The Presumption of Guilt

Fresh from the supposed celebration of equality when same sex marriage became the law in Australia, to borrow from Act III Scene 2 of the 1697 play by William Congreve, Australia is now the The Mourning Bride.  Australia is in the midst of a lust driven vengeance campaign to abandon the rule of law and the presumption of innocence.

In 2012 it was politically convenient to deny the then Speaker of the House of Representatives, Peter Slipper the presumption of innocence and subject him to a vicious media trial. Australia was in the midst of a relentless media campaign to elect a man who turned out to be the worst Prime Minister in our history, a man who could do no wrong in the eyes of his considerable media supporters.

Some time later then Qld ALP backbencher, Billy Gordon was denied the presumption of innocence and subjected to an intense media trial as a result of allegations of domestic violence and unpaid child support from a former romantic partner. The woman making the allegations against Mr Gordon apparently drew no comfort from both the ALP and the LNP when she was making her complaint. She chose the comfort of former LNP member Gavan King, whose primary motivation at the time was to gain publicity for a book he was writing about former Premier Campbell Newman.

Both the ALP and the LNP demonstrated that they did not know how to pursue a domestic violence complaint. Interestingly none of the agencies that one might expect to assist in such a matter seem to have been contacted for assistance. Nor were any of the legal firms who claim expertise in domestic violence and family law matters, despite their advertising campaigns that they provide such a service.

The media trial lead to Mr Gordon ending his relationship with the ALP and becoming an independent member of state Parliament. There was no prosecution of him by the police for domestic violence, but the then opposition leader Lawrence Springborg released and distributed confidential Child Support Agency material of Mr Gordon for political expedience. Mr Springborg was not prosecuted.

More recently, Greens senator and alleged human rights activist, Sarah Hanson-Young is a keen advocate for asylum seekers and that they should enjoy the presumption of innocence and all of their rights and privileges.  Fresh from having the High Court rule that two of her party colleagues were not eligible to sit or be chosen for the Senate because they were foreign citizens at the time they nominated for election in June 2016, (a situation that arose because they chose not to do proper due diligence on their personal circumstances prior to nominating for the election) Ms Hanson-Young ventured into the domain of local human rights.

The Daily Telegraph newspaper had recently run a front page story on allegations of improper conduct against actor Geoffrey Rush. A little earlier allegations of improper conduct had been made against another entertainment industry identity, Don Burke. Ms Hanson-Young chose to deny the presumption of innocence to actor Geoffrey Rush after she learned of the allegations in respect of him and she chose to link Mr Rush to Mr Burke, before condemning Mr Rush as similarly guilty to Mr Burke.

Mr Rush denied the allegations against him and subsequently sued the newspaper for defamation.

Undeterred by the Geoffrey Rush defamation action, another set of allegations of improper conduct were made against a high profile male entertainment industry member, all of which were denied by the entertainer in question.

Predictably the baying masses were enlivened and the calls for denying the presumption of innocence were many.

Vigilantism is the only solution for the enraged horde, who claim that the justice system with which they choose not to cooperate, delivers results that are inadequate for their vengeful appetites. Challenging the complaint and the allegations is now forbidden and those who seek to do so are infidels, deserving of complete contempt and utter scorn.

The lust for instant justice does not concern itself with the overall good of the community. It is an appetite satiated only by instant gratification.

The hypocrisy of demanding human rights for asylum seekers whilst trying to deny them to local residents is not a consideration of any significance to the madding crowd.

So visitors to Australia will now learn that all it takes is an allegation to ruin a reputation, a career and a life. An allegation that need not be supported by any tangible evidence and one that is not entitled to be challenged in any way, shape or form.

The “Acceptable” Price of False Complaints

If  you think false complaints are an acceptable price to pay in the pursuit of convictions for sexual assault and rape, then you would be happy for such a false complaint to be made about you.

As you believe all complainants should be believed, even those making false complaints, you would not challenge the evidence against you at your trial, even though that evidence is based on a false complaint.

Invariably that would lead to a conviction for you for a rape or sexual assault that you did not commit, because it was based on a false complaint.

In turn that would often lead to a jail sentence for you as a result of that conviction.

But you being convicted because of a false complaint of a rape or sexual assault that you did not commit would not trouble you, because you believe that false complaints are an acceptable price to pay in the pursuit of convictions for sexual assault and rape.

In a civilised and just society the Rule of Law applies equally to everyone. Within that society the following apply in respect of that Rule of Law: 1 The presumption of innocence 2 The right to a fair trial 3 An unproven and untested allegation is not determinative of guilt 4 Not all complainants and witnesses are truthful

A biased system is one that removes / abandons the rule of law and grants ultimate power to accusers, denying the accused the right to a fair trial in a Court properly constituted under the law. One where the accuser should always be believed, even when they are lying.

Brave is supporting the Rule of Law when the lust is to deny the right to a fair trial. The space to be heard is at a fair trial, in a Court properly constituted under the law. Dangerous is to condemn someone on the basis of an unproven and untested allegation. Hypocrisy is to demand human rights for one sector of the community whilst denying them to another.
