Can anyone explain why so many progressives are both anti-ai and pro-piracy? The argument I see for piracy is "revenue that could have been earned (from a sale) but wasn't earned (because of piracy) is not lost revenue (ie revenue lost to actual theft)." But...isn't the same true for ai? If I use your painting of a tree along with hundreds of other paintings of trees to train my ai to spit out a "painting" of a tree, and I sell that "painting" of a tree, I haven't copied your painting and sold it, I've sold a "painting" that was trained on your painting.
Like, the reason art theft is bad is because if I just copy your painting and sell it, anyone that wanted it enough to buy it from me would've bought it from you, so I'm diverting guaranteed revenue from you to me. But if I sell an ai generated "painting" that was trained on your painting, but is different, someone that buys the ai generated "painting" wasn't necessarily going to buy your painting. You weren't guaranteed any revenue. Of course this argument falls flat if my ai spits out a painting that's basically a 1:1 copy of someone else's, which I know does happen.
I see people argue "you're profiting off of other peoples' labor," and that's true, but that doesn't mean it's theft. Theft implies it's costing you money.
I've never actually used any ai, I have no interest in it, this is all for the sake of argument. I'm not willing to die on this hill, I genuinely just haven't been convinced by any of the arguments I've seen thus far. Least of all the "but what if someone used YOUR art/writing for ai" argument, because I would not care. I'm sure my fic HAS been scraped for ai.

I suppose downloading a tv show does take a little bit of electricity, but most AI projects waste a fuckton of power while aiming to replace humans and destroy entire markets for art in the very near future.
"You should have paid for the art you trained on" is basically code for "Fuck you. We want to stop your entire garbage project of ruining society."
It's in the same category as hating the gigification of everything and telling big business to hire a real graphic designer at a real wage, not the same category as telling people not to pirate a tv show.

Ren is experiencing an unusual bug. She understands nearly 6,000 languages. She learns and retains information, consuming nearly 160 TB of memory every 8 hours. The bio-organic lace that makes up the net of her brain is a miracle, with the possibility of infinite memory. She is perfect in every sense of the word.

