The Rights of Non-Muslims Under Sharia Law
Tumblr media
Sharia law is often misunderstood, especially regarding its treatment of non-Muslims. However, the Sharia has a rich tradition of pluralism, allowing non-Muslims such as Christians and Jews to follow their own laws while living in Muslim-majority societies.
1. Pluralism Under Sharia: A Historical Perspective
Sharia law is not a monolithic system but rather a framework that has historically embraced justice. Within Islamic societies, non-Muslims, particularly “People of the Book” (Christians and Jews), were allowed to practice their religion freely and follow their own legal systems concerning personal matters like marriage, divorce, and inheritance.
“Let there be no compulsion in religion: Truth stands out clear from Error.” (Quran 2:256)
This verse underscores that faith is a personal choice and that people should be allowed to practice their religion without coercion.
2. Dhimmi Status: Protection, Responsibilities, and Benefits
Non-Muslims living under Islamic rule were given the status of “dhimmi,” which granted them protection and certain rights in exchange for the payment of jizya, a tax levied on non-Muslim citizens. The jizya was not merely a tax but a means to ensure the safety and protection of non-Muslims in a Muslim-majority state. It also exempted them from military service, which was obligatory for able-bodied Muslim men.
A lesser-known aspect of the jizya is that it also contributed to providing pensions and other benefits to non-Muslims. This system ensured that non-Muslims were cared for in the state, particularly in old age or during times of need.
The Prophet Muhammad (peace be upon him) emphasised the sanctity of the protection given to non-Muslims:
“Whoever kills a mu’ahid (a person who is granted the pledge of protection by the Muslims) shall not smell the fragrance of Paradise…” (Sahih Bukhari 3166)
“If somebody harms a disbeliever that’s living under the protection of the Muslims, they have harmed me; if they have harmed me, they have harmed God.” — Prophet Muhammed, Peace be Upon him
Islamic law does not allow for double standards when it comes to justice. Non-Muslims have the right to seek justice if they are wronged by a Muslim. Historical examples show that even the highest leaders, like Caliph Ali and Caliph Umar ibn Abdulaziz, upheld the rights of non-Muslims, ensuring that justice was served when a non-Muslim was wronged.
For instance, during Caliph Ali’s time, a Muslim who killed a non-Muslim was brought to justice, and the non-Muslim’s family was given the choice to demand the death penalty or accept compensation. Islamic Governance made sure everyone was responsible for their actions and justice was served.
3. Legal Autonomy: Non-Muslims and Their Laws
One of the most remarkable aspects of the Sharia’s application is its respect for the legal autonomy of non-Muslim communities. Non-Muslims were allowed to maintain their religious laws and customs in matters of personal status. This legal pluralism was practiced in various Islamic states, where Christian, Jewish, and other religious communities had their courts and legal systems.
“To each among you, We have prescribed a law and a clear way…” (Quran 5:48)
4. The Role of Jizya in Social Welfare
Non-Muslims under Sharia law were required to pay a tax called jizya (often being lower than the 2.5% tax on the wealth of Muslims paid towards charity yearly). However, this tax was a system that provided benefits, including protection and exemption from military service and those who would be burdened to pay it were exempted from paying it. Furthermore, certain groups, such as Christian monks who dedicated their lives to worship, were even exempted from paying the jizya, showing the flexibility and fairness of the system.
In contrast to modern taxation, where everyone must contribute regardless of their role in society, Islamic law recognised the unique circumstances of different communities and adjusted its requirements accordingly.
The Jizya was used not only for the administration and protection of the state but also to provide pensions and social services and support for those in need, including the elderly and disabled non-Muslims. This practice ensured that non-Muslims were not only protected but also cared for, reflecting the Islamic commitment to justice.
“O you who have believed, be persistently standing firm for Allah, witnesses in justice, and do not let the hatred of a people prevent you from being just. Be just; that is nearer to righteousness.” (Quran 5:8)
The positive effects of this system can be seen during the time of Umar ibn Abd-Alaziz, poverty was wiped out, justice was deeply woven into the society and the animals were fed with the surplus food and wealth as they were seen as also a part of the responsibilities of the Caliph.
