NLRB rules that any union busting triggers automatic union recognition

American support for unions is at its highest level in generations, from 70% (general population) to 88% (Millenials) – and yet, American unionization rates are pathetic.
That's about to change.
The National Labor Relations Board just handed down a landmark ruling – the Cemex case – that "brought worker rights back from the dead."

At issue in Cemex was what the NLRB should do about employers that violate labor law during union drives. For decades, even the most flagrantly illegal union-busting was met with a wrist-slap. For example, if a boss threatened or fired an employee for participating in a union drive, the NLRB would typically issue a small fine and order the employer to re-hire the worker and provide back-pay.
Everyone knows that "a fine is a price." The NLRB's toothless response to cheating presented an easily solved equation for corrupt, union-hating bosses: if the fine amounts to less than the total, lifetime costs of paying a fair wage and offering fair labor conditions, you should cheat – hell, it's practically a fiduciary duty:

Enter the Cemex ruling: once a majority of workers have signed a union card, any Unfair Labor Practice by their employer triggers immediate, automatic recognition of the union. In other words, the NLRB has fitted a tilt sensor in the American labor pinball machine, and if the boss tries to cheat, they automatically lose.
Cemex is a complete 180, a radical transformation of the American labor regulator from a figleaf that legitimized union busting to an actual enforcer, upholding the law that Congress passed, rather than the law that America's oligarchs wish Congress had passed. It represents a turning point in the system of lawless impunity for American plutocracy.
In the words of Frank Wilhoit, it is is a repudiation of the conservative dogma: "There must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect":

It's also a stunning example of what regulatory competence looks like. The Biden administration is a decidedly mixed bag. On the one hand there are empty suits masquerading as technocrats, champions of the party's centrist wing (slogan: "Everything is fine and change is impossible"):

But the progressive, Sanders/Warren wing of the party installed some fantastically competent, hard-charging, principled fighters, who are chapter-and-verse on their regulatory authority and have the courage to use that authority:

They embody the old joke about the photocopier technician who charges "$1 to kick the photocopier and $79 to know where to kick it." The best Biden appointees have their boots firmly laced, and they're kicking that mother:

One such expert kicker is NLRB General Counsel Jennifer Abruzzo. Abruzzo has taken a series of muscular, bold moves to protect American workers, turning the tide in the class war that the 1% has waged on workers since the Reagan administration. For example, Abruzzo is working to turn worker misclassification – the fiction that an employee is a small business contracting with their boss, a staple of the "gig economy" – into an Unfair Labor Practice:

She's also waging war on robo-scab companies: app-based employment "platforms" like Instawork that are used to recruit workers to cross picket lines, under threat of being blocked from the app and blackballed by hundreds of local employers:

With Cemex, Abruzzo is restoring a century-old labor principle that has been gathering dust for generations: the idea that workers have the right to organize workplace gemocracies without fear of retaliation, harassment, or reprisals.
But as Harold Meyerson writes for The American Prospect, the Cemex ruling has its limits. Even if the NLRB forces and employer to recognize a union, they can't force the employer to bargain in good faith for a union contract. The National Labor Relations Act prohibits the Board from imposing a contract.
That's created a loophole that corrupt bosses have driven entire fleets of trucks through. Workers who attain union recognition face years-long struggles to win a contract, as their bosses walk away from negotiations or offer farcical "bargaining positions" in the expectation that they'll be rejected, prolonging the delay.
Democrats have been trying to fix this loophole since the LBJ years, but they've been repeatedly blocked in the senate. But Abruzzo is a consummate photocopier kicker, and she's taking aim. In Thrive Pet Healthcare, Abruzzo has argued that failing to bargain in good faith for a contract is itself an Unfair Labor Practice. That means the NLRB has the authority to act to correct it – they can't order a contract, but they can order the employer to give workers "wages, benefits, hours, and such that are comparable to those provided by comparable unionized companies in their field."
Mitch McConnell is a piece of shit, but he's no slouch at kicking photocopiers himself. For a whole year, McConnell has blocked senate confirmation hearings to fill a vacant seat on the NLRB. In the short term, this meant that the three Dems on the board were able to hand down these bold rulings without worrying about their GOP colleagues.
But McConnell was playing a long game. Board member Gwynne Wilcox's term is about to expire. If her seat remains vacant, the three remaining board members won't be able to form a quorum, and the NLRB won't be able to do anything.
As Meyerson writes, centrist Dems have refused to push McConnell on this, hoping for comity and not wanting to violate decorum. But Chuck Schumer has finally bestirred himself to fight this issue, and Alaska GOP senator Lisa Murkowski has already broken with her party to move Wilcox's confirmation to a floor vote.
The work of enforcers like DoJ Antitrust Division boss Jonathan Kanter, FTC chair Lina Khan, and SEC chair Gary Gensler is at the heart of Bidenomics: the muscular, fearless deployment of existing regulatory authority to make life better for everyday Americans.
But of course, "existing regulatory authority" isn't the last word. The judges filling stolen seats on the illegitimate Supreme Court had invented the "major questions doctrine" and have used it as a club to attack Biden's photocopier-kickers. There's real danger that Cemex – and other key actions – will get fast-tracked to SCOTUS so the dotards in robes can shatter our dreams for a better America.
Meyerson is cautiously optimistic here. At 40% (!), the Court's approval rating is at a low not seen since the New Deal showdowns. The Supremes don't have an army, they don't have cops, they just have legitimacy. If Americans refuse to acknowledge their decisions, all they can do it sit and stew:

The Court knows this. That's why they fume so publicly about attacks on their legitimacy. Without legitimacy, they're nothing. With the Supremes' support at 40% and union support at 70%, any judicial attack on Cemex could trigger term-limits, court-packing, and other doomsday scenarios that will haunt the relatively young judges for decades, as the seats they stole dwindle into irrelevance. Meyerson predicts that this will weigh on them, and may stay their hands.
Meyerson might be wrong, of course. No one ever lost money betting on the self-destructive hubris of Federalist Society judges. But even if he's wrong, his point is important. If the Supremes frustrate the democratic will of the American people, we have to smash the Supremes. Term limits, court-packing, whatever it takes:

And the more we talk about this – the more we make this consequence explicit – the more it will weigh on them, and the better the chance that they'll surprise us. That's already happening! The Supremes just crushed the Sackler opioid crime-family's dream of keeping their billions in blood-money:

But if it doesn't stop them? If they crush this dream, too? Pack the court. Impose term limits. Make it the issue. Don't apologize, don't shrug it off, don't succumb to learned helplessness. Make it our demand. Make it a litmus test: "If elected, will you vote to pack the court and clear the way for democratic legitimacy?"
Meanwhile, Cemex is already bearing fruit. After an NYC Trader Joe's violated the law to keep Trader Joe's United from organizing a store, the workers there have petitioned to have their union automatically recognized under the Cemex rule:

With the NLRB clearing the regulatory obstacles to union recognition, America's largest unions are awakening from their own long slumbers. For decades, unions have spent a desultory 3% of their budgets on organizing workers into new locals. But a leadership upset in the AFL-CIO has unions ready to catch a wave with the young workers and their 88% approval rating, with a massive planned organizing drive:

Meyerson calls on other large unions to follow suit, and the unions seem ready to do so, with new leaders and new militancy at the Teamsters and UAW, and with SEIU members at unionized Starbucks waiting for their first contracts.
Turning union-supporting workers into unionized workers is key to fighting Supreme Court sabotage. Organized labor will give fighters like Abruzzo the political cover she needs to Get Shit Done. A better America is possible. It's within our grasp. Though there is a long way to go, we are winning crucial victories all the time.
The centrist message that everything is fine and change is impossible is designed to demoralize you, to win the fight in your mind so they don't have to win it in the streets and in the jobsite. We don't have to give them that victory. It's ours for the taking.

