being an alto was literally my personality when i was in college, lol. it’s not so much now so I should probably change my url 😂😂

i think i said “oh i wanna get on tumblr” like a naive child. i’d heard that’s where all the fun fandom stuff was, and then my friend and i sat through the entire process of me making a tumblr, LOL.

i love calliope torres with my entire heart and tbh i could change it to keyla detmer (because i also love keyla detmer with my entire heart) but I feel like that should be reserved for my disco side blog...

Five people wounded in deadly Garlic Gilroy Festival shooting sue event organizers, citing ‘negligent security measures’

Analysis:

Five people who were shot at the Garlic Gilroy Festival in July and survived their injuries are suing the event organizers.

The lawsuit, filed on behalf of Wendy Towner, her husband Francisco Aguilera, Brynn Ota-Matthews, Justin Bates and Nick McFarland, accuses the iconic festival’s security of being “outdated” and “negligent,” the Mercury News reports.

The plaintiffs, having spent weeks in hospital, undergoing surgeries and out of work, are seeking compensatory damages to help pay their bills.

Wendy Towner, who was the first to try and stop the gunman, Santino Legan, said she and her husband Francisco Aguilera have been diagnosed with PTSD.

Five people who were injured during a mass shooting at the Gilroy Garlic Festival in July filed a lawsuit Tuesday, alleging that the Gilroy Garlic Festival Association provided lax security and didn’t take steps to prevent the bloodshed.

The Scarlett Law Group, based out of San Francisco, filed the suit on behalf of Wendy Towner, her husband Francisco Aguilera, Brynn Ota-Matthews, Justin Bates and Nick McFarland, according to the Mercury News. 

They were all shot when Santino Legan cut through a fence to enter the iconic festival’s grounds and opened fire into the crowd, authorities said. The 19-year-old Gilroy resident killed three people —  6-year-old Stephen Romero, 13-year-old Keyla Salazar and 25-year-old New York resident Trevor Irby — and injured 14 others.

After firing 39 rounds from a semi-automatic rifle, Legan died of a self-inflicted gunshot wound as Gilroy police officers ran toward him, authorities reported. The discovery of a “target list,” including religious institutions and courthouses, prompted the FBI to launch a domestic terrorism case as the investigation continues. However, there has been no word on Legan’s motive.

Forced to spend five weeks in hospital undergoing dozens of surgeries to recover from their gunshot wounds, Towner and Aguilera each face over $2 million in medical bills. At a press conference, Towner said the couple doesn’t know how much of those expenses will be covered by health insurance—and how much they’ll be forced to cough up. 

Safety precautions ignore present-day threats 

“There is a need for compensation in this case, but if you talk with any of the clients you see their overriding concern is that this not be allowed to happen again,” attorney Randall Scarlett said, the Mercury News reported.

The lawsuit describes the event’s security policies as “outdated” and “negligent.” The defendant’s claim hinges on an “inadequate, flimsy, low-height unsupported chain link fence that was simple to breach, located inappropriately where the shooter’s presence and entrance would be concealed by a wooded area” and was made “even worse by allowing cars, box trucks and and/or other obstructions to be placed” near the spot where Legan is believed to have entered and cut a pathway across the grounds.

“Defendants had reason to know the history of the threat of an active shooter situation at outdoor venues,” the lawsuit states, adding that festival organizers failed to not only hire and train security staff but also work in tandem with law enforcement agencies, the Mercury News said.

The Gilroy Garlic Festival Association issued a statement, which said: “The lawsuit filed today stemming from a horrific act of domestic terrorism, is not unexpected, and we will respond through the appropriate legal channels. As a non-profit organization, we must remain focused on our mission: fundraising for the entire community of Gilroy and the more than 150 charities that rely on us.”

‘Cold and unsympathetic’

Towner and Aguilera, the Mercury News reported, were vendors selling honey from their business, the Honey Ladies. Towner, one of the first people to spot and try to stop Legan, shouted at him to draw his attention away from children.

She and Aguilera were both struck by bullets in the leg. Towner chronicled being shot, only to see Legan looming over them armed with a rifle. While swapping out magazines, he coolly asked if the couple was “OK,” the lawsuit reads. The terrified pair stayed mum.

“His voice was cold and unsympathetic,” the lawsuit continues. “Had Wendy Towner uttered a word, it is certain the shooter would have shot them both dead.”

Both Towner and Aguilera have been diagnosed with post-traumatic stress disorder, and struggle to venture out in public unless they’re together, they admitted at the press conference. Given the extent of their injuries, the couple’s business now faces a murky future.

“I don’t know what medical bills we’re going to have in the future, what surgeries we might need. We need to make sure that every single one of us is taken care of,” Towner said.