There are numerous historical examples of Islamic leaders advocating for the rights of non-Muslims. For instance, the scholar Taqi al-Din famously negotiated with the Tartar leaders to secure the release of both Muslim and non-Muslim prisoners of war, demonstrating that Islamic justice extends beyond the Muslim community.

To focus on something I couldn’t give the space it deserved in the previous post: I think it is possible to have a political system which is in theory very liberal in the classical sense but which in practice is not very liberal at all, and this goes to what some critics have pointed out as the tendency of liberalism to have CB of contradictions in its practical application.
A society without any kind of worker protection, old age pension, or anti discrimination laws, and with very low taxes, might legally be very liberal in the classics sense; but for individual workers and consumers it might be a society without much meaningful choice: one of company towns and stores, where most cannot afford an education or healthcare, and where bosses have intrusive control over employees’ private lives, to say nothing of whatever ambient social prejudices (like those of gender and race) might go unaddressed in workplaces. Moreover, because inequality in wealth will pretty much always tend to produce inequality in political power, even if on paper the society is very democratic, it will likely not function in a very democratic way.
Most western countries basically recognize this and have converged on what are a pretty extensive body of rules which are in principle illiberal—in that they strongly constrain individual rights and how firms behave—in the interest of broader social aims which are nevertheless pretty liberal in spirit: anti discrimination law, environmental law, welfare programs, disability law, anti monopoly statues, consumer protection law, and so forth. Outside the really hardcore libertarians (who are a small constituency), these rules seem broadly popular, with most political fights on the subject being focused on their details, not their existence.
The thing that I think a lot of socialists broadly construed have noticed is that this is still fundamentally a contradiction, just a contradiction of a different kind. And many critics of liberalism hold, essentially, that it simply doesn’t go far enough—and some flavor of socialism (pick your favorite) can deliver on the fundamental premise we’re aiming for (I.e., general welfare and individual freedom) better than a messy kludge applied over the top of capitalism.
I think the uncomfortable truth is that the line between Real Socialism and liberal capitalism with a social-democratic patch on it isn’t actually totally hard and fast—once you get below a certain GINI coefficient and above a certain HDI I think you’re splitting metaphysical hairs. But this is an indictment of the inherent virtue of capitalism as much as it is the One True Socialism that has Never Been Tried—if you have to do heavily adulterate capitalism that it barely qualifies as such anymore, it must be contributing very little virtue indeed to the final outcome.

You aren't automatically granted a citizenship. There are a ton of steps you have to take. He might have applied but doesn't mean he will get it.
>>It also takes a really long time to get a green card too.
Harry would've entered the US on a spousal visa (like Meghan had in the UK) but to stay here permanently, he would've needed to "upgrade" his visa to a green card, which essentially a permanent residence status. You do have to be here for awhile before you can apply for a green card. I heard once it was 3-5 years but I really don't know.
And don't forget, Harry first moved to the US during the COVID lockdowns. There's a HUGE backlog of immigration paperwork because the courts (which process immigration) and the State Department (which processes the visas) were shutdown or scaled back.
My theory is that Harry's here on a diplomatic passport or used his diplomatic status as Elizabeth's grandson/Charles's son to cut through the red tape and jump a lot of queues. That's why we haven't heard anything about his immigration status. (And why we never heard anything about Meghan's immigration status while she was in the UK other than "she's keen to follow the law".)
And as for his drug use, it is a no-no and it could cause him to be deported or have his green card/residency application denied. Doesn't matter if it's past/prior use or current use. The main reason for that disqualifier is the social welfare that a drug addict may need from the state and the US not wanting to add more people to an overloaded social system if they can avoid it. Same thing for criminals/felonies - if convicted, you'll be deported so we don't have to spend more money on you.
Will Harry be deported over his drug use and illegal burial? No. He's got diplomatic protection by being King Charles's son. He's also benefiting from male white privilege and he's "wealthy" so at most he'll pay a fine and that'll be it.
