Amit Kumar had everything going for him. After graduating in engineering and landing a decent job, Amit wanted to settle down with his childhood sweetheart Renu. The couple had known each other since Class IX and dreamt of a life together. The only difficulty was that Renu belonged to a Brahmin family and Amit was a Dalit.
With their homes barely a kilometre apart in Garhwa district of Jharkhand, Renu knew her family would never approve of the match. The couple decided to run away and tie the knot in another State. And thus began their tale of unending harassment and tragedy.
The couple married at a temple in Dehradun and got their marriage registered there. They had just about settled down at Paonta Sahib in Himachal Pradesh when, in a midnight raid, the Uttar Pradesh police took away Renu, claiming that she had been abducted. Amit and Renu have not seen or spoken to each other since that fateful night of August 13, 2021.
Amit’s life has been a quagmire of legal battles and dismissed habeas corpus petitions since then. “I fear my wife is no more,” he told The Hindu.
Activists say such tragic situations can be avoided if couples like Amit and Renu are provided safe houses and special protection by the State governments as mandated by the Supreme Court.
According to data from the National Crime Records Bureau (NCRB), the number of “honour killings” in the country was 24, 25 and 33 in 2019, 2020 and 2021, respectively. Punjab, Madhya Pradesh and Jharkhand topped the list in 2021 and 2020, while Manipur was on top in 2019.
The government in 2021 informed Parliament that there were 145 “honour killing” incidents in the country between 2017 and 2019.
Interestingly, though the NCRB report attributed only 25 deaths to “honour killings” in 2020, it said there were 27 deaths due to casteism and 1,558 due to “illicit relationship”. Similarly, in 2021, 33 deaths were listed under “honour killings”, but 1,544 and 1,532 under “illicit relationship” and “love affairs”, respectively.
So far, only Delhi, Haryana and Punjab have safe houses for inter-faith and inter-religious couples. Kerala has only announced the setting up of a safe house.
In fact, only 21 States have said that they have complied with the Supreme Court directives, which means that they have asked the police officers concerned of a State for strict compliance, according to Dhanak for Humanity, a non-governmental organisation which works with such couples, helping them solemnise their marriages and providing legal support.
The Supreme Court had in 2018 directed that safe houses be set up in every district as well as a special cell in States for couples facing opposition from families and community.
Gaurav Yadav, an engineer from IIT Chennai, said he was working with survivors of “honour crimes” and couples who are in hiding to petition the government for more safe houses across the country.
“Soon we will form an official grouping and petition the government to follow the Supreme Court directives on safe houses and special cells,” Mr. Yadav said, adding that he had organised a convention regarding the same in Delhi recently.
He said though couples had been demanding that safe houses be set up, the State administrations had looked the other way.
An example is of Ravikant Chandrawanshi and Alisha, who had a harrowing time getting married under the Special Marriage Act in Chhattisgarh.
The inter-faith couple at first decided to elope and marry in Bilaspur. However, a lack of support system and security, including finances, saw them return home in Kawardha within four days.
“As my wife’s family were well to do and politically connected, they kept up the pressure on us. Finally, we had to take legal recourse and approached the High Court asking them to direct the State administration to provide the mandated safe house and police protection.
“However, we were informed that there was no safe house and Alisha had to go to a sakhi centre or a women’s safe house,” Mr. Chandravanshi said.
Though the couple approached the highest of authorities, they were not given any police protection either and had to go into hiding for around six months after their marriage.
According to Asif Iqbal of Dhanak for Humanity, most States send the girl to a Nari Niketan after couples approach them. “It is here that the girl is the most insecure as her family mostly approaches her and puts pressure to go back. Many a time, this also leads to what is known as honour killing of the girl”.
Sanjay Sachadev of Love Commandoes, an organisation which rescues and shelters such couples, said, “The need of the hour is safe houses across the country. In almost every case, the police try and send the girl to a women’s shelter and the boy is left to fend for himself.”
A couple who are staying in a Delhi safe house and did not wish to be identified said that they could not have thought of living together had it not been for the security of the safe house.
Mr. Iqbal, whose organisation has helped many couples seek legal recourse to stay together and get married, said that of the distress calls he receives, the most were from Uttar Pradesh, Maharashtra and Rajasthan.

