The federal government gave us ten days to sign away our values. Here’s our answer.

To Whom It May (Unfortunately) Concern at the U.S. Department of Education:
Thank you for your April 3 memorandum, which I read several times — not because it was legally persuasive, but because I kept checking to see if it was satire. Alas, it appears you are serious.
You’ve asked me, as superintendent of a public school district, to sign a "certification" declaring that we are not violating federal civil rights law — by, apparently, acknowledging that civil rights issues still exist. You cite Title VI of the Civil Rights Act, then proceed to argue that offering targeted support to historically marginalized students is somehow discriminatory.
That’s not just legally incoherent — it’s a philosophical Möbius strip of bad faith.
Let me see if I understand your logic:
If we acknowledge racial disparities, that’s racism.
If we help English learners catch up, that’s favoritism.
If we give a disabled child a reading aide, we’re denying someone else the chance to struggle equally.
And if we train teachers to understand bias, we’re indoctrinating them — but if we train them to ignore it, we’re “restoring neutrality”?
How convenient that your sudden concern for “equal treatment” seems to apply only when it’s used to silence conversations about race, identity, or inequality.
Let’s talk about our English learners. Would you like us to stop offering translation services during parent-teacher conferences? Should we cancel bilingual support staff to avoid the appearance of “special treatment”? Or would you prefer we just teach all content in English and hope for the best, since acknowledging linguistic barriers now counts as discrimination?
And while we’re at it — what’s your official stance on IEPs? Because last I checked, individualized education plans intentionally give students with disabilities extra support. Should we start removing accommodations to avoid offending the able-bodied majority? Maybe cancel occupational therapy altogether so no one feels left out?
If a student with a learning disability receives extended time on a test, should we now give everyone extended time, even if they don’t need it? Just to keep the playing field sufficiently flat and unthinking?
Your letter paints equity as a threat. But equity is not the threat. It’s the antidote to decades of failure. Equity is what ensures all students have a fair shot. Equity is what makes it possible for a child with a speech impediment to present at the science fair. It’s what helps the nonverbal kindergartner use an AAC device. It’s what gets the newcomer from Ukraine the ESL support she needs without being left behind.
And let’s not skip past the most insulting part of your directive — the ten-day deadline. A national directive sent to thousands of districts with the subtlety of a ransom note, demanding signatures within a week and a half or else you’ll cut funding that supports... wait for it... low-income students, disabled students, and English learners.
Brilliant. Just brilliant. A moral victory for bullies and bureaucrats everywhere.
So no, we will not be signing your “certification.”
We are not interested in joining your theater of compliance.
We are not interested in gutting equity programs that serve actual children in exchange for your political approval.
We are not interested in abandoning our legal, ethical, and educational responsibilities to satisfy your fear of facts.
We are interested in teaching the truth.
We are interested in honoring our students’ identities.
We are interested in building a school system where no child is invisible, and no teacher is punished for caring too much.
And yes — we are prepared to fight this. In the courts. In the press. In the community. In Congress, if need be.
Because this district will not be remembered as the one that folded under pressure.
We will be remembered as the one that stood its ground — not for politics, but for kids.

Congress is moving closer to putting US election technology under a stricter cybersecurity microscope.
Embedded inside this year’s Intelligence Authorization Act, which funds intelligence agencies like the CIA, is the Strengthening Election Cybersecurity to Uphold Respect for Elections through Independent Testing (SECURE IT) Act, which would require penetration testing of federally certified voting machines and ballot scanners, and create a pilot program exploring the feasibility of letting independent researchers probe all manner of election systems for flaws.
The SECURE IT Act—originally introduced by US senators Mark Warner, a Virginia Democrat, and Susan Collins, a Maine Republican—could significantly improve the security of key election technology in an era when foreign adversaries remain intent on undermining US democracy.
“This legislation will empower our researchers to think the way our adversaries do, and expose hidden vulnerabilities by attempting to penetrate our systems with the same tools and methods used by bad actors,” says Warner, who chairs the Senate Intelligence Committee.
The new push for these programs highlights the fact that even as election security concerns have shifted to more visceral dangers such as death threats against county clerks, polling-place violence, and AI-fueled disinformation, lawmakers remain worried about the possibility of hackers infiltrating voting systems, which are considered critical infrastructure but are lightly regulated compared to other vital industries.
Russia’s interference in the 2016 election shined a spotlight on threats to voting machines, and despite major improvements, even modern machines can be flawed. Experts have consistently pushed for tighter federal standards and more independent security audits. The new bill attempts to address those concerns in two ways.
The first provision would codify the US Election Assistance Commission’s recent addition of penetration testing to its certification process. (The EAC recently overhauled its certification standards, which cover voting machines and ballot scanners and which many states require their vendors to meet.)
While previous testing simply verified whether machines contained particular defensive measures—such as antivirus software and data encryption—penetration testing will simulate real-world attacks meant to find and exploit the machines’ weaknesses, potentially yielding new information about serious software flaws.
“People have been calling for mandatory [penetration] testing for years for election equipment,” says Edgardo Cortés, a former Virginia elections commissioner and an adviser to the election security team at New York University’s Brennan Center for Justice.
The bill’s second provision would require the EAC to experiment with a vulnerability disclosure program for election technology—including systems that are not subject to federal testing, such as voter registration databases and election results websites.
Vulnerability disclosure programs are essentially treasure hunts for civic-minded cyber experts. Vetted participants, operating under clear rules about which of the organizer’s computer systems are fair game, attempt to hack those systems by finding flaws in how they are designed or configured. They then report any flaws they discover to the organizer, sometimes for a reward.
By allowing a diverse group of experts to hunt for bugs in a wide range of election systems, the Warner–Collins bill could dramatically expand scrutiny of the machinery of US democracy.
The pilot program would be a high-profile test of the relationship between election vendors and researchers, who have spent decades clashing over how to examine and disclose flaws in voting systems. The bill attempts to assuage vendors’ concerns by requiring the EAC to vet prospective testers and by prohibiting testers from publicly disclosing any vulnerabilities they find for 180 days. (They would also have to immediately report vulnerabilities to the EAC and the Department of Homeland Security.)
Still, one provision could spark concern. The bill would require manufacturers to patch or otherwise mitigate serious reported vulnerabilities within 180 days of confirming them. The EAC—which must review all changes to certified voting software—would have 90 days to approve fixes; any fix not approved within that timetable would be “deemed to be certified,” though the commission could review it later.
A vendor might not be able to fix a problem, get that fix approved, and get all of its customers to deploy that fix before the nondisclosure period expires.
“Updates to equipment in the field can take many weeks, and modifying equipment close to an election date is a risky operation,” says Ben Adida, the executive director of the vendor VotingWorks.
Some vendors might also chafe at the bill’s legal protections for researchers. The legislation includes a “safe harbor” clause that exempts testing activities from the prohibitions of the Computer Fraud and Abuse Act and the Digital Millennium Copyright Act, and bars vendors from suing researchers under those laws for accidental violations of the program’s terms.
There is also a funding question. The SECURE IT Act doesn’t authorize any new money for the EAC to run these programs.
“I hope Congress accounts for the necessary funding needed to support the increased responsibilities the EAC will take on,” says EAC chair Ben Hovland. “Investments in programs like this are critical to maintaining and strengthening the security of our elections.”
Meanwhile, the bill’s prospects are unclear. Even if it passes the Senate, there is no sign of similar momentum in the House.

