Supreme Court justices appear divided in birthright citizenship arguments : NPR full story
This is going to be one of the most consequential things SCOTUS has ever done: uphold the US Constitution, the 14th Amendment, and the rule of law — or... unilaterally capitulate to Trumpism.
Trump-adjacent people have laid out how, in addition to consolidating power, their attack on the 14th Amendment and specifically our Birthright, the Birthright Citizenship we have and hold, how removing that is the pathway to restoring slavery and slave ownership in America à la the structure of the Roman Empire — really! Same people who fomented the "Green Bay Sweep" coup-attempt and violent storming of the Capitol. They're making sure there's a lot at stake here; they'll try to seize all the power and use what power they seize to seize the power they weren't able to seize at first — fascism generally and Trumpism in particular.

Donald Trump and his White House have moved to deport green-card holders for espousing pro-Palestinian views, shipped hundreds of migrants to a notorious Salvadoran mega-prison without due process (in defiance of a judge’s order), and are now publicly musing about sending United States citizens to prison in El Salvador. Trump said last weekend he would “love” to send American criminals there — and would even be “honored” to, depending on “what the law says.” White House Press Secretary Karoline Leavitt confirmed this week that the president has discussed this idea privately, too, adding he would only do this “if it’s legal.” El Salvador’s president, Nayib Bukele, has for months been offering to hold U.S. citizens in his country’s prison system, which he has turned into “a judicial black hole” rife with “systematic torture,” as one human rights advocate recently told Rolling Stone. Legal experts agree that sending American citizens to prison in El Salvador would be flagrantly illegal under both U.S. and international law — and that the idea itself is shockingly authoritarian, with few parallels in our nation’s history. The Trump administration is indeed discussing this idea behind the scenes, two sources familiar with the matter confirmed to Rolling Stone. In their most serious form, these conversations have revolved around attempting to denaturalize American citizens and deport them to other countries, including El Salvador. “You can’t deport U.S. citizens. There’s no emergency exception, there’s no special wartime authority, there’s no secret clause. You just can’t deport citizens,” says Steve Vladeck, a legal commentator and law professor at Georgetown. “Whatever grounds they try to come up with for denaturalization or expatriation, the one thing that is absolutely undeniable is that people are entitled to individualized processes, before that process can be effectuated.”
In the United States, the grounds to strip a naturalized individual of their citizenship encompass serious material offenses. They include: committing treason or terrorism, enlisting in a foreign military engaged in opposition to the United States, or lying in applications for citizenship or as part of the naturalization process.
[...] For instance, the sources add, Trump administration officials have discussed possibly denaturalizing and deporting activists and other individuals whom they label as having committed so-called “fraud” on their applications for citizenship by subsequently supporting what Team Trump decides are “pro-terrorist” causes or groups — similar to the specious arguments they’ve made to justify stripping pro-Palestine student activists of their green cards or visas. According to these sources, Trump administration attorneys and some senior appointees have also discussed potential legal justifications and technicalities they can exploit for denaturalizing citizens who are accused or convicted of certain crimes, especially if the Justice Department or other offices deems their offenses to be gang-related. The administration has already tried to justify deporting Venezuelan migrants to El Salvador under the Alien Enemies Act — the notorious 1798 law used to justify the internment of Japanese Americans during World War II — by claiming the men had ties to gangs. As CBS News’ 60 Minutes has reported, the vast majority of the men who were sent to El Salvador “have no apparent criminal convictions or even criminal charges.” Some of the allegations appear to have been based entirely on the migrants’ completely anodyne tattoos and apparel. In recent weeks, largely due to the president’s influence, some of the discussions among Trump officials and administration lawyers have touched on the idea of potentially sending some of these denaturalization targets to brutal facilities in El Salvador, the sources add.
The fact that the Trump Regime is even considering sending US citizens to CECOT in El Salvador is an abomination. Watch his regime decide to throw political dissidents (Democratic Party members, pro-LGBTQ+ rights, pro-Palestine, etc.) there if he can get away with it.

