Part 1 - Basic Concepts of Miraculous Ladybug: Miraculous Jewels
Alright! I promised you meta and now I deliver!
I feel like people mostly watch Miraculous for the romance these days. Shipping is all everyone cares about. I wonder why? Probably because writers themselves don't take their worldbuilding very seriously and because they don't put much effort into making the audience care about something other than Love Square, like the mythology behind the Miraculous, or motivations of the main villain, or some pretty heavy topics for a kid's show that they bring up and then refuse to touch again. You know, all the good things. And this is coming from someone who is a passionate multishipper. I have lived through several shipping wars in different fandoms and came out victorious after all.
I am probably the only person out there who cares about the big picture, the overall storyline and the worldbuilding of Miraculous in addition to all details and implications that could develop into fascinating plotlines relevant to the main story. It is a rather lonely fandom experience, I must confess. But, hey? Who cares? I am here to have fun and bring to the table discussions no one wants to have.
So, let's talk about the basics.
If you, as the writing team, are capable of keeping only 1 thing consistent, then please, I beg you, let it be the basic concepts of your universe. Because in this case, one has to actively put effort into writing characters and conflict resolutions badly. And also because nothing can save bad worldbuilding.
I don't have high worldbuilding standards for Miraculous. They certainly aren't as high as the ones I had for Legend of Korra (which was a badly written trainwreck, that ATLA doesn't deserve as a sequel) or the ones I currently have for Dragon Prince. Therefore I won't be too harsh in my criticisms. Granted, I think that Miraculous has better worldbuilding and lore consistency than Winx Club for example (I haven't seen the reboot yet, so writers might have fixed their worldbuilding at least a little bit). Even though I enjoyed Winx when I was younger and some elements of this story still attract me.
Both serialised and episodic shows as well as movies to the lesser extent must have some flexibility in worldbuilding and plot because you can never be 100% sure where your story is going. Maybe, you'll get money for more seasons, maybe not. However, you must never lose sight of your basic concepts. They have to stay the same no matter what, because rewriting lore and retconning major developments every new season is not and never will be called good writing.
Forgive me for using architectural metaphors, but you need a solid foundation to build any kind of structure. Otherwise, everything falls apart.
I like to apply this logic to writing as well. When designing a world where your story takes place, you must lay a few ground rules. It's especially important if you have a magic system. What kind of ideas absolutely must exist? What kind of conclusion do you want your story to have? Does your magic system has limitations? Where is the grey area? Could you introduce new elements later on?
And I feel like the writing team of Miraculous Ladybug did not ask these questions. This may feel like I am nit-picking canon material and looking for problems that simply aren't there, but I promise that I am not. You see, things that I am about to point out only seem small at first glance. But these details are actually the source of the largest plotholes in the series. And their presence negatively affects character development, conflicts and resolutions of said conflicts.
That doesn't mean that I have nothing good to say about the magic system of the show and its elements. There are a lot of great ideas and concepts. And some of them have the potential to contribute to the delightful story.
Let's dive right into it, shall we?

Camouflage
I have to give credit where it's due because the idea of camouflage and shapeshifting for Miraculouses is brilliant. It seems like Miraculous can't fundamentally change its type of jewellery or accessory. The ring will always be the ring but with a different ornament, colour or shape. This is true most of the time (Monkey Miraculous is an exception since it transformed into earplugs/headphones/headband/circlet) It makes sense and avoids plotholes. Grimoire doesn't have the pictures of each Miraculous in disguise for identity protection. That was very neat too. I have no comments. This concept was very good.
Also, since Marinette wore a nose ring of the Ox in "Kwamibuster" without any problem and Adrien wore Ladybug's earrings in "Reflekdoll", we can assume that you don't need to have piercings to wear a Miraculous. Miraculous just magically passes through your skin.
I'm interested to know the following. Can Kwamis recognise a camouflaged Miraculous on a person? Can the holder order them to confess the identity of this person? This shouldn't be possible for identity protection just like with Kwamis sensing each other. But more on that in later posts.
Power Levels
For a long time, we assume that there are only 7 Miraculouses. Turtle belongs to Master Fu, Gabriel has Butterfly and Peacock, Marinette and Adrien have Ladybug and Black Cat. Everything is pretty straightforward. Then it's revealed that there are more jewels and more boxes. It makes the worldbuilding interesting, but it also majorly complicates things, making them inconsistent.
Their position in the Miracle Box implies their power levels. Creation and destruction are the most powerful forces in existence, therefore they are at the top. Moreover, it makes this Box the most important, the most powerful out of all others. Su Han in "Furious Fu" calls it "Mother Miracle Box". Fox, Turtle, Bee, Butterfly and Peacock have less power than the main pair, but more than the Miraculous of the lower Zodiac tier (since they correspond with animals of the Chinese Zodiac).
1. Ladybug can create anything out of nothing (Lucky Charm, which gives what you need the most at the moment). This Miraculous can resurrect the dead, reverse the effects of the Cataclysm. The power of Miraculous Cure or Miraculous Ladybug can work in several ways:
it simply repairs the damage (puts stuff back together, heals injuries and so on)
it reverses time for the matter, restoring things back to the state they were before the destruction occurred (however, the Cure doesn't erase people's memories of everything that happened unless they were mind-controlled, frozen in place or transformed by Akuma into something else - this is an important point that I'll discuss some other time)
How does Miraculous Cure work when there are no supervillians? In NY Special Marinette just says this.

