Bungie is in hot water for the exposure of deep plagerism from a designer, with devs and directors following the artist for many years.

In cases like this, why didn't they hire or consult them instead of plagerising the work? It seems like such a simple solution, that i'm certain there must be something I don't understand.

Bungie has had this happen before, how does such trouble make it through the system?

Bungie's leadership says they didn't know that it happened, and I believe them. In a big studio like Bungie, there are literally hundreds of developers creating and modifying assets dozens of times on a daily basis. There is no way for any human to audit every single asset checked in to the depot against the sum total of the internet, especially when we're trying to keep things under wraps before the game is ready to be announced. Game devs don't have the kind of software tools that Youtube does to police for bad actors uploading copyrighted material.

When individual actors do this, they don't tell their bosses that they've stolen other peoples' work. They hide it and pass the work off as their own and hope nobody notices. This behavior is never condoned or encouraged by leadership because it causes nothing but a big mess for everyone involved if it gets found out. The bigger the team, the more likely somebody will notice this kind of thing. However, it isn't 100% for the same reason that players find bugs that QA missed - when a game goes public, there's often several orders of magnitude more eyes looking at it than internally. More eyeballs looking mean that it is more likely that stolen assets get found out.

After such things happen, the studio's legal representation invariably does reach out to the legally injured party (in this case Antireal) with a settlement offer. Such offers usually include a non-disclosure agreement and a non-disparagement clause in exchange for payment and either a license for the art or removal of all offending assets from the game. That is likely what is going on right now between Bungie and Antireal.

I obviously didn't watch the new James Somerton apology video ON his channel because I did not want to give that man the views and you shouldn't either! It has been re-uploaded and summarised elsewhere so that he doesn't benefit if anyone wants to see it.

The original hbomberguy video was wild to me because of all the stealing, I found it highly entertaining, loved all the Memes and it honestly did my imposter syndrome wonders! but then I watched the Todd in the shadows video and it really upset me.

He didn't just steal from other LGBT creators he lied to his mostly young LGBT audiance who were looking to an elder gay for guidance and to learn about their history.

Todd's video starts with a clip of James lies being spread by another person on a podcast, there's clips of people discussing his made up gay nazi fanfic he has presented as hard facts. He actively harmed his own community for cash! There are young gay men bringing that subject up in conversation being laughed at for falling for it and that leaves a really bad taste in my mouth.

Now I'm not a part of that community but a lot of people I love are so that angered me a lot.

...and then he comes back with another apology video, conveniently within the three months he would have had to post something on his channel to retain his monetisation status weirdly?! In which he blames both a head injury and his ADHD for his theft - at no point does he address the lying in either apology video or any of the apology posts he made that I could find.

I have combined ADHD, when I was first diagnosed the NHS referred to it as ADD with Hyperactivity element but everyone seems to have gone back to calling it ADHD and that is the term used most commonly online so that is what I refer to it is as.

I am medicated but there has been a world wide shortage of my medication and I was without it for some time over winter, which was HELL! I got nothing done.

I am in no way a big creator, Youtube for me is a fun wee hobby that will hopefully grow and allow me to collaborate with other people with similar interests but ADHD is for sure a large part of my journey as a creator.

I've published like 7 videos and currently have around 10 being worked on because, you know... ADHD! *siren noises*

I know that I am forgetful sometimes, just for the record I also had several head injuries and concussions as a child because Lil undiagnosed at the time me truly had no fear of climbing or other dangerous activities so I have my script (because free talking a subject with this brain would be nearly impossible) open in one google doc and my research open in another. It's not hard.

That's the way it was at school, college and Uni too. James claims he went to Uni to do business. Every university uses anti-plagerism software for essays and has done since like the mid 2000's? so he knows not to copy pasta. He's straight up lying there.

Another thing he's lying about is his ADHD making him forget he copied things. Now if you tell me a joke that I like it'll stick in my head and I will straight up tell it as my own later, I've been called out for this many times! But entire articles? whole sections of other peoples videos? (he also flipped a fan Vid he had ripped off of another YouTube to avoid detection and tried to pass it off as his own) No that's not something you can accidentally do even with a swiss cheese brain like mine.

Weirdly all the the paragraphs James claims he accidentally copied were also edited to remove aspects of the Trans, Bi and Ace experiences that James markedly does not believe exist. Strange considering he accidentally copied them and assumed they were his own words? Imagine going back through a paragraph you think you wrote yesterday in the edit the next day and finding swarths of things you don't agree with there?!

Why am I telling you all this? Well because I wanted to put my two cents in as a creator with this condition, partly because I felt it was somewhat of an attack on us!? He's put it out there that ADHD creators are liable to steal from others and that's not ok by me. Also I just really like the sound of my own typing!

