Putting democracy above decorum
March 7, 2025
Robert B. Hubbell
Note: I will hold a Substack livestream on Saturday, March 8, at Noon Pacific / 3:00 PM Eastern. The livestream is open to everyone who has the Substack App on their phone or tablet (The App not available on computer). I have moved the livestream later in the day because Jill and I will be traveling by train from Edinburgh to London on Saturday. I will host the livestream after we arrive in London.
Overview
There is a lot going on—to the point that it feels overwhelming. Which is Trump's point. Democrats can fight back in court on some of Trump's efforts but must rely on political blowback to slow or undo the damage that he is causing in other areas.
Democrats are doing great work in protesting and calling their representatives. Don’t let anyone tell you that such efforts are ineffective. To the contrary, they are grabbing the attention of every member of Congress, especially Republicans. We must keep up the fight on all fronts.
Trump continues to cause chaos in global trade markets, the American economy, and the lives of Americans who depend on the federal government to help keep them safe, healthy, and financially secure.
Trump's chaos will harm every American—ensuring that a backlash will eventually overwhelm Trump and his enablers. We must endure, we must not quit, we must turn our outrage and anxiety into action.
This period will not only pass but it will be recognized by future Americans and historians as a period of great peril during which ordinary citizens held the line against the forces of chaos and hate. They will regard your resistance as one of America’s finest hours. So, let’s keep our heads down and continue the hard work of defending democracy. Together, there is nothing we cannot do.
Trump backtracks on tariffs—slightly.
Trump is flip-flopping on tariffs within 48 hours—changes that are causing as much economic harm as the tariffs themselves. See AP, Trump's erratic trade policies are baffling businesses, threatening investment and economic growth.
Don’t be fooled by the headlines: Trump has not paused tariffs against Mexico and Canada. It is true that he has paused some tariffs on certain goods, but tariffs will remain on billions of dollars of goods. Per The Hill,
Officials said roughly 62 percent of imports from Canada are not covered by USMCA and would still be subject to tariffs, while 50 percent of imports from Mexico are not USMCA-compliant. . . . the White House’s unpredictable approach to tariffs has rattled financial markets, with the Dow Jones Industrial Average, the Nasdaq composite and the S&P 500 all taking on losses earlier in the week.
Meanwhile, per the Irish Times, China has issued a rebuke to the US after Trump announced tariffs against that country. Per the Irish Times,
China’s ministry of foreign affairs has promised that China will “fight to the end” with the US in a “tariff war, trade war or any other war”, marking China’s strongest rhetoric on US president Donald Trump since he entered the White House.
Tariffs are taxes on Americans! Tell a friend!
Interim US Attorney Ed Martin in D.C. threatens Georgetown Law Center over DEI
In a truly despicable, Orwellian move, Interim US Attorney for D.C. Ed Martin has threatened to investigate Georgetown Law Center unless it agrees to “remove DEI” from its curriculum. Ed Martin wrote, in part,
It has come to my attention that Georgetown Law School continues to teach and promote DEI. This is unacceptable. I have begun an inquiry into this and would welcome your response to the following questions: First, have you eliminated all DEI from your school and its curriculum? Second, if DEI is found in your courses or teaching in anyway, will you move swiftly to remove it?
At this time, you should know that no applicant for our fellows program, our summer internship, or employment in our office who is a student or affiliated with a law school or university that continues to teach and utilize DEI will be considered.
The dean of Georgetown has responded, saying in part,
The First Amendment . . . guarantees that the government cannot direct what Georgetown and its faculty teach and how to teach it. The Supreme Court has continually confirmed that among the freedoms central to a university’s First Amendment rights are its ability to determine, on academic grounds, who may teach, what to teach, and how to teach it.
Given the First Amendment protection of a university’s freedom to determine its own curriculum and how to deliver it, the [letter’s] constitutional violation behind this threat is clear, as is the attack on the University’s mission as a Jesuit and Catholic Institution. [¶] We look forward to your confirming that any Georgetown-affiliated candidates for employment with your office will receive full and fair consideration.
