Allow me to tell you about the protests at Shaheen Bagh

Allow me to tell you about the women of Shaheen Bagh.

In Shaheen Bagh, Delhi, for about a month now, women have been gathered around the clock to protest the Citizenship act that has been introduced by the BJP regime which gives selective citizenship to refugees on the basis of religion, particularly excluding from within its ambit Muslim refugees from the neighbouring countries.

These women have managed to keep alive the flame of the anti-CAA protests in India in an unprecendented way and historic way. They have sat outside in peaceful resistance for a month now, braving the coldest winters Delhi has witnessed in the last 100 years.

They are here to save the Constitution, they are here for every student that was mercilessly beaten by the police, they are here to save the idea of the country that they were born in and which no political entity has the right to eject them from.

“Mariyam Khan (centre) is a homemaker who has attended the protest every day since the sit-in began. ‘Kya karenge? Laathiyaan barsayenge? Maar denge? Humare dil mein phir bhi mohabbat hi rahegi (What will they do? Will they beat us? Will they kill us? Note that this protest is spearheaded by the Muslim women of Shaheen Bagh, but is now joined by men and women who are Hindu, Sikh and Christian who stand in solidarity with the efforts of these brave women.

“I have been covering the Shaheen Bagh protests since Dec 16 2019 and it has been the most inspiring movement I have ever witnessed. This movement reiterates the pivotal role that women play in social and political movements. The women of Shaheen Bagh take turns to stay at the protest site despite the biting cold so that they can manage their daily chores and jobs while continuing to maintain a good number at the Kalindi Kunj Highway, which they jave blocked since 15 december in protest against CAA, NRC, NPR. It is the only 24-hour protest that has been going on continuously since it started. The two special things about this particular protest are- how it shatters notions of patriarchy and how the entire community is coming together to support the smooth running of this protest. People living around Shaheen Bagh collect and donate whatever they can for the protestors- food, tea, mattresses and quilts- there is no official organiser of this protest, it is a people’s protest, yet you will always find an active team of volunteers maintaining decorum, helping people out and keeping the protest going. I cannot say it any more succintly than Nausheen did. And yet. And yet this government won’t even care to visit these women.

(The crowd gathered in Shaheen Bagh in solidarity with the women raising their tricolored flags to display that being Muslim should not mean being questioned about loyalty to one’s country at all. In the next picture, protestors have written the words हम देखेंगे, meaning “We will see” on the streets, harkening back to the icnonic and revolutionary poem by Faiz Ahmed Faiz that was written aginst the brutal tyranny of the state of Pakistan during the regime of Zia Ul Haq.)

Shaheen Bagh is not the debate room of an elite university, nor the fire-lit living room of an urban family where the problems of the country are discussed over a glass of wine. These are REAL PEOPLE who will be most affected by this act, who yes, HAVE READ THE ACT. NOBODY WOULD BE OUT ON THE STREETS IF THEY HADN’T READ THE ACT WE ARE NOT A BJP PRO CAA RALLY. Anyways, I think these women deserve a special recognition in history, in society, in the world, especially because these are the people (homemakers, elderly, Muslim, women) who will most repeatedly be erased from this narrative. And I don’t know how many people outside India are aware about this fact, but Muslim people in this country are constantly questioned about their loyalty towards India. They are constantly told to “Go to Pakistan” if they voice their opinion about not feeling safe in India. They are constantly told to prove their love for their motherland. I suppose most of us have a mother. How would you feel if a stranger walked up to you on the road and asked you if you love your mother? And if you said yes? What would you do if they asked you to show how and in what way, to what extent, you love your own mother? Its absurd and its everything wrong with this regime and its supporters. They have appropriated being patriotic.