Excuse me, what? What was that? You can't do anything when the villain is gone? What the hell?
*insert here every scene where Ladybug fixed Paris after destroying akumatized/amokized object (this action causes the Akuma victim to detransform/sentimonster to disappear - villain is gone) and purifying butterfly and feather*
It was such cheap angst. I couldn't even be upset when Adrien gave up his Miraculous, because that whole situation is just stupid. But, never mind. We aren't talking about that today.
Apparently, Lucky Charm and Miraculous Cure only work when summoned to battle a specific villain. What is the point then? Huh? You can't tell me that Ladybug has the power of unlimited creation and then say that she can't repair the damage without a special Lucky Charm that was magically synchronised with specific big bad of the week.
Ladybug also can purify Akumas. It makes sense for Ladybug to have the ability to reverse the magic of less powerful Miraculous. But this power can't be applied universally. How does this power of reversal apply to different situations where there is no evil Butterfly holder? Can Ladybug reverse the magic of any Miraculous?
The unlimited power of creation introduced in season 4 ("Mr. Pidgeon 72") is another fascinating thing. On one hand, it's logical and proves the status of this Miraculous as the most powerful. On the other hand, by introducing this power, you have created a plothole. Look, Marinette can create the charm which repels Akumas. If Ladybug can create anything then what stops her from creating a tool for finding Hawkmoth (like special glasses for discovering identities or a compass)? I mean, the show says that the power of creation is unlimited, it means that the creation of such tool is possible.
2. Black Cat can destroy anything with Cataclysm, even other Miraculous. He can kill living things and turn them into ash, but not himself. This Miraculous is supposed to have other special abilities that we don't see. And they should be equal to powers of Ladybug, both in number and in potency. Unfortunately, after 3 seasons writers didn't give us anything. It makes laughable the idea of balance between Ladybug and Black Cat.
Now, to the second tier. These Miraculouses have a singular ability, but they need a second one to keep the power balanced between Zodiac and the main pair.
3. Butterfly creates champions with different superpowers. But how does the time limit of children work for Butterfly? In theory, the countdown should start right after the creation of the Akuma since for Ladybug and Chat Noir countdown starts after activation of their powers even if they don't use them. However, if the countdown of the Butterfly begins after Akuma creation then there's no point because the holder has to stay transformed to guide their champion. The charged butterfly won't have time to even grant powers before the transformation of the child-holder drops. This issue is never explored because Gabriel doesn't have a time limit. However, I feel like it should be addressed in flashbacks of past Butterfly holders for example.
This Miraculous should be less powerful than Ladybug and Black Cat. It's often not. Some Akumas are too overpowered. Stormy Weather can move the Earth away from the Sun, Timetagger can send people through time and jump through time as well, Chat Blanc destroyed the world with a single energy blast, Miraculer could steal powers of those more powerful than her by default. These are the most notable examples. One could argue that Chat Blanc was a different case. Hawkmoth simply gave the most powerful Miraculous a boost. However, we know that even without a holder (the wildest and the most powerful form of uncontrolled Miraculous magic) Plagg's Cataclysm can't destroy the universe just like that (he presumably wiped out dinosaurs and sunk Atlantis on his own without a holder). I think that the less powerful Miraculous (Butterfly) shouldn't be able to increase the power of destruction to such a degree and give Black Cat the power to destroy celestial bodies and galaxies.
Writers want us to see Hawkmoth as the formidable villain. But it's not easy because he is less powerful than your main heroes by default of your worldbuilding. Sometimes writers make the Butterfly more powerful than creation and destruction to raise the stakes, breaking the laws of their magic system. So, how do you solve this? Let Ladybug and Black Cat keep their status as the most powerful and instead of giving Hawkmoth more magical power, make him smarter, more cunning, inventive. Gabriel is a fashion designer, whose creativity makes him a very good Butterfly holder. He has a life full of experience, he knows much more about things than the main teenage characters. Catalyst was very interesting for this very reason. Gabriel sort of discovered a cheat code to boost his powers. Show us how he experiments with his powers, how he analyses his past Akumas and tries to find the most effective ones. Maybe Gabriel tries to design Akumas that can specifically neutralise Ladybug and Chat Noir. This exploration could also give writers an opportunity to explain how the powers of Butterfly work. Can he control the type of powers he grants? Can he control the appearance of Akumas? There are many things to be explored.
4. Peacock creates sentimonsters. I remember that fans were very disappointed when the power of the Peacock was revealed at the end of season 2. I was one of them. The concept of Amoks is far too similar to akumatized butterflies. Other Miraculouses have unique abilities and keywords for their powers, while Peacock just looks like Butterfly 2.0. That glowing mask effect just adds insult to injury.
You have to start by figuring out the powers of the Peacock in a normal situation. If a holder is a good person, then how does their power work? For example, make them related to sight (because of the "eye" pattern on feathers). Maybe, Peacock grants the ability to see the several possibilities of the future, but only a few minutes ahead. Maybe, this Miraculous gives you the ability to see through someone's eyes for a few minutes (and the victim is completely unaware of the intrusion). Perhaps, Peacock allows the holder to use feathers (or tiny peacocks) as cameras one at a time and be all-seeing. These feather-spies can be destroyed by the holder or disappear on their own after some time. Such power could be devastating when used against heroes in canon.
5. Bee can paralyze. This power is pretty straightforward. Once I read a fanfiction focused on very vell done Chloe Redemption, where she fights alongside Ladybug and Chat Noir. Eventually, she grows and becomes a better person. This fic ends with an Akuma battle, where LB and CN are trapped and Akuma is ready to kill them. But Chloe uses a second power of the Bee on the villain - Miraculous Stinger. It's deadly both for the holder and for the victim (because bees die when they sting someone). Chloe kills the Akuma with a Stinger before it can get LB and CN, but she too dies making the ultimate irreversible sacrifice. I will add a link if I find it again.
6. Turtle can create a shield. I don't have much to say on this either. It feels underpowered compared to others in the second tier. Maybe Turtle can also slow down opponents (because turtles aren't the fasters animals out there).
7. Fox creates illusions and acts as their puppeteer. In order to create a balance between other powers, these illusions must hold for as long as the holder needs them to. I propose this mostly because we see that Venom of the Bee lasts very long, the shield of the Turtle lasts either until it's destroyed or the holder wants to remove it, same goes for Akumas and sentimonsters who disappear only when the holder wants them to or their affected object is destroyed.
Let's talk about Zodiac tier. Miraculous of the third tier shouldn't have the second ability like more powerful ones. These powers are the most inconsistent. Even if we haven't seen all of them yet.
8. Mouse can create many small clones of the holder. It is unclear how these clones communicate with each other and how many of them this Miraculous can create. The holder can control the number of clones. This power was very convenient in "Kwamibuster" and it makes sense symbolically for the mouse. What activates the time-limit for children? Marinette didn't have any problems with it when she became Multimouse.
9. Snake can create a 5-minute time loop and has the ability to come back in time. This Miraculous feels a bit overpowered for the Miraculous of the Zodiac Tier. The holder can reset the time as many times as he/she needs to. It's was a good source of drama and trauma in "Desperada". I was honestly surprised that Adrien was capable of fighting after spending months in a loop. But this doesn't change the fact that Snake is overpowered. You can give this Miraculous the power to hypnotise or keep the time ability but place a limit on the number of resets. How does the lyre work as a weapon? Who knows? No one!
10. Dragon can shapeshift into elements: water, wind and lightning. It has the coolest transformation words hands down (Bring the Storm and Open Sky). Apparently this Miraculous doesn't have the time limit.
11. Rabbit can time travel or jump through alternative realities, even writers aren't sure. Time-travel in this show is so badly written it gives me a headache. This Miraculous shouldn't exist just like its powers. Snake belongs to the same tier, but 5 minutes and whole centuries of time jumps aren't comparable in power levels. They are not and this is the hill I will die on. Give the Rabbit powers related to its symbolism in China like an ability to de-age people, heal them or give them a speed boost in contrast with Turtle who might have the ability to slow down.
This Miraculous is so special that its Kwami - Fluff can live separately from his Miraculous in a Miracle Box for millennia (Fluff lives in the Box in "Sandboy", but his Miraculous, pocket watch, was passed down for generations in Alix's family). This is a discussion for a separate post, however. There's a lot to unpack. We'll do that some other time. You will suffer with me but at a later date.
12. Horse can create portals. They could lead anywhere, which is pretty cool. On the other hand, this power is not very useful in direct combat, especially when it's used by a child since we can have only one portal per transformation.
13. Monkey can cause a malfunction in powers of other people. What is the point of this? This power was specifically created by writers to defeat Akuma in "Party Crasher". That's it. What if your target is not magical? How does this Miraculous work in different circumstances?
14. Pig shows people their greatest desire. Both the holder and the recipient of this power can see this desire. Chat Noir wasn't impressed in "Guiltrip" and neither was I. It's underpowered compared to other Miraculous in this tier. Also, why does the tambourine can shoot energy beams? Why?
That's all I have to say on the matter. I'll update the power analysis as needed.

JONSA: The infamous “undermine me” scene
About a week ago @jonsa101 posted a meta regarding the “undermine me” scene in season 7 (episode 1).

She discusses this particular exchange between Jon and Sansa:
Jon: You are my sister but I am king now.
Sansa: Will you start wearing a crown? (Sansa Snark is in the house, guys!)
Jon: When you question my decisions in front of the other lords and ladies, you undermine me.
 In the meta she identifies the “undermine me” line as a romantic trope that she’s seen play out in many different contexts. If you guys haven’t read the meta yet, please go and read it. @jonsa101 always has some very interesting interpretations and theories regarding the show and I really enjoy her meta work. 
 I was already planning on discussing this scene in detail as part of my upcoming series on all the Jonsa scenes but since she tagged me in the meta, I thought I’d discuss it now.
I have to say that after reading her post, I had a look at lists of romantic tropes as well as my favorite research source – youtube – in order to try and find similar examples of the “undermine me” line. I’m afraid I came out empty on this one.
 However, the more I thought about it, the more I realized that whether or not you identify this particular line as a trope, the whole exchange between them ticks a lot of romantic tropes off the list as I’ll show below.
 This is one of the things that always bothers me about people calling Jonsa shippers delusional. Even if Jonsa never becomes canon, it’s very much a fact that the writers are playing with romantic expectations in all of their scenes. You can’t swing a stick in the direction of these two without one trope or another hitting you smack in the face. So at the very least, Jonsa shippers are responding to these visual and storytelling devices. Hardly a delusion.
 For the interests of this meta I will focus strictly on the tropes used in this particular scene, which considering that it’s only 3 minutes long, I was shocked to find out is more than 1. For reference, I’m working off the list of romantic tropes found here as well as use the explanation they give for each of them. When you have the time, check it out. It’s like an Easter Egg Hunt for Jonsas.
 Like an Old Married Couple: These two people are very close and tend to bicker with each other.
 This is where I would actually place the “undermine me” line. In fact this is where I would put this entire exchange:
Jon: You are my sister but I am king now.
Sansa: Will you start wearing a crown?
Jon: When you question my decisions in front of the other lords and ladies, you undermine me.
Sansa: I can’t question your decisions anymore?
Jon: Of course you can but …
Sansa: Joffery never let anyone question his authority. Do you think he was a good king?
 Ahem … guys, I reeeally don’t think you’re fighting over what you think you’re fighting over. Also can you air your dirty married laundry in private? You’re making everyone uncomfortable!
 Now, Like an Old Married Couple is usually served with a generous helping of the Belligerent Sexual Tension and/or Unresolved Sexual Tension tropes on the side. Which would explain the seemingly random insert of Joffery in this whole conversation (there’s more to it than that but more on that later). I mean doesn’t every girl compare her brother to her ex-boyfriend? Isn’t that a thing that people do all the time?
 The thing that is very interesting here is the way these two are operating. There’s nothing really sibling-like about this interaction. This is two partners having a fight.
 But this is where it gets interesting. Because this exchange is followed by another trope:
 Aww, Look! They Really Do Love Each Other: No matter how much they fight, they really do care about each other very much.
Jon: You think I’m Joffery?
Sansa: You’re as far from Joffery as anyone I’ve ever met.
Jon: Thank you!
 Throughout my series on the Jon/D*ny romance (X) (X) (X) (X) (X), I kept talking about how Jon and Dany never seem to reach a consensus or resolve anything in any of their fights. Every Jonsa scene comes in direct contrast to that. It isn’t the absence of fighting that makes a couple work, it’s them being able to resolve and move on from a fight that does. And this is where this trope comes in. No matter how hard Jon and Sansa have a go at each other, you are never left in any doubt that they care about one another.
 But there’s more …
 Dismissing a Compliment: A character doesn't believe something nice their Love Interest tells them.
Sansa: You’re good at this, you know.
Jon: At what?
Sansa: At ruling.
Jon: No …
Sansa: You are. (beat) You are.
 Why don’t you say it again, Sans? I don’t think he heard you the last two times …
 Sansa: They respect you. They really do …
 Ok, ok. Sheesh! Are we also going to talk about how cute his hair looks today and how dreamy his eyes are?
 This is followed by the hyper-analyzed “but” lines:
 Sansa: … but you have to … Why are you laughing?
Jon: What did father used to say? Everything before the word but is horseshit.
 This may or may not have plot implications later on but for the purposes of what we’re analyzing here, the point I’m trying to make is that Jon is dismissing every nice thing Sansa has said about him and focuses only on the word “but”. Because he’s Jon Snow … You can’t pin a compliment on this guy to save your life.
Also …
 Laugh of Love: The tendency to laugh when in the presence of your Love Interest.

