Illinois Appeals Court Affirms Actor Jussie Smollett's Convictions and Jail Sentence | Newsmax.com
https://www.newsmax.com/us/jussie-smollett-illinois-appeal/2023/12/01/id/1144444/
An appeals court upheld the disorderly conduct convictions Friday of actor Jussie Smollett, who was accused of staging a racist, homophobic attack against himself in 2019 and lying about it to Chicago police.
Smollett, who appeared in the TV show "Empire," challenged the role of a special prosecutor, jury selection, evidence and many other aspects of the case. But all were turned aside in a 2-1 opinion from the Illinois Appellate Court.
Smollett had reported to police that he was the victim of a racist and homophobic attack by two men wearing ski masks. The search for the attackers soon turned into an investigation of Smollett himself, leading to his arrest on charges he had orchestrated the whole thing.
Authorities said he paid two men whom he knew from work on "Empire," which filmed in Chicago. Prosecutors said Smollett told the men what slurs to shout, and to yell that he was in "MAGA country," a reference to Donald Trump’s presidential campaign slogan.
A jury convicted Smollett in 2021 on five felony counts of disorderly conduct, a charge that can be filed in Illinois when a person lies to police.
He now will have to finish a 150-day stint in jail that was part of his sentence. Smollett spent just six days in jail while his appeal was pending.
A message seeking comment from his attorney, Nenye Uche, was not immediately returned. Lawyers for Smollett, who is Black and gay, have publicly claimed that he was the target of a racist justice system and people playing politics.
Appellate Justice Freddrenna Lyle would have thrown out the convictions. She said it was "fundamentally unfair" to appoint a special prosecutor and charge Smollett when he had already performed community service as part of a 2019 deal with Cook County prosecutors to close the case.
"It was common sense that Smollett was bargaining for a complete resolution of the matter, not simply a temporary one," Lyle said.
Special prosecutor Dan Webb was appointed to look into why the case was dropped. A grand jury subsequently restored charges against Smollett in 2020, and Webb concluded there were "substantial abuses of discretion" in the state's attorney office during the earlier round.
Smollett was not immune to a fresh round of charges, appellate Justices David Navarro and Mary Ellen Coghlan said in the majority opinion.
"The record does not contain any evidence that (prosecutors) agreed Smollett would not be further prosecuted in exchange for forfeiting his bond and performing community service," they said.

Gemstones Episode 2.8, Continued: Macaulay Culkin grows up, the Cycle Ninjas break out, and Jussie Smollett shows his stuff
Tumblr media
Previous: Episode 2.8: Baby Billy sees a ghost, Judy becomes a mom, and Kelvin gets *** up. With nude dwarf athletes
Baby Billy's Baby Boy: Harmon the special-needs son who Baby Billy abandoned at Christmas 1993. has grown into a special-needs adult (Macaulay Culkin), But nevertheless he has achieved the heterosexual nuclear family trajectory of job, house, wife, and kids.Actually, his wife has the job (a lawyer, "an educated breadwinner") but close enough.
Suddenly the doorbell rings: it's a card with a photo of Harmon on Santa's lap the day his Daddy abandoned him.  Then his Daddy!
Baby Billy wants to fix things between them, so he can move forward with his new son.  So it's not about Harmon, it's about you?  Harmon says just don't make the same mistake again, and "Can I hit you with a closed fist as hard as I can in the face?"  That's rather precise, but Baby Billy agrees, and gets walloped.
Jesse Smollett and K-Fed: Back stage before Eli's  "welcome back" service, the siblings are in makeup and practicing their enunciation. They agree to make Daddy proud by showing how much they love each other. Judy says that she loves "Jesse Smollett" and "K-Fed," whereupon Kelvin makes a strange feminine gesture.
Tumblr media
K-Fed is Kevin Federline, an actor, musician, and dj, known for his brief marriage to Britney Spears.
Jesse Smollett is Jussie Smollett (top photo and left), an actor who came out as gay in 2015.  On the Fox drama Empire (2014), he played a gay musician trying to gain the approval of father, a hiphop mogul.  Sounds more like Kelvin.
At least Jussie's character managed to kiss a dude. Kelvin won't get around to that for another umpteen episodes.
Back to the siblings: They're going to take a photo with the Millins, an impoverished family that the church is gifting $50,000.  Judy wonders why they are bothering with such a small amount, "barely any money at all." It doesn't seem worthwhile.  "Poor people love money," Kelvin explains.
Geez, just when you think these people have redeemed themselves...are they so lacking in empathy, or are they so out of touch that they don't realize that $50,000 is almost a full year's household income in South Carolina?
Wait -- where is Eli?
Eli and Junior reconcile: Eli skipped his welcome-back service to make a surprise visit to Junior's wrestling studio in Memphis.  He couldn't have waited until after church?
Suspicious of his motives (naturally, after the run-in with Jesse), Junior comes armed with his own God Squad of four musclemen. But Eli has had enough: he doesn't want to fight.
"But you ignored and disrespected me," Junior says, forgetting for a moment that Eli also broke his heart, "And sent your asshole son to threaten me with violence, to rape me.  What's up with that?"
Eli denies that he sent Jesse, and comes clean about his father murdering Junior's father. Junior is ok with it: "He was asshole, anyway."
They stand so close together that one expects them to kiss.  But then Junior drops one last bombshell: he didn't send the Cycle Ninjas.  Someone else is trying to kill Eli.  But who?
Cut to the police station.  Sheriff Brenda is on the toilet, when she hears an explosion.  The lights go out, and the fire alarm goes on.  Out in the hallway, cops are lying dead.  The Cycle Ninjas have escaped!  The end.
One episode left, and a lot of questions to answer.

