This epidemic of anti-LGBTQ violence is as important as the emergency that we are all experiencing right now”, said Pedro Julio Serrano, a CABE spokesman.

On Monday, April 27, CABE sent a letter to the Secretary of Public Security, Pedro Janer, and to the Commissioner of the Police Bureau, Henry Escalera, demanding an immediate and urgent meeting with Janer and Escalera in order to demand answers on the status of the investigations, the plan for surveillance and prevention of these crimes, as well as a guarantee that the processes will be carried out in accordance with the protocols and free of prejudice.

“The violence we are experiencing has its roots in the hateful rhetoric and actions by fundamentalist politicians and religious leaders who incite violence, who persecute, demonize and attack LGBTQ people. Enough of using us as scapegoats for your divisive agendas. We are as human beings as the rest of society and we deserve the same respect, the same freedom and the same equity”, said Carmen Milagros Vélez Vega, a CABE spokesperson. 

Natasha Alor, a young trans activist, called for “creating a society in which respect for diversity is a value, not a weapon to attack the experiences of another human being. Our lives experience violence every second of the day. This is not only unfair, it is inhumane. As trans people we demand respect for our lives and the guarantee that justice will be done so that these crimes do not go unpunished and do not happen again”. 

Lastly, Justin Jesus Santiago, a CABE ally, emphasized that “it is time for this government to demonstrate that it is going to fulfill its duty to protect trans people and LGBTQ people. We recognize the Coronavirus emergency, but there is also the emergency of homophobic and transphobic violence that is killing us. It is time to act. Not one more LGBTQ person can die because of hatred.”

Imputaciones de irregularidades por intervenciones indebidas en pesquisas, otorgación de jugosos contratos y hasta cancelación de fondos a entidades en represalia por pedir su renuncia son algunas de las manchas que persiguen a Wanda Vázquez Garced durante su gestión pública previo a ocupar la secretaría del Departamento de Justicia.

Vázquez Garced enfrentó un proceso judicial radicial radicado por la Oficina del Panel sobre el Fiscal Especial Independiente (OPFEI) por presenta intervención indebida en la pesquisa criminal sobre un escalamiento a la residencia de su hija. Mientras, su esposo, el juez Jorge A. Díaz Reverón también enfrentó una investigación administrativa por presuntamente utilizar su poder para citar a un potencial testigo del caso.

Los hechos por los que se le presentarán cargos a la Secretaria de Justicia surgieron como parte de una investigación colateral en el caso original de chat político de WhatsApp que la hoy relevada secretaria refirió.

Pero esta no es la primera ocasión en la que la abogada y exfiscal ha estado involucrada en controversias públicas. Durante su incumbencia en la Oficina de la Procuradora de las Mujeres se le imputaron irregularidades en el manejo de la investigación por violencia de género en febrero de 2012 contra el entonces candidato a la alcaldía de San Juan por el Partido Popular Democrático (PPD), Héctor Ferrer Ríos.

En aquella ocasión, el representante Ferrer Ríos acusó a Vázquez Garced y a la fiscal Melissa Vázquez de amenazar a su pareja Elisa Hernández con quitarle la custodia de su hijo y que presuntamente le ofreció trabajo en la Oficina de la Procuradora de las Mujeres. Ferrer Ríos atribuyó la investigación como una politiquería y escribió sendas cartas al gobernador Luis Fortuño y la jefa interina de la Fiscalía Federal en Puerto Rico, Rosa Emilia Rodríguez.

Una declaración de la pareja establecía que fue coaccionada por los funcionarios para declarar en contra del entonces representante del PPD. Contrario a la lentitud de los procesos investigativos recientes como el caso de WhatsApp; el referido por irregularidades en la oficina legislativa del exrepresentante Samuel Pagán, que salpica al Capitolio por posibles empleados fantasma y los furgones de la CEE, entre otros, Ferrer Ríos fue referido al OPFEI en menos de una semana. El caso fue archivado en julio de ese año.

Tras cerca de dos décadas como fiscal, Vázquez Garced fue designada en el 2010 por el entonces gobernador Luis Fortuño a dirigir la Oficina de la Procuradora de las Mujeres. Según Edda López portavoz del Frente Amplio de Mujeres, Vázquez Garced no solo incumplió con la ley 20 que crea la OPM; sino que además dejó de levantar data estadística, cerró el diálogo de la oficina con grupos feministas y hasta canceló asignaciones de fondos a albergues, organizaciones y centros en represalia por las críticas en su contra.

