To Protect the Interests of Buyers, MahaRERA Mandates Real Estate Developers to Have Three Bank Accounts for Each Project
On June 27, the Maharashtra Real Estate Regulatory Authority (MahaRERA) announced that real estate developers would not be permitted to deposit the money they receive from buyers into separate bank accounts as of July 1.
They are now required to have three different bank accounts active for each project at a single bank in order to maintain budgetary control and timely project completion.
According to the MahaRERA, developers have been told to set up three different bank accounts in a single bank for each project. The funds received from homebuyers will go into the first bank account.
According to the statement, 30% of the remaining funds will need to be retained in a third bank account, and 70% of the funds that were allotted for the project must be kept in the second bank account (escrow).
The MahaRERA noted in a statement that the decision, which will take effect on July 1, was made after taking into account the views, recommendations, and objections of all parties involved.
The RERA designated collection account and the RERA designated separate account are shielded legally against government agency attachment, according to MahaRERA.
This decision will contribute to building the trust of the flat buyer and bolster the legitimacy of the real estate industry. MahaRERA noted in a statement that this is just another important move towards improving the consumer experience.
Developers are currently required by MahaRERA to have a single designated account for each project. 70% of the project's total cost must be kept by the developers in this designated account (escrow account).
MahaRERA did note that a number of developers have been requesting that buyers place funds in multiple bank accounts for various reasons. For instance, the funds received for infrastructure and amenities like a gym, pool and parking is transferred into one bank account, while the funds reserved for an apartment booking is deposited into another.
The MahaRERA has required developers to create three bank accounts in a single bank in order to stop this practice, maintain discipline, responsibility, and uniformity in the financial operations of housing projects, and to safeguard the interests of home buyers, the regulator said in a statement.
In general, developers have applauded MahaRERA's decision since it aims to protect the project completion procedure. Developers' ultimate objective is project completion, therefore the decision benefits both homebuyers and developers, according to NAREDCO Maharashtra managing committee member Gautam Thacker.