Singh spoke eloquently on the need to protect the tribes, and ensure conditions that could help them come up to the level of the general population. Ans. K.Santharam, a member from the Madras defended the rights of the states in the Constituent Assembly. They were also required to be brought into the mainstream of the society. So special protection and care were offered to them. In society untouchables were treated as labourers. Society used their services but did not give them respectable position. They were treated as outcast and kept isolated. Their sufferings were due to their systematic marginalization. Lands of the tribals have been confiscated and had been deprived of their forests and pastures. Tribals and untouchables had no access to education. They did not take part in administration. So some legislations were required to improve their conditions. Q 7. What connection did some of the members of the Constituent Assembly make between the political situation of the time and the need for a strong Centre?

Ans. On 15 of August 1947, India became independent from the British rule. It was declared an independent country. But this independence was painful also. India was divided and Pakistan came into existence. This partition was marred with communal violence. So many leaders like Jawaharlal Nehru and Ambedkar favoured a strong Central Government for India. For their view they referred riots and violence that were ripping the nation apart. It was also felt that a strong centre was the need of the hour. Most of the members of the constituent Assembly also supported this view. Any deviation from this might jeopardize the interests of the nation. Peace, prosperity and political stability was not possible in case of a weak centre. It would fail to coordinate vital matters of common concern. So Gopalaswami Ayyangar appealed to all the members of the Constituent Assembly that” the Centre should be made as strong as possible.” It was also felt that only a strong and united centre could plan for the well-being of the country. Balakrishna Sharma also stated the similar view. It was also felt that it would mobilize all the resources , ensure strong defence against any aggressor and establish a proper administration. Almost all the members of the Constituent Assembly supported a strong central government. They felt that it was necessary to check chaos, communal violence and to usher economic development of the country. Q 8. How did the Constituent Assembly seek to resolve the language controversy?

Ans. India is very big country. It has many different regions. Different varieties of people live here and speak different languages. So for a new nation like India it was necessary to give proper attention to the intricacies of different languages.

Hindustani: Hindustani was a choice for the Congress and Mahatma Gandhi. Congress had already decided to adopt Hindustani as the national language of the country. Mahatma Gandhi was also in favour of adopting Hindustani as the national language and supported strongly for this view. He argued that everyone should speak in a language which is understood by most of the common people. Hindustani was not a new language. It was a blend of Hindi and Urdu. It was enriched by the interaction of diverse cultures and spoken by most of the people of the country.

Hindi: R.V. Dhulekar pleaded in favour of Hindi for adopting it as the national language. He came from the United Province and a Congressman. He wanted that Hindi should be used as language of constitution-making . He even said that those who did not know Hindustani were not worthy to be the members of the Constituent Assembly.

Report of the Language Committee: The language Committee of the Constituent Assembly suggested a compromise formula in its report. It suggested that Hindi in Devnagri script should be the official language of the country and tried to resolve the issue. It also suggested that transition from English to Hindi should be gradual. It was also suggested that during first fifteen years since adoption of the Constitution, English would continue to serve as for official purposes. So it was clear that the Language Committee referred Hindi as the official language not the national language.

Threat to South: The members of the Constituent Assembly who belonged to the Southern India were apprehensive of the view. They felt that Hindi would be a threat to their provincial languages. Shankar Rao from Bombay . T.A. Ramalingam Chettiar and Mrs. G. Durgabai of Madras suggested that issue of language required utmost care and needed to be handled efficiently and dextrally. The Board had last month issued a notification according to which grace marks would be granted in subjects like Sanskrit and Urdu, said a Business Insider report. While last year the Class 10 board results were out on 29 April, students usually get their results every May. However, candidates had to wait this year due to the COVID-19 pandemic. The board exams of Class 10 students were conducted from 5 to 19 March across various centres around Himachal Pradesh. According to the Indian Express, around 1.5 lakh students had appeared for the exams this year. The HPBOSE Class 12 exams were held from 4 March and were supposed to continue till 27 March, 2020. As the Geography examination was pending, the board recently announced that it would be conducting the same on 8 June across over 300 centres in the state. They serve as an ever-important reminder of the urgency of the fight for immigrant justice on our southern border and the need to stand up to the Trump administration's policies denying humanitarian protection and basic due process to families fleeing for their lives. 