"Nosotras hicimos en el 2014 un frente común para pedir su renuncia. A quienes recibían fondos de su oficina que ella identificó estaban apoyando esa postura les quitó los chavos. A la Casa Protegida Julia de Burgos le quitó $150 mil que eso es un motón y que se los diga la organización del pastor Ricky (Rosado) que se llama El Amor Espera", denunció en entrevista con este diario.

Dos fuentes adicionales confirmaron que fueron muchas las entidades dedicadas a ofrecer servicios a mujeres a las que Vázquez Garced presuntamente les quitó los fondos sin aparente razón que no fuera haberse quejado de su gestión y solicitar su salida de la procuraduría.

"¡Hizo barbaridades!", sostuvo una de las entrevistadas con la condición de que no se revelara su nombre. Al igual que López, reportó que a partir del 2014 Vázquez Garced fue mucho más confrontacional con las líderes feministas.

"En lugar de reuniones de trabajo ella lo que hizo fue reuniones de represalias, de hablarles fuerte y unilateralmente imponer medidas como tener liquidez de tres meses como requisito para obtener fondos, lo que es imposible. Sé de compañeras que tuvieron que hipotecar sus casas para poder funcionar los albergues que tenían", añadió López.

Mientras eso ocurría, a Vázquez Garced se le cuestionó el uso de fondos públicos para jugosos contratos a allegados como el de Valerie Rodríguez Erazo, esposa de Elías Sánchez, que tuvo contratos por valor de hasta $216 mil por asesoría y consultoría en OPM durante su incumbencia, según el registro de contratos de la Oficina del Contralor.

La funcionaria también protagonizó controversias por sus expresiones como procuradora al recomendar que las mujeres debían portar armas para protegerse de la violencia de género y en 2013 favorecer la pena de muerte.

Como Secretaria de Justicia, sometió al Panel del FEI una recomendación para la activación de múltiples fiscales por el escándalo de WhatsApp, pero la OPFEI solo dio paso a la designación de fiscal para el expresidente de la Comisión Estatal de Elecciones (CEE), Rafael Ramos Sáenz, y abrió una "investigación" en contra de ella. El Departamento bajo su mando también enfrentó críticas cuando, en un proceso de regla 6 como el que ella enfrenta hoy, no mandó a ningún fiscal cuando el imputado fue el exsecretario de Justicia, Guillermo Somoza (por supuestamente regatear en su auto mientras lo acompañaba su hijo menor de edad), pero asignó a cuatro fiscales para el abogado Leonardo Aldridge (por supuesta obstrucción a la justicia).

El polémico caso actual contra Vázquez Garced se complicó esta semana cuando trascendió que su esposo citó a su sala en el Tribunal Superior de Caguas al agente Marcano Marrero, potencial testigo, para viabilizar una conversación con uno de los abogados de su esposa.

"Me preguntó que si estaba disponible para hablar con uno de los abogados que litigarían a favor de la Secretaria de Justicia, le dije que no tenía problema, esperé un sala unos minutos, luego llegó el licenciado Edgar R. Vega Pabón, este me pidió salir de sala al pasillo", relató el agente en un documento oficial del Negociado de la Policía de Puerto Rico.

La relación conyugal del juez y la secretaria de justicia y su posible conflicto de intereses ya se había planteado ante el Tribunal Supremo en un caso criminal en la que la defensa del acusado solicitaba la inhibición del juez ya que podría afectarse su derecho a un "juicio justo e imparcial" por la aparente existencia de parcialidad del magistrado en favor del Estado debido a su relación con la Secretaria de Justicia.

El Supremo no intervino por lo que prevalece la sentencia del Tribunal Apelativo que, aunque, no encontró necesaria la inhibición del juez, expresó un grado de preocupación por la relación entre ambos funcionarios, por lo que exhortó a Justicia a que implementara controles para evitar la percepción de que ambos comparten confidencias e impresiones en casos criminales.

Recientemente, la Secretaria, y quien podría pasar a ser la Gobernadora de Puerto Rico el próximo 2 de agosto, fue señalada de evitar una investigación en el escándalo que salpicó la Administración Rosselló Nevares cuando aparecieron vagones llenos de suministros que debían ser entregados a los damnificados de los huracanes Irma y María.

Previo a ello, Vázquez Garced había sido señalada por dar paso a una investigación sobre el controversial chat de Telegram, que provocó la renuncia del Gobernador, cuando ella había sido nombrada en el mencionado chat. Días más tarde y ante cuestionamientos públicos, se inhibió de la investigación.

Ayer, la Secretaria se expresó "dispuesta" a tomar la "encomienda histórica" de asumir la gobernación de Puerto Rico en medio de la debacle de la Administración Rosselló Nevares.