The legal profession has been doing a great job in standing against ethical violations by attorneys promoting Trump's unlawful agenda. The attack on Georgetown is unethical and depraved. It deserves to be condemned by every lawyer in America. The American Bar Association should issue a condemnation of Ed Martin’s tactics and suggest that the licensing authority for D.C. open an investigation into Ed Martin’s ability to practice law in the District of Columbia.
Trump is threatening to shutter the Department of Education
Per CNN, Trump will sign an executive order to begin dismantling the Department of Education. Per CNN,
President Donald Trump could decide this week to take the first steps to eliminate the Department of Education, people familiar with the matter said, as he looks to dramatically shrink the size of the federal government. White House officials have prepared an executive order directing Education Secretary Linda McMahon to begin the process of dismantling the department, the sources said.
Trump recognizes that he cannot close the Department of Education without legislative action by Congress that would require overcoming the filibuster. But the need for congressional action has not stopped Trump from closing USAID without formally doing so. By the simple expedient of placing most employees on administrative leave, all work at the agency will stop.
Although such an approach is plainly unconstitutional, the Courts have yet to restrain Trump's willingness to engage in unlawful efforts to illegally do that which he cannot do legally.
In preparation for the move, the Trump administration has leaked copies of the executive order to several media outlets—even as Trump's press secretary Karoline Leavitt calls the reports “fake news.”
Trump's willingness and ability to shut down congressionally created agencies within the federal government demonstrate that he no longer views the Constitution as binding on his actions. This is an unequivocal sign that Trump has mounted a coup against the Constitution.
Federal Judge orders Trump to resume distributing grants to states
US District Judge John McConnell has extended indefinitely his order requiring Trump and his administration to distribute funds to 23 states that sued to force Trump to resume distributing funds appropriated by Congress.
See CBS News, See Judge extends block on Trump's federal assistance freeze indefinitely.
Per CBS,
U.S. District Judge John McConnell issued a preliminary injunction Thursday that prohibits agencies from halting the flow of federal funds awarded to the states through grants, contracts or other financial assistance based on a memo from the Office of Management and Budget issued during President Trump's first days in office.
Judge McConnell wrote:
The executive's categorical freeze of appropriated and obligated funds fundamentally undermines the distinct constitutional roles of each branch of our government. The interaction of the three co-equal branches of government is an intricate, delicate, and sophisticated balance — but it is crucial to our form of constitutional governance. Here, the executive put itself above Congress.
Good for Judge McConnell! His ruling exposes the attack by Trump on the fundamental concept of separation of powers under the Constitution. If this case makes its way to the Supreme Court, the issue will be joined in a way that will force the Court to resolve the question head-on. We should not fear that confrontation! We are on the right side of the law and history. We will be vindicated by the Court. And if we are not, we will know everything we need to know for the struggle to come.
Trump fires FEMA lawyer who refuses to prepare a memo defending clawback of $80 million in FEMA funds
See The Handbasket, FEMA’s top lawyer placed on leave after less than one week in role.
Per The Handbasket,
Josh Stanton [a FEMA senior lawyer] was asked sometime this week to write a memo stating that the mid-February seizure of $80 million from the city of New York meant for migrant shelters had legal justification; this was despite the fact that it almost certainly did not. The money that was taken back was lawfully obligated by FEMA pursuant to congressionally allocated funds. Stanton reportedly refused to write such a memo, The Handbasket has learned, and then he was put on leave.
We need more lawyers like Joshua Stanton to stand up against Trump's illegal actions. It only takes a handful of resisters to open the floodgates!
Concluding Thoughts
I have run out of steam and must end here, even though there are other significant stories to cover. But I cannot close without mentioning two unsettling developments within the Democratic Party on Thursday.
