A new lawsuit filed by more than 100 federal workers today in the US Southern District Court of New York alleges that the Trump administration’s decision to give Elon Musk’s so-called Department of Government Efficiency (DOGE) access to their sensitive personal data is illegal. The plaintiffs are asking the court for an injunction to cut off DOGE’s access to information from the Office of Personnel Management (OPM), which functions as the HR department of the United States and houses data on federal workers such as their Social Security numbers, phone numbers, and personnel files. WIRED previously reported that Musk and people with connections to him had taken over OPM.
“OPM defendants gave DOGE defendants and DOGE’s agents—many of whom are under the age of 25 and are or were until recently employees of Musk’s private companies—‘administrative’ access to OPM computer systems, without undergoing any normal, rigorous national-security vetting,” the complaint alleges. The plaintiffs accuse DOGE of violating the Privacy Act, a 1974 law that determines how the government can collect, use, and store personal information.
Elon Musk, the DOGE organization, the Office of Personnel Management, and the OPM’s acting director Charles Ezell are named as defendants in the case. The plaintiffs include over a hundred individual federal workers from across the US government as well as groups that represent them, including AFL-CIO, a coalition of labor unions, the American Federation of Government Employees, and the Association of Administrative Law Judges. The AFGE represents over 800,000 federal workers ranging from Social Security Administration employees to border patrol agents.
The plaintiffs are represented by prominent tech industry lawyers, including counsel from the Electronic Frontier Foundation, a digital rights group, as well as Mark Lemley, an intellectual property and tech lawyer who recently dropped Meta as a client in its contentious AI copyright lawsuit because he objected to what he alleges is the company’s embrace of “neo-Nazi madness.”
“DOGE's unlawful access to employee records turns out to be the means by which they are trying to accomplish a number of other illegal ends. It is how they got a list of all government employees to make their illegal buyout offer, for instance. It gives them access to information about transgender employees so they can illegally discriminate against those employees. And it lays the groundwork for the illegal firings we have seen across multiple departments,” Lemley told WIRED.
EFF lawyer Victoria Noble says there are heightened concerns about DOGE’s data access because of the political nature of Musk’s project. For example, Noble says, there’s a risk that Musk and his acolytes may use OPM data to target ideological opponents or “people they see as disloyal.”
“There's significant risk that this information could be used to identify employees to essentially terminate based on improper considerations,” Noble told WIRED. “There's medical information, there's disability information, there's information about people's involvement with unions.”
The Office of Personnel Management and the White House did not immediately respond to requests for comment.
The team behind the lawsuit plans to push even further. “This is just phase one, focused on getting an injunction to stop the continuing violation of the law,” says Lemley. The next phase will include filing a class-action lawsuit on behalf of impacted federal workers.
“Any current or former federal employee who spends or loses even a small amount of money responding to the data breach, for example, by purchasing credit monitoring services, is entitled to a minimum of $1000 in statutory damages,” Lemley says. The complaint specifies that the plaintiffs have already paid for credit monitoring and web monitoring services to protect themselves against DOGE potentially mishandling their data.
The lawsuit is part of a flurry of complaints filed in recent days opposing various executive orders signed by Trump as well as activities conducted by DOGE, which has dispatched a cadre of Musk loyalists to radically overhaul and sometimes effectively dismantle various government agencies.
An earlier lawsuit filed against the Office of Personnel Management on January 27 alleges that DOGE was operating an illegal server at OPM. On Monday, the Electronic Privacy Information Center, a privacy-focused nonprofit, brought its own lawsuit against OPM, the US Department of the Treasury, and DOGE, alleging “the largest and most consequential data breach in US history.” Filed in a US District Court in Virginia, it also called for an injunction to halt DOGE’s access to sensitive data.
The American Civil Liberties Union (ACLU) has similarly characterized DOGE’s data access as potentially illegal in a letter to members of Congress sent last week.
The courts have already taken some limited actions to curb DOGE’s campaign. On Saturday, a federal judge blocked Musk’s lieutenants from accessing Treasury Department records that contained sensitive personal data such as Social Security and bank account numbers. The Trump Administration is already aggressively pushing back, calling the order “unprecedented judicial interference.” Today, President Trump reportedly prepared to sign an executive order directing federal agencies to work with DOGE.

Let’s be absolutely clear about what’s happening, Donald Trump and Elon Musk are executing a full-scale hostile takeover of the federal government’s tech infrastructure, turning nonpartisan, career-protected civil servant positions into political appointees they can install at will. This is not about efficiency. It’s not about governance. It’s about raw, unchecked power.