Hey so this is happening and it's bad. Palestine is not recognized as a state by much of the world, so this risks making these children stateless.
Belgium saying it has nothing to do with the current round of conflict doesn't mean a damn thing. It's not like Israel hasn't been bombing the shit out of Gaza before August. What sets off alarm bells for me is this:
[The spokesperson] said that the Belgian authorities remain concerned about potential "abuses" of the country's asylum system. "The Foreigners' Office regularly notes that Palestinians in the European Union go to Belgium to have children there in order to acquire Belgian citizenship and, consequently, to benefit from family reunification," he said. "[We will] fight against practices where people who do not have the right to do so try to possess Belgian nationality," he added.
I trust this anti-immigrant rhetoric is familiar to Americans and others. Oh no, they get to have kids outside of a war zone, get citizenship in the EU, and keep their families together. What an awful thing to help enable.
By definition, people who apply for asylum are in a bad spot. Certainly it is one way people will try to game the system, but people will attempt to exploit any advantage they think they have, especially if it gets them out of very real danger.
I don't know anything about how asylum in the EU/Belgium works or if the Foreigners' Office can even do this, but it is deeply concerning they think they might have the authority to do something that drastic. Denaturalization of groups (usually ethnic minorities) is closely associated with ethnic cleansing and genocide.
Please be aware of this sort of rhetoric around citizenship and nationality, and how it is used to punish already vulnerable people. Push back against it, because it is absolutely wrong and extremely frightening as a barometer of what people think is acceptable.

Right-wing media figures are escalating a long-running campaign to give the president vast powers to denaturalize and deport naturalized citizens, a generally rare occurrence that would represent a significant new front in President Donald Trump’s campaign to restrict immigration and limit citizenship in the United States. On March 19, Article III Project founder and MAGA media influencer Mike Davis told Axios: “What's going to be on the horizon are denaturalization cases.” “You're going to have Hamas supporters who have been naturalized within the last 10 years, and they are eligible to lose their status as citizens and get deported,” he added. “It's worth it." The article reported that Trump’s campaign to restrict immigration through the Supreme Court is being “spearheaded” by Stephen Miller, the White House deputy chief of staff for policy. Naturalized U.S. citizens are people born outside of the United States who have gone through a lengthy process to secure the rights and privileges of somebody born in the country. Since the end of the Cold War it has been unusual for the U.S. to denaturalize citizens, with only about 11 instances per year between 1990 and 2017, according to the Immigrant Legal Resource Center. In recent years, conservative pundits and think tanks have sought to drastically increase those numbers. MAGA media figures have targeted pro-Palestinian organizers, a high-profile journalist, and, in at least one instance, a sitting member of Congress in their campaigns to denaturalize citizens, which are frequently directed at people who are (or are perceived to be) Muslim. These threats are extreme, even by right-wing media standards — and where MAGA punditry often falls light on specifics, white papers from conservative think tanks look to offer a veneer of policy respectability to the calls for ramping up denaturalization. MAGA media goes all in on denaturalization
The Article III Project’s Mike Davis is perhaps the loudest voice in MAGA media pushing for Trump to ramp up denaturalization efforts, which he frequently directs at pro-Palestinian activists. The calls for denaturalization are part of a larger right-wing media campaign to smear pro-Palestinian protests, Palestinians being considered for refugee relocation, and Palestinian activists like Mahmoud Khalil — a green card holder arrested and detained by ICE. Denaturalization as a tool for political oppression
The premise underlying the right’s anti-immigration arguments — sometimes implicit, sometimes explicit — is that certain categories of people don’t have fundamental civil rights and their entire life is contingent on the whims of an increasingly fascistic federal government. These efforts are about reproducing a social hierarchy where some individuals are protected less than others in the eyes of the law based on their religion, national origins, or political beliefs. Now, as right-wing media and their allies in the Trump administration wage an all-out campaign against immigrants — both inside the United States and at border crossings, directed at those with and without legal authorization to live in the country — their attacks targeting naturalized citizens are poised to open the latest front in that war.
The right-wing media’s war on naturalized US citizens has ramped up as part of Donald Trump’s xenophobic immigration restrictionism campaign, as it seeks the denaturalization and deportation of those who support or attend pro-Palestine protests under the wafer thin guise of “supporting Hamas”.
