Tomorrow, Friday November 17, the German Bundestag will vote on a draft law that could decide that naturalization for residents would be dependent on a commitment to Israel’s right to exist.
The bill, which includes a law that would change the criminal code, was submitted by the Christian Democratic Party’s (CDU) parliamentary group.
It would impact individuals seeking residency, asylum, and naturalization, and its intent is to “provide better protection against the further entrenchment and spread of antisemitism that has “immigrated from abroad.”
“Since the day of the attack,” the law states in its introduction, “disgusting rallies and demonstrations have also taken place on German streets, expressing unconcealed joy at the deaths of Jews and revealing an alarming level of antisemitism.”
A majority of protests across Germany have not only been peaceful but have only called for the German government to back a ceasefire to stop the genocide of the Palestinian people.
I attended multiple demonstrations across Germany, and the only visible threat to public safety has been from the police. In fact, I was a witness to one demonstration in Frankfurt where the police banned it from taking place mere minutes before it was about to begin. Hundreds of people were met with water cannons, extreme levels of police presence, and kettling by law enforcement that led to the detainment of over 300 people.
In another I attended in Mannheim, the only act of antisemitism committed was a man on the sidelines of our protest raising his hand in a Nazi salute to antagonize and intimidate pro-Palestinian demonstrators. He was arrested soon after, and local publications reported he was, in fact, not a part of our planned demonstration.
In 2022, over 80 percent of all antisemitic crimes in Germany were committed by the German far right, according to the federal police. However, the new draft bill does not include these statistics. Instead, it attributes violent antisemitism with sympathy with “Hamas terrorism,” which they claim is “cheered and propagated on German streets and schoolyards.”
The bill clearly singles out Arabs and migrants, claiming antisemitism in Germany is now only “imported.”
“A significant portion of those are obviously immigrants from countries in North Africa and the Middle East, where antisemitism and hostility towards Israel have a particular breeding ground,” the draft law states, backed by no concrete evidence for such remarkable claims.
It continues: “as well as their descendants, the instruments of residence, asylum and citizenship law must be used more consistently than before- in addition to general means such as criminal law- in order to combat antisemitism in Germany more effectively.”
In summary, the law not only creates a prerequisite where a citizenship application will only be granted if the individual declares a commitment to Israel’s right to exist and swears that they did not pursue any endeavors directed against Israel, but it can also strip the residency status and the citizenship of dual nationals who have been convicted of an antisemitic crime. This would also include a prison sentence of at least one year.
“Maintaining the legal status quo is not an option,” the draft law says, “as the current legal situation is clearly not suitable for effectively combating the specific antisemitism that is widespread among some foreigners in Germany.”
In Germany, what constitutes an “antisemitic crime” is extremely ambiguous. In 2017, the federal government officially adopted the International Holocaust Remembrance Alliance’s (IHRA) Working Definition of Antisemitism. Advocates, scholars, and legal experts at the European Legal Support Center (ELSC) as well as other organizations for example, have long criticized the IHRA definition, arguing it redefines antisemitism by wrongly conflating criticism of Israel with anti-Jewish racism.
According to a report conducted by ELSC and published earlier this year, the invocation of the definition almost exclusively targets Palestinian rights advocacy, harming Palestinian and Jewish activists in particular.
Now that Germany has specifically labeled the protests as examples of antisemitism that should be criminalized, there is much cause for concern for pro-Palestinian activists. Already, there have been examples such as the stripping of refugee status from a Palestinian activist from Syria and denying residency to Palestinian doctors who have only been a part of a Palestinian cultural group.

“Violent excesses at demonstrations- such as the pro-Palestinian demonstrations in October 2023- must be appropriately sanctioned. However, the increasing abuse of the right to demonstrate can often not be adequately punished,” the draft law says. “The regulation of breach of the peace is too narrow.
We have already witnessed banned demonstrations in cities and violent police arrests detaining people only carrying flags and wearing keffiyehs or simply holding anti-war signs. In Berlin, home to one of the largest Palestinian diasporas in Europe, there have been regular police presence and clear examples of racial profiling, and harassment against anyone who might “look” like they are attending a previously banned demonstration.

Anyway, as a political asylum applicant, I still don’t see to what end there would be a political mobilization of normative discourses that are being roundly rejected by the government of Italy- discourses which I am familiar with- in order to subsequently argue that since the government of Italy is rejecting such discourses then it should not be considered a viable option for asylum on the grounds of my being gender queer- which is claimed to have been what I have been concealing from the Italian office of immigration.
Well… I mean… there is the likely intended outcome of my political asylum application being rejected, but even then the degree of political interference will be particularly salient such that the degrees of freedom (which is a statistical term) permitted the government of Italy, with regard to its own domestic immigration regulations, would be significantly limited to such an extent that it would be simply too inconvenient for Italy to continue to consider my application to the ends my request has been made to achieve.