First, California Governor Gavin Newsom said during a podcast that it was “deeply unfair” for transgender athletes to be allowed to compete in collegiate sports. Newsom’s comments are unfortunate and wrong on many levels. Trump and MAGA are attacking transgender people because they know they can get away with it. After Trump has succeeded in normalizing discrimination against transgender people, he will expand his target to include LGBTQ people and women.
We should defend transgender people because it is the right thing to do; but if that doesn’t convince us, we should defend transgender people because we are “next” if Trump succeeds in normalizing discrimination against any group.
Second, ten Democrats joined all Republicans in voting to censure Democratic Rep. Al Green for interrupting Trump's speech to the joint session of Congress. The ten Democrats are identified in this article: The Hill, 10 Democrats join Republicans in censuring Al Green.
Trump stood before Congress as a tyrant working to overthrow the Constitution and neuter Congress. As between Al Green’s comments during Trump's speech and the lies spewing from Trump's mouth, the problem is not Al Green.
Shame on the Democrats who are putting decorum and arcane rules above the need to defend democracy as vociferously and ferociously as we can. It is time to stop being polite. It is time to speak the truth, including by shouting it from the floor of the Capitol. Democratic leaders must break free of convention and custom to respond to the urgent need to defend democracy!

Summary of this Substack post from Bill McKibben:
In the forefront is the most crucial issue facing humanity, the climate crisis. Railroads have a keystone role in addressing it. They are the fastest route to cut climate pollution from one of its major sources, transportation. Rail is already the most efficient mode to haul freight on land. Moving freight from trucks to rail reduces energy use by three to five times. Electrifying rail and running it on renewable energy is the quickest track to eliminate climate pollution in long-distance freight and passenger transportation. It allows higher speeds that make trains competitive with air travel in many corridors.
Reducing diesel pollution by shifting freight from trucks to rail, running rail on electricity, and electrifying trucks for the shorter hauls for which truck electrification is most feasible, saves the health and lives of people living along highways and tracks, and near warehouse districts and railyards. As well, this reduces particulate pollution from tire and brake wear, another significant health hazard. Moving from aviation to passenger rail slashes pollution close to airports. Since communities around all these tend to be lower-income, where many people of color live, railroads offer a key environmental justice solution.
Railroads are also key to unlocking rapid renewable energy growth, reducing power sector climate pollution. The greatest obstacle to swift expansion is a lack of long distance lines to transmit electricity from remote solar and wind resources to population centers where demand is concentrated. Transmission can be most quickly added along railroad right-of-ways under single ownerships and with traditional industrial uses, as opposed to multiple parcels where lines are often blocked by local opposition.

The Bargain of Working Hard and Getting a Job Simply Doesn’t Hold Anymore
In this economy, you can do everything right and still be unemployed—and not just if you’re a recent grad.
Even experienced workers share the perception that this is the worst job market of their lifetime. “I’ve been laid off before,” Dave told me, sighing as he acknowledged that periods of looking for work are part of having a career. “But it’s never been this hard to just get interest on a résum. Even during the Great Recession and COVID, there were fewer postings, but it was never this quiet.”
. . .
Across industries, the number of private sector jobs added last month was the lowest we’ve seen in a year. Overall hiring rates are at their lowest level since the pre-COVID era.
. . .
The job postings that are available can be frustrating, to say the least. “It’s like, We’re looking for someone who’s trained in marketing and can do sales and bookkeeping and basic accounting on Excel,” the Substack writer who goes by Femcel vented to me in a video conversation.
“OK, you actually should be hiring an accountant, a salesperson, and a marketer. But you want someone who’s going to be a catchall for the random stuff in the office that needs to get done, and to pay one bad salary.”
And sometimes, the jobs that have been listed don’t really exist at all. A Resume Builder study from last summer found that 3 out of 10 online postings are “ghosts,” meaning that the roles don’t exist or employers don’t actually plan to fill said roles.
. . .
