The CFPB is genuinely making America better, and they're going HARD

On June 20, I'm keynoting the LOCUS AWARDS in OAKLAND.

Let's take a sec here and notice something genuinely great happening in the US government: the Consumer Finance Protection Bureau's stunning, unbroken streak of major, muscular victories over the forces of corporate corruption, with the backing of the Supreme Court (yes, that Supreme Court), and which is only speeding up!

A little background. The CFPB was created in 2010. It was Elizabeth Warren's brainchild, an institution that was supposed to regulate finance from the perspective of the American public, not the American finance sector. Rather than fighting to "stabilize" the financial sector (the mission that led to Obama taking his advisor Timothy Geithner's advice to permit the foreclosure crisis to continue in order to "foam the runways" for the banks), the Bureau would fight to defend us from bankers.

The CFPB got off to a rocky start, with challenges to the unique system of long-term leadership appointments meant to depoliticize the office, as well as the sudden resignation of its inaugural boss, who broke his promise to see his term through in order to launch an unsuccessful bid for political office.

But after the 2020 election, the Bureau came into its own, when Biden poached Rohit Chopra from the FTC and put him in charge. Chopra went on a tear, taking on landlords who violated the covid eviction moratorium:

Then banning payday lenders' scummiest tactics:

Then striking at one of fintech's most predatory grifts, the "earned wage access" hustle:

Then closing the loophole that let credit reporting bureaus (like Equifax, who doxed every single American in a spectacular 2019 breach) avoid regulation by creating data brokerage divisions and claiming they weren't part of the regulated activity of credit reporting:

Chopra went on to promise to ban data-brokers altogether:

Then he banned comparison shopping sites where you go to find the best bank accounts and credit cards from accepting bribes and putting more expensive options at the top of the list. Instead, he's requiring banks to send the CFPB regular, accurate lists of all their charges, and standing up a federal operated comparison shopping site that gives only accurate and honest rankings. Finally, he's made an interoperability rule requiring banks to let you transfer to another institution with one click, just like you change phone carriers. That means you can search an honest site to find the best deal on your banking, and then, with a single click, transfer your accounts, your account history, your payees, and all your other banking data to that new bank:

Somewhere in there, big business got scared. They cooked up a legal theory declaring the CFPB's funding mechanism to be unconstitutional and got the case fast-tracked to the Supreme Court, in a bid to put Chopra and the CFPB permanently out of business. Instead, the Supremes – these Supremes! – upheld the CFPB's funding mechanism in a 7-2 ruling:

That ruling was a starter pistol for Chopra and the Bureau. Maybe it seemed like they were taking big swings before, but it turns out all that was just a warmup. Last week on The American Prospect, Robert Kuttner rounded up all the stuff the Bureau is kicking off:

First: regulating Buy Now, Pay Later companies (think: Klarna) as credit-card companies, with all the requirements for disclosure and interest rate caps dictated by the Truth In Lending Act:

Next: creating a registry of habitual corporate criminals. This rogues gallery will make it harder for other agencies – like the DOJ – and state Attorneys General to offer bullshit "delayed prosecution agreements" to companies that compulsively rip us off:

Then there's the rule against "fine print deception" – which is when the fine print in a contract lies to you about your rights, like when a mortgage lender forces you waive a right you can't actually waive, or car lenders that make you waive your bankruptcy rights, which, again, you can't waive:

As Kuttner writes, the common thread running through all these orders is that they ban deceptive practices – they make it illegal for companies to steal from us by lying to us. Especially in these dying days of class action suits – rapidly becoming obsolete thanks to "mandatory arbitration waivers" that make you sign away your right to join a class action – agencies like the CFPB are our only hope of punishing companies that lie to us to steal from us.

There's a lot of bad stuff going on in the world right now, and much of it – including an active genocide – is coming from the Biden White House.

But there are people in the Biden Administration who care about the American people and who are effective and committed fighters who have our back. What's more, they're winning. That doesn't make all the bad news go away, but sometimes it feels good to take a moment and take the W.

“Well I’ll go first my name is Yunah and I’m currently 19 going on 20,be sure to be free with me” she introduced with a smile.

“I’ll go second my name is Minju im currently 19,I may look angry but I promise you I’m nice” Minju introduced with a smile.

“Are you an 04’ liner?” Yunah asked Minju to which she nodded.

“Ooo a same year friend” Yunah exclaimed clapping her hands.

“I’ll go next my name is moka and I’m also 19 adding to the 04’ line of the group” she introduced with a cute smile.

“Are you Korean?” Wonhee asked tilting her head….

“No im from Japan” moka responded.

“Ah! I’m also from Japan!” Iroha said and her and moka looked at each other smiling.

“Next my name is youngseo born in 2005 meaning I’m 18” the next person introduced.

