In Defence Of Oasis
Exploring the hype behind one of Britain’s most loved and raucous rock n roll bands.

Unless you’ve been living under the most soundproof of rocks this week, you will have heard the news. After a decade and a half of the alluring ‘will-they-won’t-they’ drama, the Gallagher brothers Noel and Liam have rekindled just as suddenly as they’d ended it all backstage at a gig in Paris in 2009.
The rumours abound on social media suddenly began to feel a lot less like fantasies when Oasis, Noel and Liam’s accounts all teased an announcement last Saturday. Oasis had made announcements since their split, usually about anniversaries, merchandise and documentaries, this wasn’t out of the ordinary. In fact, the band would soon be marking 30 years since their era-defining debut album Definitely Maybe came out in August 1994. Singer Liam Gallagher had also threatened to reunite the band on plenty of occasions in the ensuing decade, but never made good on his word. Why should this time have felt different?
In theory, it shouldn’t have. The village eventually loses interest in the boy crying wolf. And yet, when Liam Gallagher stepped onto the Main Stage at Reading festival to perform a headlining set on Sunday and opened with nostalgic on-screen visuals of Oasis, any doubt left in fans’ minds quickly evaporated.
The following Tuesday, the band confirmed what we already knew: Oasis, the biggest Britpop band of the 1990s, were back in action.
The avalanche of articles followed like they hadn’t in over 20 years: Oasis had undoubtedly reignited the fantasies of music magazines and publications that were otherwise scaling down in the face of rising operational costs. We’ve now seen over 20 NME articles, news on the BBC website, a revived radio documentary on BBC 6 Music, countless Rolling Stone thinkpieces, news in SPIN Magazine, the Manchester Evening News, gossip in the rags of the Sun, Mail, Metro. The mural in Manchester. The millions of people that tried to get tickets for the reunion dates that sold out in hours. It’s easy to be sick of it all, to think there wasn’t a band more overrated, overhyped or beloved than Oasis.
But let’s forget the hymns for a moment. Let us re-examine the appeal of the band before the myth: five boys from Manchester who believed in nothing more than the rock ‘n’ roll dream. And certainly, nothing less.
Cast your mind back to 1994, before the success and idolatry, before their songs would be turned into design-for-life anthems, before the band would be permanently woven into the fabric of British music history. Strip all that away and try to imagine hearing a then-relatively unknown Oasis for the first time. Imagine being told that half the band was not yet 22 years old, that they were a new band, releasing their third-ever single? Can you imagine, however simple it may have been lyrically, hearing Live Forever for the first time? In particular, just 4 months after Kurt Cobain’s suicide, after many fans were left feeling like they were staring at the definitive end of an era of honest independent music?
In 1994, Oasis were ’77’s punk all over again. Entering a landscape of artists (a term Liam Gallagher has derided) who internalised their music and recoiled at the notion of explicit success, Oasis were a brash rejection of shoegaze and indie’s philosophies, even going as far as to instruct the presenters of BBC Radio 1’s Evening Sessions to tell the world that Oasis were not an indie band. They were a rock ‘n’ roll band, and a band that dared to aim high, openly and with no apologies (all apologies for the pun). 
That was a philosophy they would live by until the bitter end, for better or worse. In a world of falling ambition and no hope, as Britain emerged ravaged by the Thatcher years to find there was nowhere left for its young to go, Oasis were determined to write their own destiny, largely for themselves, but invariably, for their entire generation.

... As he continued making games, Wright would become inspired by the postwar architect Christopher Alexander, whose 1977 book A Pattern Language became a cult manual for city design. It divided metropolitan life into modular elements—“SMALL PUBLIC SQUARES,” “GREEN STREETS,” “SHOPPING STREET”—and then instructed readers on how they should be combined. In this approach an environment became an almost mathematical operation: “Each pattern describes a problem which occurs,” Alexander writes, “and then describes the core of the solution to that problem, in such a way that you can use this solution a million times over, without ever doing it the same way twice.”
