Entering the United States has become more precarious since the start of the second Trump administration in January. There has been an apparent surge in both foreign visitors and US visa holders being detained, questioned, and even deported at the border. As the situation evolves, demand for flights from Canada and Europe has plummeted as people reevaluate their travel plans.
Many people, though, can’t avoid border crossings, whether they are returning home after traveling for work or visiting friends and family abroad. Regardless of the reason for travel, US Customs and Border Protection (CBP) officials have the authority to search people’s phones and other devices as they determine who is allowed to enter the country. Multiple travelers have reported being questioned or turned away at the US border in recent weeks in relation to content on their phones.
While not unique to the US border—other nations also have powers to inspect phones—the increasingly volatile nature of the Trump administration’s border policies is causing people to rethink the risks of carrying devices packed with personal information to and from the US. Canadian authorities have updated travel guidance to warn of phone searches and seizures, some corporate executives are reconsidering the devices they carry, some officials in Europe continue to receive burner phones for certain trips to the US, and the Committee to Protect Journalists has warned foreign reporters about device searches at the US border.
With this in mind, here’s the WIRED guide to planning for bringing a smartphone across the border. You should also use WIRED’s guide to entering the US with your digital privacy intact to get a broader view of how to minimize data and take precautions. But start here for everything smartphone.
What Can CBP Access?
Do CBP officials have the authority to search your phone at the border? The short answer is yes. Searches are either manual, with a border official looking through the device, or more advanced, involving forensic tools to extract data en masse. To get into your phone, border officials can ask for your PIN or biometric to unlock the phone. However, your legal status and right to enter the US will make a difference in what a search might look like at the border.
Generally, border zones—which includes US international airports—fall outside of Fourth Amendment protections that require a warrant for a device to be searched (though one federal court has ruled otherwise). As such, CBP has the power to search any traveler’s phone or other electronic devices, such as computers and cameras, when they’re entering the country. US citizens and green card holders can refuse a device search without being denied entry, but they may face additional questioning or temporary device seizure. And as the Trump administration pushes the norms of acceptable government conduct, it is possible that, in practice, green card holders could face new repercussions for declining a device search. US visa holders and foreign visitors can face detention and deportation for refusing a device search.
“Not everybody has the same risk profile,” says Molly Rose Freeman Cyr, a member of Amnesty International’s Security Lab. “A person’s legal status, the social media accounts that they use, the messaging apps that they use, and the contents of their chats” should all factor into their risk calculus and the decisions they make about border crossings, Cyr says.
If you feel safe refusing a search, make sure to disable biometrics used to unlock your device, like face or fingerprint scanners, which CBP officers can use to access your device. Instead, use only a PIN or an alphanumeric code (if available on your device). Make sure to keep your phone’s operating system up to date, which can make it hard to crack with forensic tools.
You should also consider factors like nationality, citizenship, profession, and geopolitical views in assessing whether you or someone you’re traveling with could be at higher risk of scrutiny during border crossings.
In short, you need to make some decisions before you travel about whether you would be prepared to refuse a device search and whether you want to make changes to your devices before your trips.
Keep in mind that there are simple steps anyone can take to keep your devices out of sight and, hopefully, out of mind during border crossings. It’s always a good idea to obtain a printed boarding pass or prepare other paper documents for review and then turn your phone off and store it in your bag before you approach a CBP agent.
Traveling With an Alternate Phone
There are two ways to approach device privacy for border crossings. One is to start with a clean slate, purchasing a phone for the purpose of traveling or wiping and repurposing your old phone—if it still receives software updates.
The device doesn’t need to be a true “burner” phone, in the sense that you will be carrying it with you as if nothing is out of the ordinary, so you don’t need to purchase it with cash or take other steps to ensure that it can’t be connected to you. The idea, though, is to build a sanitized version of your digital life on the travel phone, ideally with separate communication and social media accounts created specifically for travel. This way, if your device is searched, it won’t have the back catalog of data—old text messages, years of photos, forgotten apps, and access to many or all of your digital accounts—that exists on your primary phone and could reveal details of your political views, your associations, or your movements over time.