“2005?!” Yunah was the first to exclaim.

“Well i thought I was going to be the maknae but i guess I can’t since you’re a year younger” Minju said.

“Same” moka and Yunah agreed.

“I’m the next my name is Wonhee,I’m 16yrs old going on 17” she introduced smiling brightly.

“I knew I’d find someone younger than me!” Youngseo spoke snapping her fingers.

“Woah you’re 3yrs younger than me!” Minju exclaimed widening her eyes.

“I’m next my name is Iroha and I’m also Japanese currently 15 born in 2008” she introduced shyly.

Your eyes widened as the second to the last person was even older than you.

“Oo another Japanese!” Moka exclaimed.

“I’m 4yrs older I’m staring to feel old” Minju said and they all laughed.

They’re all older than you and you’re the last person.

“I guess I’m last…My name is Hong Yn and I’m 13yrs old born in 2010” you said with a wide smile.

“A 10’ liner!!” Yunah exclaimed.

“Now I do feel old…I’m SIX YEARS OLDER THAN YOU!!” Minju exclaimed.

They all looked at you shocked making you nervous.

“I thought I was going to be the maknae but I’m actually the eldest” Yunah said amazed.

“She’s so cute! She fits maknae vibes so well” wonhee cooed making you blush.

Although it was a common thing you’ve heard hearing it from your new members mouths made you blush.

“Ahhh!” Moka squished your cheeks.

“They’re so chubby and cute” moka said looking at you.

“Tell me I’m not the only one who thought they were going to be the maknae?” Yunah asked.

“Nah I think we all thought that” they responded.

“Well yn we’ll all have to look out for you a lot” Youngseo said looking at you.

“You still go to school right?” Yunah asked and you nodded.

Never was the expression “same old, same old" more appropriate than when it comes to government statements and attitude towards welfare payments.

Below is a series of statements by various Conservative Chancellors since 2010.

“The benefit system is broken. I  think people in this country understand that the welfare system needs to change."  (George Osborne 02/04/2013

“DWP’s own statics show that nearly 90 people died every month between December 2011 and February 2014 after their ESA benefit stopped because a work capability assessment found them able to work." (Independent: 23/11/16)

“Sajid Javid insists Universal Credit cut will go ahead amid warnings of ‘catastrophic’ consequences" (Canary:12/09/21)

“Jeremy Hunt has been accused of "demonising" disabled people after announcing sweeping welfare changes that will strip them of benefits if they don't look for a job.”  (Sky News: 22/11/23)

“Tories pledge to cut rising welfare bills." (Rishi Sunak LBC News: 08/06/24)

Every Tory Chancellor has cut welfare payments. It is what we expect from uncaring Conservative governments whose priorities are always  cutting government spending.

No Tory government seems to be concerned about the causes of a rising welfare bill – junk food leading to ill health, decades of low wages, a rigged housing market leading to unaffordable rents and a lack of social housing, starving the NHS of sufficient funding, a total lack of planning regarding social care of the elderly. I could go on.

The one connecting theme is those on welfare are seen as unworthy of even the little help they are given. Time and time again, it is the poorest and least healthy in our society who are told they must make sacrifices to save the country money because it is their fault they are poor or sick.

Strangely it is never the rich and wealthy who are asked to contribute more. They can go on enjoying paying a lower tax rate for their unearned income than the ordinary men and women who have to work for a living; and while the British government provides £23billion to corporations and big business over the next three years, the poorest in our society  must take a cut in their benefits. In short, the poor and the sick are subsidizing big business.

This is what we expect from the Tories and comes as no surprise. What is disheartening is that this is now the policy of the Starmer Labour government.

Really?  The poor and the sick are to pay for the defence of the rich and wealthy? It's a novel idea but how about the rich and the wealthy paying some of the necessary increase in defence spending? Perhaps an end to their tax breaks? Perhaps an end to their tax avoidance schemes? Perhaps a tax on their wealth? Maybe British business could be charged a defence levy?

But no, that just isn’t going to happen. Starmer is a Blairite and Blaire is a supporter of the old neo-liberal economic order. The disillusionment with neo-liberal free market economics and its failure to boost the living standards of ordinary Americans has led to the rise of the populist hard-right Donald Trump. The same thing is going to happen here and Starmer and the Conservative party will only have themselves to blame.

The Symphony No. 9 in E minor, "From the New World", Op. 95, B. 178 (Symfonie č. 9 e moll "Z nového světa"), popularly known as the New World Symphony, was composed by Antonín Dvořák in 1893 while he was the director of the National Conservatory of Music of America from 1892 to 1895. It premiered in New York City on 16 December 1893. It has been described as one of the most popular of all symphonies.

I decided to audition for the X Factor in 2010 when I was 16, and I was put in a band with five boys.