Maxis was acquired by EA in 1997; three years later Wright released The Sims, the ur-game, a simulation of humanity itself. In the same way that Alexander proposed curating infinite variety under a standardizing aegis, so could the components of The Sims be shuffled and toggled into ever-proliferating realities. Wright had lost his home in the Oakland firestorm of 1991, and has said that the original purpose of The Sims was to simulate the building and designing of houses. Indeed, the game maintains a lasting obsession with real estate. To play a family one must buy a home, and a home in The Sims is like a zen garden: obsessively tended to, an object of constant maintenance and contemplation. One can spend hours surveying possible wallpaper choices or creating a painstakingly gabled roof. In a 2022 oral history published by Vice, the franchise’s first art director, Charles London, said that The Sims was meant to be “an architecture game.” Little characters were added to “score” the design choices, only to eventually become the main feature and appeal.
Some commentators believe that The Sims is meant to satirize suburbia. “The boredom, the sterility, the uselessness and the futility of contemporary life,” writes the media scholar Alexander Galloway, “are depicted precisely using the things that represent it best: a middle-class suburban house, an Ikea catalogue of personal possessions, crappy food and even less appetizing music, the same dozen mindless tasks over and over.” Others have argued that the game is more sincere, a naif’s tribute to property ownership and what one gaming website calls its “beautiful scenery and idyllic backdrops.” There are listicles, Reddit threads, and YouTube channels dedicated to ranking and showcasing Sims mansions, guided by the same voyeurism as the tours of real houses in Architectural Digest.
But Wright, who left EA in 2009, did not give these manicured pixels a matching suburban ethos. A home in The Sims lacks the usual animating forces of family life. Intimacy between relatives is measured in points, increasing or decreasing without any given injury or kindness settling into a memory. A Sims home is not a haven or stage for emotions; it is only a system that challenges players to maintain its various parts. The game’s characters therefore never seem to experience the ongoing dramas of domesticity—neither its tender feelings nor its threat of betrayal, violence, resentment, dependency, scandal, and mutual ruination. As London put it, Sims characters, in their levels of happiness, signify the “efficient choices” a user makes in “object placement and room design.” The game, in effect, exports the density and urgency of the city and its management to the suburbs. The toilet, the refrigerator, and the bed are the chief fixtures of the game, meant to be visited in efficient choreographies of clicking.
This is, ultimately, less a narrative project than an ecological one. The Sims is about holistic relations, the quick and at times perilous responsiveness of one part of the whole to another. A Sim’s mood will plummet if her house is poorly decorated, or if she hasn’t taken the garbage out, or if, in an effort to learn a skill, she’s forgotten to fulfill a need. This kind of hair-trigger existence may explain the impulse that so many players cite of wanting to set their Sims on fire or drown them in swimming pools. Contra popular belief, these users are not behaving like psychopaths so much as feeling an understandable reflex toward entropy. One desires to see the system lurch into breakdown, to dash the finely made dollhouse into pieces...
... One helps a Sim by employing an algorithm, which is often the same thing as internalizing it. Far from providing a nostalgic refuge from the contemporary Internet, in other words, The Sims taps into one of the Web’s most foundational assumptions: that the processes of thinking and producing can be reduced to a series of commands. The user, in this view, becomes more creative as she becomes more machine-like. The rules allow her to manufacture possibilities; she is less an author employing technology for her own ends than an emitter of inputs, a conscript of the machine’s algorithmic logic.
Nowhere is that logic more apparent than in generative AI. At its most basic an algorithm is a set of instructions for achieving a designated result, such as the prompt that one might use to generate email text, say, or an atrocity photo in the style of Hayao Miyazaki. In 2018 Will Wright announced his first project in years, a game called Proxi, which has still yet to appear. In it, players will use AI to build animated scenes based on their memories, which they can then tweak and modulate as they wish.