Starting with a clean slate makes it easy to practice “data minimization,” or reducing the data available to another person: Simply put the things you’ll need for a trip on the phone without anything you won’t need. You might make a travel email address, some alternate social media accounts, and a separate account for end-to-end encrypted communications using an app like Signal or WhatsApp. Ideally you would totally silo your real digital life from this travel life. But you can also include some of your regular personal apps, building back from the ground up while determining on a selective basis whether you have existing accounts that you feel comfortable potentially exposing. Perhaps, for example, you think that showing a connection to your employer or a community organization could be advantageous in a fraught situation.
Privacy and digital rights advocates largely prefer the approach of building a travel device from scratch, but they caution that a phone that is too squeaky clean, too much like a burner phone, can arouse suspicion.
“You have to ‘seed’ the device. Use the phone for a day or even for a few hours. It just can't be clean clean. That’s weird,” says Matt Mitchell, founder of CryptoHarlem, a security and privacy training and advocacy nonprofit. “My recommendation is to make a finsta for travel, because if they ask you what your profile is, how are you gonna say ‘I don't use any social media’? Many people have a few accounts anyway. One ratchet, one wholesome—add one travel.”
Cyr, from Amnesty International, also points out that a true burner phone would be a “dumb” phone, which wouldn’t be able to run apps for encrypted communications. “The advantage that we all have with smartphones is that you can communicate in an encrypted way,” Cyr says. “People should be conscious that any nonencrypted communication is less secure than a phone call or a message on an application like Signal.”
While a travel device doesn’t need to use a prepaid SIM card bought with cash, it should not share your normal phone number, since this number is likely linked to most if not all of your key digital accounts. Buy a SIM card for your trip or only use the device on Wi-Fi.
Traveling With Your Primary Phone
The other approach you can take to protecting your device during border crossings is to modify your primary smartphone before travel. This involves removing old photos and messages and storing them somewhere else, cleaning out nonessential apps, and either removing some apps altogether or logging out of them with your main accounts and logging back in with travel accounts.
Mohammed Al-Maskati, digital security helpline director at the rights group Access Now, says that people should consider this type of clean-out before they travel. “I will look at my device and see what apps I need,” he says. “If I don't need the app, I just remove it.”
Al-Maskati adds that he suggests people particularly remember to remove dating apps and anything related to LGBTQI communities, especially if they consider themselves to be at higher risk of facing a device search. And generally, this approach is only safe if you are particularly diligent about removing every app that might expose you to risk.
You could use your own phone as a travel phone by backing it up, wiping it, building a travel device with only the apps you really need while traveling, going on your trip, and then restoring from the backup when you get home. This approach is doable but time consuming, and it creates more opportunities for operational security mistakes or what are known as “opsec fails.” If you try to delete all of your old, unwanted apps, but miss one, you could end up exposing an old social media account or other historic service that has forgotten data in it. Messaging apps can have easily searchable archives going back years and can automatically save photos and files without you realizing it. And if you back up all of your data to the cloud and take it off your device, but are still logged into the cloud account underpinning other services (like your main Google or Apple account), you could be asked to produce the data from the cloud for inspection.
Still, if you assess that you are at low risk of facing scrutiny during a border crossing or you don’t have access to an additional device for travel, modifying your main smartphone is a good option. Just be careful.
What To Do, If Nothing Else
Given all of this, you may be hyped up and ready to throw your phone in the ocean. Or you may be thinking there’s no way in hell that you’re ever going to take the time to deal with any of this. For those in the latter camp, you’ve come this far, so don’t click away just yet. If you don’t want to take the time to make a bunch of changes, and you don’t think you’re at particular risk during border crossings (though keep in mind that it’s possible your risk is higher than you realize), there are still a few easy things you can do to protect your digital privacy that are better than nothing.
First, as mentioned above, print a paper boarding pass and any other documents you might need. Even if you don’t turn your phone off and stow it in a bag for your entire entry or exit process, you can put it in your pocket and have your paper ticket and other documents ready while actually interacting with agents. And taking basic digital hygiene steps, like updating your phone and removing apps and data you no longer need, can go a long way.
“We all need to be recognizing that authorities may scrutinize your online presence, including social media activity and posts you’ve published,” says Danacea Vo, founder of Cyberlixir, a cybersecurity provider for nonprofits and vulnerable communities. “Since people have gotten more vocal on social media, they’re very worried about this. Some have even decided not to risk traveling to or from the US this year.”

