Barely a day after former President Donald Trump was indicted for the third time, some Senate Republicans are already trying to undermine the credibility of the federal judge who was randomly assigned to preside over his trial.
Here’s a detail they’re hoping you won’t notice: They unanimously voted to confirm her.
Sen. Ted Cruz (R-Texas), speaking on his podcast on Wednesday, accused U.S. District Judge Tanya Chutkan of being “relentlessly hostile” to Trump and claimed that she has “a reputation for being far-left, even by D.C. District Court standards.”
But Cruz voted to put Chutkan into her seat on the U.S. District Court for the District of Columbia in June 2014. So did every other Senate Republican when she was unanimously confirmed, 95-0.
That includes Sen. Lindsey Graham (R-S.C.), who nonsensically claimed Wednesday that “any conviction in D.C. against Donald Trump is not legitimate.”
“The judge in this case hates Trump,” Graham said in a Fox News interview. “You can convict Trump of kidnapping Lindbergh’s baby in D.C. You need to have a change of venue. We need a new judge. And we need to win in 2024 to stop this crazy crap.”
Aides to Cruz and Graham did not respond to requests for comment on how the senators square their votes to confirm Chutkan with their criticisms of her ability to be a fair judge.
Tuesday’s federal indictment of Trump accuses him of serious crimes related to the 2020 presidential election and the Jan. 6, 2021, Capitol insurrection: conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.
Chutkan, a Jamaica-born former assistant public defender and an appointee of former President Barack Obama, has already been overseeing cases related to the Jan. 6 attack. She’s handed out some of the most aggressive sentences yet to rioters who took part in the violence that day. Of the 11 cases that have come before her, she imposed tougher sentences than those sought by the Justice Department seven times and matched what the Justice Department was seeking four times, according to an Associated Press review.
In all 11 cases, Chutkan sentenced the defendants to prison time.
This is what is likely driving the GOP attacks on Chutkan: They know she’s not likely to go easy on Trump now.
Beyond trying to discredit the judge, some Republicans, like Graham, are parroting Trump’s absurd demand for a change of venue. The former president has called for moving his case to the “more diverse” and “politically unbiased nearby State of West Virginia!” (Virginia and Maryland are much closer to D.C., for what it’s worth.)
Not a single Republican raised concerns about Chutkan during her nomination hearing in the Senate Judiciary Committee in February 2014. In fact, only one GOP member of the committee even showed up to the hearing: Sen. John Cornyn (Texas), who was only there to rave about a separate Texas judicial nominee on the schedule. He left before Chutkan was up.
Cruz and Graham were both members of the committee at the time.
Neither attended Chutkan’s hearing.

WASHINGTON — Senate Republicans on Wednesday blocked a Democratic-sponsored bill that would require Supreme Court justices to adopt a binding code of conduct. “The highest court in the land cannot and should not have the lowest ethical standards,” Judiciary Committee Chairman Dick Durbin, D-Ill., said in a floor speech before the motion. Durbin took to the Senate floor Wednesday and sought to pass the Supreme Court Ethics, Recusal, and Transparency (SCERT) Act by “unanimous consent,” which immediately faced Republican opposition. As he promised to do Tuesday, Sen. Lindsey Graham, R-S.C., led a group of GOP senators in blocking the Democratic request, effectively stalling the legislation.
Graham called the bill an “unconstitutional overreach” that would “undermine the court’s ability to operate effectively.” He was joined by Sens. John Kennedy, R-La., Mike Lee, R-Utah, and others in objecting. “I do not think this bill is about ethics. This bill is about abortion,” Kennedy said on the floor Wednesday, accusing Democrats of pushing it because they’re angry that the court overruled Roe v. Wade. That sparked a debate on the floor, with numerous Democrats chiming in to make the case for the bill as an instrument of transparency and a way to protect the legitimacy of the court. The bill would require the justices to adopt a binding code of conduct, create a mechanism to investigate allegations of violations of the code and other laws, require them to explain decisions to recuse themselves from cases and improve disclosure rules when a justice is connected to a party or amicus in a case.
“The Supreme Court has squandered its almost mystical authority, its unique power in the federal government,” Sen. Richard Blumenthal, D-Conn., said in a floor speech.
Republicans in the Senate voted against the SCERT Act, thereby making themselves enablers to the corruption of the right-wing SCOTUS majority.

