This one of those times where it’s clear Horikoshi doesn’t have a good understanding of the criminal justice system.
Law enforcement can’t just wave a wand and know whether someone was acting of their own free will. This idea that they have test for brainwashing is also contradicted by canon by (1) All for One’s everything and (2) the bee villain from the Vigilantes spinoff (who is also technically part of All for One’s everything). And if they think they have such a device, it clearly doesn’t actually work considering that it didn’t even catch Kurogiri.