The growing automation of HR means that fewer humans are involved in the hiring process, with A.I. taking on tasks like writing and sharing job descriptions, screening résumés, putting job-seekers on “block lists,” and even conducting interviews—all of which can make the process of actually connecting with an employer incredibly vexing.

TOP NEWS & ARTICLES
A US court ruled that Google is a monopoly, and has broken antitrust laws. This decision will be appealed, but in the meantime, could affect similar cases against large tech giants.
Did you violate a Facebook policy? Meta is now offering a “training course” in lieu of having the page’s reach limited for Professional Mode users.
Google Ads shown in Canada will have a 2.5% surcharge applied as of October 1, due to new Canadian tax laws.
SEO: GOOGLE & OTHER SEARCH ENGINES
Search Engine Roundtable’s Google report for July is out; we’re still waiting for the next core update.
SOCIAL MEDIA - All Aspects, By Site
Facebook (includes relevant general news from Meta)
Meta’s latest legal development: a $1.4 billion settlement with Texas over facial recognition and privacy.
Instagram
Instagram is highlighting “Views” in its metrics in an attempt to get creators to focus on reach instead of follower numbers.
Pinterest
Pinterest is testing outside ads on the site. The ad auction system would include revenue sharing.
Reddit
Reddit confirmed that anyone who wants to use Reddit posts for AI training and other data collection will need to pay for them, just as Google and OpenAI did.
Second quarter 2024 was great for Reddit, with revenue growth of 54%. Like almost every other platform, they are planning on using AI in their search results, perhaps to summarize content.
Threads
Threads now claims over 200 million active users.
TikTok
TikTok is now adding group chats, which can include up to 32 people.
TikTok is being sued by the US Federal Trade Commission, for allowing children under 13 to sign up and have their data harvested.

CONTENT MARKETING (includes blogging, emails, and strategies)
Email software Mad Mimi is shutting down as of August 30. Owner GoDaddy is hoping to move users to its GoDaddy Digital Marketing setup.
Content ideas for September include National Dog Week.
You can now post on Substack without having an actual newsletter, as the platform tries to become more like a social media site.
As of November, Patreon memberships started in the iOS app will be subject to a 30% surcharge from Apple. Patreon is giving creators the ability to add that charge to the member's bill, or pay it themselves.
ONLINE ADVERTISING (EXCEPT INDIVIDUAL SOCIAL MEDIA AND ECOMMERCE SITES)
Google worked with Meta to break the search engine’s rules on advertising to children through a loophole that showed ads for Instagram to YouTube viewers in the 13-17 year old demographic. Google says they have stopped the campaign, and that “We prohibit ads being personalized to people under-18, period”.
Google’s Performance Max ads now have new tools, including some with AI.
Microsoft’s search and news advertising revenue was up 19% in the second quarter, a very good result for them.
One of the interesting tidbits from the recent Google antitrust decision is that Amazon sells more advertising than either Google or Meta’s slice of retail ads.
BUSINESS & CONSUMER TRENDS, STATS & REPORTS; SOCIOLOGY & PSYCHOLOGY, CUSTOMER SERVICE
More than half of Gen Z claim to have bought items while spending time on social media in the past half year, higher than other generations.
Shopify’s president claimed that Christmas shopping started in July on their millions of sites, with holiday decor and ornament sales doubling, and advent calendar sales going up a whopping 4,463%.

2024 accomplishments I need to put somewhere and I don’t have a journal:
- changed my relationship to drinking in a v healthy way which then spiraled into overall health, diet, and training. My habits are in a great spot that I’m proud of. -I’ve focused more on original writing, especially by querying my novel. I only got rejections but I learned a lot about the process + revising and finishing a project no matter how much you want to pick and pick at it. Started novel #2 plus script #10 and short form essays on a substack.