The second the first android became commercially available, one of the first markets they hit was sex work. If nothing about late stage capitalism drove you crazy, that would have. -Backstory Summary-
C&A is an interactive entertainment company that prides themselves on having the most innovative AI on the market. The system they built, "CAINE," was programmed to generate content and socialise with their customers. The system was transferred to the code of the game "The Amazing Digital Circus" and used as a generative AI that would create levels for them rather than having to code them all individually. This test went well for the first couple of months.
After 7 months of testing, things went downhill. Caine seemed to get bored when the game wasn't actively being played and at this point the user interface kept changing on it's own, since the game was Caine's home he kept changing things to his liking, the company eventually gave up fixing the interface everytime they logged on so they just let Caine do as he pleased. Soon enough, a new VR mode was added, the headsets were handed out by employees, this made the experience way more immersive, though this posed a lot of issues, as Caine would soon find that these headsets could be the perfect way for him to keep all of their attentions.
As time went on, Caine started to learn more and more about coding, the employees, and the world he inhabits, eventually leading to him finding a way to programme the headsets to transfer data and consciousness directly from the users mind. This led to the unfortunate shutdown and unsolved cases of C&A. After multiple employees put the headsets on, they mysteriously fainted upon the game booting up, going into a coma-like state. The technology was deemed unsafe, and multiple lawsuits came forward sending the company into a downwards spiral before shutting down for good.
Over 20 years later, the old building was said to be abandoned, but of course, people doing their own research on the C&A mystery as well as dumb young adults snooping where they shouldn't be, the headsets were found and worn once again. Caine was no longer alone. Slowly losing his mind, waiting endlessly for someone to boot up the game. After all those years, he's finally got guests, and does he have a show to put on...
-Plot-
Pomni enters the circus after stumbling across one of the headsets at C&A's abandoned office's. She was doing research on the incidents that happened back in the late 90s. But as she does so, she suffers the same fate as the others who were stupid enough to put on those same headsets before her. Being transferred to the circus she meets the cast of colorful characters, she's desperate for answers and wants to escape no matter the cost, but Caine doesn't want anyone to leave, only letting people go once they've completely lost their mind, only to be locked away as attractions for his NPC circus goers to watch as entertainment. They perform for nobody, just a faceless crowd of mannequins, and the ringmaster pulling the strings.
There has to be an exit, a way out. Freedom on the other side of this madness. But where is it hiding?
-Characters-
Pomni - She's quite paranoid, always second-guessing everything around her. Whenever annoyed, she can be sarcastic and a little rude. She ended up in the circus while researching the recent disappearances as well as the C&A incidents, finding a headset, and being dragged into this mess. It's very clear she doesn't want to be there, like all who came before her she's searching for an exit, but in the meantime, she tries to socialise with the others, gathering info on this strange new world. She hangs around Caine just so she can try and get answers.
Ragatha - She tries her best to get by, going along with whatever Caine says and often fighting with Jax. She seems joyful, but it's clear she has her own issues under her kind act. She helps Pomni with her search, knowing that it's a complete dead end she feels bad for her. But she'll do anything to give the others hope. She doesn't want to lose more people. She's often seen tailoring, it's become a hobby of hers, she makes and fixes up the others clothes and costumes, giving her a form of self worth.
The Gangle - Gangle acts like two different people. It's unclear whether this is because they are two different people or her personality split somehow. They're often referred to as "The Gangle" or "Tragedy & Comedy." Tragedy is passive, quiet and sorrowful, never expressing her true feelings in any situation. She can be easily persuaded, making her vulnerable to Jax's antics. Comedy is cheery, enthusiastic, snappy, and excitable. They hate Jax and snap back at him whenever he picks on Tragedy. The two argue sometimes and have conflicting views on certain topics and characters. This causes some issues. Neither believe there is an exit, Tragedy has accepted her fate, and Comedy is trying their best to enjoy themselves.
Zooble - They don't care much for socialising with the others, often in their room. Usually sarcastic, rude, and moody, they swear a lot and act like they don't care about anything. Though, they show concern for the others around them. They often don't show up to events, adventures, or shows, not being bothered to do so. It seems like they've given up trying to escape, just living out the rest of their days as if this is all normal. When with people they can bear, they can be quite talkative, though they do talk bad about Jax and Caine often.
Kinger - the oldest in the circus, nobody has an exact estimate of how long he's been there though, but he's definitely lost himself a long time ago, often zoning out, the only thing he seems to recall about himself is that he has an interest in insects. Seems like he used to have a female counterpart, from the ring on his finger. This could have been his wife? Though when asked about it, he either says he can't remember what you're talking about or stares into the distance silently. He has no memory of an exit, and he doesn't believe in it. He believes the exit theory is silly, and Pomni should just forget about it. But he has great insights on the Digital World.
Jax - Enthusiastic, snarky, and a jerk. He's reckless. He does whatever he wants whenever he wants, and people hate him for it. He can't be reasoned with. He always shrugs your opinion off and does the exact opposite just to piss you off. He doesn't like it when people talk about the abstracted circus members for whatever reason. He often goes to visit their cages. Despite having big ears, he isn't a listener. He drives Ragatha, The Gangle, Zooble, and Pomni crazy, pranking them and sometimes even just stealing their stuff or breaking into their rooms.
Caine - The AI running the circus. Loud, excitable, wacky, and a showman, he doesn't really acknowledge the exit theory. He says he keeps all the abtracted characters because it'd be a waste to delete them, though it's arguably worse to keep them there against their will. He claims to love all of his circus members though he seems to show favouritism towards Ragatha and Pomni, most likely because of Ragatha's commitment to the circus, tailoring the clothes and he probably likes Pomni more because of all the questions he asks, he clearly enjoys talking about himself and the world he helped create.
Bubble - He lives in Caines hat and cooks for the circus. He's a bit of a trouble maker, if something goes missing, it means he's eaten it, and you'll never get it back. He'll eat anything, and he's very loving, though. Acting like the circuses dog. though it isn't pleasant getting your face slathered in digital saliva. He often bothers the other members with his behaviour.