To Kick or Not to Kick......
For context this post is all about today’s eliminator 1 game played in the Indian Super League between Kerala Blasters FC vs Bengaluru FC.
KBFC vs BFC is always played in an electric atmosphere. Whichever stage of the league or whichever stadium it is being played at. If you have your doubts look at what happened last time when KBFC visited BFC this season. I personally witnessed it. But every single time there is a sure shot winner involved - Football, the beautiful game.
But today I feel like it died, on the field, even before the final whistle was blown.  
So basically, a TLDR version of events.  KBFC and BFC were playing to see who goes to meet Mumbai City FC for the Semi Finals. Post 90 minutes and enough changes at both ends, the score remained 0 - 0. We end up at extra time as expected. a BFC player gets fouled at the edge of KBFC penalty area and they get awarded a free kick. All business as usual. But Chettri takes up the free kick which is the bone of contention here. We can clearly see no KBFC player was ready. We even don’t see the referee marking the 7-yard line. I didn't see him blowing his whistle. Chettri kick the ball and score. Shocking everyone. Following which our Aashan asks KBFC to walk off. BFC wins due to forfeit.
Here are my 2 paisa about it. The first and the foremost thing in any game is sportsman’s spirit. All 22 players on ground want to win but at what cost? 
BFC’s justification is that this was a quickly taken free kick and apparently KBFC were caught napping. In that case can anyone explain why as per the Law of the Game 2022-23 taken straight from AIFF website ( https://www.the-aiff.com/media/uploads/2022/09/Laws-of-the-Game-2022_23.pdf) on page 186 it states the following

Apparently, that is taken form the section called Practical Guidelines for match officials. So, if a free kick that is to be taken just outside the opponent’s penalty box, doesn’t appropriate distance is required? Doesn’t the referee have to mark the distance where the wall can stand legally?
Apparently, the referee Hon. Crystal John hasn’t read it I guess or maybe he forgot it.
I won’t be lying when I say that I haven’t played football much. At least never professionally, that’s for sure.
Being a Fan of KBFC, it feels sad to lose anytime. However, losing in such a manner that too due to a “Legend” of Indian Football is disheartening.
I am also not a fan of our manager dealt with the situation. He should have let the game play on. Let BFC win and then go out of this season with the head held high. We are KBFC, we fight., till the end. Let BFC win on a so called quickly taken “freekick”.
Whatever it is, Indian Football will never be the same again. Something will change. Let’s see if it's for the better or for the worse.
At the end of the day, I lost all my respect for Mr. Chettri. I am no longer going to support or cheer for you ever even when you wear our national jersey. I will support the national team though. In case you are wondering, a small reminder Chettri is not Indian National Team and Indian National Team is not Chettri. I am also disappointed with Ivan. But I will still support him. I will still support KBFC. Can’t wait for West Block Blues to come to Kochi. BEWARE

The Apex Court on March 11, 2024, issued guidelines that are a mandatory minimum measure to secure the fundamental rights and dignity of intimate partners, and members of the LGBTQ+ communities in illegal detention. The Apex Court held that the High Court must adhere to these guidelines in the judgment dealing with habeas corpus petitions or petitions for police protection by intimate partners.
In a significant development, the Apex Court set aside the order of the Kerala High Court where the High Court directed the corpus X to go for counseling. The matter before the Kerala High Court was a Habeas Corpus petition filed by the present appellant alleging that Corpus X had been forcibly detained by her parents. The appellant and the Corpus have an intimate relationship and the Corpus wanted to stay with the Appellant. (Corpus and Appellant belong to the same sex).
The Kerala High Court after interaction with X through video conferencing at the office of the District Legal Services Authority (DLSA) directed that X be counselled by the psychologist of the Centre.
Directions for counseling or parental care have a deterrent effect on members of the LGBTQ+ community. Courts must bear in mind that the concept of ‘family’ is not limited to the natal family but also encompasses a person's chosen family. This is true for all persons.
