Important HIPAA Compliance Issues in 2018
As 2018 gets underway, experts offer advice on some important issues related to HIPAA compliance. One issue is patient access to medical records. Kathy Downing, vice president of information governance and standards at the American Health Information Management Association, said her organization receives many complaints from patients who have issues receiving medical information even though right of access has been in place since 2003.This area is what Downing calls “super low-hanging fruit on the HIPAA tree.” If patients request records, there is no need to make them wait 30 days. If the records are stored electronically, practices should allow patients to receive their information in that format.
  “The reason this is important is because in a lot of the cases, patients may be seeing multiple providers for chronic conditions, and having their chart allows them to be more engaged in their care,” she said. “It's an important patient right, and important for population health and patient engagement.”
  By giving patients their records, providers are also allowing them to do a quality review to ensure their information is correct. Electronic medical records commonly contain errors, mainly because of copying and pasting of data, Downing said.
  If physicians are uncomfortable talking with patients about information in their charts, she recommends that practices appoint a nurse who can deal with patient queries. Portals can also be a good resource to guide patients through their information. If someone has been diagnosed with prediabetes, for instance, a portal can provide links to trusted online sources that can answer patient questions.
  Increased enforcement?
Another HIPAA-related question facing medical practices this year is the Office for Civil Rights (OCR) approach to HIPAA enforcement. Michael Bossenbroek, a partner at Wachler & Associates, P.C. in Royal Oak, Michigan, listened to remarks at a HIPAA conference last fall from the new OCR director. OCR might be striking a different tone as a new administration takes the reins. “How they balance the objectives of education and compliance with enforcement remains to be seen,” Bossenbroek said.
  The OCR director gave no specifics, Bossenbroek said. Whatever approach emerges from OCR, as before, providers need to ensure they have the basics completed, with a risk analysis performed and solid policies and procedures in place.
  Chris Apgar, CEO and president of Apgar & Associates LLC, in Portland, Oregon, said OCR has made it clear there will be continued enforcement activity in the coming years. No one is immune from them, he said. He recently worked with a small entity that had their wrists slapped by OCR. He helped them prepare a response, and when they failed to follow through with their plan, he had to mediate between the organization and OCR.
  “If you respond to OCR in an appropriate and timely manner and follow through, they go away,” he said. “If you don't, they stick around. They are not going away.”
  Shortage of security talent
Health care organizations will continue to face a shortage of information technology (IT) security talent in 2018, Apgar said. A report released this past summer by the US Department of Health and Human Services found that 3 out of 4 hospitals do not have a designated information technology (IT) security professional.
  Larger organizations are better able than small groups to afford hiring IT talent, which can be expensive, Apgar said. But smaller organizations, which often delegate IT security to office staff who are already busy with other tasks, have options. Apgar recommends looking for students graduating from information security programs and bringing them on board as interns. Small groups do not require the same kinds of security setup that a Cleveland Clinic or Kaiser might need, and young individuals can help build and run systems. Organizations can grow a position with them when they are new in the field, although these individuals could leave when they become seasoned and expect a higher salary.

With OCR increasingly scrutinizing and auditing business associates, it is important for practitioners to ensure their vendors are compliant. Apgar said the vendors he works with are increasingly motivated to do this for fear of losing customers. These customers – health care practitioners – are demanding proof of compliance.
  To better understand a vendor's compliance, providers can request policies and procedures and ask to see their risk analysis and any other pertinent documentation. Some ask that vendors fill out a security questionnaire. Others go even further. Groups like Apgar's company can act as a third party to conduct a risk assessment, then attest in writing that a vendor has either mitigated or accepted risks found in the analysis.
  New tools
It used to cost anywhere from $75,000 to $100,000 for a tool that would automatically monitor audit logs and send alerts if an anomaly is found for a hospital or larger clinic, Apgar said. Over the past couple of years, new options have hit the market that lowered the cost to $35,000 or less, which is a game changer for HIPAA compliance, he said.
  “As more technology becomes affordable, there is a higher likelihood that regulatory bodies will push back and say providers have to use it,” Agar said. “If a hospital is generating and not regularly reviewing audit logs, they will look negligent to regulators.”
  Technology tends to move with the needs of the market. For instance, as cyber crime has become increasingly prevalent, tools have been developed and marketed to prevent attacks. Some tools look both internally and externally in a network to see if unusual behavior is occurring, and sends an alert if any anomaly is found.
  Keeping track of technology as it becomes more affordable is not always simple. Apgar said providers can look at IT newsletters and check with their state associations to stay atop of new and affordable tools coming on the market.

Our Kitchen Manager make a difference by:
Planning nutritionally-sound menus for three meals a day, seven days a week.  Menus must accommodate any residents who have special dietary needs.
Developing and manage the food service budget.  Identify, prioritize, and arrange purchase of all food and kitchen supplies needed to prepare daily meals.  Develop food vendor relationships and purchase food for multiple sites. As requested, research and select food product vendors. 
Overseeing day-to-day operations of kitchens at residential sites, including the training of residents to prepare and cook meals, assisting as needed and assist with donation pick-up.