Hey! It’s me, Victor.
No, of course it’s me. Duh. Who else would it be? It’s my journal, after all. I’m still getting used to doing this, so it’ll be rough around the edges for a while.
Okay, so it’s possible I might be a tiny bit nervous. I’m in my room right now, which you can probably see, and I'm gathering up the last of my stuff for my tropical adventure on Kainani Island because I’m leaving in a few hours. I still have to figure out a way to pack my new camera safely. Yuri gave it to me as a surprise present for my trip, and I can hardly believe I now own an actual piece of photography equipment that isn’t my phone or the unpredictable old pocket camera I got from my Uncle Stephen.
I think Yuri giving me a camera means he expects me to bring home lots of beautiful pictures from Kainani Island. As well as pictures of scenery, I’ll have to take as many photos of tropical flowers as I can. Yuri loves flowers. I’d rather he saw them for himself than for me to take pictures of them, but sadly, I didn’t succeed in convincing him to come along, so you guessed it. I’m going by myself.
I’m sure Yuri isn’t happy about me flying halfway around the world. I'm convinced he thinks I’ll fall into some sort of misadventure. But like, that almost never happens, and… Okay, no. It does, but what bad thing could possibly happen in a paradise like Kainani?
Kainani Island is a tiny country, and from all my research, I’ve learned that they have an incredibly low crime rate, no factories, no paved roads, and very few motorized vehicles. Their largest industries are fishing and fruit farming, and their greatest claim to fame is how pristine the island and the ocean around it are. Taking care of their natural environment is a high priority for them. which is likely the biggest reason why they only allow a certain number of foreign visitors each year.
You have to apply for a visa to go there. I applied for visas for me and Yuri around the end of March, on the chance that Yuri would eventually make up his mind to come with me.
Let me just say that the visa process for Kainani is a lot more involved than what I had to do for Japan. As a Canadian, I didn’t even need a visa to come here. I only had to apply for a travel authorization, which took a few minutes to complete online, and then I was allowed to stay in Japan for up to 90 days as a visitor. Before the 90 days were up, Yuri and I submitted the paperwork for him to sponsor me for Japanese permanent resident status, and now I have a work permit which is valid for two years. I’m thankful for that.
It probably goes without saying, but I also feel really grateful that my visa request for Kainani was approved so fast. It's early May and it's starting to warm up nicely in Kyoto Prefecture where we live, and I suspect a lot more people would want to go to a tropical island when it’s colder here. Maybe this is a slower period of tourism for Kainani, which could explain why I got my visa so quickly.
Personally, I’d rather go to Kainani now, in spring, before it starts getting too hot there. Besides, the summers are gorgeous here, and I want to be with Yuri for the Festival of Snow and all the other fun summer activities. Also, I’ll have to get a real job soon to help pay the household expenses and fund my next big adventure. My savings aren’t going to last indefinitely, and what I make from teaching swimming lessons isn’t exactly a get rich quick plan. Yuri says late spring is the best time for a job search, since summer is peak tourist season here in the Matsumori area and more businesses will be hiring staff to accommodate the influx of visitors.
I wonder if I can find a job that involves sports. That’d be ideal, since that’s my area of expertise. My college diploma is in Health and Wellness Management, and back home in Canada I was a personal trainer and swimming instructor. I’d be happy to do something like that here, but what I’d really like is to be a snowboarding instructor like our friend Seiji Hinamori. I mean, who wouldn’t want to get paid to snowboard?
Yeah, I hear the protests, “Don’t you already get paid to snowboard?” Technically I do, but only if I win, and even though I’m awesome, wins are never guaranteed. I’ve had a couple of product deals in the past, but they were nothing major. It was just local businesses in Maple Grove who wanted an allegedly famous athlete to be in their low-budget TV commercials for random stuff that's totally unrelated to sports. Like, I was on a commercial for a pet supplies shop once. My mom and my friends thought that was hilarious. Yuri says he thinks I might be able to get better brand representation deals here. I hope he’s right, because I’m not selling any more aquarium filters or organic dog treats on community cable TV.