As well as pretty much every other scene he has with her. Either Sansa is a proficient stand-up comedian or Jon is just really, really happy whenever he’s around her, even when he’s angry at her. Totally platonic, guys! Nothing to see here!

 And lastly ….
 Like Parent, Like Spouse: A character's Love Interest is similar to one of their parents, be it in looks or personality.
 In every god damn episode they have together and also here:

In conclusion, for those at home not keeping count, that’s 7 tropes used in a 3 minute scene. Is it any small wonder this might seem familiar to people? Either way you want to slice it, you have seen these visual and narrative cues in other stories. Tropes don’t become tropes because no one ever used them.
 Now I did title this meta “the infamous undermine me scene” for a reason. That’s because this scene, as almost all Jonsa scenes, has three layers that are all thrown at the audience simultaneously. Two of these layers are good, one of these layers is BAD. Let’s see if you guess which is which:
 What the characters are fighting about
 This is where the whole text vs. subtext analysis comes in. Ideally, any scene in any story you ever read or watch, should have both a surface level as well as subtext. Now and again you will get scenes, out of necessity, that are simply what they say on the tin but writers are actively dissuaded from doing this on the whole. It would be very boring and frankly poor storytelling if subtext was non-existent and people simply talked at each other, complete with an accurate, objective narrative on what they’re saying and why they’re saying it. To put it simply, it wouldn’t be a satisfying journey for the audience.
 So what is the surface level? Well, this is a direct follow-up to the preceding scene where Jon pardons Alice and Ned and Sansa argues against it. The argument got pretty heated between the two of them so now we’re given a scene where we can see the resolution of said argument.
 What you should keep in mind at this stage is how that argument ended:
Sansa: They died fighting for Ramsay. Give the castles to the families of the men who died fighting for you.
Jon: […] I will not punish a son for his father’s sins and I will not take a family home away from a family it has belonged to for centuries. That is my decision and my decision is final.
 Check-mate, as they say. Jon won that argument. He is the king and he made his decision. Case closed. On a purely surface level, that argument was finalized. We didn’t really need the “undermine me” scene unless we attempt to infer things that are no presented to us directly.
 Which brings us to …
 What the characters are really fighting about
Jon: You are my sister but I am king now.
Sansa: Will you start wearing a crown?
Jon: When you question my decisions in front of the other lords and ladies, you undermine me.
 The question here is why does Jon feel undermined? I think the answer is not because he doesn’t want Sansa questioning his decisions, as she seems to believe. Nor is it because he suspects some sort of nefarious ulterior motive (we’ll leave that for that pesky 3rd layer we’ll talk about shortly).
 We all know Jon values dialogue and collaboration. What we also know is that whatever Sansa says affects him very deeply. You can deduce this from their scenes but, for confirmation, we also have Kit saying that Sansa “twists” Jon. So we can assume that their argument hurts him in some way and even though he put his foot down during the meeting, he still feels the need to clarify the issue with her which is why they’re having the conversation.
 Now people have pointed out that, as one of his vassals, Sansa has every right to question him publicly. The problem is that’s not how Jon sees her. He very distinctly separates Sansa from the rest of his court. And since we already had the “we need to trust each other” scene at the end of season 6, I think it’s safe to assume that he sees the two of them as a unit that is supposed to be on the same page so the fact that Sansa speaks out against him in public, instead of privately, feels like a betrayal.
 There’s also his character and history to consider. Jon has never been the kind of person to take criticism very well, mostly because he’s felt unworthy and rejected all his life. And now he’s gone from the Bastard of Winterfell to King in the North in the span of a few months. That would leave just about anyone feeling uncertain of how much people truly trust their judgement.
 However, if there’s one thing you learn sooner or later, is that there are two sides to every story. That’s why it’s never a good idea to side with one party whenever couples fight.
 Because if we look at things from Sansa’s perspective, you can see how she might feel dismissed. The fact of the matter is Jon isn’t the world’s greatest communicator and failed to talk his decision over with Sansa before announcing it to the Council, which in turn makes Sansa feel sidelined, hence her aggressive snark and Joffrey digs. And we get an explanation of that here:
Sansa: He [Ned] was trying to protect us. He never wanted us to see how dirty the world really is but father couldn’t protect me and neither can you. So stop trying.
 Sansa is operating under a false assumption as well. Jon looks at their argument and feels undermined. Sansa looks at Jon avoiding her counsel and thinks that he does it because he sees her as his little sister that is in need of protection.
 Now Jon, bless his heart, does try to put Sansa in the little sister box at times but he fails at it miserably, partly because Sansa doesn’t let him and partly because what he needs from her is very far removed from what sisters usually provide.
 So there they are … two “siblings” stuck on a balcony having a lovers quarrel. Just another day at Winterfell.
 Which brings us to what I like to call …
 The “D&D screwing with us” layer
 Why do I say that the writers are screwing with us in this scene? Well, because of this:
Sansa: Joffery never let anyone question his authority. Do you think he was a good king?
 There is absolutely no reasonable explanation for why they felt the need to bring Joffery, one of the worst people this show has ever inflicted on us, in this conversation. Firstly, because there is no parallel to be drawn between Jon and Joffery in this situation. For one, if Joffrey was the king here, Alice and Ned’s heads would be decorating the walls. They would certainly not have been brought back into the fold which is what Jon has done for them. Secondly, since Jon is very much talking his head off to Sansa at the moment, it’s pretty obvious that he isn’t above explaining his reactions.
 What she says is, honestly, incredibly insulting which is why she backtracks out of it as quickly as the writers would allow:
Jon: Do you think I’m Joffrey?
Sansa: You’re as far from Joffrey as anyone I’ve ever met. (all the while looking extremely guilty)
 If the mention is here in order to clue us in on the fact that Sansa views Jon as something other than her brother, by comparing him to the only person she’s ever had romantic feelings for, there’s again no need for that. Seven romantic tropes in one 3-minute scene is more than enough to get that point across.
 So why do the writers have her say this? I would argue that this mention is in here in order to advance the “darkSansa” agenda, particularly since this is a scene where Jon says he feels undermined by her twice.
It doesn’t matter that Sansa backtracks on the Joffrey fiasco, it doesn’t matter that she tells him she doesn’t want to undermine him, while desperately sighing with loving eyes that she wants him to listen to her.  The “darkSansa” idea sticks.
 And that’s because the audience support is very much skewed  in  Jon’s favor. Being on tumblr, sometimes you forget that the Jonsa fam is very much the minority and that exclusive Sansa fans are the unicorns of this fandom (#love4unicorns). The vast majority of this audience will not look at Jon as an unreliable narrator, as every character in this show is, but as the ultimate authority on how this scene should be viewed.
 If he says he feels undermined, then it must be because he’s being undermined, which by extension means that Sansa will betray him. And her mentioning Joffery only helps to further antagonize the audience against her.
 Does that mean the Ds want us to hate Sansa for no particular reason? Not really. What they really, really want is to, yet again, beat the “Starkbowl” horse until it expires from exhaustion. And they’re willing to compromise emotional development and cut off the audience from essential POVs to achieve that.
 In season 6, when they first teased Starkbowl, they did it for emotional turmoil. They gave us that beautiful, heart breaking reunion scene only to immediately have Sansa start to be seemingly duplicitous. Because wouldn’t it be just so tragic that after Jon found new purpose in life through Sansa and she finally found safety and comfort with someone that actually cared for her, she would turn everything on its head and betray him?
 In season 7, they wanted to resurrect it because of the Littlefinger twist ending. This little “Joffrey” titbit and the “undermining” conversation helped plant the seeds for it so when Arya (another fan favorite) began accusing her of plotting against Jon, the audience would have this early scene to fall back on, despite the fact that Sansa continuously supports Jon’s policy while he’s away and constantly talks about him, to the point where she almost sounds like Sam talking about Gilly.
 What I’m trying to get at with this example is that the writers are not operating in good faith when telling this story. They will constantly throw things in to tease plot points that never come to pass. I don’t like this narrative choice at all, because it requires being cut off from certain characters POVs (Jon and Sansa are champions of this in season 7) which in turn puts distance between the audience and them, when the core of good storytelling to me is seeing characters wrestle with decisions and emotions not off-screen, but right before our eyes.
However, at the very least, what all of this should tell you, is that you should never simply relay on what the ‘explicit’ meaning of a scene is because there’s far more lurking beneath the surface.