‘The point they seem to be making was that they should not have the right to say it’
Massachusetts Institute of Technology students behind flyers and chalkings recently found at the school that included slurs against LGBTQ people were protesting the university’s emerging policies in support of free speech.
The incident came in the wake of a two-month-old MIT faculty resolution that defends freedom of speech and expression — even speech some find “offensive or injurious.”
A Feb. 23 memo from MIT administrators stated flyers posted across campus and some chalking outside a school entrance “contained slurs directly targeting the LBGTQ+ community.”
MIT’s bias response team investigated, the memo added, and determined “the messages were put up by students choosing to use extreme speech to call attention to and protest what they see as the implications of” several new pro-free speech policies and efforts at the school.
“The chalking and flyers that carried slurs were put up as part of a much larger set of flyers, expressing a wide range of views, many framed in provocative terms. We have been told that these flyers were intended to probe the boundaries of MIT’s commitment to freedom of expression and to determine how this commitment comports with MIT policies, including those on harassment,” stated the memo, written by Dean for Student Life Suzy Nelson and Institute Community and Equity Officer John Dozier.
Peter Bonilla, executive director of the MIT Free Speech Alliance, said he couldn’t say for sure whether the students who posted the messages are left-leaning progressives, but added “whatever the content of the messages, whatever was being said, the point they seem to be making was that they should not have the right to say it.”
From the little MIT administration has released about the content of the flyers and chalkings, “that kind of protest should be protected under MIT’s policies,” Bonilla told The Fix in a telephone interview Thursday.
He said meeting the legal threshold of unprotected speech categories like incitement, targeted harassment and unlawful threats probably could not be met with flyers and chalkings, that “it’s hard for a message posted in that kind of medium to meet that threshold on its own.”
Campus leaders “are working on creating a range of different opportunities to engage and inspire individuals across campus to learn about, practice and model the skills to confidently, constructively, respectfully express ourselves – and listen to each other – across differences,” Allen stated.
Asked for details on the content of the flyers and chalkings, Allen stated the university’s full statement on that matter is encompassed in Nelson’s and Dozier’s memo.
The new pro-free speech policies that have upset MIT students and prompted the false flag campaign include the free speech faculty resolution approved in December as well as a final report of the faculty Ad Hoc Working Group on Free Expression.
In the wake of these developments, Kornbluth — who took the helm of MIT on Jan. 1 — stated in a Feb. 16 announcement plans to review the school’s existing policies on academic freedom and free expression and determine “what changes if any may be necessary to bring them in line with” the faculty’s final report.
She also called for creating “a range of different opportunities to engage and inspire all of us, across our community, to learn about, practice and model the skills to confidently, constructively, respectfully express ourselves – and listen to each other – across differences.”
MIT was engulfed in controversy in 2021 for canceling a guest lecture to be given by University of Chicago geophysicist Dorian Abbot.
A report released in mid-January by the Foundation for Individual Rights and Expression also found that “Large portions of MIT faculty and students are afraid to express their views in various academic settings. Faculty and students are at least as afraid of each other as they are of the administration.”
In response to the flyers and chalkings, the MIT Free Speech Alliance stated in a news release that “protesting against the scope of the free speech protections offered by MIT’s new free expression statement is itself protected expression, and students are well within their rights to engage in such protest.”
“…Assuming the speech at issue is protected, disciplinary investigations or charges against students over the content of this expression are unwarranted.”
==
When the demand for hate exceeds the supply.
While it's true there's no reason or need for disciplinary action, that doesn't preclude them recovering the costs of the investigation into a phony incident.

Sixty years ago, students were protesting for free speech. Today, power-mad authoritarian student groups conduct false flag campaigns to abolish it.