Okay, back to the topic of my trip. I didn't mean to get sidetracked like that, but I'm easily distracted. When I was a kid, my mom thought I had ADHD like my Uncle Stephen. She had me tested, but it turned out that I don't have it. I'm just super bad at staying on track 'cause I can't stop thinking about a hundred things at once, especially when I'm anxious or excited.
Right. I was talking about Kainani Island.
Our next-door neighbours, Jinsei and Kimiko, are going to take me to the airport. Yuri said he couldn’t do it because of some online work meeting, but I think the real reason is that he doesn’t like farewells and he didn’t want to inadvertently make a scene in public. Never mind that I’d be the one crying, it’d still be uncomfortable for him. We’ll say goodbye at home. That’ll be better for both of us, I think.
Jinsei and Kimiko are fraternal twins, and they’re around the same age as Yuri and me, and they love snowboarding as much as we do. Before I got here, Yuri didn’t know them very well despite living next door to them for two years, but I fixed that situation. Nothing says 'Hello, friends!" like a big plate of sugar cookies with frosting and rainbow sprinkles, and I'm a great baker. We started socializing a lot more after that, and now we’re all great friends.
Jinsei and Kimiko think I’m funny, although I’m not sure that’s always a compliment. Jin says I’m rambunctious. Even though that’s sorta true, it’s not a word I would’ve expected to come out of the mouth of another twenty-five year old. I think using words like that kind of makes him sound like an old man, and to me, that’s really funny.
Anyway, I asked Kimiko to look in on Yuri while I’m away, 'cause honestly, I'm worried about leaving him. It’s not that he can’t take care of himself. He lived alone before I moved in, but… you know. His health isn’t the greatest, and anything could happen to him, and I wouldn’t be here to help him if he needed me.
Our conversation earlier today didn't do much to ease my anxiety about Yuri staying alone. He had been quiet for most of the day, and it was clear to me that he was upset, although he didn't offer any explanation. It bothered me to see him like that, so I decided I'd better approach the topic myself.
“What’s up?” I asked. I dropped down beside him on the sofa and put my arm around his shoulders. “Want to talk about why you look so mopey?”
It was a stupid way to start, but no doubt you've already worked out that subtlety isn’t my strong point. Luckily for me, Yuri is used to my verbal clumsiness by now and usually puts up with me being dumb and socially inept.
He didn’t lean into my embrace, but he did look up from the book he was pretending to read. “Do I really need to tell you? You should know.”
“I’m guessing it’s about my trip,” I said.
“Yes.”
“You’re absolutely sure you don’t want to go with me?” I asked.
“You’re absolutely sure you have to go?” he countered.
“I don’t absolutely have to,” I told him. “If you really don’t want me to go—”
“No.” He shook his head. “This is what you want. I’m not going to stop you from doing it. It’s just… I’m going to miss you.”
“I’ll miss you too,” I told him. “But, it’s not like we won’t be in contact. I’ll call you every day.”
“Promise?”
“Yeah,” I said. “I promise.”
"Okay." He gave me a weak smile. “If you’re leaving tonight, hadn’t you better finish packing your stuff?”
“Ah, crap!” I exclaimed. “Yeah. I gotta get on that. I guess I’d better learn to be more organized if I’m going to make a habit of world travelling.”
And there’s the explanation for why I was shoving stuff into my bag at almost the last minute. We're right back to those attention and focus issues again. Welcome to my life.
“And you’re worried about me,” Yuri remarked. This time, his smile didn’t look forced.
“I think my concerns about you are legitimate,” I insisted.
“What do you mean?”
“You know exactly what I mean. You need to get lots of rest and have regular meals. Healthy meals. Don’t try to exist on just grape juice and soy milk while I’m gone, all right? Remember to take your medication, and eat food.”
“Okay.”
“I’m serious, Yuri. If you’re sick while I’m gone—“
He gazed at me with those beautiful, soulful brown eyes of his. “You’d come straight back, right?”
“Yes! You know I would. But knowing what you’re like, you probably wouldn’t tell me, would you?”
“No, because I wouldn’t want you to worry while you're away,” he admitted.
“You know I will anyway.“
“Try not to,” he said. “I’ll be fine.”
“You’d better be,” I said, attempting to sound fierce and failing spectacularly at it.
“Or else...?”
“Or else I’ll have no choice but to never, ever leave you again.”
