The High Court set aside the order of the Special Inspector General of Prison, Nagpur & directed him to reconsider the application of the petitioner for Furlough Leave for an appropriate period with suitable conditions.

The Court observed that the purpose of furlough leave is to maintain family ties and assist in the prisoner’s rehabilitation. Denying furlough without solid evidence of a real and imminent risk undermines this objective.

Fact

The petitioner, Pralhad Feku Gupta, a convict serving life imprisonment for offenses under Sections 302, 449, 436, and 201 of the Indian Penal Code, sought furlough leave for 28 days to spend time with his family. The application for furlough was denied by the Special Inspector General of Prison, Nagpur, based on a negative report from the Superintendent of Police, Maharajganj, Uttar Pradesh. The petitioner challenged this denial under Articles 226 and 227 of the Constitution of India.

Argument of the Parties

Petitioner's Submission

The petitioner has already served four years, five months, and twenty-five days of his life sentence.

Furlough leave is a legal right intended to allow prisoners to reconnect with their families, which plays a crucial role in their rehabilitation and reintegration into society.

The petitioner is willing to provide a surety, and his family is ready to support him during his furlough period.

Respondent State's Submission

The negative police report was primarily based on the possibility of the petitioner absconding due to his young age (26 years) and unmarried status.

However, the police report dated 26.07.2023 acknowledged that the petitioner’s mother was willing to act as a surety and that the petitioner’s release would not cause any law and order issues in Uttar Pradesh.

Court's Observation

The grounds for rejecting the furlough leave were not substantial or compelling. The mere possibility of absconding, based on age and marital status, is speculative and does not constitute a valid reason for denial.

The sanctioning authority cannot blindly accept a police report without assessing the overall situation and considering the potential benefits of allowing furlough with appropriate conditions.

I feel like if anything Christian is a professor…with the way he be schooling those-

He’s probably very knowledge in various subjects

But if anything he’ll adapt to it, just trying to help you

I HAVE A THEORY that he’ll stay up reading the next chapter or the directions for your next assignment and tries to figure out ways to make the process easier

i mean truly no disrespect but the older generation is so weirdly excited about ai and chat gpt like i get some level of excitement but my company is so excited about it they want to use it for everything. i already dodged the bullet when they wanted to replace our translator when i told them someone still has to check on translation anyway bc it just simply can make mistakes or be poisoned by activists. and during my last performance review my manager pointed out how i keep forgetting small things and she gave me a "homework" to think about ways i can keep track of things i supposed to do daily. and she said and i kid you not "maybe ask chat gpt for some apps or something". girl i can google it. chat gpt is going to google it. its just one extra step in googling. why would i use that. to read a review? its going to have micro transactions hidden inside of it anyway

DO NOT USE KOKOBOT

While not a "will scam you out of your money" thing, the Kokobot is just not ethical or a good idea. Its from a "mental health nonprofit" from the minds that brought you "airbnb aka ruining the housing market with the gig economy".

For one thing, they're acting like mental health professionals aren't real people which feeds into all sorts of biases.

Then one has to consider, if they're "random people", do they have the training for crisis management? Can they tell if someone is about to commit suicide or is just having thoughts? Can these people handle more disturbing discussions?

Its like a tech bro decided to see if its possible to make money off a discord vent channel with all the major problems of a discord vent channel (no therapists, no crisis management, pls stop using the vent channel to replace therapy) left unsolved.

Oh but it somehow gets worse.

See. One of the co-founders of Koko had the brilliant idea to set up an experiment to see if chat gpt can be used to replace actual people/professionals.

He even stated he didn't bother going to the ethics review board aka IRB because he believed he was exempt from their rules.

Oh, and no one involved in the experiment consented, there was anger they were talking to a bot, AND many of Koko's users are adolescents. As far as we know this didn't lead to anyone spiralling but we DON'T KNOW SINCE THIS WAS AN INFORMAL EXPERIMENT.

Now, there is some debate as to whether or not the IRB COULD get involved, due to lack of clarity regarding how scientific this was.

Regardless, it was unethical and dangerous. Be wary of Koko amd Kokobot.
