Marina [Silva] does not want to build BR-319,” Lula said during a visit to a poor community in the city of Manaquiri, about 150 kilometers from Manaus.

“BR-319 was built in the 1970s, it was abandoned due to the negligence of I don’t know who, it remained inoperative, and today it’s like this: it has one part that works at either end and in the middle there are 400 kilometers rendered unusable”, he added.

When passable in the dry season, the 885-kilometer road is the only overland connection between Manaus, a heaving city of 2 million people, and the rest of Brazil.

To its advocates, the BR-319 is a vital piece of infrastructure that must be recovered for the benefit of the populations and economies of the Amazon; to its detractors, it is a blight on the most preserved area of the rainforest, that threatens widespread environmental destruction.

At his initial court appearance, Castillo looked downcast as he gave simple yes or no answers and his attorney argued that he had been arbitrarily ousted from Peru’s presidency on trumped-up charges of rebellion.

The U.S. condemned Castillo’s power grab as illegal and even leftist allies have refused to speak out against his overthrow. A major exception was Mexican President Andrés Manuel López Obrador, who called Castillo’s removal a “soft coup” fueled by deep-seated racism against the former school teacher from the heavily indigenous Andean highlands.

“It is no longer military intervention,” said López Obrador. “It’s done with control of the media by the oligarchs, undermining legal and legitimately constituted authorities, especially if they want to do something for the benefit of the long-suffering people who do not belong to the elites.”

Meanwhile , Castillo’s successor, like many Peruvians, seemed eager to turn the page. In comments to journalists Thursday, Dina Boluarte, who served as Castillo’s vice president, appealed for a “truce” from the political feuding that has paralyzed Peru for years so that she can “reorient” the country. With polls showing Peruvians despising Congress even more than they do Castillo, she suggested that she would consider holding early elections — something that requires approval of a hard-to-muster constitutional amendment. But once in office he cycled through dozens of inexperienced Cabinet choices, a number of whom have been accused of wrongdoing. He also faced a hostile Congress, which first tried to impeach him last December. At the time, a relatively small group of opposition lawmakers cited an investigation by prosecutors into illicit financing of the governing party. To remove the president requires two-thirds of the 130 lawmakers to vote in favor. Only 46 voted in favor.

Congress tried to impeach Castillo again in March for “permanent moral incapacity,” a term incorporated into Peruvian constitutional law that experts say lacks an objective definition and that Congress has used more than a half dozen times since 2017 to try to remove presidents. The effort failed, this time with only 55 votes in favor.

On Wednesday, Peru was girding for a third impeachment vote. The night before, the president said in an unusual midnight address on state television that a certain sector of Congress had it out for him and that he was paying for mistakes made due to inexperience. [...]

The president can dissolve congress to end a political standoff but only in limited circumstances — after losing two votes of confidence in Congress, which last occurred in 2019, when then President Martin Vizcarra dismissed lawmakers. [...]

Despite the high political drama, only small clashes erupted between a handful of Castillo supporters and riot police on guard outside.

Boluarte, a 60-year-old lawyer, was sworn in as Peru’s first female president. She said her first order of business would be to address corruption, ostensibly what led to Castillo’s downfall. [...]

López Obrador said Thursday that he had greenlighted Castillo’s request for asylum that he made in a phone call to the Mexican president’s office. But he said those plans were frustrated when Castillo was intercepted by police on his way to the Mexican Embassy in Lima, where a group of protesters awaited.

Colombia’s President Gustavo Petro said Castillo had committed “political suicide” by weaponizing a seldom-used clause of the constitution to combat his adversaries in Congress, who he said never allowed Castillo to govern.

Anti-democracy can’t be fought with more anti-democracy,” he said, echoing similar comments by Brazil’s incoming president, Luiz Inacio Lula da Silva.

Safe the week: Kleiner Worksshop, letzte Woche September 2024: Lex Satyra. Auf Antrag des Augustgastes Friedrich, von dem nicht nur die Anregung ausgeht, wird's gemacht.

1.

Thema wird die Satire (auch in Form der Burleske) sein, aus rechtstheoretischer und rechtshistorischer Sicht.

Die Satire soll nach kanonischem Recht, nach Gratians Decretum ein Gesetz sein und Gesetze haben. Das wollen wir historisch und theoretisch an Exempeln entfalten (weil wir nirgends den Wortlaut dieses einen Gesetzes, nicht einen Wortlaut gefunden haben, viele, viele, viele aber. Wir fragen auch nach dem Verfahren um dieses Gesetz oder nach dem Verfahren dieses Gesetzes. Auf Bruna Limas Forschung zu Luiz Gama hin, dem brasilianischen Befreier, dem Abolitionisten, dem ersten schwarzen Anwalt und erstem Autor der brasilianischen Recht-und-Literatur-Bewegung (Law and Literature) fassen wir auch die Burleske als Gesetz der Satire auf. Gama veröffentliche Burlesken im Kampf um das Recht. Es soll also unter anderem nicht nur um weißen Humor, sondern auch um schwarzen Humor gehen. Nicht nur weißer Scherz, Schmerz, nicht nur weiße Papiere, Satire, tiefere und schiefere Bedeutung, alles das auch schwarz.