He looked directly into my face and said seriously, “I’d be perfectly fine with that.”
As gently as I could, I pulled him closer for a proper hug. He only resisted for a fraction of a second. Then, he wrapped his arms around me and held onto me like he never wanted to let me go.
“I love you,” I whispered.
He didn’t respond in kind, but I didn’t find that unusual. People in Japan don’t tend to say ‘I love you’ as easily and frequently as we do in the West, even to the people who are the most important to them. I have absolutely no doubt that Yuri loves me though, regardless of how sparingly he uses the actual words.
After a minute or so, he gave me something better than a verbal reply. He pulled away from me just enough so we could kiss.
Something you should know about Yuri and me is that we rarely kiss each other on the mouth. Neither of us are particularly comfortable with touching on our lips, and both of us have to really want to do it. If we’re not both in the right headspace, it’s not gonna happen.
I remember our first real kiss. It was awkward and completely unplanned. I mean, I’d thought about it a lot, but Yuri has issues with physical contact and even though we considered ourselves a couple since before I moved here, it took a while for him to be okay with the level of physical affection we enjoy now. Our first kiss was also kind of weird for me because I’d never kissed another man before. I’ve always been attracted to people of every gender, so the concept of kissing another man wasn't the issue. It was that I’d never been in a relationship that was more than a friendship with a guy before I met Yuri, and... yeah. You know how mainstream media romanticizes first kisses and makes them seem all magical with metaphorical fireworks and glitter or whatever? It was totally not like that.
But, for all its strangeness, I can’t say I hadn’t liked it. Initially, I hadn’t been sure Yuri liked it, though. As soon as it was done, he’d pressed his face into the crook of my neck and sobbed so hard that I’d thought he was going to make himself sick.
I had tried to reassure him. “We don’t have to do that again.”
“No,” he’d managed to say. “I... I want to. Not now, but... another time? I didn’t know I could... be afraid to do it and also like it? I’m sorry. I’m not making sense.”
“Don’t worry. I get it.” I’d said. “You’re making total sense.”
And in a strange way, I felt like I knew exactly what he was experiencing even if I couldn’t explain it. It was happiness, fear, relief, safety and uncertainty all jumbled together in the most illogical emotion possible, yet it seemed perfectly appropriate for that moment. I hadn’t known how to console him then; I’d barely known how to calm myself. All I could do was hold him and stroke his hair and tell him I loved him.
Today when we kissed, Yuri didn’t cry, but it seemed he was feeling scared and uncertain.
“Hey,” I said. “Listen to me. I love you, okay? I love you more than anything.”
“More than anything? Even more than snowboarding?”
“Way more than snowboarding,” I said, suddenly concerned that I might be the one to start weeping. “More than anything. And I’m going to remind you of that every day when I call you.”
“You’d better,” he said. It came out barely audible, and wasn’t any more fierce sounding than my own attempt had been, but the intensity of emotion was there nevertheless.
“Or else...?” I murmured.
“Or else.” He didn’t get any further than that.
We sat there for a long time, just embracing each other and not talking. I couldn’t help wondering if going away was the wrong choice after all, and I spent what seemed like half an eternity trying to make arguments in my head to justify my reasons for going.
After a while, Yuri relaxed his arms. He gave me a feathery little kiss on the side of my neck and then leaned back.
“Yuri?”
“I want you to be happy,” he said. “I want you to live your life the way you want to, and if that means letting you go for a bit, then I… I’m okay with that.”
“Are you sure?”
He nodded. “Yes, I’m sure.”
“You’re amazing, you know that?” I said. “You’re so brave, and I’m proud of you.”
“I’m not the brave one. I’m not travelling around the world.”
“I’m not brave. It doesn’t take that much courage to do what you already want to do and aren't scared about,” I told him. “Courage is when you’re scared but you stay strong anyway. I know you don’t like this, but I’m glad you’re letting me do it, and I think you’re awesome for understanding.”
“Just come back to me,” he said, his voice trembling slightly. “Promise you’ll come back safe, and that’ll give me courage.”
I had to blink a bunch of times, and breathing normally around the painful lump in my throat seemed next to impossible, but I got out, “I promise.”
“Thank you,” he said. Several heartbeats ticked by and then he added softly, ‘I love you, Victor.”

