dear americans,

as a polish queer woman and human rights activist, i know exactly how you're feeling right now and what to expect from these elections. i lived through the 2015-2023 regime of pis, a right-wing populist party that divided families in the same way trump did. i’ve experienced the rise of fascism in poland, the influence of far-right parties like konfederacja, and their “santa’s little helpers”—ordo iuris, an ultra-conservative catholic organization (banned in many countries, mind you) that helped enforce a near-total abortion ban and runs anti-queer campaigns in public spaces. i supported the black protests in 2016 as a middle schooler when they first tried to ban abortion. as an adult, i actively participated in the 2020 women’s strike, running from police tear gas daily after they finally passed the ban. i supported friends who faced charges.

i’ve lived through intense homophobia in poland as a queer teen and adult. i survived the first pride march in my hometown, where far-right extremists threw stones and glass at us. i endured the anti-queer propaganda spread by the ruling party in state-owned media. i survived the “rainbow night,” poland’s own stonewall moment in summer 2020, when police arrested around 50 queer activists following the arrest of margo, a nonbinary activist. i survived the "lgbt-free zones," the targeted violence, the slurs from strangers on the street, and the protests i held against queerphobia. it was hard as fuck, but i survived.

but just because i survived, it doesn’t mean others did. many women died because of the abortion ban—marta, justyna, izabela, dorota, joanna, maria, and many others who didn’t survive pis’s draconian anti-abortion laws. milo, kacper, michał, zuzia (she was 12), wiktor, and other queer and trans kids and young adults took their own lives because of the relentless queerphobia.

despite all of this, our experience in poland can serve as a guide now. here are some tips for staying safe and how we, polish queers and women, organized under the regime:

safety first, always. if you know someone who’s had an abortion, no you don’t. if you know someone is trans, no you don’t. if you know people who help with safe abortions, no you don’t—at least not until you know it’s 100% safe to share. if you are queer or have had an abortion, only share this with people you trust fully. most importantly, not everyone has to be an activist just because they’re part of a minority. if it feels unsafe to share that you're queer, trans, etc., then don’t. it doesn’t make you any less queer.

use secure, encrypted messaging like signal for conversations on potentially risky topics, such as queerness, abortion, organizing counter-actions, protests—anything that might be used against you.

stay anonymous online. if you want to research or report something without surveillance, do not use regular internet. get a vpn (mullvad is affordable and reliable), download the tor browser (for both onion and standard links), and if you plan to whistleblow, consider using a riseup email account.

organize and build networks. community is everything now. support each other, foster independence, because your government won’t have your back. set up collectives, grassroots movements. create lists of trusted professionals—lawyers, doctors, etc.—who can offer support.

to lawyers and doctors: please consider pro-bono work. this is what got us through poland’s hardest times. your work will be needed now more than ever.

for protests or risky actions: always write a pro-bono lawyer’s number on your arm with a permanent marker.

There are cultural, procedural, and common sense reasons why Japan's correctional organs would not be compelled to release a mass murderer with a preternatural capacity for serial killing who sought to destroy the social order to satisfy his god complex based on threats made by such mass murderer's riotous cult.

This isn't to say Kira worshippers wouldn't influence Light's sentencing. I'm sure they would since Japanese courts take into account the impact of a convicted person's crime(s) on Japanese society when determining whether the death penalty is appropriate, and instigating civil unrest that threatens national security constitutes a comically deleterious impact on Japanese society.

This also presumes a public and transparent process, but even where the circumstances aren't nearly so extraordinary, Japanese criminal proceedings are not terribly transparent. For example:

From the moment of arrest, prosecutors may strictly limit access to defendants; even defense counsel and family are often barred from contact.

Defense counsel has the right to request access to evidence the prosecutor uses in court, but the prosecution can withhold all other evidence. Further, defense counsel is only permitted to use disclosed evidence to prepare for trial, and cannot disclose information obtained during pre-trial discovery (including to the public).