Okay this is what I thought.
Thank you for taking the time to write it out. I was too lazy to look it up for myself but I have friends who became US citizens and it took YEARS.
I always figured he has some sort of diplomatic status and I imagine if he did want to become a US citizen some red tape would be cut.

Company formation in Bangladesh
Tumblr media
Company formation in Bangladesh is governed by the Companies Act, 1994, and regulated by the Registrar of Joint Stock Companies and Firms (RJSC). Foreign investors typically establish a Private Limited Company (Ltd), which allows limited liability and separate legal status. Up to 100% foreign ownership is allowed in most sectors.
Key steps include reserving a company name with RJSC and preparing the Memorandum of Association (MOA) and Articles of Association (AOA). Once the incorporation documents are submitted, RJSC issues a Certificate of Incorporation, providing the company with a legal identity and registration number.
After incorporation, the company must obtain a Tax Identification Number (TIN) from the National Board of Revenue (NBR) and register for Value Added Tax (VAT) if applicable. Opening a corporate bank account and complying with capital contribution requirements are essential. Depending on the industry, additional licenses or permits may be required. For employing staff, companies must also register with the Social Security and Welfare Fund and adhere to local labor laws.

Exploring the Benefits of Replacing a Birth Certificate
Tumblr media
A birth certificate is one of the most significant documents a person can possess. As an official record of your birth, it proves your identity, nationality, and family heritage. However, life can sometimes take unexpected turns—whether you misplace it during a move, it gets damaged, or you're asked for a copy when you least expect it. In such situations, obtaining a replacement birth certificate becomes crucial.
This article will explore the numerous benefits of replacing a birth certificate, outlining the importance of having this document ready and available for various legal, personal, and official purposes.
Why Birth Certificates Are Essential
Before delving into the advantages of obtaining a replacement birth certificate, it’s essential to understand the significance of this document. Birth certificates serve as the foundational proof of identity for everyone. They include vital details such as the individual’s full name, date of birth, place of birth, and parentage.
Birth certificates are needed for several purposes:
Identification: Whether applying for a job, enrolling in school, or opening a bank account, proof of identity is often required. A birth certificate is one of the most widely accepted forms of identification.
Citizenship and Nationality: Birth certificates are crucial in proving citizenship, especially when applying for a passport or any other government-issued identification. They confirm your status as a citizen and give you access to your country’s rights and privileges.
Government Benefits: Whether it's social security, healthcare, or welfare benefits, most government agencies require a birth certificate as proof of age and identity.
Legal Matters: In legal disputes related to inheritance, custody, or guardianship, birth certificates may be used to establish relationships between family members and verify a person's identity.
Given these essential uses, it's evident that having a birth certificate is crucial for day-to-day functioning. However, if the document is lost or damaged, you may face significant hurdles in completing various tasks. Replacing a birth certificate can alleviate these issues and provide multiple benefits.
Benefits of Replacing a Birth Certificate
1. Ensuring Access to Vital Services
One of the most important benefits of obtaining a replacement birth certificate is ensuring you have access to crucial services. Many essential services—such as healthcare, education, and legal assistance—require proof of identity and citizenship, which is most commonly verified using a birth certificate.
For instance, if you're planning to enroll your child in school, a birth certificate is usually required to prove their age and citizenship. Similarly, applying for health insurance or other government benefits typically requires a certified birth certificate. Without it, you may face delays or even rejection of these services.
Having a replacement birth certificate ensures that you always have access to the services and benefits you and your family need, avoiding unnecessary stress or inconvenience.
2. Facilitating Travel and Passport Applications
If you plan to travel internationally, you’ll need a passport, and obtaining one requires a valid birth certificate. A lost or damaged birth certificate can delay your passport application, potentially ruining travel plans.
Additionally, some countries require parents traveling with children to carry birth certificates as proof of the child’s identity and parentage. This is especially true for single parents or guardians who may need to prove their relationship with the child when crossing borders. Having a replacement birth certificate can make this process smoother and prevent complications at immigration checkpoints.