Granted my situation is a bit different since im doing online college rather than in person but after a few semesters i think if you cant understand why people are at least tempted to use ai youre just refusing to see the real problems in academia lmao.

I have had classes where I get absolutely ZERO feedback from professors on my writing while having to submit drafts of stuff every week. I have had classes where i havent met the minimum requirements and gotten 100% on assignments because my professors just dont even look at my shit because im not a problem student. Why should i care when my professors dont even if its for understandable reasons like theyre swamped with other stuff im still getting the short end of the stick. And im paying for this!! Why should i try when no one respects my time. And grades if anything should be thought of as a reflection of the time you put into a class or understanding a professors bullshit preferences not a reflection of your actual intelligence lmao and some people just dont want to put in the time for that and i dont blame them! I put in the time and i just get frustrated for it theyre chilling at least!! It doesnt affect me at all if someone else chatgpts their essays but what does affect me is professors not doing shit for an entire semester yelling at me not to use ai while they use ai plagerism checkers and try and fight ai but making me record myself repeating the points of my fucking paper theyre gonna read anyways because they have a contract with a video software company!!

What would you say are your biggest writing tips/tricks? I am absolutely blown away by your writing, and it's inspiring me to get back into writing again.

first of all this ask is incredibly kind and I love you very much! you should definitely get back into it! it’s a lot of fun!

here are some tips I can think of right now -

write what you want to write! you’ll have a lot more fun playing with concepts that you enjoy.

write who you want to write for! don’t write for a character just because they’re popular in the fandom. you won’t enjoy it and you’ll regret those fics!! (as someone who wrote two b*lly fics when they started, I’m filled w regret)

use software like grammarly to help with grammar and tenses if you need it!

have a beta reader! this can be a pal or a group of folks. it’s great to get feedback before you post!

ask for opinions from folks you trust! whether it’s about the concept or ideas or whatever, it’s really helpful to have someone else give their input.

do some character studies! watch the series/show/movie or read the book again to get a feel for the characters you’re writing. there are also lots of headcanons and character analysis’ on tumblr for characters that can really help you get in touch w the person you’re writing for!

read other stories with similar ideas to get your own - don’t plagerize ofc but it can help you brainstorm! the only way I can write smut the way I do is bc I ... read ... a lot of it!!!! lmao

listen to feedback!! you don’t always have to do what people suggest but it’s always helpful to hear input from the reader!

use prompt lists! they’re helpful and using one doesn’t mean you’re unoriginal or not creative !!!!!!

this is just abt getting reads but for tumblr specifically, the way you present the fic has a lot to do with engagement. formatting it the right way makes a big difference. I’m not sure who started the gif attachment to stories thing but I think people are more prone to click if you use a gif?? it’s kinda weird but whatever works! it’s also good to have a summary, list the word count, and def list any warnings!!! also make sure you label any smut and use read mores!!!

believe in your work!!!!!! be proud in your works. do NOT compare yourself to other writers. at all. ever. think of three of your fave authors - they’re not all the same, right? They shouldn’t be! different styles and techniques are super important. write how you naturally do. give yourself a fuckin milkshake for writing 700 words. you deserve it! writing isn’t easy but if you’re creating and spending time on it, that’s awesome!!! that’s a feat in itself! believe in yourself and love the content you create and you will thrive!

So I’ve seen a lot about AI Art recently, and from the takes I’m seeing I’m really coming down heavily on the side of the AIs here.

A big part of this is because those opposing AI art for the most part seem to have little understanding of how it actually works. Or machine learning in general.

A much bigger part is the solutions proposed don’t actually address the actual problems and mostly they seem concentrated around IP protection and vaguely defined plagerism.

But let’s imagine for a second that a new next-gen AI art generator is announced, and thanks to all they’ve learned from the current models the new one no longer needs all that publicly-available training data, just a small amount produced in-house! And it’s got a built in protection that makes it Impossible to create a piece of art of a person or character if you can’t prove you own the IP!

Isn’t that wonderful?

No. Clearly it isn’t, because it doesn’t actually solve anything. Much as people enjoy playing around with it, the risk to artists doesn’t come from the potential of people stealing thier OCs and/or distinctive art style, it comes from buisness thinking they can replace thier art department with a software licence, and the potential influence the developers may have on the landscape going forward. Critically, the big companies with significant reason to hire artists are exactly the ones who own their own IPs and by definition possess large amounts of training data, and as such least likely to be constrained by any such legislation.

In my opinion AI art is here to stay, and I consider it a good thing, because the most impressive and stirring works being created at the moment aren’t just Ai genereated, they’re made by artists actually providing images for the AI to start with and working further with what it spits out: using it as a tool for creating art instead of a complete solution.