Spring has sprung por Kevin Madore Por Flickr: The steam locomotives at Connecticut's Valley Railroad are typically inactive from January through March, while the railroad performs annual inspections and catches up on maintenance after the grueling holiday schedule that they run. The first event every spring is typically "Your Hand on the Throttle." This event provides an opportunity for railroad enthusiasts, who always wondered if they could handle running a steam locomotive, to actually do that under the close supervision of an experienced crew. These trips are typically operated with just a light locomotive (no cars behind), run between Essex and Chester Station. Patrons get some classroom instruction and then about an hour of actual throttle time. In this frame, we see Valley Railroad Mikado #40, making her way north on a "Your Hand" trip in April of 2009, passing by Pratt Cove, near Milepost 6.8. Pratt Cove is a nature preserve and fresh water tidal marsh. It's a favorite location with bird and nature photographers.

All five judges on Brazil’s Supreme Court panel voted last week to uphold a ban on Elon Musk’s social media platform X in the country, rendering the mobile app inaccessible to almost 212 million users in Brazil [note by the mod: the author probably mixed up - Brazil's total population is 212 million people, but its users amount to about 25 million].
Anatel, the telecommunications regulator of Brazil, instructed internet service providers to halt users’ access to the social media platform after X failed to appoint a legal representative in the South American country, a requirement for any foreign company wishing to operate in the country. A deadline had been set for August 29 by Supreme Court Justice Alexandre de Moraes.
After the deadline passed, de Moraes said in a statement: “Elon Musk showed his total disrespect for Brazilian sovereignty and, in particular, for the judiciary, setting himself up as a true supranational entity and immune to the laws of each country.”
Musk snapped back, calling de Moraes “an evil dictator” for shutting down the “#1 source of truth in Brazil”.
Judge de Moraes also issued a daily fine of 50,000 reals ($8,965) to be imposed on businesses and individuals in Brazil making use of virtual private networks (VPNs) to access X.
This is not the first time X has been banned by a country. China was the first country to ban the platform in June 2009 when it was still called Twitter, two days before the 20th anniversary of the Tiananmen Square massacre.

Know Your Judge: Considerations for When to File a Spoliation Motion
Prior posts have discussed sanctions generally, as well as decisions analyzing the particulars of the operative rules (see November 2024 and December 2023 posts), but today’s blog discusses considerations for when, during a litigation, is the proper time to file a spoliation motion.
District Judge Iain Johnston’s[1] decision in Groves, Inc. v R.C. Bremer Marketing Associates, et al.provides not only a helpful discussion of the issue but also a reminder that practitioners should understand each judge’s rules and preferences when appearing in court.
Background
Groves Inc. brought a spoliation motion against defendant Christopher Sheppard.
Specifically, movant alleged emails were spoliated and sought a permissive adverse inference jury instruction.
Plaintiff submitted the motion to the court and fully briefed it while proceeding with expert discovery, fact witness depositions, and awaiting dates for summary judgment or trial.
Although the court, paraphrasing Inspector Clouseau, held, “now is not the time to be filing a spoliation motion” and denied the motion without prejudice, it provided a useful discussion on the timing of filing spoliation motions.
The court noted it has been presented with Rule 37(e) motions at various stages of an action: during discovery; in the middle of summary judgment briefing, requiring the briefing to be stayed while the spoliation issue was resolved; in the form of a motion in limine after the issue was raised during summary judgment; and in the middle of trial. It noted there are instances when the filing is too early or too late, and noted “there’s a sweet spot when the filing of the spoliation motion is just right. But determining that sweet spot will vary depending on the specific facts presented as well as the judge who decides the motion.” Finding that sweet spot, the court indicated, requires “a conversation” where counsel notifies “the court and opposing counsel as soon as possible about a spoliation concern and calmly and professionally talk[s] to them about the most reasonable and best options to address the concern,” notwithstanding that “some counsel view assertions of spoliation as a declaration of war.”