-after my last relationship ended, I was worried that I would backslide when my insecurities were triggered again. It had me avoiding serious dating opportunities for a while. But this year did trigger insecurities and I’m super proud of how I handled them!!! Allowed a lot of forgiveness for past stupidity and immaturity. Has me feeling hopeful for 2025! -anyone who knows me irl (which I hope is none of you lol) knows that I had the absolute worst style for yeeeaaarsss but this year I buckled down about finding vintage/thrifted clothes I could style pieces with and I’ll say…hottest I’ve ever been , booyah.
-I did not travel as much as I usually do though I do admit my scale is different than the average but it has allowed me to save for a dream trip in 2025 that I can use my CC points on and I’m PUMPED.
This was just a wonderful year of slow living, growth, and so many reminders of how lucky I am for the friends turned family I have built over the years. I am surrounded by genuinely kind, creative, and loyal people and that is, as it always will be, my biggest accomplishment.
#Personal#for me really#Genuinely excited for 2025#Now I’m going to finish watching when Harry met Sally and then go out for a late night dinner for midnight#Life is good

The Slow Waves of Progress

Hey everyone! It’s Tish here, and I wanted to share something new and exciting that I’ve been working on. It’s been a while since I last talked about my creative process, so today, I’m bringing you into my world—where ideas take shape, and imagination runs wild. Lately, I’ve been focusing on a new character, Justine, a young witch-in-training who has become a huge inspiration for me. She represents growth, ambition, and the magic that comes with discovering your own creative voice.
Justine’s hat isn’t just an accessory; it symbolizes her dreams and aspirations, much like how my own creative journey has been shaped by my desire to improve and explore new artistic directions. I see so much of myself in her—the determination to learn, the excitement of new discoveries, and the occasional frustration when things don’t turn out quite right. Just like Justine, I’m always pushing myself to refine my craft and bring my ideas to life in the best way possible.
One of my favorite elements of Justine’s design is her staff, topped with a flame that represents her passion for magic. To me, this is a perfect metaphor for the artistic journey. There’s always this internal fire pushing me forward, urging me to create, even when doubt creeps in. Art is about constantly evolving, and Justine’s story reflects that ongoing process of learning and growth.
What I love most about working on a character like Justine is that she reminds me of the excitement that comes with embracing change. Whether it’s experimenting with new techniques, exploring different styles, or simply allowing myself to make mistakes and learn from them, every step of this journey adds to my growth as an artist. It’s not always easy, but I’ve realized that some of the best breakthroughs come from those moments of struggle and uncertainty.
For me, creativity is a kind of magic in itself. The ability to transform a blank canvas into something full of life and personality is something I’ll never take for granted. Every character I create, every pattern I incorporate, and every color I choose contributes to this evolving story I’m telling through my work. Justine embodies that magic—the belief that with enough dedication and practice, we can bring our wildest ideas to life.
As I continue developing Justine’s story, I find myself reflecting on my own path as an artist. There’s always something new to learn, another challenge to take on, and more ways to express myself through my art. Just like Justine, I want to keep pushing forward, discovering new possibilities, and creating work that feels true to who I am.

(the OP of this post politely asked if i could say more about why I think it is stupid. I am happy to do so because I care deeply about this stuff and want people to have access to the better versions of the ideas Sam Kriss is ripping off for his substack, and also because if I saw Sam Kriss in the street i would rip his liver out with my teeth. Hi, Sam. Stay the fuck away from conventions or I'll kill you in real life.)
First, a condensing of his essay as I understand it. In 6,200 words Mr. Kriss makes the following points:
(1) we live Online but didn’t used to; we may not live Online in the future; the Internet brings us “low-res” ‘minimum viable products’ that guarantee happiness but never go past their minimum; that people agree that the fire hose of Online has “destroyed their attention spans”; (2) “there is nothing there” online; “pouty nineteen-year-old” “nymphets” found out I grope women and don’t like me anymore; people don’t write first novels anymore they’re writing second and third novels and I like those less; (3) petroleum is awesome; extractive capital is the only “real” form of growth; a strange assertion that nobody wanted to touch Saudi oil money; and finally the 2010′s canard: ‘data is the new oil’ (but NOT in an AI training corpus way, the only way that could possibly be true); social media is bad because of Islam (??); communicating online about social justice is inherently pointless because “our global miracle of psychic togetherness” (this is my phrase, in fairness, but also in fairness, I am an outsider artist with very sincere opinions about this stuff), he says that that miracle is fundamentally Saudi; “as if the entire terrain of combat wasn’t [sic] provided by a nightmare head-chopping theocratic state”. (?????)
