While it's true that Title III of the Americans with Disabilities Act of 1990 does not yet formally consider digital/online as covered by the ADA, the DOJ has strongly supported that interpretation since the early 2000's.
The courts may be split on this interpretation, but they're mostly split by state. And since you can't simply block entire states from seeing your site on the internet, yes, you're exposed to potential lawsuits in those states, should anyone wish to file the complaint. Those precedents mean wise money says you should at minimum satisfy WCAG requirements.
Unless, of course, you have government contracts, in which case, fix everything, asap. You're at serious risk of losing those contracts, because the Federal Govt does require compliance and will end (and has ended) agreements with non-compliant companies.
It's a lot cheaper to pay designers and developers to fix things now than it is to pay possibly millions in damages, repeatedly, later.
...and by the way:
