Napalm — Banksy, 2004

This 2004 Banksy screen print is a fair use triple threat, treading upon the copyrights of Disney, McDonald’s, and photojournalist Nick Ut. Ut’s horrific image of a young girl, naked, crying, and running alongside villagers of Trảng Bàng during the Vietnam War, deservedly earned Ut a Pulitzer Prize in 1973. Banksy’s use of this image alongside icons of corporate consumerism, falls squarely under fair use provisions “…for purposes such as criticism, comment, [and] news reporting….”

None of these images, by themselves, would be protected by fair use. However, combined as they are, the composition makes biting visual commentary on the motives and aftermath of war.