The court then specifically addressed the filing timing of such motions, providing guidance on tardy spoliation motions (collecting cases), premature spoliation motions (collecting cases) and, importantly, the best time to file spoliation motions.
Tardy Spoliation Motions
Referencing what the court deemed the leading opinion regarding tardy spoliation motions (Goodman v. Praxair Servs.), it noted that spoliation motions should be “filed as soon as reasonably possible after discovery of the facts that underlie the motion.”
[2] In Goodman, a 2009 case, Judge Grimm identified five factors courts should consider in determining if a spoliation motion is tardy: “how long after the close of discovery the relevant spoliation motion has been made,” the “temporal proximity between a spoliation motion and motions for summary judgment,” whether the spoliation motion was made on the eve of trial, whether a Rule 16 scheduling order or local rule set a deadline for filing spoliation motions, and the moving party’s explanation of why the spoliation motion was not filed earlier.
The first factor was described as the “key.”
The second factor assumes generally that spoliation motions should be made before summary judgment motions are filed. [3] Regardless of the factors, the court said, the ultimate question in determining whether a spoliation motion is tardy is whether the requested relief sought was made without unreasonable delay.
The court then noted that Groves’ motion was not tardy.
Rather, the concern was whether it was premature.
The court then turned its attention to discussing premature spoliation motions.
Premature Spoliation Motions
According to the court, “counsel can also jump the gun” and file spoliation motions too early – i.e., when the movant doesn’t have sufficient facts.
An obvious example is filing a spoliation motion before discovery has been served and responded to.
Less obvious but more common is filing spoliation motions under Rule 37(e) when the movant hasn’t yet established that the electronically stored information (ESI) cannot be restored or replaced – a prerequisite to obtaining relief under Rule 37(e).
However, assuming it has been established that the spoliated ESI can’t be restored or replaced, the court noted that “other factors impact the appropriate timing of spoliation motions.”
For example, the existence and proximity of case management deadlines; whether fact discovery is closed; whether amended pleadings are still permitted; whether a trial date has been set, and whether the parties are still in pretrial discovery and not near the date for filing summary judgment motions.[4]
Another critical factor to consider is the likely remedy – whether it be a corrective measure or a sanction – that the moving party anticipates seeking, which informs consideration of the best time for the motion.
For example, a party seeking to extend or reopen discovery should file a spoliation motion before discovery closes or as soon as possible thereafter.
Alternatively, if a party anticipates seeking evidentiary remedies, filing the spoliation motion before or with the summary judgment motion might make more sense.
Another critical factor is whether an evidentiary hearing will be necessary to resolve factual disputes relating to the spoliation.
Analysis
Against these guideposts, the court analyzed the facts before it, noting the timing was appropriate since parties were conducting fact discovery; Movant did not allege it could not proceed with expert discovery as a result of the spoliation; there would be no prejudice to defendant Shepperd if the spoliation issue is decided later, given Groves sought a permissive adverse inference jury instruction as relief (noting that trial was a long way off with “off-ramps for this action before a jury trial,” possibly including settlement and summary judgment).
Rather than expend resources on a spoliation motion at this time when they could be used elsewhere, the court denied the motion without prejudice, assuring the movant it had not waived the issue because it was timely raised and brought to the attention of Shepperd and the court.
It further noted no party would be prejudiced by deferring the issue under the facts of this case, including the fact that the specific relief sought was a permissive adverse jury instruction.
Rather, the parties, the court, and other litigants seeking access to the court’s resources “will benefit by holding the issue in abeyance until it needs to be decided.”
And the court directed that “[a]fter the close of all discovery, if any of the parties intend on moving for summary judgment, Groves [could] take up the issue with the Court during its summary judgment prefiling conference.”[5]
Conclusion
There are several important lessons within this decision, including the importance of engaging counsel in a cooperative way to resolve issues before rushing to motion practice.