“Have I ever told you how much I love your hair at this length?”
Jungkook hisses under his breath, narrowly avoiding death from a flank-attack and managing to get cover to recoup before diving back into the match. “No?”
“Really?” Y/N muses in a shocked voice behind him, lightly touching his shoulders. Jungkook bites his lip to concentrate on what’s happening in game, the hair on the back of his neck tingling.
Y/N was dropped off here for the day because her parents had to go out of town for some or other social gathering. Jungkook remembers waiting for her by the front door, respectfully bowing his head when her father gave him a curt nod.
He remembers how his stomach fluttered when she turned to him with the biggest grin after hugging her mother goodbye, half-jogging toward him before throwing her arms around his neck in a tight, excited hug.
He remembers the way he patted her back and smiled sheepishly at her parents from over her shoulder, hoping they were too far away to notice the blush on his cheeks.
“Yeah. I think you might’ve commented on how long it’s gotten since summer started, but otherwise you haven’t said much.” Jungkook groans and throws his head back between your knees, a frustrated sigh leaving his lips. That’s his sixth loss in a row.
Y/N gives him a pitying tut, using her hand on the back of his neck to gently lift his head, completely oblivious to the intense inner-rumblings of Jungkook’s wolf. She bring her hands up into his hair, dragging her fingers through the silky strands…gently tugging knots loose and running her nails over his scalp.
Jungkook’s shoulders relax and he closes his eyes with a breathy little sigh, his controller going slack in his lap.
Y/N giggles knowingly. “I really do love your hair at this length, you know. It’s nice when it’s long.”
“Mmm…” Jungkook hums distractedly, his eyebrows scrunching together at just how nice it feels to have her hands in his hair. “Why’s it…nice?”
He thinks she shrugs. “Can play with it better when it’s long.”
A smirk pulls the corners of his lips up. “Head out your ass, Kook.”
Jungkook can’t help but laugh. “Sorry. I’ll keep my hair at this length forever if you like playing with it, though. S’really nice,” he mumbles, leaning back into the couch and sighing contentedly.
She continues her ministrations with a quiet hum. “Can I tie it up for you later? Wanna see if I can get it into a ponytail.”
“It’s not that long,” Jungkook pouts, eyes still closed.
“Probably not, but it wouldn’t hurt to try.”
Jungkook hums in agreement, letting her run her fingers through his hair in relative silence. He doesn’t even notice when he lets go of the controller to instead loop his arms through her legs, pulling his arms through until his hands are resting comfortably on her knees.
“Who’s cooking tonight?” Y/N asks curiously, as if she’s only just remembered that Jungkook’s house is never this quiet.
“Dunno. Jiminie hyung said they were going out for drinks to celebrate Yoongi’s promotion, so most of them are out.”
“You mean we’re alone?”
“No?” Jungkook says carefully. “The noonas are having a bonfire out back. Why? Are you not comfortable being alone with me?” The thought makes him deflate.
She gives his hair a reprimanding tug and Jungkook has to bite his tongue to stop himself from gasping.
She says something, but Jungkook’s too focused on controlling the rapid beating of his heart and excited prancing of his wolf to hear.
“Jungkook!”
He yelps and rubs the back of his head, flipping around to glare at Y/N, betrayed. “What was that for?!”
“For not listening to me,” she snaps. Jungkook humphs and pouts, smiling satisfied when she rolls her eyes with a sigh and apologizes under her breath. “Sorry for smacking you.”
He doubts he’ll ever get tired of the way she lowers her voice when speaking to him so sincerely.
“Sorry for not listening,” he concedes. “What were you saying?”
“Can you come with me to ask Lisa and them about food?” She reaches forward to fix his glasses and mindlessly brushes a strand of hair behind his ear.
He hopes she doesn’t notice the stars in his eyes. “Sure.”
The two of them get up and Jungkook follows closely behind Y/N as they make their way to the back yard. He closes the sliding door behind him as Y/N walks ahead, joining her with a small smile.
“‘Sup.” Jennie bro-nods at him from where she’s sitting next to Rosé.
“Hi, noona.” Jungkook smiles. “You guys having fun?” He stands closer to Y/N when he notices her shiver.
“I think we should be asking you that,” Rosé laughs, lifting her head to grin at him devilishly as she wiggles her eyebrows.
Jungkook resists the urge to flip her the bird, settling for a roll of his eyes. When he looks back at Y/N, she’s watching them butcher with a faraway smile, so he nudges her back to attention.
She clears her throat. “Jungkook and I were wondering about food. Is someone cooking?” she asks, putting her hands in her pockets and leaning into Jungkook’s arm to fight off the cold.
Lisa scoffs with a dramatic shake of her head, stoking the fire with a black-burnt stick. “You brats. Always waiting for someone to cook for you.” She shakes her head in mock-disappointment.
Y/N smiles sheepishly and Jungkook glares pointedly at his sister. “Really, Li?”
“What!” She widens her eyes at him. “It’s not like I’m lying!”
Jisoo sighs, muttering something under her breath. “Why don’t you two boil us some ramen, then? The rest of the guys aren’t going to be back until much later, so just enough for us should be fine.”
Y/N nods eagerly. “Will do. Thanks, unnie. We’ll bring it out when it’s ready.”
“Thanks babe.” Jennie blows Y/N a kiss—Jungkook resists his wolf’s urge to growl at her.
“C’mon, Koo. Let’s go.” Y/N tugs on his sleeve until they’re walking side-by-side, sliding the door open and waiting for Jungkook to close it again before skipping to the kitchen.
He grabs the television remote to play some music, joining Y/N in the kitchen like it’s second nature. Which he supposes it is.
He grabs a large pot from the cupboard as Y/N turns the stove on. Fills the pot with water while she grabs the ramen packets. Sets out seven pairs of chopsticks as she puts the sauce in.
She uses a pair of chopsticks to stir everything in the pot, and Jungkook goes back to the living room to change the song.
When he comes back, she’s watching him; leaning against the counter with a small smile. He smiles back and walks straight into her arms, wrapping his arms around her back and nuzzling into the crook of her neck.
Y/N giggles, one hand on his side and the other in his hair. Jungkook will be eternally grateful for how her attitude towards affection changed after those first few months of their friendship. She had been so touch-averse, he almost cried when she kept rejecting his attempts at physical contact.
He doesn’t know when it changed, but he’s glad it did.
Jungkook breathes in her scent, rumbling deep in his chest. God, she smells so nice. So so nice. He’s convinced it’s the best smell on earth.
“Because it’s soft.”
“Hm?” Jungkook makes a confused noise, stomach fluttering at her shy giggle right by his ear.
“Your hair, I mean. I think I like it because it’s so soft.”
Jungkook grins into her neck with a small shake of his head. “Thanks, Y/N.”
She hums, scratching at his scalp until the water’s fully boiled and the smell of ramen drives her to let him go.
Jungkook watches her cook with a lovestruck smile on his face.
He can’t wait for the day that this is his norm.
The day they’re finally together the way he so wishes they could be…
Because it’s soft.

