Le très médiatique député La France insoumise François Ruffin, journaliste et cinéaste, récompensé d’un César du Meilleur documentaire pour Merci patron !, est au cœur d’une polémique politique digne… d’une fiction.

D’après Le Monde, entre janvier 2015 et mars 2016, l’ancien directeur du renseignement intérieur Bernard Squarcini serait parvenu à infiltrer la rédaction du magazine trimestriel Fakir, fondé par François Ruffin, qui y occupe encore aujourd’hui le poste de rédacteur en chef. D’après Jean-François Digeon, ancien chargé de sécurité de LVMH, M. Squarcini aurait fait entrer « une taupe qui travaillait pour une société d’intelligence économique qui avait fait les poubelles de Fakir ou piqué des documents » – la société en question, I2F, est dirigée par un ancien policier, Hervé Séveno. Des pratiques qui auraient été provoquées en réponse au tournage de Merci patron !, qui suivait l’histoire du couple Klur se retrouvant au chômage suite à la délocalisation de leur usine de textile (filiale du groupe LVMH) en Pologne. Le pot de terre, le pot de fer et, au milieu, les barbouzes. Le futur député François Ruffin et son journal Fakir ont fait l’objet, pendant au moins une année, d’un espionnage méthodique à la demande de la multinationale LVMH, selon plusieurs rapports inédits obtenus par Mediapart, dont certains évoquent des informations relevant de la vie privée.

Cette surveillance a valu au patron de LVMH, le milliardaire Bernard Arnault, d’être entendu le 17 janvier dernier par la police dans le cadre d’une enquête visant l’ancien maître-espion Bernard Squarcini, qui travaille notamment pour le géant du luxe. « Je n’ai aucune information à ce sujet », s’est contenté de répondre la première fortune française, selon le procès-verbal de son audition comme simple témoin.

À l’époque des faits, François Ruffin n’était pas le député de La France insoumise (LFI) qu’il est devenu mais un journaliste et documentariste engagé, en plein tournage de Merci Patron !, un film saignant sur le leader mondial du luxe qui a obtenu en 2017 le César du meilleur documentaire.

Le film raconte le combat de Ruffin en faveur d’une famille du Nord, les Klur, qui ont été licenciés d’une entreprise sous-traitante de LVMH après une brutale délocalisation en Pologne. Il n’en fallait manifestement pas plus pour mettre la multinationale sur les dents.

D’après les témoignages et documents recueillis par Mediapart, LVMH a sous-traité à un cabinet privé d’intelligence économique dirigé par un ancien policier l’opération de surveillance de François Ruffin et de plusieurs membres du journal qu’il dirigeait alors, sur une période allant au moins de mars 2015 à février 2016. À la tête de ce cabinet, baptisé I2F, se trouve un certain Hervé Seveno, un ancien de la Division nationale antiterroriste (DNAT) et de la Brigade financière dans les années 1980 et 1990.

Dans une note de synthèse à en-tête d’I2F établie en mars 2015, on peut par exemple lire : « Le suivi de Fakir depuis ce début d’année, à travers plusieurs réunions internes ou publiques, amène à penser que François Ruffin a désormais une liberté totale dans ses opérations. En effet, E., coordinateur de Fakir, a finalement démissionné à la suite de désaccords avec François Ruffin. C’est désormais J., la compagne de François Ruffin, qui coordonne les actions de Fakir » – Mediapart a décidé de ne pas publier les identités complètes de E. et J. qui figurent bien dans les rapports.

Sollicité pour réagir, notamment sur les éléments de vie privée figurant dans cette note, François Ruffin confie : « Ah ouais, quand même ! À l’époque, cette relation sentimentale n’était pas officielle. Tous les membres de Fakir n’étaient pas forcément au courant… »

Le même rapport de mars 2015 s’intéresse également aux supposées ramifications de Fakir avec d’autres groupes contestataires, comme Les Désobéissants, mais aussi avec les zadistes de Sivens ou des mouvements de défense des animaux, voire de black blocs. « Cette montée en gamme de la communication des Désobéissants présente un facteur de risque à ne pas négliger à l’occasion des prochains événements de LVMH », conclut le cabinet privé.