Hey, nonnie!
First I’d like to apologize for taking so long to answer. I’ve been really busy with the Christmas season and I haven’t had time to sit down and really get through my inbox. 
Secondly, I’m really sorry but I don’t watch Skam so I can’t really comment on the way the tv show might employ silences. 
What I will say is that silences in films are not all created equal. Silence doesn’t have to always be a clue that something is wrong. There are comforting silences as well that can show people actually being comfortable in each other’s company. One thing to remember is that time in cinema is different to time in the real world. One minute in real life is nothing (unless it’s one minute to leaving the office in which case it’s an ETERNITY! :))) ). In cinema, one minute is a terribly long time and if you use that time for silence it can make the viewer feel uncomfortable. One great example of this is The Office (both British and US versions). The Office has a really cringy, squirm in your seat type of humor and the reason for that is the silences that inevitably follow after a character does something (mostly following Michael Scott/David Brent’s antics). A good example of this in GOT is the awkward AF silence that follows Missandei’s introducing D*ny’s never ending list of titles. There’s no feed-back to this and the scene lingers in the silence a bit too much for comfort. 
In order to really understand the difference I’m going to give you two romantic examples below so you kind of see what I mean.

Notice just how awkward that is. You have one charactersaying: “I love you” and the other just staring blankly at them. Huge redflag there, right? 
Now look at this scene:

No words in this at all. But it’s not really uncomfortable.They’re looking at each other, smiling, getting a little bit closer to eachother, enjoying the music and just generally loving being next to each other.It’s a bit awkward at first but it’s the kind of awkwardness that is buildingtowards something deeper and more meaningful. 
That being said, I don’tthink that silence is really what plagues the D*ny/Jon scenes. They talk aftera fashion but they’re either talking at each other, over each other or theyjump from one subject to another because they can never get a flow going. 
In the scene where I saidthis:

they’re changing subjects asif they’re in the Olympics. They start off talking about thedragons. There D*ny reveals something deeply personal about herself. All Targshad a special bond with their dragons but D*ny is unique in that she sees thedragons not just as pets or weapons. She views them as her children. Hertelling Jon that was an opening for him to get closer to her. If he had trulycared to get to know her better, he could have asked about how she got them forexample or what she feels when she rides Drogon, etc. Instead he changes thesubject and asks about the Field of Fire 2.0. She gives him an ambiguous answerbut when he doesn’t press the issue (why doesn’t he press the issue?), shefeels the need to explain herself. She brings up the battle of the bastards andnow it would be Jon’s turn to explain himself, if he wanted her to get to knowhim better. He could have talked about how much of a monster Ramsay was, aboutwhat happened to his sister, about his little brother, about how him, Sansa andthe wildlings were forced to go to battle against Ramsay because he wasplanning on killing all of them, etc. He doesn’t do that. He gives her anequally ambiguous answer and then keeps his mouth firmly shut. It’s D*ny thatpushes back again asking him about Davos’ comment about him talking a knife tothe heart and instead of telling her the truth, he lies to her. 
Also please note that by the end of that scene none of the conflicts raised in the scene were resolved: 
1. Jon calls the dragons beasts/D*ny calls them her children - resolution?!? Anyone, anywhere? Something? 
2. D*ny burns people alive and Jon “doesn’t know how to feel about that” - resolution? who’s that? Don’t know her. 
3. D*ny brings up Davos’ comment, something that she’s been obsessing over since the first moment she met Jon - Resolution?!? New Phone! Who dis? 
That’s what I mean aboutthere being no flow in their conversations. It’s because Jon is activelyholding back from revealing more about himself to her and is very guarded inthe way he speaks to her, which doesn’t really happen in scenes where you wantyour characters to connect and fall in love. 
Jon doesn’t do that, forexample, in his scenes with Ygritte. He kind of starts doing it once they’vehad sex and she keeps pushing him to commit to her and we know why he does thatthen: he can’t truly commit to Ygritte because he’s already committed to the NWand despite pretending that he’s left the order, he actually hasn’t. And evenin those scenes, he can’t help himself from picturing Ygritte as his lady loveor trying to warn her that the wildling cause is doomed. Because he loves her.Where are those types of conflicts in his rel with D*ny? I have yet to see them…

Motion to Stay Prosecution or Discovery Not Available to Avoid Criminal Prosecution

When a Defendant Defrauds an Insurer and Negligently Allows an Employee to Die on the Job has no Relationship to the Claim of Property Owners who sued for Damages

In Rebecca Chi Wai Lam, Xue Ming Pan, Cui Mei Li, Hua Hui Lin and Kit Lai Lin Chee v. 993 60th Street Realty Inc., Xin Long Dai, Ground to Sky City Builders Corp., S M TAM Architect, PLLC, WSC Group LLC, “John and Jane Does 1-10” and “XYZ Corporations 1-10”, 2020 NY Slip Op 51144(U), 514453/2018, Supreme Court, Kings County (October 5, 2020) property owners sued builders who damaged their property. Since an employee of the builders died and they committed a panoply of crimes in addition to damaging the property of the plaintiffs, they sought an order staying trial and discovery since they intended to assert their Fifth Amendment right to remain silent.
FACTS
Defendants claim that the principals of each entity, as well as WSC itself, were indicted by a grand jury empaneled at the request of the Kings County District Attorney’s Office on November 15, 2019. They claimed that two men are the only people with knowledge of the facts and circumstances who can be produced for a deposition or to testify at trial, and that each of them intends to invoke his Fifth Amendment right against self-incrimination at both the deposition and at the trial of this action.
This is an action brought by the individuals who own three adjacent homes for damages to their homes arising from excavation work which was allegedly performed by movants for defendant property owner for a project at the rear of plaintiffs’ homes, on the other side of the block. A worker was killed when a masonry wall collapsed on top of him.
A motion to stay a civil action pending resolution of a related criminal action is directed to the sound discretion of the trial court.  A compelling factor is a situation where a defendant will invoke his or her constitutional right against self-incrimination. The United States or New York State Constitutions do not prevent the court from exercising its discretion to stay proceedings in a civil action until a related criminal dispute is resolved.
ANALYSIS
The homeowners are not wealthy. Their homeowners’ insurance refused to pay their claims. They want the damage to their homes repaired, and they claim they would be prejudiced if they have to wait until the criminal proceeding is over, particularly as the state is in the midst of the Covid-19 pandemic and jury trials are backlogged.
There are nine criminal defendants who were indicted. The motion is denied with regard to GTS, as there is no pending criminal proceeding against it or its principals or employees.
WSC and its two principals (as well as six other named defendants, which include Wilson Garcia, a foreman who worked for WSC) were indicted for crimes, but not all of them were indicted for each of the crimes, that included but was not limited to: Manslaughter in the Second Degree; Criminally Negligent Homicide; Insurance Fraud in the Third Degree; and a panoply of other crimes.
The “victims” of the crimes charged in the indictment are not the plaintiffs.
The one crime that can be said to “overlap” with this action, however, where one of the plaintiffs is the alleged victim, is the Sixth Count, for criminal mischief (a misdemeanor). Mr. Lin is one of the five plaintiffs in this action. Criminal mischief is usually charged for offenses such as “keying” the car of a former friend, throwing a brick through a window, etc. It is not ordinarily used for construction work.
While there are multiple charges of offering a false instrument for filing with respect to the Bay Ridge project they do not directly relate to this lawsuit. These charges relate to filing false certificates of correction after violations were issued, and concern worker safety, such as falsely certifying that there was a fire guard, a construction superintendent present, proper fencing, and the safeguarding persons and property at the worksite.
The court concludes, therefore, that the one count applicable to (one of) the plaintiffs, criminal mischief, a misdemeanor, is not enough of an “overlap” to stay this action.
The primary reason for this is that the plaintiffs’ cause of action here does not require movants’ testimony as it is a strict liability tort. The only defendants who remain here are the property owner, who did not put in any papers in connection with this motion, and the movants.  The owner may be vicariously liable, but WSC is the only defendant that performed the excavation work at the site who is named in the caption.
The term “recklessly” as used in this definition has its own special meaning in our law. A person RECKLESSLY damages property of another in an amount exceeding two hundred fifty dollars when that person does so by engaging in conduct which creates or contributes to a substantial and unjustifiable risk that such damage will occur, and when he or she is aware of and consciously disregards that risk, and when the risk is of such nature and degree that disregarding it constitutes a gross deviation from the standard of conduct that a reasonable person would observe in the situation.
Thus, while a stay would cause inconvenience and delay to the plaintiffs, the failure to grant the stay would not cause the defendant WSC to suffer the severe prejudice of being deprived of a defense. This is because there is no defense to the liability portion of plaintiffs’ claim, other than, for example, that the wrong defendant was named, as the defendant did not do the excavation work.
Since a prior determination in the criminal proceeding would not have collateral estoppel effect in this action and would not simplify the issues to be proved at trial.
ZALMA OPINION
The Fifth Amendment of the U.S. Constitution protects a person from being compelled to incriminate himself to a crime. It is not an unlimited right. It does not apply to facts that have nothing to do with the crimes for which he was indicted. Since the plaintiffs are only suing for damage done to their property, not the conduct that resulted in the criminal indictments, including homicide and insurance fraud, the motion was properly denied.