With the end of the 2025 Texas legislative session approaching Monday's finish line, the House and Senate are engaging in legislative ping pong across the rotunda with bills approved by both chambers. In this version of ping pong, each chamber decides whether to accept the changes made by the other or escalate the debate by settling differences via a conference committee.

Landmark school funding bill now goes to the governor
Sweeping legislation to boost funding for public schools was sent to the governor's desk Thursday, completing the "Texas Two Step" designed to change the face of K-12 education in Texas.
Step one fulfilled Gov. Greg Abbott's wish for a school voucher-like program through Senate Bill 2, which will make public money available to help pay for private education. He signed it into law in an elaborate ceremony earlier this month.
House Bill 2 is step two. It provides $4.2 billion for teacher pay raises, expands the merit-based pay program known as the Teacher Incentive Allotment, invests in teacher preparation and certification programs, and creates a new $1.3 billion fixed cost fund for districts to pay overhead expenses. It also rewrites the way the state’s special education system works, setting aside $850 million more for such programs, and provides $430 million more for school safety.

'Spay. Neuter. Adopt': More options for animal friendly license plates
Abbott has signed legislation to expand the list of slogans available for license plates.
Senate Bill 1568 allows the Department of State Health Services to diversify plate design options to boost public interest and increase funding. The first redesign, “Spay. Neuter. Adopt.”, will offer Texans an easy way to support pets.
The Animal-Friendly License Plate Program, originally established in 1997, provides money for free and low-cost spay and neuter initiatives.
Part of major water-supply legislative package advances
One part of the major legislative package to address the need for a reliable water supply in Texas made it across the finish line Thursday when the House agreed to the Senate's changes to a proposed constitutional amendment.
House Joint Resolution 7 is a referendum that would start the allocation of $1 billion annually to the Texas Water Fund for up to 10 years by redirecting a portion of state sales tax collections. The money will help pay for more water and to repair aging infrastructure for local entities. Texas voters will have final approval on the plan in November.
The other part of the package, Senate Bill 7, was still awaiting final approval Thursday. This is the legislation that would put the law on the books. The constitutional amendment would authorize the legislation.
Foreign-ownership bill heads to the governor
Legislation to restrict land ownership from people "domiciled" in nations hostile to the United States was sent to the governor's desk Thursday.
Senate Bill 17, authored by Brenham Republican Sen. Lois Kolkhorst and sponsored by Rep. Cole Hefner, R-Mount Pleasant, in the House, seeks to bar individuals and companies from "adversarial nations" as identified by the U.S. national intelligence director — currently, China, Russia, Iran and North Korea — from owning land or real estate in Texas. It also gives the governor authority to add or remove countries from the list.
Each chamber offered its own version of the legislation, and the proposal sent to the governor was the work of a conference committee, which reconciled the differences.
The measure would grant the attorney general jurisdiction to investigate "land law" violations and would make it a state jail felony to knowingly purchase property despite the restrictions.
The conference committee report passed largely along party lines. Democratic Rep. Gene Wu of Houston said it would have the unintended consequence of hindering some members of the Asian community with legal standing to be in the United States from being able to purchase homes and businesses.