He returns to sensible good ideas from other people, instead of his own half-remembered misquote of Cyclonopedia. He says hey, targeted ads don’t work (they don’t); web3 isn’t cool (it isn’t); “the ship’s rats” are “stripping the galley” as it sinks. That’s true, but it’s not even a complaint about media OR forms of communication, it’s a diagnosis of the vampires robbing everyone and calling themselves Private Equity Firms, he just sneaks it in there and hopes you won’t notice he’s run out of examples. Section (4) is totally incoherent; he’s mad at TV but blames the Internet; he’s mad at USAmerican politics but blames the Internet (instead of sensibly deciding to kill a Congressman with a brick); he’s mad that people know he’s a sex pest (and blames the Internet for letting them find out). He agrees with most people that the George Floyd protests did not fundamentally change America’s founding sins of racism and brutal violence (and, bizarrely, blames the Internet). In his shortest section, #5, ostensibly his thesis, he simply predicts that “[p]rint magazines will outlive Substack”. okay thanks so much let’s hit the bong real quick i love you for reading this
Here’s what’s wrong and who he’s ripping off. A lot of the time Mr. Kriss wants to complain about something a company does to people, but he gets mad at the people who decide to do it. “Short attention spans”, the uselessness of “the time you give over to the machine” - to him, this is your fault, is my fault, and he’s not at all interested in even figuring out whether or not any of it is Meta or Twitter or Alphabet’s fault (even though it’s mostly Meta or Twitter or Alphabet’s fault). He also says the only solution is that “there is still time to do something else[...] giving me[...]money” so that he can “create something that is not like the Internet”. “People claim to be deeply worried by this stuff, but I think you secretly like it”, he negs. Please subscribe to my Substack. Please give me money. I used to have subscribers and money and now I don't and I miss them both. Sections 1, 2, and 3, in these I think sam kriss is writing, y’know, hey I read some stuff and talked about it with smart people over drinks a couple years ago and here’s what I remember from that. He’s “right” in that he is repeating smart people smart ideas about the real world, but he’s ‘wrong’ in the ways he lacks their ability to contextualize those ideas. 3′s stress on oil dollars and Saudi petrocapital, one of the longer and more interesting ideas in the VERY LONG essay, is a ripoff of and sad misunderstanding of the stuff in Reza Negarestani’s Cyclonopedia, a book that a lot of people read the year it came out and which very few people have read since. Cyclonopedia is an impressive piece of literature about the sentience of oil and the petro-political ramifications we all live in. Negarestani is another one of those CCRU types like Nick Land (Fanged Noumena) and Mark Fisher (Flatline Constructs) who are mostly relevant for giving people like Richard Spencer zoom interview backdrops of a bookshelf. On BeReal: I use BeReal and Mr. Kriss obviously does not; he is mad about the way he assumes the app works, but it doesn’t work that way (you can post “lates” and my friends - we are in our 30s - normally do post “late” by an hour or two). He says man, these millenial women, they’re taking photos of the thing they’re doing at the time they’re supposed to take that photo, and they’re posting it on the app that tells them when to take that photo and what it should look like. and, again, just like social media, it’s still women’s fault for not writing novels instead. How progressive. The stuff about ‘cancel culture’ is so obviously just “sex pest mad people found out about him” that I won’t bother to discuss it but c’mon obviously that is stupid. right? Thanks!