2017 year in review
I already posted this year end poll to my DW, but since there are people mentioned who follow me here but not there, I thought I should cross-post it to Tumblr.
What did you do in 2017 that you'd never done before?
♥ I visited a couple of new cities. Utica, NY has a beautiful train station and so many awesome older out-of-service trains hanging out on display on the tracks nearby. Venice, CA is full of brilliant street art and I loved the beach and boardwalk. I hadn’t been outside the Greyhound station in Pittsburgh, PA until this year but it turned out to be a cool city with a beautiful park. Pontiac, MI wasn’t much to write home about but I enjoyed the company of the people I was with. ♥ I saw baseball games at Wrigley Field (Cubs v Mets) and Fenway Park (Sox v Yankees)  ♥ I walked over The Williamsburg Bridge! I love walking and I guess I have a thing about walking over bridges. I get excited about it. ♥ I took my mom to get a tattoo. Holy shit. ♥ I saw a solar eclipse! ♥ While I had participated in many marches and demonstrations before 2017, this year was the first time I found myself at two or five in the same week! Did you keep your new years' resolutions, and will you make more for next year? The resolutions I made for 2017: —visit a new city I visited a few! —make a new friend SO MANY! ♥ 2017 brought me Anna, Kelly, Andy, Lewis, Angie, Charissa, Emily, Leslie, Erica, Esmerelda, Vanessa, Blathnaid, and Jackie. I also got much closer with my friends Jen and Jesse. —get a new tattoo This didn’t work out for me this year, but MY MOM GOT ONE. —learn a new skill What I’d intended was to become more proficient with driving, crochet, and cooking. What I ended up doing was learning three completely new systems at work and taking over a handful of new processes. That isn’t nearly as exciting, but it counts. —be kind Yes, always. —be strong It’s a struggle. —fight Trump and don’t give up When I was little my parents used to joke I should have been a hippie in the 60s with all my yelling and the causes that broke my little heart, but with all the protests, marches, letters written and phone calls I’ve made this year alone, I think I have a home in this decade. I am keeping the same resolutions for 2018. I think they’re good resolutions to keep every year. I also have been very forgiving of myself for slipping on keeping healthy diet and exercise habits this difficult year but I want to work on that in 2018. Did someone close to you give birth? Get married? There was a little boy named Oliver born in my TBS family and one named Cillian in my Killers family. And, my sister-in-law got married! Did anyone close to you die? My grandpa Jack passed away this summer and it broke my heart. My best friend from high school, Chrissy, let go the next month. Neither should have been that unexpected, but both shook me to pieces. What countries did you visit? Not even Canada! Very unlike me. What would you like to have in 2018 that you lacked in 2017? I’d like to rediscover my healthy diet and exercise habits and create a few better mental health habits. What date from 2017 will remain etched upon your memory, and why? June 3rd. I’ll never forget how brightly the sun was shining the day my grandfather passed away. I was all alone in Chicago with no one to cry on, and it was a very difficult day, to say the least. I was in Chicago to see U2 and it wasn’t easy to drag myself out of the hostel bed to go to the show, but I think it was good for me to be around people, and the music was healing, even if there were moments I wept to heavily that the crowd parted around me to give me space. What was your biggest achievement(s) of the year? I made it through. What was your biggest failure(s)? I’m not letting myself count any failures this year. I made it through. Did you suffer illness or injury? Depression. No physical injuries. What was your favorite meal of 2017? ♥ While I was following Taking Back Sunday up the west coast I spent a beach day with my LA family—my aunt and her husband, my cousin and her husband, and their two children. I rarely get to see that part of my family. We all went to The Olive Garden for dinner before they put my on my bus to Santa Cruz and we sat there talking and stuffing our faces for hours. ♥ Also while I was on the west coast, I met up with my best friend Nini after she got out of work and we went for dinner before we went to see a concert together, just as we’d done on dozens of evenings when she lived in NYC. It was good to feel just like old times. ♥ I always love Denny’s or IHOP with my tour family after shows. Melissa and I laughed so loud in so many diners in the middle of the night this year we should be banned in several states. We had a big family dinner in IHOP after TBS’ holiday shows. ♥ When I was in Chicago for Riot Fest, my young friend Jesse took me to my favorite vegan diner and bought me lunch.  ♥ I love weekend brunches with Mikey at our favorite shitty diner ♥ Christmas Eve dinner is special every year What was the best thing you bought? I bought tickets to take my dad to see David Hyde Pierce star as Scrooge in a reading of “A Christmas Carol” and that was very important. I don’t spend enough time with him. Where did most of your money go? Tour and travel. Always tour and travel. What did you get really, really, really excited about? ♥ This past Election Day was pretty encouraging. So many democrats but also so much diversity and so many firsts! The most satisfying was watching that charming transphobe in Virginia replaced by a transgender woman. ♥ I was stoked on participating in The Women’s March and The Science March. They made me feel energized and hopeful. ♥ “Excited” isn’t the word for how I felt about the #MeToo movement, but to see so many people taken seriously about having been sexually harassed and assaulted and to see so many abusers face real consequences took my breath away. It’s so heartening to see that we’re finally listening. ♥ I got very excited for my bands’ tours! TBS’ Tidal Wave Tour! U2’s The Joshua Tree 30th Anniversary Tour! The Killers didn’t tour yet but they had a couple of shows and I was SUPER EXCITED ♥ Brendon Urie was in Kinky Boots on Broadway and I was so excited and proud that I bought a front row seat for the first night and brought him roses to celebrate his Broadway debut. What songs will always remind you of 2017?: ♥ Whenever I hear U2’s “One Tree Hill” it will make me think of my grandfather and singing it to Heaven at the show the night we lost him. I’ll see you again when the stars fall from the sky. ♥ Taking Back Sunday’s “Divine Intervention” will always be special to me for all the times Adam sang it for me this year. ♥ The Killers put out “Run for Cover” and it made my rebel heart happy. The first time I heard it was at their show this summer and I almost flew over the stage lights. Share a moment you had with a friend you didn't even know in 2016. Kelly was the only one brave enough to go on The Zipper with me at Riot Fest, even after we saw them briefly stop the ride to do a quick repair. We laughed so hard they probably heard us on the ground, and we didn’t die. Describe a mundane moment that meant a lot to you. ♥ When Jen came from SLC to visit we spent a day walking 12 miles down and up Manhattan, over the bridge to Queens, and through LIC so I could show her the waterfront I love so much. It wasn’t exactly mundane, but not something many people would consider fun. ♥ I took a trip to Cleveland with Sean and Andy, and while we had a lot of fun when they let me drag them around showing them the sights, we also had a lot of fun sitting around our hotel room at night playing board games. ♥ My little Jesse was too young to get into the bar where John Nolan was DJing after a TBS show, but we held hands over the fence that surrounded the yard and danced together to “Sweet Caroline.” ♥ I love laying around watching YouTube videos with Mikey and laughing together or squeaking over cute animals. ♥ Kari and I went wading in Asbury Park and Coney Island on the same weekend. ♥ I spent two days with Neon and Glitz just sitting on the couch talking until we got hungry enough to go out for food. ♥ When I was in Disneyland with Nini and Erica we took a break to sit eating ice cream together. What are you most looking forward to in 2018? ♥ I have a couple of Killers shows, one with U2, and a handful with John Nolan. I’m sure TBS will be around at some point. The Hives and The All-American Rejects are welcome to tour any time now. ♥ VOTING. I cannot fucking wait. What was your greatest musical discovery? I loved seeing Worriers. Diet Cig are a delight. I went to Emo Night the weekend before and danced until I was dizzy. I saw Modern Chemistry on my Birthday Eve. The weekend after my birthday I got together with my family, ate lots of cake, and got murdered by my mother in Monopoly. I took a trip to California and Nini and I saw U2 at The Rose Bowl and then Disneyland the next day. And, I got myself front row seats to see baby boy Brendon Urie on Broadway. What one thing would have made your year immeasurably more satisfying? I’d be complaining about all different things if HRC had won the election last year but I’d definitely be happier. How would you describe your personal fashion concept in 2017? Comfort What kept you sane? Mikey. Music. Making plans. My friends. Yelling at politicians. Long walks. Which celebrity/public figure did you fancy the most? Chris Evans and Billie Joe Armstrong are beautiful human beings. I love people with a big angry mouth. What political issue stirred you the most? Unhinged coverage of Trump is hurting the media