Rather, it's to stampede talk-radio-addled supporters into backing the oligarchy's agenda. Conservatives are (partially) right about woke capitalism. It is a threat to democracy. Concentrating the power to decide who gets to speak and what they get to say into the hands of five or six corporations, mostly run by mediocre billionaires, is bad for society. Conservatives are only partially right about woke capitalism, though. Here's what they're wrong about: corporations don't have values. Target isn't selling Pride tees because they support progressive causes, they're selling them because it seems like a good way to increase returns to their shareholders. Individuals – even top executives – at Target might endorse the cause, but the company will only durably support the cause if that endorsement is profitable, which means that when it stops being profitable, the company will stop supporting the cause:

The idea that corporations have values isn't merely stupid, it's very dangerous. The Hobby Lobby decision – which allows corporations to deny basic health-care expenses for women on the basis that a Bronze Age mystic wouldn't approve of an IUD – rests on the ideological foundation that corporate personhood includes corporate values:

There are undeniably instances in which corporate monopoly power benefits progressive causes, but these are side-effects of corporate power's main purpose, namely: taking money and power away from working people and giving it to rich people. That is what monopoly power is for.
Which brings me to ad-tech, "brand safety," and the demise of Jezebel, the 16 year old feminist website whose shuttering was just announced by its latest owner, G/O Media:

Jezebel's demise is the direct result of monopoly power. Jezebel writes about current affairs – sex, politics, abortion, and other important issues of great moment and significance. When we talk about journalism as a public good, necessary for a healthy civic life, this is what we mean. But unfortunately for Jezebel – and any other news outlet covering current events – there are vast, invisible forces that exist solely to starve this kind of coverage of advertising revenue.
Writing for the independent news site 404 Media, reporter Emanuel Maiberg and former Motherboard editor-in-chief Jason Koebler go deep on the "brand safety" industry, whose mission is to assist corporations in blocking their ads from showing up alongside real news:

Maiberg and Koebler explain how industry associations like the World Federation of Marketers' Global Alliance for Responsible Media (GARM) promulgate "frameworks" to help advertisers automatically detect and exclude real news from consideration when their ads are placed:

This boycott makes use of scammy "AI" technology like "sentiment and emotional analysis" to determine whether an article is suitable for monetization. These parameters are then fed to the ad-tech duopoly's ad auction system, so Google and Meta (who control the vast majority of online advertising) can ensure that real news is starved of cash.
But reality is not brand-safe, and high quality, reputable journalistic outlets are concerned with reality, which means that the "brand safe" outlets that attract the most revenue are garbage websites that haven't yet been blacklisted by the ad-safety cartel, leading to major brands' ads showing up alongside notorious internet gross-out images like "goatse":

More than a fifth of "brand safe" ad placements end up on "made for advertising" sites, which 404 Media describe as "trash websites that plagiarize content, are literally spam, pay for fake traffic, or are autogenerated websites that serve no other purpose than capturing ad dollars":

Despite all this, many progressives have become cheerleaders for "brand safety," as a countervailing force to the drawdown of trust and safety at online platforms, which led to the re-platforming of Nazis, QAnon conspiratorialists, TERFs, and other overt elements of the reactionary movement's vanguard on Twitter and Facebook. Articles about ads for major brands showing up alongside Nazi content on Twitter are now a staple of progressive reporting, presented as evidence of Elon Musk's lack of business acumen. The message of these stories is "Musk is bad at business because he's allowing Nazis on his platform, which will send advertisers bolting for the exits to avoid brand-safety crises."
This isn't wrong. Musk is a bad businessman (he's a good scam artist, though). Twitter is hemorrhaging advertisers, notwithstanding the desperate (and easily debunked) stats-juking its "CEO," Linda Yaccarino, floats onstage at tech conferences:

But progressives are out of their minds if they think the primary effect of the brand safety industry is punishing Elon Musk for secretly loving Nazis. The primary effect of brand safety is killing reality-based coverage of the news of the day, and since reality has a well-known anti-conservative bias, anything that works against the reality-based community is ultimately good for oligarchy:

Jezebel began life as a Gawker Media site, beloved of millions of readers, destroyed when FBI informant Peter Thiel secretly funded Hulk Hogan's lawsuit against the publisher in a successful bid to put them out of business to retaliate for their unfavorable coverage of Thiel:

It was not the man’s brain that was speaking it was his larynx. The stuff that was coming out of him consisted of words but it was not speech in true sense: it was a noise uttered in unconsciousness like the quacking of a duck.
When investors and analysts speak of "content" (rather than, say, "journalism"), this is what they mean – a warm slurry of platitudes, purged of any jagged-edged fragments to render it a perfectly suitable carrier for commercial messages targeted based on surveillance data about the "consumer" whose eyeballs are upon it.
This aversion to reality has been present among corporate decisionmakers since the earliest days, but the consolidation of power among large firms – ad-tech firms, online platforms, and "brands" themselves – makes corporate realityphobia much easier to turn into, well, reality, giving advertisers the fine-grained power to put Jezebel and every site like it out of business.
As Koebler and Maiberg's headliine so aptly puts it, "Advertisers Don’t Want Sites Like Jezebel to Exist."
The reason to deplore Nazis on Twitter is because they are Nazis, not because their content isn't brand-safe. The short-term wins progressives gain by legitimizing a corporate veto over what we see online are vastly overshadowed by the most important consequence of brand safety: the mass extinction of reality-based reporting. Reality isn't brand safe. If you're in the reality based community, brand safety should be your sworn enemy, even if they help you temporarily get a couple of Nazis kicked off Twitter.