My partner is trans and american, currently living with me here in canada on a visitor's visa. Soon, we'll be applying for his permanent residency, with my sponsoring him as a common law spouse. I have no god to pray to but I'm still praying everything goes through because with what's happening in the states, I cant let him go back there.
He's from a blue state but that don't matter much. His passport has the correct designation, but his birth certificate and SSN are still under his sex assigned at birth. I worry what will happen if he has to try and live and work with this discrepancy there.
He's on T, and even without insurance it's cheaper here. I dont know how long it will be available for in his home country. If he has to go back home, how long will it be before he can no longer access this life saving medication?
We have very little money, we're barely making ends meet, and because of his visa, he cant work so I've been the sole earner for the last 15 months. We're going broke and tbh I dont give a fuck because this, moving in together, was the right decision. The PR application is gonna cost close to 1.5k and i dont give a fuck because he's not going back there, I'm not going to let him go back there, I'm not letting them make him unsafe. Not only do i need him in my home, in my life, beside me, but i need him safe.
Im not one to catastrophize, I've been on the "this is bad but let's be reasonable in our expectations" wagon for a while, but i just feel like... Maybe the fear mongering is getting to me, idk but i feel like the last protections americans have are being eroded... Trump has the tiktok propaganda machine in his pocket, he's working the system to fill all seats of power with yes-men, he's eroding the fabric of democracy by being ruthlessly disinterested in even appearing ethical... He is so power hungry and his belief in like, the Divine Right of Billionaires, its proven right by this election... If you have sufficient money and lies and moral disregard, you can do Anything...
All this to say i am extremely stressed out in a way i never have been before. Money is tighter than my grandma's asshole, the abstract political landscape is looking rocky as hell, and for the first time i have a personal vested interest in american politics and i feel like someone i love is in danger, and I'm mostly helpless to that. It's in the hands of my own government, who could reject him, and i just have to hope and pray to whatever that he can stay here and stay safe. I'm burned the fuck out, I've been hustling to keep us afloat, and we need more money, and i need this part to be over so i can stop worrying sbout it. If he has to go back idk how I'll carry on.
So yeah I'm pretty stressed rn

The White House has yet to formally announce the initiative, but some US permanent residents and foreign visitors are already being asked if they have applied for a “Trump Card Visa.”
President Donald Trump first floated the idea of creating a $5 million golden visa in February, describing it as a way for wealthy individuals to buy residency in the United States and a pathway to becoming US citizens. How this would work is unclear: Federal law dictates how many permanent residency cards can be issued each year and who can get them, and experts say Congress would need to pass new legislation to raise the cap or change eligibility rules.
DOGE’s involvement in the visa project shows how quickly Musk and his team have expanded their purview. Trump’s initial executive order creating DOGE tasked the group with boosting government productivity by "modernizing federal technology and software.” Less than four months later, DOGE appears to be playing a central role in shaping the American immigration system.
Representatives from DOGE have spent the past several weeks coordinating on the golden visa program with officials from Customs and Border Protection (CBP), US Citizenship and Immigration Services (USCIS), the State Department, and other agencies, according to sources with knowledge of the meetings. On Musk’s side, the project is being overseen by two high-profile DOGE associates, Marko Elez and Edward Coristine.
One focus area for Musk’s team has been figuring out how to plug current US government systems for verifying travelers and processing immigration applications into what may eventually become a stand-alone website designed specifically for the Trump Card Visa. In late March, DOGE registered the domain trumpcard.gov, according to public records published by the Cybersecurity and Infrastructure Security Agency.
Tests conducted by WIRED show the website has subdomains corresponding to a number of federal agencies and systems, including CBP, the State Department, and the USCIS Electronic Immigration System, the main portal for processing visa paperwork. The subdomains indicate that trumpcard.gov has been connected to digital infrastructure across multiple parts of the federal government.
A reference to the Trump Card Visa has also been added in the live application form for Global Entry, a program run by US Customs and Border Protection (CBP) that allows preapproved US citizens, green card holders, and travelers from certain countries to enter the US through a fast lane, saving them time at the airport. People who apply for Global Entry with a foreign passport are currently given the option to select if they have “submitted an application for a Trump Card Visa,” tests by WIRED show.