Manager – HST Performance Metrics
The Oregon Health Authority (OHA) is a state agency dedicated to helping people and communities achieve optimum physical, mental and social well-being through partnerships, prevention and access to quality, affordable health care. This employment opportunity is with the Office of Health Analytics, under the Oregon Health Authority (OHA). There is one full-time, permanent position located in Portland (421 SW Oak Street). This position is classified as management service, supervisory and is not represented by a union.
DUTIES & RESPONSIBILITIES:
The primary purpose of this position is to directly manage the development and implementation of a broad spectrum of performance metrics that support the Triple Aim and quality improvement activities. In this role, the manager will provide hands-on guidance, coordination, leadership, quality control and improvement to a team of analysts across the Office of Health Analytics in support of Medicaid and broader health system transformation. The availability of timely and accurate performance metrics is a keystone to Oregon’s Medicaid and broader health system transformation. The creation of this position is to continue building the internal capacity needed to develop and disseminate performance metrics for a range of internal and external needs, including dashboards, federal reporting, and pay-for-performance programs.   This position requires in-depth understanding of performance metrics, national standards for quality and access measures, measure development and reporting, health care claims, encounter, enrollment, and survey data to develop, produce, and inform performance measurement for a range of programs and stakeholders, primarily Medicaid and Medicaid Coordinated Care Organizations (CCOs), but also including Oregon hospitals and health plans offered by the Public Employees Benefits Board, the Oregon Educators Benefits Board, and the Insurance Exchange.   This person will work collaboratively in a team with other Health Analytics managers, OHA leadership, the Director of Health Analytics, as well as other agencies, including the Department of Human Services (DHS), the Department of Consumer and Business Services (DCBS), and the Department of Education (DOE). This person must have experience and be able to provide technical leadership and direction to analysts and policy/program staff as they utilize complex data systems and large data sets including the state’s Medicaid Management Information System, All Payer All Claims database, existing population-based surveys and data sources, such as vital records, and emerging data sources, such as the Clinical Quality Metrics Registry (CQMR). Experience with data display and presentation would be valuable.   The emphasis for this position is twofold: sustaining and continuously improving the current process for timely and accurate production and analysis of Oregon’s Medicaid health system transformation metrics at the statewide and CCO levels, as well as by assorted subcategories; and developing and aligning measures across OHA programs and the broader health system. This position will also work closely with OHA and other agency leadership to develop measurement strategies and aligned measures that address integration and coordination, such as shared metrics for CCOs and Early Learning Hubs and the Hospital Transformation Performance Program. This position will also provide direction and oversight for OHA’s portfolio of health system transformation evaluation projects, including but not limited to Medicaid waiver evaluation projects.   The position requires a strong ability to clarify and prioritize tasks in order to effectively navigate a challenging and fast-paced work environment with a broad array of stakeholders. This position will provide technical support to the legislatively created Medicaid Metrics & Scoring Committee, Health Plan Quality Metrics Committee and Hospital Metrics Advisory Committee. The position will also provide technical support to the Director of Health Analytics, including OHA’s Quality Council and Quality and Health Outcomes Committee (QHOC). The position will also work with data aggregation vendors, various other committees and workgroups, and representatives of CCOs, health plans, and other external partners.   The person in this position will demonstrate recognition of the value of individual and cultural differences and help to create a work environment where talents and abilities are valued. 
MINIMUM QUALIFICATIONS: Four years of management experience in a public or private organization which included responsibility for each of the following: a) development of program rules and policies, b) development of long- and short-range goals and plans, c) program evaluation, and d) budget preparation.   OR    Three years of management experience in a public or private organization which included responsibility for each of the following: a) development of program rules and policies, b) development of long- and short-range goals and plans, c) program evaluation, and d) budget preparation; AND 45-48 quarter hours (30-32 semester hours) of graduate level coursework in management.
  DESIRED ATTRIBUTES:
Experience working with analytic teams to produce systematic and user-friendly metrics and information for internal and external audiences including lay people/citizens, and non-analytic experts.
Demonstrated skill in working with stakeholders/partners in developing metrics.
Extensive experience developing or tailoring health care metrics (e.g., adapting HEDIS metrics, creating electronic health record-based metrics).
Experience designing and/or implementing health care-related evaluations.
Experience and knowledge of health care quality improvement initiatives.
Experience and skill in managing or providing technical leadership in matrixed or cross-organizational communication structure.
Experience with contract management.
Experience with health outcomes research, health care delivery systems research, or experience using health care expenditure, utilization and quality assurance data.
Experience and knowledge of Medicaid and Medicare and other health insurance programs.
Experience and knowledge of Oregon’s health system transformation.
Experience with and knowledge of health care and population based quality, access and cost metrics.
  SPECIAL REQUIREMENTS:
Knowledge of and experience with metric design, statistical principles, and data presentation.
Bachelor’s degree plus three years of progressively responsible experience in quantitative/qualitative analysis or an appropriate combination of education and experience in a related field. An MPH, MBA, MHA, MS, or Ph.D. in a related area may be substituted for two years of experience.
