Lawyers for trans woman Roxanne Tickle have argued she is a woman and was discriminated against when she was banned from using a female-only app.
The question of whether someone is a woman is not just biological but also social and psychological, a court has heard on the first day of a landmark trans-rights lawsuit.
Trans woman Roxanne Tickle is suing female-only social media platform Giggle for Girls after having her access to the app revoked in September 2021.
The app and its founder, Sall Grover, illegally discriminated on the grounds of gender identity, Tickle's lawyer Georgina Costello told a Federal Court hearing in Sydney on Tuesday
"The evidence will show that Ms Tickle is a woman," Costello said.
"She perceives herself as a woman. She presents herself as a woman."
'An online refuge'
Giggle's barrister Bridie Nolan said the app was created to give women a safe space, free from "male online digital violence".
Grover experienced sexual abuse during her time working as a screenwriter in Hollywood and had undergone trauma therapy, the court was told.
The app offered a range of ways for users to connect, including finding roommates and engaging socially or romantically.
"The vision was to create an online refuge," Ms Nolan said.
"It would be a place without harassment, mansplaining, d*** pics, stalking, aggression."
Nolan argued the app was not in breach of sex discrimination laws, which allow for "special measures intended to achieve equality".
The app created greater "equality between men and women in public life" by creating a safe space for women online, she said.
Therefore, excluding Tickle, who Nolan argued was a man, would constitute a "special measure" under the laws, she said.

Costello labelled Giggle's arguments "artificial, after-the-fact justifications" for discrimination against transgender women.
Tickle was issued a birth certificate stating she was female a year after undergoing gender-affirming surgery in October 2019.
Costello told the court in her opening statement that "gender is not merely a biological question, it is partly social and partly psychological".
"Ms Tickle was assigned male gender at birth but she has changed to being a woman and that fact is clear in this case," she said.
Representatives from the Australian Human Rights Commission, including Sex Discrimination Commissioner Anna Cody are assisting the court by providing submissions about the "meaning, scope and validity of relevant provisions of the Sex Discrimination Act".
"The commissioner is not a party to the proceeding and has not made submissions about whether Ms Tickle was in fact discriminated against," the human rights commission said in a statement.
It is the first time a case alleging gender identity discrimination has been heard by the Federal Court.
'Unwilling to tolerate any view contrary to their own'
Supporters for both sides gathered outside the Federal Court for the start of the proceedings, protesting within metres of each other.
Justice Robert Bromwich said the court would not tolerate any "intimidation or harassment" either within the courtroom or outside it.

"I appreciate that the issues from this case give rise to strongly held views and emotions," he said.
Some members of the public had shown they were "unable or unwilling to tolerate the existence of any view contrary to their own", Bromwich added.

In a statement filed with the Australian Human Rights Commission in December 2021, before the Federal Court case was launched, Tickle outlined the alleged discrimination.
"I believe that I am being discriminated against by being provided with extremely limited functionality of a smartphone app by the app provider compared to that of other users because I am a transgender woman," Tickle wrote.
"I am legally permitted to identify as female."
The hearing continues.

It doesn’t take a team of federal agents to figure out that if you picked up this magazine, you’re probably one of the 300 million people from around the world who watched some version of NCIS last year. That’s just a smidge under the entire population of the United States.
The massive fandom around the military procedural, which reigns as the most watched drama on broadcast TV, began in 2003 with a spectacular series premiere from cocreators Donald P. Bellisario and Don McGill. The episode, inspired by the 1997 movie Air Force One, introduced what would become the show’s signature recipe of action, emotion, and a dash of humor when agent Leroy Jethro Gibbs (Mark Harmon) and Dr. Donald “Ducky” Mallard (David McCallum) investigate a mysterious death aboard the presidential plane.
We fell in love with Gibbs’ gruffness (OK, his good looks didn’t hurt either) and Ducky’s intellect. We were intrigued by the twisty case and fascinated by an agency we’d never heard of: the Naval Criminal Investigative Service, which solves crimes involving the Navy and Marine Corps.

The distinct characters back at HQ sealed the deal. The original cast included a roundup of agents with lovable quirks: by-the-book profiler Caitlin Todd (Sasha Alexander), flirtatious Tony DiNozzo (Michael Weatherly), and tech geek Tim McGee (Sean Murray). In the lab, we got the unexpected goth/nerd forensic specialist Abby Sciuto (Pauley Perrette) and Ducky’s dedicated and sensitive assistant Jimmy Palmer (Brian Dietzen).
Over the years, NCIS built a reliable world that we could return to every week. It was governed by “Gibbs’ Rules,” practical guidelines for successfully solving cases and living life (new ones popped up all the time). We got to know our beloved characters better through eye-opening backstories, sometimes revealing tragic incidents. There were in-office rivalries and romances. (Tony and Ziva [Cote de Pablo] forever! — their story will continue in a new spinoff) Recognizable baddies kept coming back for more until the agents took them out—as we cheered them on from our sofas.
And those agents handled it all with the qualities expected at the real-life U.S. Naval Academy: “competence, character, compassion.” In a tumultuous world, it was a comfort to hang out at Navy Yard HQ in the bullpen, aka “the big orange room,” with decent folks like that.
As with any workplace, people have come and gone. Some we lost tragically. Others opted to move on. Saying goodbye to Gibbs when he retired in 2021 was the hardest. But NCIS has a way of reinventing itself. The new team leader, Alden Parker (Gary Cole), is more gregarious than the taciturn Gibbs, but as we’ve learned since he arrived, like his predecessor, he’s got plenty from his past that haunts him.
Bringing to life the multilayered characters of NCIS are writers, producers and crew, many of them with the show for decades. (Some even worked on JAG, the military legal drama from which NCIS spun off.) They’ve expanded into multiple spinoffs: NCIS: Los Angeles, NCIS: New Orleans and NCIS: Hawai‘i. The latest, NCIS: Sydney, debuted in November 2023.
Speaking to the deep staying power of not just the format but the characters, a forthcoming prequel, NCIS: Origins, will tell the story of a young Gibbs. Mark Harmon’s son Sean played the junior Leroy in NCIS flashbacks, but the new series will cast a different actor. Both Harmons will serve as executive producers.
The possibilities for the future of NCIS are endless. Bring on the milestone 1,000th episode of the franchise, coming in April!

My friends Holly and Katie, are now the guardians of two teenagers after their mom died in a car accident. Katie was hired as an in-home assistant for X a month before their mom died. After her death, Holly and Katie learned that the kids have no family who can take them and that they would be separated if put into foster care. They have gotten uncontested legal guardianship for one year and plan to file for permanent guardianship. They are good, compassionate people. I feel grateful that Katie happened to take that job - these kids will have caring, compassionate, and trauma-informed adults who understand disability in their lives (not only was Katie X’s support worker, Holly is a teacher of Deaf children and teens with disabilities, and they both have their own experiences with disability as well)
Now, Katie is no longer eligible to be paid for taking care of X due to federal regulations of the position, and since they are not going through the foster care system, they are not eligible to receive a stipend to help offset costs. They went from a family of 3 (they already had one son who is 12) to a family of 5, and they only have one income. Any amount would help and please share widely! 💜

The Entrepreneurial Life of Charles Sidney Dole

Remembered for his creation of one of Crystal Lake, Illinois’ most emblematic structures, Charles Sidney Dole was born in 1819 in Bloomfield, which became a suburb of Detroit. His father, Judge Sydney Dole, served as a prominent local community member. As one of the area’s earliest settlers, he issued the first legal document ever produced in Oakland County.
Following a devastating fire, Charles and his younger brother James left for Chicago, then known as Fort Dearborn, where their uncle George W. Dole resided. With an enterprising character, George contributed to the 1838 construction of Chicago’s first grain storage facility. In 1848, the small burgh took a significant step toward becoming a modern city after completing the Illinois and Michigan Canal. In addition, the municipality gained the Chicago and Galena Railroad. It inked the community with lead mines in Galena. The Market Building served as the first city hall on State Street.
When George accepted an appointment as Chicago’s postmaster in 1850, 31-year-old Charles became the Assistant Postmaster. He subsequently established C.S. Dole & Co., a grain commission business, with his brother James. The two purchased and sold wheat and constructed grain storage facilities. Then, Charles became involved in the broader industry as an early Chicago Board of Trade member.
In 1850, the Board tried to establish quality standards for wheat, which the industry lacked. However, it had difficulty enforcing them as Chicago developed a reputation for producing inferior wheat. In 1858, Charles and S.H. Butler led a newly formed committee and created a new set of recommendations. The committee adopted them, bolstering the city’s major grain center position. In 2024, many of these standards remain in place in Chicago.
Then, in 1860, Charles diversified his entrepreneurial footprint, founding Armour, Dole & Co., which maintained a grain elevator at the Chicago, Burlington & Quincy Railroad depot. With an initial capacity of 850,000 bushels, they expanded it to 2.1 million bushels within a decade and attained a 6.3 million bushel granary capacity by the early 1880s.
Personally, Charles S. Dole also experienced a transformation. He married his cousin Julia Louise Coffin on October 9, 1858, at St. James Episcopal Church. By the early 1860s, he had purchased a thousand acres in Crystal Lake, 45 miles northwest of Chicago, intending to settle down and start a family. The community established Crystal Lake Depot in 1856 in the downtown area of Dearborn as it continued experiencing growth.
The land Charles acquired had a lake view, and he spent $100,000 on constructing a three-story mansion with adjacent stables and a garden. The property included an extensive stock farm, a half-mile racetrack, and a stable that bred Percheron horses. He resided there with his wife Julia, mother-in-law Mrs. Harriet Coffin, and two daughters and a son until the 1890s.
Moreover, Charles amassed a fortune as the railroad helped transport grain products to market. During his daughter’s wedding in 1883, he notably constructed a spur line that brought guests from the Chicago and Northwestern railway tracks to the mansion doors. Among the venerable guests was Julian Rumsey, Chicago’s mayor, and first cousin Levi Leiter, the initial partner of department store magnate Marshall Field.