Additionally, sanctions motions are fact-intensive, costly to brief, and a potential drain on judicial and party resources.
Litigants should evaluate the Goodman factors and give thought to the best time to bring a sanctions motion so it isn’t waived, but also is resolved efficiently.
And, critically, know your judge.
Understand the judge’s rules, preferences, and prior decisions.[6]
[1] Those familiar with Judge Johnston’s writing understand he often includes humor, interesting quotes, and practical application to his decisions. This decision follows course, beginning with “This Court attracts Rule 37(e) motions like chum attracts sharks. (So—yes—in this simile, the Court is fish guts and fish heads.)”
[2] Retired Judge Grimm listed several reasons why spoliation issues should be raised with the court as soon as practicable: the motions are “fact intensive, can require extensive evidentiary hearings, can disrupt the timing of the rest of the case (with significant costs resulting to the parties and the court), and the remedy sought or provided can significantly affect the case.” Id. at 508.
[3] Although a 2023 case (National Fair Housing All v. Bank of America, N.A.) explicitly added prejudice as a sixth Goodman factor, the court noted that implicit in some of the Goodman factors is the concept of prejudice.
For example, a spoliation motion that would alter summary judgment briefs and the court’s ruling “would result in significant wasted resources.
Similarly, making a spoliation motion on the eve of trial can completely derail the scheduled trial, which—again—prejudices the non-movant, the court, and the other litigants who are seeking to have their actions resolved.”
[4] The court noted that while there are excellent reasons for delaying a decision on alleged spoliation, a “movant’s desire to obtain a ruling that it can use as settlement leverage is not on the list of excellent reasons.”
[5] The court noted if movant felt the “spoliation issue will not affect the summary judgment briefing, the Court will defer the issue until resolution of any summary judgment motions. If, however, it believes that the spoliation issue will affect any summary judgment briefing, it should inform the Court during the summary judgment prefiling conference so that the issue can be addressed in the most efficient way. If the case bypasses the seemingly obligatory summary judgment process and proceeds directly to a jury trial, then the Court will address the issue of an adverse jury instruction by way of a motion in limine with the final pretrial order.”
[6] Judge Johnston notes in the decision, “Strangely, in places, the parties take certain positions regarding Rule 37(e), ignoring the Court’s previous extensive decisions concerning Rule 37(e) motions.

But one would think that rather than completely ignoring this Court’s orders directly on point and citing other district court decisions – which are likewise not precedential – the parties would at least address these decisions and attempt to distinguish them.

Adding the tank covers saved CCAD tens of thousands of exhaust being needlessly exhausted and tremendous amounts of energy savings. The project was successfully completed and handed over to the government in 2005.
Later in 2005, Precision Machine of Savannah contacted PDG looking for an anodizing line to be built and installed in their facility in Savannah, GA. PDG went a step further and offered PMS a manual anodizing line constructed with semi-automatic tank covers opened and closed by push button by their operators on the tank line. PDG also provided and installed a closed looped waste water treatment system including a DI water system and holding tank. Once handed over to PMS, They were able to bring their anodizing needs under their own roof and control the flow of their work for their customers.
In 2009 PDG offered the DOD through the Air Force a bid for the supply and installation of a small arms plating facility to be installed in Camp Tami, Iraq. PDG was awarded the contract and Richard flew to Baghdad to be ushered into Camp Taji to kick off the project with a site inspection and walk through.
In 2011, PDG installed the small arms plating facility including Type I,II and III anodizing processes.
In 2012, PDG was awarded a purchase order to install a semiautomatic chemical etch line for a DOD Contractor, which PDG provided a series of polypropylene chemical tanks and semiautomatic tank covers for the line.
In 2015, PDG was awarded with a purchase order for an automated anodizing line for a large aerospace vendor in a new facility in Orangeburg, SC. PDG provided an automated overhead hoist with several process tanks, including wastewater treatment system and holding tanks.