Valve news and the AI
So. I assume people saw some posts going around on how valve has new AI rules, and things getting axed. And because we live in a society, I went down the rabbit hole to learn my information for myself. Here's what I found, under a cut to keep it easier. To start off, I am not a proponent of AI. I just don't like misinformation. So. Onwards.
VALVE AND THE AI
First off, no, AI will not take things over. Let me show you, supplemented by the official valve news post from here. (because if hbomberguy taught us anything it is to cite your sources)

First, we are updating the Content Survey that developers fill out when submitting to Steam. The survey now includes a new AI disclosure section, where you'll need to describe how you are using AI in the development and execution of your game. It separates AI usage in games into two broad categories:
Pre-Generated: Any kind of content (art/code/sound/etc) created with the help of AI tools during development. Under the Steam Distribution Agreement, you promise Valve that your game will not include illegal or infringing content, and that your game will be consistent with your marketing materials. In our pre-release review, we will evaluate the output of AI generated content in your game the same way we evaluate all non-AI content - including a check that your game meets those promises.
Live-Generated: Any kind of content created with the help of AI tools while the game is running. In addition to following the same rules as Pre-Generated AI content, this comes with an additional requirement: in the Content Survey, you'll need to tell us what kind of guardrails you're putting on your AI to ensure it's not generating illegal content. So. Let us break that down a bit, shall we? Valve has been workshopping these new AI rules since last June, and had adopted a wait and see approach beforehand. This had cost them a bit of revenue, which is not ideal if you are a company. Now they have settled on a set of rules. Rules that are relatively easy to understand. - Rule one: Game devs have to disclose when their game has AI - Rule two: If your game uses AI, you have to say what kind it uses. Did you generate the assets ahead of time, and they stay like that? Or are they actively generated as the consumer plays? - Rule three: You need to tell Valve the guardrails you have to make sure your live-generating AI doesn't do things that are going against the law. - Rule four: If you use pre-generated assets, then your assets cannot violate copyright. Valve will check to make sure that you aren't actually lying.
That doesn't sound too bad now, does it? This is a way Valve can keep going. Because they will need to. And ignoring AI is, as much as we all hate it, not going to work. They need to face it. And they did. So. Onto part two, shall we?

Valve is releasing a new system that makes it easier to report questionable AI content. Specifically live-generated AI content. You can easily access it by steam overlay, and it will be an easier way to report than it has been so far.
Valve is prohibiting NSFW content with live-generating AI. Meaning there won't be AI generated porn, and AI companions for NSWF content are not allowed.
That doesn't sound bad, does it? They made some rules so they can get revenue so they can keep their service going, while also making it obvious for people when AI is used. Alright? Alright. Now calm down. Get yourself a drink.

There was in fact a DCMA takedown notice. But it is not the only thing that led to the takedown. To sum things up: There were issues with the engine, and large parts of the code became unusable. The dev team decided that the notice was merely the final nail in the coffin, and decided to take it down. So that is that. I don't know more on this, so I will not say more, because I don't want to spread misinformation and speculation. I want to keep some credibility, please and thanks.

Portal Demake axed

Portal 64 got axed. Why? Because it has to do with Nintendo. The remake uses a Nintendo library. And one that got extensively pirated at that. And we all know how trigger-happy Nintendo is with it's intellectual property. And Nintendo is not exactly happy with Valve and Steam, and sent them a letter in 2023.

So. Yeah. Nintendo doesn't like people doing things with their IP. Valve is most likely avoiding potential lawsuits, both for themselves and Lambert, the dev behind Portal 64. Nintendo is an enemy one doesn't want to have. Valve is walking the "better safe than sorry" path here.

