Civil Appeal The Director (Admn. and HR) KPTCL & Ors. v. C.P. Mundinamani & Ors.
The Division Bench of the Supreme Court comprising Hon’ble Mr. Justice M R Shah J & Hon’ble Mr. Justice C T Ravikumar J upheld the decision of the Division Bench of the #KarnatakaHighCourt at #Bengaluru vide their order dated 11.04.2023. The #DivisionBench of the #HighCourt #quashed the #order of #SingleJudge of the High Court and #allowed the #grant of one #annualincrement which the respondents had #earned #oneday #prior to the #retirementday on attaining the age of superannuation.
Facts:
Aggrieved by the order passed by the Division Bench of Karnataka High Court #CivilAppeal is filed by the Director Karnataka Power Transmission Corporation Limited (#KTPCL) before the #SupremeCourt of India.
The Single Judge of the High Court has dismissed the Writ Petition of the Respondents Employees praying for grant of annual increment to them for their service rendered in the preceding year.
In this case the employees/Respondent were going to retire the very next day from which annual increment was alleged to be effective as per the Karnataka Electricity Board Employees Service Regulations, 1997 #KEBESR 1997.
The Regulation provides that an increment accrues from the day following that on which it is earned, the appellants denied the annual increment on the ground that the day on which the increment accrued the respective employees – original writ petitioners were not in service.
The Division Bench of the Karnataka High Court #HC #relied on the decision of various HC including #Madras High Court in the case of P. Ayyamperumal; the #DelhiHighCourt in the case of Gopal Singh Vs. Union of India and Ors; the #AllahabadHighCourt in the case of Nand Vijay Singh and Ors. Vs. Union of India and Ors.;the #MadhyaPradeshHighCourt in the case of Yogendra Singh Bhadauria and Ors. Vs. State of Madhya Pradesh; the #OrissaHigh Court in the case of AFR Arun Kumar Biswal Vs. State of Odisha and Anr. & the #GujaratHighCourt in the case of State of Gujarat Vs. Takhatsinh Udesinh Songara.
It was held by the High Court that once an employee has earned the increment on completing one-year service he cannot be denied the benefit of such annual increment on his attaining the age of superannuation and/or the day of retirement on the very next day.
It was contended by the KTPCL that increment is given to motivate the employees to perform well in their service. But when the employee is no longer in service there is no question of grant of annual increment.
Issue: Whether an employee who has earned the annual increment is entitled to the same despite the fact that he has retired on the very next day of earning the increment?
Observation of the Supreme Court
Increment is earned on one year past service rendered in a time scale. Therefore, the submission of KTPCL that when employee is no longer in service therefore there is no question of grant of annual increment is not to be accepted.
The moment a government servant has rendered service for a specified period with good conduct, in a time scale, he is entitled to the annual increment.
Merely because, the government servant has retired on the very next day, he can’t be denied the annual increment which he has earned for rendering the service with good conduct and efficiently in the preceding one year.
The increment can be withheld only by way of punishment or he has not performed the duty efficiently.
The word “accrue” should be understood liberally and would mean payable on the succeeding day.
The Division Bench of the High Court has rightly directed the KTPCL to grant one annual increment which the original writ petitioners earned on the last day of their service for rendering their services preceding one year from the date of retirement with good behavior and efficiently.
Decision: The present appeal deserves to be dismissed and is dismissed, accordingly.

चैतन्य भारत न्यूज अहमदाबाद. कानूनी प्रावधानों के तहत मॉल-मल्टीप्लेक्स में आने वाले लोगों से पार्किंग शुल्क वसूलने का कोई अधिकार नहीं है। इसी अधिकार का हक जनता को दिलाते हुए गुजरात हाई कोर्ट ने कहा कि, 'मॉल तथा अन्य निजी व्यावसायिक संस्थान पार्किंग शुल्क नहीं वसूल सकते।' कार्यकारी मुख्य न्यायधीश अनंत एस. दवे और न्यायमूर्ति बीरेन वैष्णव की खंडपीठ के समक्ष पेश किए गए शपथपत्र में दोनों प्रतिवादियों ने कहा कि, 'मॉल का निर्माण व्यापार संबंधी परिभाषा के तहत है। इसलिए कॉमर्शियल पार्किंग सहित 20 फीसदी पार्किंग यहां आने वाले लोगों के लिए अलग से रखना पड़ता है।' इसके बाद हाईकोर्ट ने कहा कि, 'व्यवसायिक संगठनों को पार्किंग का खर्च खुद वहन करना चाहिए। उन्हें लोगों से पार्किंग शुल्क लेने का कोई अधिकार नहीं है।' खबरों के मुताबिक, अनंत एस. दवे और न्यायाधीश बीरेन वैष्णव की बेंच से व्यवसायिक संगठनों की मांग की थी कि, रख-रखाव खर्च आदि के लिए पार्किंग शुल्क वसूलने की छूट दी जाए। पार्किंग चार्ज को लेकर गुजरात प्रोविंशियल म्युनिसिपल कॉर्पोरेशन एक्ट 1949, गुजरात टाउन प्लानिंग एंड अर्बन डवलपमेंट एक्ट 1976 और जीडीसीआर में ऐसा कोई प्रावधान नहीं है जिसके तहत मॉल-मल्टीप्लेक्स संचालक उनके यहां आने वाले लोगों से पार्किंग चार्ज वसूल सकें।   Read the full article