The problem for them is that after Trump is gone, their self-abasing, grovelling, and humiliating comments will still be on the public record.
An unequivocal defeat for Trump would send the GOP into a vortex of chaos. That's even more of an incentive to make sure he's beaten.

The Biden administration is willing to work with Congress to potentially impose sanctions against international criminal court officials over the prosecutor’s request for arrest warrants for Israeli leaders over the Gaza war, Antony Blinken, the secretary of state, said on Tuesday.
At a Senate appropriations subcommittee hearing, Republican Lindsey Graham told Blinken he wanted to see renewed US sanctions on the court in response to the move announced by ICC prosecutor Karim Khan on Monday.
“I want to take actions, not just words,” Graham said to Blinken. “Will you support [a] bipartisan effort to sanction the ICC, not only for the outrage against Israel but to protect, in the future, our own interest?”
“I welcome working with you on that,” Blinken said.[...]
Joe Biden and his political opponents have sharply criticized Khan’s announcement, arguing the court does not have jurisdiction over the Gaza conflict and raising concerns over process.
The United States is not a member of the court, but has supported past prosecutions, including the ICC’s decision last year to issue an arrest warrant for Vladimir Putin, the Russian president, over the war in Ukraine.
Republican members of Congress have previously threatened legislation to impose sanctions on the ICC, but a measure cannot become law without support from Joe Biden and his fellow Democrats, who control the Senate.

Sen. Lindsey Graham, the top Republican on the Judiciary Committee, plans to block an effort by Senate Democrats to unanimously pass a Supreme Court ethics bill Wednesday on the Senate floor.
“I will object,” Graham, R-S.C., told NBC News.
Senate Majority Whip Dick Durbin, D-Ill., who chairs the Judiciary Committee, said earlier Tuesday that he would make a unanimous consent request to pass Supreme Court ethics legislation that the panel advanced last July.
Graham's objection means the bill won't be able to move forward, because any senator can block a request.
It isn't clear whether the measure will come up for a vote under the normal process, but Senate Majority Leader Chuck Schumer, D-N.Y., said he’s considering it.
Even before Graham made his comments, Democrats doubted the legislation would advance. “I think I know the outcome, but we’re going to go through the exercise to make sure that both parties are in the record,” Durbin told reporters Tuesday afternoon.
The Democratic-led Judiciary Committee advanced the Supreme Court Ethics, Recusal, and Transparency Act on a party-line vote nearly a year ago, but it can't break a filibuster on the Senate floor without 60 votes. Democrats have 51 members, and no Republican is on board with the bill.
In a news release, Democrats said the vote follows "a myriad of apparent ethical lapses by Supreme Court justices, which demonstrate the need for ethics reform."
A spokesperson for the Supreme Court didn't immediately respond to a request for comment Tuesday night.
Justice Clarence Thomas reported a pair of trips in 2019 with billionaire friend Harlan Crow to Bali and to the private Bohemian Grove club in California in his annual financial disclosure report, which was released last week. ProPublica reported on Thomas' and other justices' previously undisclosed lavish travel in a series of stories last year that raised questions about the court’s ethics.
The bill would give the court 180 days to adopt and publish a code of conduct, allowing the public to submit ethics complaints that would then be reviewed by a randomly selected panel of lower-court judges. It would also establish new rules for disclosing gifts and travel.
The legislation would also require justices to publicly explain any decisions to recuse from cases.
Durbin last month called on Supreme Court Justice Samuel Alito to recuse himself from a pair of cases tied to the Capitol riot on Jan. 6, 2021, after The New York Times reported that an upside-down American flag was displayed outside his home in the days after the riot. Alito declined to step away from those cases.