In this regard, replacing a birth certificate is an essential step for anyone planning to travel, ensuring that all documentation is in order.
3. Supporting Legal Processes and Documentation
Birth certificates play a critical role in various legal matters. They may be required when:
Settling estates: In cases of inheritance or estate settlement, birth certificates help establish relationships between the deceased and the heirs.
Applying for custody or guardianship: When dealing with custody or guardianship matters, birth certificates help verify the relationships between children and parents or guardians.
Adoption processes: Birth certificates are essential in adoption cases to formalize the identity of the adopted child and their new family ties.
Marriage applications: Many countries require individuals to present birth certificates when applying for marriage licenses to confirm their age and legal eligibility.
Having a replacement birth certificate in these scenarios can expedite legal processes, prevent delays, and ensure that all necessary documentation is in place.
4. Simplifying Employment Applications
When applying for a job, employers often request proof of identity and citizenship to confirm that the applicant is eligible to work. While passports and driver’s licenses are commonly used for this purpose, birth certificates remain a valid and frequently requested form of identification, especially for those without passports or other government-issued documents.
If you’re asked to provide a birth certificate during the hiring process, not having one available could delay or even jeopardize your employment opportunities. By obtaining a replacement birth certificate, you can ensure that you’re fully prepared when job opportunities arise, simplifying the application process and avoiding unnecessary setbacks.
5. Securing Government Benefits
Social security, pensions, and other government programs require individuals to present birth certificates to verify their age and eligibility for benefits. For example:
Retirement and pension benefits: A birth certificate may be needed to confirm your age when applying for retirement benefits, ensuring you qualify for the appropriate benefits at the right time.
Social security and disability benefits: Birth certificates are also required when applying for social security or disability benefits, proving your identity and establishing your eligibility.
Medicare and Medicaid: Birth certificates are often used to verify identity when applying for healthcare programs like Medicare and Medicaid.
Replacing a lost or damaged birth certificate ensures that you and your family have access to the benefits you’re entitled to without facing unnecessary delays or denials.
6. Protecting Against Identity Theft
In today’s digital age, identity theft has become a growing concern. When sensitive documents like birth certificates are lost or stolen, they can fall into the wrong hands, leading to cases of identity fraud. Criminals can use stolen birth certificates to open bank accounts, apply for loans, or even commit fraud in someone else’s name.
By obtaining a replacement birth certificate, you not only regain control over your personal information but also protect yourself from potential identity theft. It’s advisable to report any lost or stolen birth certificates to the relevant authorities and request a replacement as soon as possible to mitigate any risks.
7. Peace of Mind
Finally, one of the most important benefits of replacing a birth certificate is the peace of mind that comes with knowing you have access to this critical document whenever you need it. Life can be unpredictable, and having your birth certificate on hand—whether for legal matters, travel, or government services—can prevent unnecessary stress and provide a sense of security.
By replacing a lost or damaged birth certificate, you can rest assured that you’re prepared for any situation that may require proof of your identity or citizenship.
Replacing a birth certificate offers numerous benefits, from ensuring access to vital services to facilitating legal and travel processes. This essential document is a cornerstone of personal identification, and without it, you may face unnecessary delays, complications, or even missed opportunities. Whether for job applications, government benefits, or securing your family’s future, having a replacement birth certificate can save you time, money, and stress.
If your birth certificate is lost, damaged, or outdated, it’s well worth the effort to obtain a replacement. Not only does it ensure that you’re ready for whatever life throws your way, but it also gives you the peace of mind that comes with being prepared.

How to Register a Section 8 Company: A Complete Overview
Tumblr media
In India, a Section 8 company is a special category of non-profit organization established under the Companies Act, 2013. Designed for promoting charitable purposes such as education, social welfare, religion, and health, a Section 8 company provides a structured and legally recognized way to operate for public benefit without the intent of profit distribution. This article provides a detailed overview of the registration process, helping you navigate the steps to establish your own Section 8 company.
