BethanyStorro, 28, was leaving a Starbucks in Vancouver, Washington, US, when an African American female approached her. Storro said the stranger said, fHey, pretty girl, do you want to drink this?’ when Storro said no, the woman threw the contents of the cup onto Storro’s face.
At a press conference Storro said that it was ‘the most painful thing ever’, her head was bandaged. ‘It ripped through my clothing the instant it touched my shirt; I could feel it burning through my second layer of skin.’
It wasn’t coffee in the cup, it was acid. Storro had severe burns to her face which the authorities believed was sulphuric or hydrochloric acid. She avoided permanent damage to her eyesight because she was wearing sunglasses at the time. Storro said about her attacker, ‘I have never, ever seen this girl in my entire life. When I first saw her, she had this weirdness about her – like jealousy, rage.’
Public donations of money poured to Storro and she went on a shopping spree. She was invited to appear on the Oprah show until the truth was revealed.
Police investigated the crime but found numerous inconsistencies in her story that wasn’t adding up. Storro later admitted that she had made the entire story up, and her injuries were self-inflicted. She had wiped drain cleaner onto her face.
During her trial, Storro pled not guilty to theft charges. Many believe that Storro made up the story to gain attention and so people would feel sorry for her. She also gained a lot of money from the story, $20,000 all up. She paid $620 for a chemical facial peel with the donated money for her recovery. She also went on a shopping spree, bought clothes, travel expenses, a new computer, and restaurant expenses.
Storro said she did it because she wanted to commit suicide. This didn’t add up, because if she wanted to commit suicide, she would have drunk it, not smudged it on her face.
Storro was sentenced to a mental health treatment after pleading guilty to making a false statement to a public official. Theft charges were dropped, and her father said that they will return all the money. Her racist claim that a black woman attacked her, also didn’t do her any favours. She later apologized to the African American community. Storro was charged to pay at least $4,000 of police overtime.
Her memoir Facing The Truth was released in 2013. She writes about how she suffers from mental health.

Fact:
The victim had filed an FIR alleging that the appellant had forcibly dragged her to an area, and had subsequently #thrownacid on her when she retaliated.
Bail Granted by Apex Court to the alleged accused of #AcidAttack
1. The #ApexCourt #granted #bail to the alleged accused appellant who was in jail for more than a year and is charged for throwing acid on Govnt Servan posted as Lekhpal with the intention to kill her.
2. Bail was also given for the reason that out of 7 witnesses, 4 #vital #privatewitnesses were already #examined
3. However, Bail was given with terms and conditions and in case of any breach of the conditions given in bail or any other conditions imposed by the trial Court, the #trialcourt has the #rights to #cancel the bail granted to the appellant.
#Conditions of #Bail
1. The appellant will #notenter #Agra where the complainant resides till the Court proceedings conclude, #except attending to the #Courtproceedings.
2. The appellant shall not, in any manner, #come within the #vicinity of the #complainant.
Background
1. Bail application was earlier moved before Allahabad High Court #rejected it.
2. The Allahabad High Court in the impugned order rejecting bail had taken note of the #CCTVfootage collected during the investigation where the #accused was seen #chasing the #victim and even after some altercation, he continued to chase and threaten her and was also seen throwing certain liquid on her.
3. During the course of trial, the FIR dated September 7, 2021 was lodged for offences u/s 354A, 354D, 353, 283, 504, 506 IPC.
4. The accused allegedly made another attempt of acid attack on the victim for which charge-sheet was submitted under Section 326B, 354 and 506 IPC.
Submission of the Counsel of the Appellant
1. It was contended that appellant is in fact innocent and was falsely implicated in the case.
2. It was argued that in the injury report of the victim, no injury was found on her body.
3. Therefore, no offence under Section 326-B I.P.C. is made out against him.
4. Further that he is languishing in jail since September, 2022.
Earlier Allahabad High Court Rejected Bail Application
1. The Allahabad High Court in the order while rejecting the bail application had observed, “Considering the overall facts and circumstances of the case as well as keeping in view the submissions advanced on behalf of parties, gravity of offence, role assigned to applicant, severity of punishment and also considering the repeated offence of the applicant against the victim, who is a government servant, I do not find any good ground to release the applicant on bail”.

ACID ATTACK
Acid attack is not something unheard of in India. It has shocked the conscience of our nation again and again - with mutilated faces, unbeaten survivors coming to the frontlines to share their horrific stories, and families driven to bankruptcy supporting recovery costs. The Indian Penal Code was modified in 2013 for the first time to add regulations tailored to acid attacks. But have we done enough? Do enough of us care? Why should we care? Why should we care anymore than we do for general fight for women's rights and safety in India about acid attacks? Accepting a drink from a local shopkeeper? Or rebuking harassment on the streets? Just being in home sitting on a couch? These are all known causes of attacks on acid attack survivors. The lastest story - is that of Piyali Dutta - who got caught in a crossfire and now is an acid survivor for life. Sonali Mukherjee's story - attacked while sleeping in her own house for standing up to harassment - is one that should keep all of us awake as it could have been, or still can be, anyone. 85% of victims are women, so acid attack can overwhelmingly be classified as gender violence. For the 15% male victims, the primary cause of attack is property dispute. What factors allow such attacks? Un-counseled anger and frustration is behind the crimes as much as pre-disposition to sociopathic traits, and violence and societal chauvinism plays a significant role (85% of the victims are women). But the real culprit to blame is the ease to get away with it. Anger over rejection causes the desire to lash out and inherent disregard for women in specific and human suffering in general seeds the thought, but the lax laws - both to limit availability and to counter the crime - is what lets the perpetrators convert their thoughts in to action. Paints and household cleaners remain another easy to avail source and even though regulation has now been passed in India, the police force is understaffed to go after the numerous shops selling acids as household cleaners or cleaners with acid above permissible levels.