Turn down the volume. Unclench your fist. Turn the dial back down from 11. Trump isn’t going anywhere for a while. Deal with it.
A year ago this week, I marveled at the pot-boiling-over frenzy of Donald Trump Derangement Syndrome in the media. Well, today, the media’s kitchen is a shambles. Spaghetti sauce is splattered all over the walls, and the Fourth Estate is pouring more Prego marinara into the pot while keeping the heat turned up to the level marked “thermonuclear.”
Not only is everything (still) hyper-politicized, but the lines between news media, lifestyle media and flat-out activism have faded into irrelevance. On Wednesday, the lead story in Teen Vogue, next to stories about how “I Will Never Use Regular Soap Again After THIS $6 Foam Body Wash” and “Everyone Basically Wore Lingerie to the VS Fashion Show After Party,” was this screaming headline: “The United States Voted ‘No’ on an Anti-Nazi UN Resolution.” It ran over a terrifying picture of crowds carrying banners, some featuring swastikas, with smoke in the background suggesting a terror attack. Only when you click through do you discover that there is no news here whatsoever: The US votes against this meaningless, nonbinding UN gambit every year because the US has this thing called the First Amendment. President Obama’s appointees also opposed the resolution.
Meanwhile, “Black-ish” star Tracee Ellis Ross addressed a Women of the Year Summit earlier this month hosted by Glamour magazine. Her speech was ostensibly about being 45 and childless, but it could easily have been made by a women’s-studies professor at Barnard instead of a sitcom star: “I look back and think about all the ways we’re told that those two goals: being chosen and having kids, are what makes you worthy ... this narrow story of ‘husband plus child equals woman.’ And the patriarchy--the patriarchy is not pleased with me right now. I’m failing at my function. Let me tell you, Mike Pence is f--ing confused by me right now.”
It seems unlikely that Vice President Pence is wandering around the White House buttonholing aides and saying, “My gosh, did you know that Tracee Ellis Ross is 45 and is unmarried with no children? I’m so confused by this information!” At the same Glamour magazine event, Congresswoman Maxine Waters called out, “You recognize when a leader is dangerous” and got the crowd chanting, “Impeach him! Impeach him!”
These days the drop-down menu on the website for Teen Vogue has “fashion” in the No. 2 spot. No. 1 is “news and politics.” Its latest edition stars Hillary Clinton on the cover alongside the headline, “Nevertheless, WE RESIST.” Readers resisted right back.
Teen Vogue has done so badly trading teen fixations for lefty harrumphing that this latest issue, which is also guest-edited by Her Hillaryness, will be the last to hit newsstands.
The culture warriors’ incessant politicization of everything has reached new levels of the ridiculous. At Newsweek on Monday, a story about a sociological study that revealed women like men who appear to be strong and wealthy was headlined in all caps: “MEN WITH MUSCLES AND MONEY ARE MORE ATTRACTIVE TO STRAIGHT WOMEN AND GAY MEN--SHOWING GENDER ROLES AREN’T PROGRESSING.” What’s more, this story was filed under “Tech & Science” rather than “Opinion.”
Over at Cosmopolitan, they’ve been running headlines like “This Theory About Why Donald Trump Actually Won the Election Will Leave You Worrying About Humankind.” Suddenly Cosmo’s unofficial motto is “Hot Sex Tips--and Why You Should Be Worrying About Humankind.” The GQ Resistance, meanwhile, is being run by the left-leaning Keith Olbermann, whose style is reflected in pieces with titles like “It’s Your Civic Duty to Ruin Thanksgiving by Bringing Up Trump.”
The unhinged coverage of all Trump scandals, real and imagined, has cost the media in the eyes of the public, among whom only 39 percent said they had a “great deal” or even “some” confidence in news outlets last November.
In the following months, the media tried to sell the idea that Trump supporters had been conned by “fake news” (based on a minuscule amount of Russian spending on Facebook propaganda that added up to the cost of less than a single airing of one commercial on a prime-time network TV show). But the cry of “fake news” was thrown right back in their face by Trump fans who sensed the claim was simply an attempt to distract from uncomfortable truths about Clinton’s shortcomings.
As of last month, still only 48 percent of Americans said they trusted the media, with 45 percent saying they have “hardly any” confidence in it. In other words, it’s basically a coin flip as to whether or not any given American thinks the media is just making stuff up. They aren’t, usually. But with every fashion glossy and sitcom star still beating a drum for Hillary a year after the election, while bashing Trump and everything he stands for from the front page to the sports section, can you blame people for losing respect for the press?
The media are correct in thinking they have an important duty in the Trump era. But the people are correct in noticing that the media is filtering everything through an obsessive hatred for Trump.