Une autre note, datée du 15 avril 2015, montre que les barbouzes au service de LVMH ont pris la peine de relever la plaque d’immatriculation d’un véhicule appartenant à Fakir ; à quelles fins précises ? Le document cite également le contenu d’un mail qui a circulé au sein de l’équipe concernant l’organisation d’une éventuelle opération du journal pendant une assemblée générale de LVMH.

Le cabinet privé termine sa note par ces quelques mots : « Nous restons en alerte. »

Interrogé par Mediapart, Hervé Seveno, le patron d’I2F, confirme avoir travaillé sur Ruffin et Fakir. « Je ne peux pas mentionner le nom de mon commanditaire parce que je suis tenu par des clauses de confidentialité. Mais il est exact qu'on nous avait demandé une cartographie de Fakir, c'est ma spécialité. Il faut comprendre qu'il existe parfois des groupes activistes qui, sous couvert d'altermondialisme, mènent des opérations offensives. Certains veulent du coup savoir qui ils sont, comment ils sont financés, ce qu'ils prévoient », explique Hervé Seveno.

Le patron d'I2F, à qui nous avons soumis les documents en notre possession, précise : « Toutes les informations que nous rapportons sont ensuite la propriété du client, à condition que nous n'utilisions aucune méthode illégale, évidemment. » « Il faut savoir qu'il y avait à l'époque de fortes dissensions au sein de Fakir et il n'était pas difficile d'avoir des sources humaines. Mais ce n'est ni moi ni mes collaborateurs qui traitions ces sources, cela passait par un indépendant que nous avions fait travailler. Il n'y a eu aucune démarche illégale de notre part ni d'interception de mails. Si on cite un mail dans un rapport, c'est que nous en avions entendu parler, mais il n'y a eu aucun hacking. Je ne sais pas faire », ajoute Hervé Seveno.

« C’est moi la taupe ! »

L’opération Fakir a mobilisé plusieurs personnes pendant de longs mois. L’une d’entre elles, l’enquêteur privé Jean-Charles Brisard, souvent sollicité par les chaînes de télévision pour ses expertises sur le terrorisme, a lui aussi confirmé à Mediapart avoir travaillé en 2015 sur Fakir (réalisation de trombinoscope des membres de l'équipe ou calendrier d'événements à venir), mais il dément avoir personnellement effectué la moindre démarche sur la vie privée de François Ruffin et ses collègues.

« J’ai fait de la veille, c’est vrai, sur ses publications, ses activités et les événements qu’il organisait. Mais je ne me suis jamais intéressé à la vie privée de quiconque. Il faut savoir qu’à l’époque, beaucoup de groupes, pas que LVMH, s’intéressaient à la propagande de Fakir. J’ai donc fait des notes que je faisais passer », assure Brisard, qui ne confirme ni n’infirme avoir directement travaillé pour le compte de la société I2F de Hervé Seveno. « Peut-être », dit-il simplement.

Selon des éléments comptables, I2F a facturé près de 160 000 euros ses prestations de « suivi » de Fakir. « J’aurais pu faire plusieurs Merci Patron ! avec un budget pareil ! » se marre François Ruffin. Hervé Seveno nuance ce chiffre : « Je pense que c'était moins. »

D’après la police, toute l’opération de surveillance de François Ruffin et de Fakir a été directement supervisée par Bernard Squarcini, patron des services secrets intérieurs sous Nicolas Sarkozy, désormais reconverti dans le privé, notamment au service de LVMH où il dispose d’un bureau et même d’une adresse électronique. Sollicité par Mediapart, Bernard Squarcini n’a souhaité faire aucun commentaire.

Celui qui est parfois surnommé « Le Squale » est aujourd’hui multi-mis en examen par les juges d’instruction Serge Tournaire et Aude Buresi pour avoir servi des intérêts privés du temps où il était à la tête de la Direction centrale du renseignement intérieur (DCRI, aujourd’hui Direction générale de la sécurité intérieure, DGSI) puis, une fois dans le privé à partir de 2012, pour avoir profité de ses anciennes entrées dans l’appareil d’État afin de faire de juteuses affaires.