1.Section 8 Company
A Section 8 company registration is distinct from other business entities due to its non-profit nature. Its primary characteristics include:
-Charitable Objective: The company must be formed for promoting charitable activities or social welfare, without any intention of distributing profits to members.
-Tax Exemptions: Section 8 companies are eligible for certain tax benefits under the Income Tax Act, 1961, which can be advantageous for organizations relying on donations and grants.
-Regulatory Requirements: These companies must adhere to strict regulatory standards, including annual reporting and auditing, to maintain transparency and accountability.
2.Eligibility Criteria
To register a Section 8 company, ensure your organization meets the following criteria:
-Purpose: The company’s primary objective should be charitable, such as promoting education, health, or social causes.
-Profit Distribution: Profits must be used for the company’s objectives and not distributed among members.
-Minimum Members: A private Section 8 company requires at least two members, while a public Section 8 company needs at least seven.
3.Name Reservation
Choosing a suitable name for your Section 8 company is crucial:
-Descriptive Name: The name should clearly reflect the charitable nature of the organization.
-Unique and Non-resemblance: Ensure the name is unique and does not resemble any existing company names.
-Suffix: It should include “Section 8 Company” to denote its non-profit status.
You can reserve the company name through the Ministry of Corporate Affairs (MCA) portal by filing the SPICe+ form or using the RUN (Reserve Unique Name) service.
4.Obtain Digital Signature Certificate (DSC) and Director Identification Number (DIN)
For the registration process, you will need:
-Digital Signature Certificate (DSC): Required for signing electronic documents. Obtain DSCs for all proposed directors of the company.
-Director Identification Number (DIN): Each director must have a valid DIN, which can be obtained by applying through the MCA portal by providing necessary identification and address proof.
5.Drafting the Memorandum and Articles of Association
Two crucial documents for incorporation are:
-Memorandum of Association (MoA): This document outlines the company’s objectives, which must align with charitable purposes. It includes the company’s name, registered office address, and the nature of its activities.
-Articles of Association (AoA): This document details the rules for the company’s internal management. The AoA should be consistent with the MoA and the provisions governing Section 8 companies.
6.Filing the Registration Documents
To proceed with registration, file the necessary documents with the Registrar of Companies (RoC):
-SPICe+ Form: The single-window application for incorporation. It includes details about the company, its directors, and the registered office.
-Attachments: Provide identification and address proofs of directors, DSCs, DINs, MoA, AoA, and a declaration from professionals.
7.Applying for a Section 8 License
Alongside the incorporation documents, apply for a Section 8 license:
-Form INC-12: This form is used to request a license under Section 8 of the Companies Act.
-Supporting Documents: Include a detailed description of the proposed activities, financial projections, and evidence of the company’s charitable objectives.
8.Verification and Issuance of Certificate
The RoC will review the submitted documents and, if satisfied, grant the Section 8 license. This process may take several weeks. Once approved, the RoC will issue:
-Certificate of Incorporation: Official confirmation of the company’s formation.
-Section 8 License: Authorizes the company to operate as a non-profit organization.
9.Post-Incorporation Compliance
After registration, ensure ongoing compliance:
-Obtain PAN and TAN: These are necessary for tax purposes and for deducting tax at source.
-Open a Bank Account: In the company’s name to handle financial transactions.
-Annual Filings: Submit annual financial statements and compliance reports to the RoC.
-Tax Returns: File income tax returns and adhere to other applicable tax regulations.
10.Seek Professional Guidance
Given the complexity of the registration process, consulting professionals can be highly beneficial:
-Legal Advisors: Assist with drafting and filing documents and ensuring compliance with legal requirements.
-Accountants: Provide guidance on tax implications and financial record-keeping.
-Company Secretaries: Help with regulatory compliance and corporate governance.
Conclusion
Registering a Section 8 company is a significant step towards establishing a non-profit organization dedicated to charitable causes. By following the outlined process—from the requirements to ensuring ongoing compliance—you can successfully set up your Section 8 company and make a meaningful impact.