WIRED confirmed that citizens of China, Russia, Ukraine, South Korea, and many other countries are eligible to select the Trump Card Visa option in their Global Entry applications. It appears that only Canadian nationals are excluded; they are directed instead to the existing NEXUS program for prescreened travelers from the US and Canada to speed through customs processing.
The White House did not respond to a request for comment.

During a podcast appearance in March, Trump’s commerce secretary, Howard Lutnick, claimed he had already sold 1,000 gold cards. He noted that Trump had estimated they could sell 1 million overall. The idea, Lutnick told the hosts of the All In show, was to allow people to purchase the right to live in the United States and pay taxes only on their income earned in the country.
One of the hosts, Chamath Palihapitiya, relayed a conversation he said he had with Musk about the project: “One of the most difficult parts of it, is, it turns out, all of the CPB infrastructure to do all these checks, it’s like a lot of COBOL mainframes and the amount of technology that has to get rewritten.”
The White House hasn’t clarified whether it believes current immigration law provides the president statutory authority for creating the Trump Card Visa. “It’s not clear what the legal basis is, unless they do something such as have Congress pass a bill through both houses and the president signs it, which is called legislation,” says Stuart Anderson, executive director of the National Foundation for American Policy, a nonpartisan think tank focused on trade and immigration issues.
The current system for issuing permanent residency cards, known as green cards, is governed by laws such as the Immigration Act of 1990, which outline in detail who is eligible to receive green cards and in what numbers. The per-country cap has led to a long backlog for immigrants from countries like India, some of whom have already been waiting for over a decade to receive a green card. The Trump administration hasn’t said whether it intends to permit Trump Card Visa holders to skip this line and receive permanent residency in the US on an accelerated timeline.
The US government has the capacity to dole out roughly 1.1 million permanent resident cards in the current fiscal year, which are divided into categories for family members, workers with advanced skills, and other groups based on precise rules.
Lutnick originally proposed Trump’s gold card as a replacement for one of these categories, known as the EB-5 investor visa, which is perhaps the closest thing the United States currently has to a golden visa.
Created by Congress in 1990, the program currently allows roughly 10,000 foreigners to obtain a green card each year by making a $1.05 million investment in the United States (or $800,000 in rural areas and regions plagued by high unemployment), supporting at least 10 full-time jobs.
When the program was initially crafted, experts say, lawmakers went to great lengths to ensure it wasn’t seen as a pathway for corrupt oligarchs to unfairly buy their way into the United States. Part of that effort was ensuring immigration authorities carefully assess each EB-5 application to verify the investment funds aren’t coming from illegal or unsavory sources.
"There’s a whole unit in USCIS filled with economists and national security experts” who review EB-5 applications, says Doug Rand, a former senior adviser at USCIS under the Biden administration. During his time in the government, Rand says, there was so much paperwork associated with EB-5 petitions that the towering stacks of files caused the floor inside USCIS headquarters to sag.
It’s not clear if this same level of scrutiny will be applied to the gold card program. When asked during the February briefing whether a Russian oligarch would be eligible, Trump said “yeah, possibly, hey I know some Russian oligarchs that are very nice people.”
Advocates for the existing EB-5 program say it has mostly been used by ordinary immigrants who saved for years to invest in American real estate developments and other enterprises, and expect to make their money back one day. In other words, it’s not a group of people who can typically afford to pay $5 million for a gold card and never see those funds again.
“Most people who are trying to take advantage of the EB-5 program as a pathway to a green card and citizenship do not have that type of money,” says Brad Sher, chief executive of EB5 Group, an investment firm that specializes in raising money for EB5 real estate projects. “They are mostly working-class people who work hard to save their money, and they're often using a majority of their savings to come up with the investment amounts to take advantage of EB-5.” (Sher adds that he is supportive of Trump’s Gold Card, though he hopes it can coexist alongside the EB-5 visa).
During the initial Oval Office briefing on February 25, Lutnick said the gold card initiative would be launching in about two weeks. During his podcast interview, which came out a month later on March 20, he also claimed the project was right around the corner. “About two weeks from today it goes out,” Lutnick said, slicing his hand through the air for emphasis. Whether it’s actually ready and, if so, when it will be announced, remain unknown.