Bernard Squarcini est notamment mis en examen pour « abus de confiance » pour avoir mobilisé les moyens de l’État fin 2008, hors de tout cadre judiciaire, dans une affaire privée au profit de… Bernard Arnault (voir notre enquête). Il est également accusé de « compromission du secret de la défense nationale » pour avoir conservé par-devers lui plusieurs centaines de documents classifiés, découverts par la police lors d’une perquisition à son domicile ainsi que dans un coffre de banque, à la BNP Paribas.

C’est dans le cadre de l’affaire Squarcini qu’en début d’année, Bernard Arnault a été entendu par la police au sujet de la surveillance de Fakir, mais également sur d’autres dérives impliquant LVMH. Le milliardaire a dit n’être au courant de rien et s'est déchargé sur des cadres du groupe.

Bernard Squarcini est une bonne connaissance de Hervé Seveno, le patron du cabinet auteur des rapports sur Ruffin que révèle aujourd’hui Mediapart – et qui n’apparaissent pas à ce jour dans la procédure judiciaire visant « Le Squale ». Les deux hommes cultivent une autre amitié commune : l’intermédiaire Alexandre Djouhri, mis en cause dans l’affaire des financements libyens de Sarkozy. Dans une attestation fournie à la justice britannique – Djouhri est actuellement menacé à Londres d’une extradition dans l’affaire libyenne –, Seveno se présente lui-même comme un « ami très proche » de l’intermédiaire.

D'après nos informations, un autre cabinet qu'I2F a travaillé sur Fakir avant 2015. Un ancien conseiller en sécurité de LVMH, l’ex-commissaire principal des Renseignements généraux Jean-François Digeon, avait reconnu devant les enquêteurs que Bernard Squarcini avait fait espionner Fakir en 2014. « Il m’a dit que c’était un informateur en poste au sein de Fakir, une taupe quoi, qui travaillait pour une société d’intelligence économique qui avait fait les poubelles de Fakir ou piqué des documents », avait indiqué en septembre 2016 Jean-François Digeon à la police, comme l’avait rapporté L’Obs. « Ça, ce n'était pas nous… », indique aujourd'hui Hervé Seveno, d'I2F, à Mediapart.

Sollicités, ni Jean-François Digeon ni son avocat n’ont retourné nos appels.

En octobre 2016, entendu par les juges Tournaire et Buresi, Jean-François Digeon a toutefois raconté sur procès-verbal une anecdote burlesque remontant à avril 2014, au moment d’une assemblée générale de LVMH que la bande de Ruffin voulait perturber. « Il y a eu beaucoup de remue-ménage par les gens de Fakir qui ont essayé de s’y introduire. […] J’ai intercepté un des chahuteurs et c’est comme ça que j’ai chopé la taupe. Il m’a dit que c’était lui la taupe. Il m’a dit : “Laissez-moi, laissez-moi, demandez, c’est moi la taupe !” ». L’ex de LVMH a ajouté : « J’ai demandé confirmation et on m’a dit que c’était vrai. »

François Ruffin et plusieurs membres de Fakir se souviennent très bien de la taupe, qui se faisait appeler Marc Foll – de toute évidence une fausse identité. Il était surnommé en interne « le Libanais ». « Le mec était tellement bizarre qu’on s’est vite dit qu’on avait été infiltré. Alors on s’est amusé à l’intoxiquer et notamment à faire croire qu’on était beaucoup plus importants que ce que nous étions vraiment », confie Ruffin, qui pensait que cela n’était pas allé plus loin. Mediapart n’est pas parvenu à identifier « Marc Foll ».

Informé du contenu précis des rapports d’I2F, le député insoumis dit aujourd’hui ne pas exclure de se constituer partie civile auprès de la justice dans l’affaire Squarcini. « Il faut que je voie avec mes avocats », assure-t-il.

François Ruffin dit par ailleurs s’inquiéter des porosités qui pourraient exister entre certaines officines au service de LVMH et la police. Pour appuyer ses soupçons, le député raconte qu’à l’occasion d’une intervention que Fakir avait envisagé de faire devant un magasin Dior (propriété de LVMH), il s’était retrouvé face à une escouade de policiers en tenue, dont certains avaient en main un trombinoscope précis des membres de Fakir. « D’où ça venait ? », se demande le parlementaire.

Contacté, le groupe LVMH n’a pas donné suite.