We have car chase QUESTIONS!🧐
Meghan SMOLLETT's security team flagged down a random taxi cab outside of a Hertz Rental Car storefront.
The driver picked up the 3 Meghans and 1 security guy, drove them around the block for 10 minutes, then dropped them off---- back at the same Hertz storefront where he was flagged down for the pickup. $50 for a 10 minute chase.
Tumblr media Tumblr media
1-What disappointing news were they reading on Doria's phone BEFORE the hoax?
Tumblr media
2-Maybe they saw The Princess of Wales was (still) TRENDING while The Meghans were the laughing stock in a Hertz dress?
Tumblr media
3-Do they look worried about SECURITY? The Meghans arranged for the paparazzi to gather outside of the Hertz storefront and the photographers were planning to follow them out for dinner.
4-Why did they irresponsibly walk through the photographers via the street level exit instead of the Hertz garage?
Tumblr media
They have been teasing the public with a car crash scene since megflix.
4-At what point during this enjoyable paparazzi frenzy did they initiate the Operation Paparazzi Chase Hoax?
Tumblr media
5-What security team would irresponsibly assign his charges to some random bright yellow NYC taxi cab in an attempt to shake off the paparazzi?
In Megflix Meghan said "safety first." She mentioned driving into a garage to avoid the invisible paparazzi.
6-So why did they seek safety in a strange vehicle instead of the Heartz garage?
The Meghans used their histrionic press release to shut down the distribution of the taxi cab photos and video footage. They claimed the photos were obtained under duress yet the driver disputes those claims.
7-So what is the real reason?
8-If they are comfortable riding in random NYC taxi cabs (with the window rolled down) then why on earth should ANY government fund the cost of their security?
9-The freelance photographers told Backgrid that 1 SUV in their convoy was recklessly driving. Was that before or after the taxi cab ride?
10-In megflix, the Meghans used video footage that violated Diana's privacy, Catherine's privacy and others. Their law suits resurrected footage that violates Chelsey Davey's privacy. It has even opened the floodgates for their suckit squad to harass Chesley online.
They dont really care about privacy rights, they care about manipulating facts to manufacture THEIR TRUTH.
No way would they give a random driver their lodging location.
11-What was the point of the 10 min trip around the block? Were they strategizing next steps?
12-What happened in 10 min around the block that made it "safe" to transfer from a strange taxi back to their SUV?
13-Where were their dinner reservations and for what time?
14-We know Meghan is capable of falling apart with tears from 1 or both eyes, so what's with her post-taxi cab facial expression?
The actress is not frightened or upset. She looks like someone searching for a rock that she can crawl underneath.
Tumblr media Tumblr media Tumblr media
A walk of shame before an alleged 15 minute pit stop at a local NYPD station where no police report was filed. They basically stopped to get directions🤡
This seems like a psychological operation gone wrong. It reminds me of the day Meghan arranged for paparazzi to snap photos of her sitting with Ralph Lauren models (talking to the air) amongst Cressida and other members of the "glossy posse" at Wimbledon. The same week in 2016 that they want us to believe she was first introduced to Harry by Violet.
Unfortunately for her, she was assigned to the wrong seat but because she had arranged to be photographed, we were gifted with photos of her showing her complimentary ticket and angrily playing musical chairs because she was in the wrong seat.
We watched Meghan contact Serena's team (Jill Smoller) who allowed her to join them in the family box with Anna Wintour who offered her a sweater (she appeared cold wearing black SUEDE in July to advertise the off season RL dress).
My point---The Meghans arranged for the paparazzi frenzy but it backfired. The taxi cab photos and video footage expose them as liars and hoaxers.
They didn't file a police report or press charges against the big bad paparazzi.
15-Did they stop by the police precinct for damage control?
Was it a way to temporarily legitimize their hoax, thereby affording them enough time to make the front pages of the UK papers they claim to loathe?
The digital imprint and permanent digital search engines will be VICTIM Meghan in the ugly Hertz dress. Any criticism of her appearance, participation trophies or hoax is harassment because the papers were bullied (using of the "Diana Card") into printing the 1st side of the story.
"The one who states his case first seems right, until the other comes and examines him." // "The first one to plead his cause seems right, Until his neighbor comes and examines him." Proverbs 18:17
Let's see how they spin themselves out of this web of lies.
Tumblr media
By the way, Sunshine Sachs represents Jussie Smollett and Tyler Perry bailed him out of jail and flew him out of Chicago to LA. Just sayin'.

The guy - Abimbola Osundairo - Jussie Smollett tried to pay to fake beat him up is fighting on the Canelo undercard this Saturday.
Tumblr media
And he's fighting a legit guy in Bek Nurmaganbet, a former standout for the Kazakhstan national boxing team.
Also worth noting that Osundairo was a legit amateur. Won the USA National Championship at lightweight.