It has gained heightened significance for LGBTQ+ persons on account of the violence and lack of safety that they may experience at the hands of their natal family. When faced with humiliation, indignity, and even violence, people look to their partners and friends who become their chosen family. These chosen families often outlast natal families as a source of immeasurable support, love, mutual aid, and social respect.
In SLP the Apex Court appointed Ms Saleena V G Nair, a Senior Judicial Officer to have an interview in the premises of Principal Judge Family Court Kollam and submit a comprehensive report based on the interview to the Apex Court. In the report it was submitted by the Judicial Officer, X is a major & has done a Master in Arts. She is living with her parents of her own will. She intends to become a lecturer and is focused on her career. She has a mobile and is free to move wherever she desires. At this point, she doesn’t want to marry anyone or live with anyone. She also stated that the Appellant is her close friend.
Apex Court observed there is no reason to disbelieve the report.

Guidelines
Habeas corpus petitions and petitions for protection filed by a partner, friend, or a natal family member must be given priority in listing and hearing before the court. A court must avoid adjourning the matter, or delays in the disposal of the case;
In evaluating the locus standi of a partner or friend, the court must not make a roving inquiry into the precise nature of the relationship between the appellant and the person;
The effort must be to create an environment conducive to a free and uncoerced dialogue to ascertain the wishes of the corpus;
The court must ensure that the corpus is produced before the court and given the opportunity to interact with the judges in person in chambers to ensure the privacy and safety of the detained or missing person. The court must conduct in-camera proceedings. The recording of the statement must be transcribed and the recording must be secured to ensure that it is not accessible to any other party;
The court must ensure that the wishes of the detained person is not unduly influenced by the Court, the police, or the natal family during the course of the proceedings. In particular, the court must ensure that the individuals(s) alleged to be detaining the individual against their volition are not present in the same environment as the detained or missing person. Similarly, in petitions seeking police protection from the natal family of the parties, the family must not be placed in the same environment as the petitioners;
Upon securing the environment and inviting the detained or missing person in chambers, the court must make active efforts to put the detained or missing person at ease. The preferred name and pronouns of the detained or missing person may be asked. The person must be given a comfortable seating, access to drinking water, and a washroom. They must be allowed to take periodic breaks to collect themselves. The judge must adopt a friendly and compassionate demeanor and make all efforts to defuse any tension or discomfort. Courts must ensure that the detained or missing person faces no obstacles in being able to express their wishes to the court;
A court while dealing with the detained or missing person may ascertain the age of the detained or missing person. However, the minority of the detained or missing person must not be used, at the threshold, to dismiss a habeas corpus petition against illegal detention by a natal family;
The judges must showcase sincere empathy and compassion for the case of the detained or missing person. Social morality is laden with homophobic or transphobic views or any personal predilection of the judge or sympathy for the natal family must be eschewed. The court must ensure that the law is followed in ascertaining the free will of the detained or missing person;
If a detained or missing person expresses their wish to not go back to the alleged detainer or the natal family, then the person must be released immediately without any further delay;
The court must acknowledge that some intimate partners may face social stigma and a neutral stand of the law would be detrimental to the fundamental freedoms of the appellant. Therefore, a court while dealing with a petition for police protection by intimate partners on the grounds that they are a same sex, transgender, inter-faith, or inter-caste couple must grant an ad-interim measure, such as immediately granting police protection to the petitioners, before establishing the threshold requirement of being at grave risk of violence and abuse. The protection granted to intimate partners must be with a view to maintaining their privacy and dignity;
The Court shall not pass any directions for counseling or parental care when the corpus is produced before the Court. The role of the Court is limited to ascertaining the will of the person. The Court must not adopt counseling as a means of changing the mind of the appellant, or the detained/missing person;
The Judge during the interaction with the corpus to ascertain their views must not attempt to change or influence the admission of the sexual orientation or gender identity of the appellant or the corpus. The court must act swiftly against any queerphobic, transphobic, or otherwise derogatory conduct or remark by the alleged detainers, court staff, or lawyers; and
Sexual orientation and gender identity fall in the core zone of privacy of an individual. These identities are a matter of self-identification and no stigma or moral judgment must be imposed when dealing with cases involving parties from the LGBTQ+ community. Courts must exercise caution in passing any direction or making any comment which may be perceived as pejorative.