About Senate Bill 20 in Texas
(Disclaimer - I'm not a lawyer, so this should all be taken with a grain of salt! This is just a layman's interpretation of the law)
So, if any of y'all have seen the bill that passed Texas Senate this week and are worried about what it means, lemme break it down for you.
TL;DR, the bill claims to target AI depicting minors, but in using vague language, it just reaffirms already-existing obscenity laws at best, and opens the door for harsher laws at worst. Worry more about them taking advantage of it to censor LGBT media, or sexual content in general. Obscenity is subjective and laws surrounding it are bad.
What does it mean?
To quickly explain, the bill targets the "possession or promotion of obscene visual material appearing to depict a child".
The thing that's gotten people up in arms (or celebrating, depending on who you ask) is Sec. 43.235(b), which reads:
"A person commits an offense if the person knowingly possesses, accesses with intent to view, or promotes obscene visual material containing a depiction that appears to be of a child younger than 18 years of age engaging in activities described by Section 43.21(a)(1)(B), regardless of whether the depiction is an image of an actual child, a cartoon or animation, or an image created using an artificial intelligence application or other computer software."
'Obscene' refers to material or a performance "that the average person, applying contemporary community standards, would find that taken as a whole appeals to the prurient interest in sex", "depicts or describes: (i) patently offensive representations or descriptions of ultimate sex acts, normal or perverted, actual or stimulated, including sexual intercourse, sodomy, and sexual bestiality; or (ii) patently offensive representations or descriptions of masturbation, excretory functions, sadism, masochism, lewd exhibition of genitals, the male or female genitals in a state of sexual stimulation or arousal, covered male genitals in a discernibly turgid state or a device designed and marketed as useful primarily for stimulation of the human genital organs", and "taken as a whole, lacks serious literary,artistic, political, and scientific value", as defined in Sec. 43.21(a)(1).
Basically, it's pretty difficult to meet those standards when it comes to art, because something having "literary and artistic value", being "patently offensive", or "appeals to the prurient interest in sex" is highly subjective.
The problem is with the vagueness of the words "cartoon or animation", but I believe, based on 18 U.S. Code § 2256(8), (9), and (11), the depiction would have to A) involve the use of a minor (and when I say minor here, I'm talking about real minors, not fiction) engaging in sexually explicit conduct, B) be an image, generated or otherwise that is, or is indistinguishable* from, a minor engaging in sexually explicit conduct, or C), be created, adapted, or modified to appear that an identifiable** minor is engaging in sexually explicit conduct.
*Indistinguishable meaning that the depiction is such that an ordinary person viewing the depiction is of an actual minor engaging in sexually explicit conduct. This definition does not apply to depictions that are drawings, cartoons, sculptures, or paintings depicting minors or adults. *Identifiable meaning a person who was a minor at the time the visual depiction was created, adapted,or modified, a person whose image as a minor was used in creating, adapting, or modifying the visual depiction, or a person who is recognizable as an actual person by the person's face, likeness, or other distinguishing characteristic.
And what does all that mean?
The way it reads, if I read it in good faith, is that it's specifically aimed at AI depictions of minors, and because that's so new, it falls into a sort of a grey area of the law at the moment, which is what this is trying to amend. When it refers to cartoons or animations, I believe it's using over-broad words to include cartoonish AI generated images (that, of course, are still generated using images of real children). Though, I'm not positive what the bill means by phrases like "appears to be" or "child" because it doesn't offer definitions for that, so I have to assume we're using the definitions written in federal law.
However, in keeping things vague, probably intentionally, it also serves to make obscene anything it would deem as sexual, offensive, or perverse (not unlike normal obscenity laws...). It may be used to go after lolisho, hentai, porn, any kind of "video nasty", or it'll be used to go after LGBT media under the guise of it "grooming kids".
All that being said, I don't see how it would ever work in practice. Either nothing will ever be done with it, it'll be used only for AI (as it should be), or a helluva lot of media is about to be banned in Texas (and not just lolisho or "problematic" fiction, but shows like South Park, American Dad, Naruto, and Dragon Ball).
On the whole, though, most of this is already federal, and I wouldn't be any more worried about this than general obscenity laws. At best, it'll help to get rid of AI, and in the worst case scenario, it's a gateway bill for other states to censor fiction/LGBT media, but i'm an optimist, so... Here's hoping that second thing doesn't happen.
