[A friend, GD, has been researching and writing about Kingston, Ontario, history, and with his permission I wanted to start sharing his research here. This is preliminary, but he is focusing on popular entertainment, consumption, racism, political alliances, and the daily life of a small town as a microcosm of broader issues in Canadian history.]
On the evening of April 9th, 1909, William Welch, an employee of Booth's wood and coal company, cursed so loudly and at length while watching a movie at the Princess Theatre that ladies in the audience complained to the management. Proprietor Robert Lipman, whose father Barney was on the executive board of the Hebrew Congregation of Kingston, asked Welch to leave. He refused. Lipman brought in a policeman, at which time Welch stormed out, vowing revenge.
Later that night he returned and attacked Lipman, who was sitting near the ticket office, punching him in the face.
Welch was fined five dollars and ordered to pay a bond of one hundred dollars, which, if forfeited, would result in jail time.
But maybe a deal was struck, because a couple of months later, in June, 1909, the Kingston police enlisted Welch for a sting operation that targeted "foreigners", including three Jews.
The traps were set by police constable Samuel Arniel, the darling of the Lord's Day Alliance. It was his job to enforce the Sunday laws. Arniel had also been employed by Booth the collier before turning to police work. That's how he knew Welch.
The targets were ice cream parlors run by immigrant confectioners. Arniel, a plainclothes policeman, would stand watch outside as Welch and his accomplices entered the premises of these establishments on a Sunday, and order ice cream or tobacco or gum or fruit. Upon receipt of these forbidden items, Arniel would sweep in and make an arrest. Who were the men he charged with desecrating the Sabbath? George Masoud, a Syrian; Henry Turk, a Jew; Thomas Sakellaris, a Greek; Thomas Petters, a German; Zangwell Handler, a Jew; and someone the Whig named as "P. Sevine." This was a typo. There was a Jewish confectioner, Simon Leveine, who would be targeted again later in the month; he was the person erroneously dubbed Sevine.
The Lord's Day Act was passed in 1906 in the middle of the decade that brought more non-British immigrants to Canada than ever before. It was a weapon wielded by nativists, as the judge's address to the immigrant men indicates: "In disposing of the cases the magistrate gave the accused a good lecture, referring to the fact that none of them were Canadians, or Kingstonians, all being of foreign extraction, which went to show that the merchants who lived here respected the wishes of the community and kept closed on Sundays."
What the judge failed to mention was that drug stores sold cigars, candy, liquor, and ice cream as well. But they were owned by respectable old stock Canadians like Dr. William Gibson, proprietor of the Red Cross drugstore, which stayed open all day Sunday. A letter to the Whig's editor in defense of the six men charged pointed this out, but druggists got away with selling non-essentials on Sundays until 1911.