Equal Launchpad? The Discrimination Allegations Rocking SpaceX

With all the controversy surrounding Elon Musk’s ventures into the website formerly known as Twitter, one almost forgets that he also runs spacecraft manufacturer and designer SpaceX. But the South African entrepreneur has had his hands full recently, with SpaceX being named in a lawsuit by the Department of Justice on August 24th, alleging discrimination in its hiring policies over claims that the company has unfair hiring practices with regards to asylees and refugees [1]. In United States of America v. SPACE EXPLORATION TECHNOLOGIES CORP. d/b/a SPACEX, the DOJ cites various examples of violating the Immigration and Nationality Act, a seminal piece of legislation from 1952 that governs all things immigration and citizenship in the United States. The complaint states that “online postings and statements by [Musk] and other SpaceX officials and recruiters… discouraged asylees and refugees from applying to the company by wrongly stating that SpaceX can only hire U.S. citizens and lawful permanent residents” [2].
Seeking asylum and refugee status are some of the most important concepts in international law, legally protecting the rights of citizens being unfairly persecuted by their own governments, and allowing them to migrate to other countries for their own safety. The process of seeking asylum and refugee status (slightly different concepts that will be used interchangeably for the purposes of this article) in the United States is rather complex and in need of reform, but the country houses a significant amount of these persons, as the U.S. has welcomed more than three million refugees since 1975 [3] and averaging about eighteen thousand asylum seekers entering the country yearly since 1990 [4]. However, neither people granted asylum or refugees are eligible to receive citizenship or a green card for at least a year after entering the country, and this immigratory gray area is what SpaceX has been accused of discriminating against. It is perfectly legal to work in the United States while awaiting a green card, and the DOJ reference 8 U.S.C. § 1158(c)(l) and Section 7.3 (Refugees and Asylees) of the U.S. Citizenship and Immigration Services Handbook for Employers as argument for this assertion.
And yet Musk alone was cited to have claimed that the company was not allowed to hire employees that did not have a green card on multiple occasions, both on Twitter and in video tapings of interviews. Furthermore, SpaceX’s own hiring records show multiple instances of applicants being rejected due to their lack of US citizenship, including a case of “an asylee who had more than nine years of relevant engineering experience and had graduated from Georgia Tech University” being rejected by a recruiter using the code “"not authorized to work/ITAR ineligible". Another case involved a job applicant rejected by a recruiter using the more neutral code "doesn't meet preferred qualification," while a hiring manager listed the reason as, "not U.S. citizen or green card." But the most concerning statistic of all? Out of more than 10,000 hires in between September 2018 and May 2022, SpaceX hired only one individual who was an asylee and identified as such in his application, merely four months after the company was notified that they were under investigation by the Immigrant and Employee Rights Section (IER) in 2020.
The IER’s investigation concluded in November 2022 after delays caused by SpaceX’s drawn out submitting of key records, and “found reasonable cause to believe that SpaceX had engaged in a pattern or practice of unfair immigration-related employment practices in violation of 8 U.S.C. § 1324b(a)(l)(B).”, leading to the DOJ’s lawsuit. Lawyers and judges will decide on the merits of the case, but the publicity that has stemmed from the lawsuit, not to mention what will be said if the courts rule in the DOJ’s favor, will do nothing but hurt the SpaceX reputation already faltering due to Musks’ other ventures. A new bipartisan swing-state poll from Global Strategy Groups showed 82 percent of voters marking that they “believe the immigration system is broken” [5], indicating that immigration policy is an extremely relevant issue in current politics. The United States has always been a country founded on immigrants, but the modern political landscape now more than ever is focused on reform, and takes issues such as discrimination more seriously. In this sense SpaceX has already lost from this case, with the company surely being forced to publically reevaluate their hiring practices regardless of the eventual verdict.

Trump cited the need to address the threat of terrorism as the catalyst for the travel ban, with the White House fact sheet noting specifically about Afghanistan: "The Taliban, a Specially Designated Global Terrorist (SDGT) group, controls Afghanistan. Afghanistan lacks a competent or cooperative central authority for issuing passports or civil documents and it does not have appropriate screening and vetting measures." The administration also cited visa overstay statistics in its reasoning for Afghanistan's inclusion. A separate program giving Afghan nationals temporary protected status in the U.S. expired in May, with final termination scheduled for July 14. In a news release at the time the end of that status was announced, Secretary of Homeland Security Kristi Noem stated: "Afghanistan has had an improved security situation, and its stabilizing economy no longer prevent [Afghans] from returning to their home country." The release further explained that Noem "determined that permitting Afghan nationals to remain temporarily in the United States is contrary to the national interest of the United States." The head of AfghanEvac, Navy veteran Shawn VanDiver, called the travel ban a "betrayal." "This ban does nothing to protect Americans. It punishes Afghan allies, family members, students, professionals, and humanitarian parolees—many of whom were already promised a pathway to safety," he said in a statement.