If it were not for the last minute, nothing would ever get done, but with Brexit, last minutes keep coming without any final resolution. The entire Brexit process, including endless discussions, debates, and prognostications, is fast becoming as certain as death and taxes, but it appears that Boris Johnson, putting all of his “shenanigans” aside, may finally have the votes to make “It” happen, or so say a few insiders.
Although this drama has a way of creating crescendos without the expected and satisfying denouement, once more we find ourselves at “the brink”, and we are being told that a “Deal-Brexit” is close at hand, despite London streets being filled with protesters that object to what the government intends to complete. All the wrangling and threats of job losses, intermixed with the exit of intellectual capital to parts unknown, may finally drop from front-page news. But are we getting the cart ahead of the horse, again?
Where are we now?
After Theresa May had negotiated an initial withdrawal agreement with the EU and then had Parliament send her crashing to flaming destruction, not once, but three times over, the general consensus was that Johnson could do no better. The EU would never consider making any changes. They would prefer that the UK never leave in the first place. But alas, Boris pulled a rabbit out of his bag of tricks, producing a revised agreement on Thursday and demanding a special vote on Saturday.
It was not to be. As the BBC reported:
However, in the first Saturday sitting in the Commons for 37 years, MPs instead voted in favour of an amendment withholding approval of the deal until all the necessary legislation to implement it had been passed.
The vote for an amendment demanding that Johnson adhere to the “Benn Act” was close, 322 to 306. The Benn Act had been passed previously to prevent any overt attempt at a Brexit with “no deal”. The Saturday ruling instructed Johnson and his government to request first an extension from the EU, before there would be any consideration of his bill.
Johnson had already been rebuked once by the Supreme Court for trying to circumvent various requirements under the rule of law, another of this new breed of populist leader that feels compelled to do whatever it takes to get what he wants, even if it means bending the law. Johnson was already on the record, per the Wall Street Journal, that:
He would rather die in a ditch than request an extension”. The NY Times also noted that: “Prime Minister Boris Johnson has adamantly opposed the idea of holding a second Brexit referendum.
May had tried the soft approach. Boris prefers outright aggression.
A letter was promptly drafted requesting an extension, but Boris refused to sign it, his clever way of flaunting the Benn Act. He complied by sending the request, but he also sent a second letter, which he did sign, asking the EU to ignore the first letter. His reasoning is that he needs the pressure of a threatened “No-deal Brexit” to force lawmakers to come to the table and stop dragging their feet. His actual entreaty to the EU states:
A further extension would damage the interests of the U.K. and our EU partners.” Michael Gove, a senior minister in Mr. Johnson’s administration, said to Sky News on Saturday: “We are going to leave on Oct. 31. We have the means and the ability to do so.
The soonest the EU could capitulate would be Thursday, and, even then, a unanimous vote would be necessary to grant an extension. Before any action could be taken, however, the group would need to debate whether to approve or not, and if approved, when to take that action, and how long of a delay to grant. Several EU leaders have spoken out that they do not want further delays, but if they were to delay until April of 2020, that would leave open the option of a new referendum being held on the entire “Leave/Stay” question.
As for what happens next, the Wall Street Journal reported:
Parliamentary approval for the deal, which could come as soon as Monday, would mark a significant political victory for Mr. Johnson and pave the way for the U.K. finally to exit from the EU after more than three years of negotiation and fierce debate. Downing Street would hope to use a win to attempt to race through the final stages of legislative scrutiny of the proposals in time for an Oct. 31 exit.
Does Johnson really have the votes this time around?
It remains to be seen if Johnson’s “double letter” single entendre that disregards the letter of the Benn Act ends up in court and delays the process further still. There are a few legislators that believe Johnson is “in contempt of Parliament or the courts”, a rather unfortunate turn of events, but if ignored, then what other laws may be mangled along the way? Johnson claims that he has complied with the law and that his new deal will be “the greatest single restoration of national sovereignty in parliamentary history.”
The challenge for Boris and his team is to persuade nine lawmakers that voted against him on Saturday to support him on Monday or Tuesday. As a point in fact, 28 lawmakers that voted against May’s proposal are now backing Johnson, and several other recalcitrant Conservatives, who recently exited the party, have come around, too.
As you might expect, there have been many number crunchers busily adding the heads in favor of Boris’s new deal in the background and now believe that he just might pull it off. Foreign Secretary Dominic Raab said in an interview with the British Broadcasting Corp. on Sunday:
We seem to have the numbers in the House of Commons.
Maddy Thimont Jack, senior researcher at the Institute for Government, has concluded that the government’s deal has “quite a good chance”.
What do the people think?
The forgotten ones in this debating debacle have been the people of Great Britain, who now feel, after three years of deliberation, that the original Brexit vote was a force-put via heavy-handed marketing types that disguised the true consequences that would come with a split from the EU. Last year at this time, protests in the street drew a few hundred thousand citizens. On Saturday outside the House of Commons, rally organizers are claiming that over one million protesters demonstrated in the streets against Boris Johnson’s proposals and the aggressive nature of his political tactics.
As for the people’s reaction to current discussions, “upset” would be putting it lightly. Nigel Farage, the former United Kingdom Independence Party leader and the person responsible for launching the original Brexit campaign in the UK, told Fox News:
We have this big, hard deadline of Halloween, October 31. We are supposed to leave then. It now looks unlikely that we will, so as you can probably imagine the anger that is building amongst British voters is unlike anything I have ever seen before.
The NY Times gathered these comments from a few attendees:
Ollie Lloyd, 42, who was among those protesting: “This is a last-ditch attempt to get them to hear our voices. This is about what kind of country we want to be. Do we want to be an open and tolerant country, or one that is closed off and inward looking?”
Ollie’s father, Gil Lloyd, 68, added: “I am just horrified at the whole thing.”
Dorothy Milosevic, 63: “The whole thing was sold on a lot of lies. Since that morning when we woke up to find that the leavers had won, it is has been gloom and despondency.”
Anoushka Nairac, a student at Magdalen College School: “We came here today because we want to let our voices be heard. My father is an immigrant who set up his own company and provided jobs for citizens. It makes me annoyed; people are not looking at the facts.”
The protest was not a single act by Londoners or the wealthy class, as critics had countered. Support came from all over the UK, as 170 buses delivered protestors from several other parts of the country, including Glasgow and Edinburgh in Scotland; in Belfast, Northern Ireland; and in Cheltenham, in southern England. Celebrities and former government officials, which included former prime ministers Tony Blair, of the Labour Party, and John Major, a Conservative, were also in attendance.
Concluding Remarks
Mr. Johnson and his staff are expected to appeal for another vote from Parliament as early as today or Tuesday, well before the EU can react to granting any kind of delay. “The quicker, the better” is the thinking at this point or risk one more opportunity for lawmakers to waffle on previous “Leave” commitments.
Will the people’s protest be heard? Greg Brown, 41, an engineer from Middlesbrough, epitomized the feelings of the madding throng: “I am embarrassed to say that there was a big Leave vote in the north east. Europe stands for peace, for multilateral negotiations, workers rights, paternity rights, jobs and free trade. In the three years since the vote, I have not yet heard a decent reason for voting Leave, and here we are standing on a cliff edge.”
One thing seems certain. We will have a vote this week. A “Yes” vote would be a coup for Johnson, but there would follow another process of “further legislative scrutiny”. There will undoubtedly be those that would want to make their mark on the annals of history by proposing an adjustment here or there or even move for a new referendum. A “No” vote would create more uncertainty, and as many pundits have said before, it would be “déjà vu” all over again, “standing on a cliff edge”.

How did you get your start in motion design, animation, or whatever it is that you do? I majored in the Animation program at SCAD and started making the switch to Motion Design late in my junior year. By the time I graduated in May 2016 I had a few motion media classes under my belt, but my portfolio was not where I wanted it to be (you can view it here, password is sabrina2016). Out of 50+ internship applications sent over the course of junior and senior year, I was either rejected or I didn’t receive a response from anyone. I moved back home with my parents in Spring, Texas and spent the first month out of school not knowing what to do next. I only knew that my portfolio was not the same caliber as the reels from studios that I admired and desperately wanted to work for, so I decided to try and close the skill gap between my work and theirs.
I developed a game plan to polish my demo reel, resume, and personal branding. Recognizing that I didn’t have to reinvent the wheel, I used the steal-like-an-artist approach. I identified my dream studios and used them as a guide for the type of work I wanted to create. I referenced the reels and websites of my SCAD peers who had graduated and immediately found work, like Joash Berkeley, Crosby Ignasher, Eli Orth, and Sarah Beth Morgan. I also enrolled in School of Motion’s Animation and Design bootcamps. Ideas for personal projects kept jumping around in my head, but I wanted to dedicate the rest of 2016 to learning, so I started organizing each idea in a notebook including details like a 2-week breakdown of each project with daily to-do lists, sketches, and lists of the materials or assets I would need. My New Years’ Resolution for 2017 was to open the notebook and go through it project-by-project with the goal of finishing a new demo reel and portfolio website by summertime. I ended up finishing it in early March (you can view it here). Blend 2017 was announced that spring and I snagged a ticket before they were gone. I’m extremely introverted but I didn’t want that to get in the way of meeting new people, so I looked into who was attending and reached out to the artists I admired in the hopes of introducing myself and not being a complete stranger at the event. I was acutely aware that I was a newbie, but to my surprise I received many responses and ended up meeting almost everyone I contacted. It was a magical and intensely motivational experience!
After Blend I continued applying for internship positions and quickly learned that my location was a hindrance, as very few studios would help pay for relocation. I tried to send 5-10 applications a day. Finally I received a response from Matt Vojacek from ZwellyCo after spotting his call for interns on Twitter. We had a phone interview, and we’ve been working together on and off ever since. Working with Matt taught me what it means to be a true mentor; he opened the lines of communication so I could work remotely, he didn’t take advantage of my low experience level by making me work for free, we did weekly Skype calls where I could ask him questions about motion design or freelancing, and when he felt that my skills had surpassed the level of an intern he promoted me to Motion Graphics Designer and gave me a raise(!!). I wouldn’t be where I am now if he hadn’t taken a chance on my potential. Still, the type of work I wanted to do wasn’t in Houston, Texas. During a short trip to New York with my family, I used the same technique I used at Blend and contacted a few producers in the hopes of introducing myself personally. After visiting with Daniel Castro, Emily Collins, and Todd St John, it became clear that if I was in New York I would get freelance work, which was all I needed to hear. Back in Texas I ordered the Freelance Manifesto, packed two large suitcases with necessities, and flew back to New York 2 weeks later to live in an apartment my parents and I found through Craigslist. Timing was on my side; as winter approached, there were more job openings because clients steadily liquidated their budgets before year’s end. I also took advantage of the abundance of networking opportunities in the city, involving myself in Punanimation NYC. This lead to several jobs from referrals, but more importantly a tight-knit support group of kind and immensely talented artists. Most of my initial freelance bookings came from cold-emailing producers, politely introducing myself and my reel. The first few jobs were short-term, lasting only a day or two, but the relationships established during those bookings has lasted far longer. Most of my current clients are return clients that contact me directly. Dedication and strategy helped orient and prepare myself for career risks. My goal for the future is to help others do the same.
State your privilege – What circumstances may have helped or hindered you along the way?
I’m an only child, and my parents viewed my education as a team effort between all three of us. I maintained my academic and artistic scholarships and they helped me pay for SCAD with the additional aid of low-interest loans. I had very little debt by the time I graduated due to their financial support, and the rest was paid off within the year. Freedom from the burden of debt is a huge privilege that allowed me to make decisions that not everyone has the opportunity to make. It’s a gift easily taken for granted and I try to honor that by budgeting responsibly and paying it forward to marginalized artists. Luckily, SCAD isn’t the be-all-end-all of motion design education, especially with the resources available online for a fraction of the cost.
What are some best practices you use today?
I love animation but I wouldn’t die on a hill for it, so I make an effort to eat healthily and keep to a schedule. I avoid pulling all-nighters at all costs. Once work ends, I declare myself done for the day and I can run errands, cook, or go to an event. I also like to physically write to-do lists to keep my thoughts organized.
How have you learned to practice self-care? What do you do to take care of yourself?
Like many others who spend time online, I got to the point where social media was largely negative and emotionally draining. I downloaded browser extensions like Facebook Fluff-Buster to curate my Facebook feed, and I’m not afraid to unfollow or unfriend someone if I find myself feeling consistently annoyed or angry at their posts. I’ve also completely erased my Twitter a few times, removing all of my tweets and starting over from scratch. I try to keep my social media limited to following my family, close friends or acquaintances that I plan on meeting again, animation studios, and a handful of artists I like. I’m not concerned with followers whatsoever; the goal is to dip my toe into everything without drowning in the current.
What advice do you have for those just starting out?
Identify your weaknesses and find a balance between healthy competition and imposter syndrome. You shouldn’t work in a vacuum, but you also shouldn’t psych yourself into thinking that it’s impossible to reach your goals by comparing yourself to other people. Instead, take what you know you’re good at and combine it with the influences that make you excited to learn more. Take advantage of the knowledge that’s available online and apply your own twist to it after you learn the basics. Get out of your comfort zone and involve yourself in communities--the more you can do in-person, the better. Finally, you don’t have to suffer to prove your dedication; if you’re suffering, allow yourself to get the help you need. Animation is cool but it’s not worth isolating yourself, falling prey to anxiety, or losing sleep.