Japan's constitution mandates open courts, but this does not extend to criminal court records, which are controlled by prosecutors and, if published, anonymized.

Japan’s death penalty law requires that executions must be carried out quietly and without public notice. Death-sentenced prisoners are kept in strict solitary confinement and monitored by 24-hour surveillance cameras. Prisoners are informed just one hour before their sentence is carried out, so their families and defense lawyers only learn about the execution after the fact.

Japanese prosecutors exercise immense discretion based on an opaque system of internal deliberation and consensus and, are substantially insulated from public scrutiny. This doesn't mean they're never influenced by the public, but its rare, and relatively weak.

tl;dr: (1) serious threats to a national government by fringe cultists are not usually a compelling criminal defense, but can be used to justify harsher sentencing; (2) there is 0 potential of Light being released if arrested, but very high potential for Ryuk becoming bored and killing Light before the Japanese government can get around to it. Which, isn't not canonically what happened.

PMD AU ideas:

The Hexcore is still around-but there are hints to its true nature. Remember how, in the Deoxys movie, one of the titular Deoxys manifested as a little swirl of psychic power due to it being dormant? Imagine that, but the little swirl is trapped inside the Hexcore. --That said, the Hexcore isn't really "alive" until Sky is consumed-the Virus never had the chance to become conscious. (It more... Merges with Viktor's own consciousness.)

-Viktor's consciousness is not subsumed by the virus, nor is he directly controlled. It's more akin to an infection that alters parts of his personality, but he's still technically acting on his own free will. The Deoxys Virus dredges up all the dark, hidden thoughts and personality traits buried deep in his subconscious, thing he didn't even know existed, and brings them to the forefront-but it never forces him to act on them. (I'm mostly taking this route because it's a lot creepier, and more insidious, than straight mind control. How can you say you're being controlled by an external force when all the external force does is dredge up the parts of yourself that even you were unaware of, and then lets you choose whether or not to act on them?) --(Viktor's mental state at that point was already pretty bad: the virus just makes it Worse.)

-The Herald of the Arcane is a "Regional Variant" of Deoxys that's Steel/Psychic Type. Imagine a Deoxys with metallic skin, the Herald of the Arcane's color scheme, and the golden crown-like filigree, and you have PMD Viktor's final form. His Ability, Arcanic Connection, gives him a resistance to Ghost and Dark-type moves.

-Post-game, you have a chance at running into Jayce and Viktor in an optional side quest. Viktor is still a Deoxys (since it was a one-way transformation, an his body basically is the viral mass now), but he's also come back to his senses and is extremely guilt-ridden over what he tried to do. Fortunately, Jayce loves him regardless of appearance, and he's trying to help Viktor see the advantages of his new form.

ok full disclosure i dont think ive ever seen the deoxys movie in full (or if i have, ive forgotten all of it lmao) so im relying on you (and bulbapedia) for that side of it. though the way it effects viktor in this seems pretty accurate to the hexcore in canon (it doesn't control him directly, but instead exploits the HELL out of every fear and weakness he's got buried in his subconscious to influence him to act upon it's will) which i love so so much. its still you but you can't trust your own mind nor can you tell where it ends and you begin. fun times <3

ngl the Herald of the Arcane sounds busted as hell with that ability and type combo. and also one of those creatures that isn't too scary as an adult but as a child is gonna leave scars. that or its gonna alter them on a fundamental level thats going to effect their interests in the future forever. (actually a while ago i came up with a fakemon for both versions of viktor and jayce. viktor's specifically was a normal/steel type (heraline) that turned either into electric/steel (macherald) or ghost/steel (archerald) depending on whether you give him the normal or corrupted hexcore)

(similarly, jayce had one that was a rock type (i never figured out a name for this guy unfortunately) that turned into a rock/fighting (giohund) or rock/fairy (talishund) depending on if it gets a gemstone or teardrop crystal)