We remain at the frontlines of the family separation fight. In early 2018, the ACLU filed a federal lawsuit to stop the separation of families at the border and to require the immediate reunion of all separated children and parents. And last June, a federal judge issued a national injunction in our lawsuit, requiring the reunification of thousands. We have continually fought the administration’s efforts to stonewall the reunification and continue their zero-tolerance policy toward people who come to the United States seeking asylum.

We are in court working to block President Trump’s abuse of emergency powers to secure funds for a border wall Congress denied (thanks in part to our advocacy in D.C.). In May, a federal judge ruled in our lawsuit, which we filed on behalf of the Sierra Club and the Southern Border Communities Coalition (SBCC), that President Trump couldn’t get his wall by illegally diverting taxpayer money. The Sierra Club and SBCC represent the communities who live in, protect, and treasure the lands and communities along the southern border. The Trump administration appealed that decision, and we await the next steps from the 9th circuit.

But we’re not just responding to the moment — we’re building for immigrant justice in the future. The ACLU is a nationwide organization, with an on-the-ground presence in all 50 states, the District of Columbia, and Puerto Rico. Because we have a vibrant presence in every state, we at the ACLU are not only able to push back against abuses and litigate, but also work to enact pro-immigrant rights laws.

The Border Rights Center (BRC), housed at the ACLU of Texas, advocates for the 15 million people from California to Texas who call our southwest border home. The ACLU staff in our affiliates and the BRC work closely with border communities and people coming to the United States, and serve as an important watchdog on the federal immigration agencies at the border, especially Customs and Border Protection (CBP). This week, they shared this latest dispatch about the inhumanity and suffering of the people in our government’s care at the border.

After we filed our family separation lawsuit, it quickly became clear that the Trump administration didn’t have a plan to meet the court-ordered deadlines to reunite families. In one court filing, lawyers for the Trump administration suggested that the ACLU should take on the responsibility of finding those missing parents. Because the government wasn’t willing to carry out the search itself, the ACLU, along with a small group of other organizations, set out to do just that. Across the country, we, in partnership with movement leaders and activists, have built coalitions necessary to move a proactive agenda forward in the states. In Washington state, Colorado, Connecticut, Illinois, Utah, New York, and others, we’ve seen legislatures stand up for immigrants, and we have been proud to support allies and fellow community members in pushing for positive change. 

In Washington, we helped lead the coalition that just three weeks ago passed the American Dream and American Promise Act to protect Dreamers as well as Temporary Protected Status and Deferred Enforced Departure beneficiaries from deportation. It’s a historic piece of legislation that affects more than two million immigrants and is the first stand-alone bill granting a pathway to citizenship to pass a chamber of Congress since 2010. It also represents an essential victory for undocumented activists and all those whose lives have been thrown into uncertainty by the Trump administration. We are currently looking towards the Senate to pass this bill so that it can become law.

Even in the midst of extreme rhetoric, many of these wins will limit the Trump administration’s ability to carry out its threats to deport millions.

Across the country, volunteers with our Rights for All campaign are asking presidential candidates to commit to an overhaul of our immigration system. We know that executive leadership is necessary to create a fair and achievable path to citizenship for people who are undocumented, to reduce the number of people languishing in immigration detention, and to put an end to ICE’s reliance on local law enforcement to facilitate deportations.

Our volunteers are securing commitments from presidential candidates and holding them accountable to civil rights for all, regardless of immigration status. We are already seeing the impact of this work, with the criminalization of border-crossing — a policy against which the ACLU has fought for years — getting significant attention at the first democratic presidential debate.

The ACLU is also educating people in America about their rights, especially when dealing with immigration officials. Last year, we joined forces with Brooklyn Defender Services to create and distribute a series of powerful and informative videos based on true stories to provide real action points for what to do when ICE is outside our doors, in our homes, in our communities, and/or arrests us. The videos are available in English, Spanish, Urdu, Arabic, Hatian Creole, Russian, and Mandarin.