So What is the solution? Awareness campaigns appealing to public to not sell, distribute, or use - especially with listed consequences of high profile convictions and warning women to be aware of the signs and to take threats seriously,these are the things that we need to remember. (in almost all of the cases there had been pre-warnings and even something as simple as knowing to scream when being approached is known to be a deterrent)And all this needs to have central govt. allocated funding. Same is needed for widely publishing immediate first aid steps (acid burns need to be treated fast and right to minimize damage). Elimination of bureaucracy is needed for victim rehabilitation. All the steps discussed will not ease the pain of the victim but at least help them seek justice. NALSA’s Compensation Scheme for Women Victims/Survivors of Sexual Assault/other Crimes, 2018
"Acid Attack Survivor"
Present case is filed by the #survivor of #acidattack. Survivor happens to be the minor girl of 17 years and his brother also acid victim survivor of 14 years. The Compensation to acid attack survivor is awarded under the (National Legal Services Authority)#NALSA’sCompensationSchemeforWomenVictims/ #SurvivorsofSexualAssault/ #otherCrimes2018.
Paramita Bera & Anr. V. The Union of India & Ors. WPA 5633/2021, Before Hon'ble Calcutta High Court According to the scheme, a minimum compensation of Rupees 7 to 8 lacs is payable, with an additional 50% of the said amount, on account of the victim being a minor girl child.
Here the boy had been paid a sum of Rs.4,50,000/- as per the existing Rules.
Now the issue before the Hon'ble #CalcuttaHighCourt was addressing the claim of the minor girl. #SupremeCourt as well as the High Courts of the Country acknowledged that the Acid attack victim goes through the physical, economic, social, and psychological ramifications.
Hon'ble Apex Court in Parivartan Kendra Vs. Union of India & ors., reported in (2016) 3 SCC 571 felt the plight of the survivor and had observed that, 1. The likeliness of the victim getting a job which involves physical exertion of energy is very low. The social stigma and the pain that she has to go through for not being accepted by the society cannot be neglected. Furthermore, the general reaction of loathing which she would have to encounter and the humiliation that she would have to face throughout her life cannot be compensated in terms of money. 2. As a result of the physical injury, the victim will #notbeabletoleadanormal life and cannot dream of marriage prospects. 3. Since her skin is fragile due to the acid attack, she would have to take care of it for the rest of her life. Therefore, the aftercare and rehabilitation cost that has to be incurred will have huge financial implications on her and her family. Recently in Nipun Saxena & Anr. Vs. Union of India & ors., reported in (2020) 18 SCC 499, Hon’ble Court applauded the NALSA’s Compensation Scheme for Women Victims and added that,
1. We have gone through the Scheme prepared by NALSA with the assistance of the Amicus Curiae and we are of the view that it contains the best practices of all similar schemes and should be implemented by all the State Governments and Union Territory Administrations. 2. . ……We make it clear that the Scheme postulates only the minimum requirements. This does not preclude the State Governments and Union Territory Administrations from adding to the Scheme. However, nothing should be taken away from the Scheme.
Observation of the Calcutta High Court
1. The Apex Court’s judgement has created an obligation upon the State Governments to have similar provisions in consonance with the Scheme. 2. The NALSA’s Compensation Scheme for Women Victims 2018 provides that acid attack victims with face disfigurement, must get compensation ranging from a minimum of Rupees 7 lacs to a maximum compensation of Rupees 8 lacs. 3. The Scheme also postulates that minor victims are eligible for compensation that is 50% higher than the minimum amount specified in the Scheme. It appears that the State of West Bengal has not complied with the mandate of the Supreme Court in Nipun Saxena & anr. Vs. Union of India & ors (supra) and has failed to amend its own scheme of compensation in tune with NALSA’s Compensation Scheme for Women Victims/Survivors of Sexual Assault/other Crimes, 2018. 4. It is unfortunate that this West Bengal, which was once known for its progressive feminist discourse, with women such as Begum Rokeya Sakhawat Hossain, Sarojini Naidu Chattopadhyay and many others, has forgotten its feminist roots.
Order
Hon’ble Mr. Justice Shekhar B Saraf J vide order dt.08.09.2023, directed the Government of West Bengal to immediately act in accordance with the Supreme Court judgement and frame its scheme as per NALSA’s Compensation Scheme for Women Victims, 2018 within a period of eight weeks from 08.09.2023.
The girl child was a minor and is accordingly eligible for a minimum amount of Rupees 7,00,000/, as compensation as per NALSA’s Compensation Scheme 2018 and an additional 50% of the said minimum amount (i.e., Rupees 3,50,000/-) is payable to the victim on account of her being a minor girl child. Accordingly, the total compensation payable to the victim is Rupees 10,50,000/-. Further, the State of West Bengal was directed to pay the further sum of Rupees 7,50,000/- to the State Legal Services Authority, West Bengal who shall disburse the entire sum to petitioner no.1 within a period of four weeks from date.