June 27, 2017 - Jackie, New York City
I’m in New York for a few weeks, thanks to the incredible generosity and thoughtfulness of two dear friends that live here.
I'm writing this while sitting in the main reading room of the New York Public library. It is a sanctuary of gilded beauty. It has ornate, detailed carving which covers the vaulted ceiling. Fluffy pink, renaissance-like clouds adorn the centre panels. Glorious streams of sunshine pour in through giant arched windows.
The large, concert-hall sized room, is surrounded by reference books, with a small, wrought iron balcony adding more books to the room. There are dozens of long tables, with intricately carved bases. Four brass lamps adorn each table. The air-conditioning is a life saver! There are a few hundred people in here, and yet, the silence is sublime.  
It’s my fourth time being in the city, and I admit it, I LOVE New York! There is an energy here unlike any other city I’ve been to.
Three weeks is the longest I’ve spent in New York. There’s a certain luxury in that duration in so far as, I’m able to be more leisurely about doing things. There is no rush.
"Intentional meandering" I call it - it's something I'm working on; more about that another time.
I even spent most of yesterday hanging out at my friend's place, and not going anywhere, or doing anything, for most of the day. After an intense, action packed first five days, it was grand to spend the day at (their) home and relax.
A couple of things I’d like to boast about at this point. I must look like a New Yorker. Once again, while out for a walk on my own last night, I was stopped by someone and asked for directions. It’s happened twice before on previous trips here.
Each time, I’m proud to say I knew the answer, and happily pointed out directions to get ‘tourists’ to their destination.
Another thing I noticed just today. There are of course, copious amounts of people working in the tourism industry here. On any given street corner, people are handing out flyers for bus tours, restaurants, sight-seeing trips, ride-to-the-roof-of-this-building excursions, add infinity.
Almost none of them stop me. I either look like a local, or a completely unapproachable ass. Either one works for me!
This weekend was the 48th annual New York Pride March. I had the incredibly good fortune to participate in the march, riding on a float with my friend’s employer.
Truly, a stand alone life event, that I will never forget.

An energy like I’ve not experienced before.
I was here in New York during Pride in 2012, two days after equal marriage came into law, throughout NY State!
Another stand alone moment in time.
On Sunday, there was an even more powerful sense of connection with spectators, as we travelled along.  Some spectators stood ten deep at points.
There was a palpable sense of jubilant camaraderie and celebration. Defiance. Definitely resistance and persistance. I've been marching for over 35 years. The love was everywhere. Strangers waving, singing, dancing and blowing kisses.
Certain intersections had pairs of large dump trucks blocking them off.
Some streets were barricaded with pairs of garbage trucks.
Everything is impacted by the current political climate.
I didn’t take any of that for granted. Nor will I - I shall march as long as I can, and hope one day, we won’t have to. Alas, there is still much work to be done.
I had thought about perhaps utilizing some of my ‘luxury’ time, to go out and meet a stranger. I hadn’t really planned on it happening today, and in meeting Jackie, it just seemed natural.
Strolling down Fifth Avenue, I was first drawn to Jackie's vintage film camera. I’m a hobby photographer and have, over the years had the distinct pleasure of using some quality older cameras.
A friend once had a Hasselblad camera. It's a large format camera that makes the most delicious clunk-click sound with each shutter release. My first real sense of geekdom. Clunk-click. Ahhh.
Jackie was filming outside a specific 'tower' on Fifth Avenue. One  that I wouldn’t have wanted to stop in front of, let alone photograph. Okay, I did take one or two shots, which I intend to alter.
But her camera made me want to ask questions, even though I know very little about the technical aspects.
If you’ve been following this project for any time, you’ll know I speak of self-imposed rules. You'll also know, on occasion, I liberate myself from my own constraints.
I break the rules because I can.
Today, I gave myself permission to not be so intent on getting a full life story. It was about connecting with a stranger.
While I didn’t go into the whole backstory of The Stranger Project - est. 2014, I explained the idea. I asked Jackie if it would be alright to ask a few questions, and to take Jackie’s photo, which I would post here. She readily agreed, while continuing to work.
“I’m an only child,” Jackie told me. Of all my ice-breaker, conversation starting questions, this is one of my personal favourites. I'm fascinated by the difference between people who grew up as an only child, compared to those who had siblings.
“No, I don’t feel that I missed out on anything as an only child. However, ironically, I have a nine-year-old son, and he desperately wants to have siblings,” she said.
“I guess it’s because he sees his friends with brothers and sisters. Alas, that ship has sailed.” We both chuckled at that.
As a film maker, Jackie is still using old school film. Each canister of film lasts two and a half minutes, and costs around $25USD to develop, when she’s working with colour film.
Just thinking of the gamble and cost would be prohibitive to me. In our 'new-age' need for instant gratification, the wait and uncertainty would be an exercise in patience and willingness. To wait, and then discover the work isn't what one hoped for. This could be a grand discovery, or a resolute sense of failure. I’m projecting my own perspectives here.  
It was no surprise to me when I asked Jackie what she does.
“I teach this,” she says, pointing to her camera.
“I teach film-making,” she said. Jackie is from New Hampshire, in the north-eastern United States.
I found out that Jackie is a professor of film and electronic arts. A faculty member at Bard College, founded in 1860, a college of the liberal arts and sciences. Of course, she teaches film making.
I asked if I would know of her work. “The one piece I’m most proud of,” she said, “is a film I made called ‘The Observers’.
It's about one of the world’s last staffed weather observatories, at Mount Washington, in New Hampshire.”
Currently, Jackie is working on a film about the 45th US President’s vast property holdings. I loved that throughout the conversation, not once did we use ‘that' name.
While chatting, as I mentioned, Jackie continued to work, and as happens, I managed to throw her off, or so I felt at least. 
She had opened the camera to remove the reel she had been filming when I approached her. The camera needed a new film reel. Dropping the box out of her hand into her bag amongst other film boxes, which all looked the same to me. She placed a new film in the camera and wound it into it's sprocket.
“I don’t know which film canister I just used. Hmmm. I think it was this one. Or was it this one?” she asked of herself. I knew it was time to let her get back to focusing on her task at hand. Filming people coming in and out of the large tower we were chatting in front of.
“It was nice chatting. Thanks so very much, for letting me ask questions and take your photo. I hope you’ll look for the story,” I said as we shook hands.
“It was fun,” she said. “And now you’ve met a stranger in New York!” #notastranger

So, about that announcement that I was supposed to post yesterday (whoops)... I am very proud to announce that this summer, this dotwork Koi fish will be shown through the Art in the Windows program in Lockport, NY! Soon I will be taking this piece to get photographed and the people at Lockport Main Street Inc. will be printing it at a high resolution to be displayed in a window on Main St in a building for rent! I've had to keep this a secret for a while, but it was so worth it. So far, the only information I have is that there's a reception planned for June 10th, but when I acquire more info I will definitely share it with everyone!