Unter anderem hat sich Peter Goodrich mit dem Thema im Rahmen seiner Beiträge zur Minor Iurisprudence beschäftigt ("Lex Laetans"). Friedrich Weber-Steinhaus arbeitet zu den Akten Karl Krauss' - was unter anderem die Frage aufdrängt, ob es mit einem Gesetz der Satire auch Verfahren, Routinen, Routen, Medien der Satire gibt und ob es weiter noch satirische Objekte gibt. Die These lautet: ja, das alles gibt es und ist präzise, historisch und theoretisch entfaltbar.

Eine weitere probenhafte These lautet vorläufig: Bei allen satirischen Texten, allen satirischen Techniken und Objekten handelt es sich um Weisen des Zuviel: too much und/oder too soon erscheint die Satire und die Satire erscheint too much, too soon, weil ihr etwas zuviel ist und die darum etwas einholen will, was noch nicht geschrieben, noch nicht sichtbar und noch nicht wahrnehmbar ist. Nicht unbedingt fröhliche Wissenschaft, aber schon gerne auch fröhliche Wissenschaft, vielleicht sogar ein Schuss fröhlich organisierter Pessimismus oder sogar, wer weiß, fröhlicher Messianismus, auf jeden Fall: gay is the message. Nicht froh, alles andere als froh, ist die Botschaft trotz allem fröhlich. Wenn Lagen und Situationen hoffnungslos, aber nicht ernst sind, dann bilden sich, so eine dritte These, Millieus und 'kleine Tope' der Satire. Ob sich frohe Botschaften ins Boot der Satire setzen lassen und Testamente Satiren sein können, ist äußerst fraglich, dem wollen wir aber ohnehin später einmal nachgehen. Jetzt erst einmal anfangen, jetzt nicht froh und trotz allem fröhlich.

Das too much too soon, aus dem Satire sprudelt und spukt, erscheint einerseits ein Fund aus der Archäologie des Pluralismus zu sein. Aber seltsam, ein seltsamer Fund, den es ist schwer erkennbar, was an der Satire vermehrt, was durch sie vermehrt sein sollte. Nicht erst bei Karl Krauss kommt die Satire auch rigide daher. Vorläufig legen wir sie an den Rand und ordnet sie noch nicht der Pluralisierung, nicht der Vermehrung zu.

Man erkennt es gleich, wenn man denn aus dem Umfeld der Bild- und Rechtswissenschaft am MPI in Frankfurt kommt: Der oben abgebildete Druck ist aus dem gleichen Druckhaus, aus dem auch Pancirolis notitia dignitatum stammt. In Lyon stand das Haus, so sehendortdie Drucke um 1600 aus, vielfaltig und barock. Das Druckersignet ist gegenüber dem Signet der Drucke der notitia dignitatum variiert! Dazu gibt es was zu sagen, später!

Der Druck hat Suggestivkraft, das sagt das Druckhaus auch. Das Bundesverfassungsgericht, dessen Geschichtshüter, der Erzähler Grimm einfordert, man solle es noch viel viel wichtiger und ernster nehmen als es genommen wird , hat zur Theorie und Geschichte der Suggestivkraft einiges geschrieben. Die These lautet dort (ich paraphrasiere) das sich die Sugestivkraft aus den Büchern und Theatern, dem Kino und den Stadtplätze, von den Strassen, von "Kneipe, Kirche und Kino" ("Trotzki") zurückgezogen haben muss (oder dort nie war), und im gartenartig, paradiesisch gepflegten Reservat des Rundfunks brodele. Kennze Rundfunkanstalten? Kennze Landesmedienanstalten? Lustige Idee!

Anders gesagt: Grimm und die immer noch übrigen Erzähler des Bundesverfassungsgerichts sagen, ZDF und RTL seien hypnotisch, sollten hypnotisch sein oder könnten hypnotisch sein, auf jeden Fall sitze dort regierungs- und verwaltungsbedürftige Suggestivkraft. Kann sein, habe keinen Fernseher mehr und im Internet deren Seiten noch nie besucht. Aber wer weiß, was die Massen, Folks, Vöker und Bevölkerungen so tun. Auf jeden Fall haben die barocken Drucke aus Lyon dolle Wirkungen auf mich.
