Review of the CIVIL CODE OF THE PHILLIPINES Chapter 1: Effect and Application of Laws

ARTICLE 7

"Laws are repealed only by subsequent ones, and their violation or non-observance shall not be excused by disuse, or custom or practice to the contrary.

When the courts declare a law to b inconsistent with the Constitution, the former shall be void and the latter shall govern.

Administrative and executive acts, orders and regulations shall be valid only when they are not contrary to the laws or the Constitution."

In this article, there are three (3) important principles:

Prohibition of irrepealable laws.

Constitutional supremacy.

Effects of unconstitutionality.

Article 7 is obvious because time moves forward.

A repeal of law takes in two forms, Express Repeal and Implied Repeal.

Express repeal means that the repeal is contained in a special provisions of a subsequent law. When an Express Repeal is repealed, there is no revival, except when the repealing law provides.

There is an Implied Repeal when the following requisites are present:

a. There is an OLD Law and a NEW Law.

b. Both laws cover the same subject matter.

c. The new law is repugnant or INCOMPATIBLE with the old law.

When an Implied Repeal is repealed, there is automatic revival, except when the repealing provides otherwise.

In Statutory Construction there is a rule that in case there is conflict between the prohibitions of an old law and the new law. It is the new law that should govern. The new law will prevail because it is the new, more updated, and more recent reflection of the intentions of the law maker.

The second part of the paragraph, it says that the Constitution is the supreme law of the land. All laws, administrative or executive acts, orders and regulations must conform with the Constitution. If there is conflict between the law or executive act and the Constitution, then the Constitution always prevails. This is known as the principle of Constitutional Supremacy.

What is unconstitutional acts?

"An unconstitutional act is not a law; it confers no rights; it imposes no duties; it affords no protection; it creates no office; it is in legal contemplation as inoperative as though it had never been passed." This was the ruling of the Supreme Court in the case of Chavez vs. Judicial and Bar Council.

The Daily Routine Of My Life

For me, life is an interesting adventure worth living. I enjoy every bit of my life and enjoy things around me such as, beautiful landscape, budding flowers, wonders of science seen in different forms, city life, and the leisure of free time. Though much of my daily life is routine based, yet the variety of daily existence make my daily life an exciting adventure.

My day begins at 9 a.m. my mother or sometimes my granny wakes me up with a cup of milk, scrambled egg, hotdog, and rice after breakfast I will do my mornings duties, I will fix myself and my things and get ready to go in school I spend most of my time in school hence my daily life follows a very simple routine it is more or less the same except on Sunday.

My class end at 8 o' clock p.m. and after school I will go directly to our house and do my school works after doing my tasks my family and I will eat dinner together, dinner will serve as our family bonding during weekdays after dinner it is going to be my leisure time, I will surf to the internet and open my social media accounts sometimes I watch movies if I don't have any tasks or schoolworks to do. Mostly I spend my extra time in learning different songs to play on a guitar and other instruments and during long weekends I do paintings and sketching stuffs because this is my hobby, I really love music and arts.

During Sunday and Wednesday I always go to gym with my bestfriend because I want to be fit and healthy we enjoyed doing it that's why it is also part of my routine and during Sunday it is my busy and happy day because there are lot of things to do but I enjoy what am I doing. Sunday is our family day I woke up early to wash my clothes, do my schoolworks and go to gym after some errands I am going to church with my family and eat outside or sometimes we do shopping. During my free day I always do what I love so I go to shoots because I really want to be a model someday and I realize that if you dream on something you need to start pusuing it now do not waste your time on doing useless thing because life is short.

Honestly speaking, boredom is a word which is missing in my dictionary of life. Life is too precious to be idled away in lethargic existence and in useless ventures. My daily routine is jam-packed with actions and activities and keeps me and my mind busy all the time. The adventures of daily life make it interesting and an exciting journey.

This is really worrying for European unity. Article 7 was never designed to be actually used. It was designed as the threat so this would never happen. 

Hungary was handed all opportunities to avoid this. But unfortunately, Viktor Orban ignored them all. It almost felt like he wanted to test them, to find out if the EU would be willing to take this step.

If the EU would have not stood up, the threat designed as a deterrence would have become an idle threat and lost all respect. 

Tough choice nevertheless.