For decades, agency CIOs have been nonpartisan professionals, selected for their expertise, not their political allegiance. Now, with this move, Trump is stripping away that impartiality and opening the floodgates for political loyalists—potentially Musk’s own allies—to take over the very systems that handle federal cybersecurity, IT budgets, and even the infrastructure of government payments.
This isn’t just a problem—it’s a national security nightmare. We are talking about the people who oversee our country’s most sensitive digital infrastructure being hand-picked based on political loyalty rather than competence. And it gets worse: Musk’s so-called “Department of Government Efficiency” (DOGE) has already infiltrated agencies, accessed critical databases, and clashed with federal officials. Two USAID employees were put on leave simply for trying to protect sensitive government data. That’s not “efficiency.” That’s authoritarianism.
And let’s not forget—Trump just signed an executive order making it easier to fire career civil servants. This means that anyone standing in the way of this coup, anyone trying to blow the whistle on corruption, anyone daring to say “no” to Trump and Musk’s reckless overreach, is now at risk of being tossed out and replaced with yet another yes-man.
This is what happens when you let an unhinged billionaire and a twice-impeached authoritarian work together to consolidate power. It’s no longer about governing; it’s about control. Control of government systems, control of the workforce, and control of the very mechanisms that keep democracy running.
And the kicker: the White House “rightly expects” these new CIOs to not just execute policy but actively sell Trump’s agenda to the public. Translation? These positions aren’t just being politicized—they’re being turned into propaganda arms.
This isn’t just a “tech coup,” it’s a direct assault on the very foundation of an independent and functional government. And if Republicans in Congress—or anyone who still believes in democracy—don’t step up to stop this, we are looking at a federal government whose IT systems, cybersecurity defenses, and sensitive data will be under the control of Trump’s cronies and Musk’s minions.
This is corruption in broad daylight. The only question now is: who’s going to have the courage to fight it?

Several of Elon Musk’s associates installed at the Office of Personnel Management (OPM) have received unprecedented access to federal human resources databases containing sensitive personal information for millions of federal employees. According to two members of OPM staff with direct knowledge, the Musk team running OPM has the ability to extract information from databases that store medical histories, personally identifiable information, workplace evaluations, and other private data. The staffers spoke on the condition of anonymity because they were not authorized to speak publicly and feared professional retaliation. Musk Watch also reviewed internal OPM correspondence confirming that expansive access to the database was provided to Musk associates.
The arrangement presents acute privacy and security risks, one of the OPM staffers said. Among the government outsiders granted entry to the OPM databases is University of California Berkeley student Akash Bobba, a software engineer who graduated high school less than three years ago. He previously interned at Meta and Palantir, a technology firm chaired by Musk-ally and fellow billionaire Peter Thiel. Edward Coristine, another 2022 high school graduate and former software engineering intern at Musk’s Neuralink, has also been given access to the databases.
Other Musk underlings embedded at OPM following President Donald Trump’s inauguration include the agency’s new chief of staff, Amanda Scales, who until January was a human resources staffer at xAI, Musk’s artificial intelligence firm, and Brian Bjelde, who has spent the past 21 years at Musk's SpaceX, including the last 10 leading the human resources department. They are joined by Gavin Kliger, a former Twitter software engineer serving as a special advisor to the director of OPM, and Riccardo Biasini, a former software engineer at Musk’s tunneling venture, the Boring Company. OPM did not respond to a request for comment. Shortly after Trump took office, OPM installed Greg Hogan to serve as its new chief information officer (CIO). Hogan was tapped to replace OPM CIO Melvin Brown, who had accepted the job less than a month ago. The civil servants who oversee the OPM’s information technology services were then instructed to provide access to Musk's associates, according to the OPM staffers who spoke to Musk Watch. One of the OPM staffers received an email from the agency’s new leadership instructing them to give Musk’s team “access [to] the system as an admin user" and "code read and write permissions." “They have access to the code itself, which means they can make updates to anything that they want,” the staffer explained. USAJOBS, the federal government’s official hiring site, was one of the systems that Musk's associates were given access to. The database stores personal information — Social Security numbers, home addresses, employment records — provided by private individuals who have applied for federal jobs, regardless of whether the applicants went on to work for the government. Musk’s aides were also given access to the OPM’s Enterprise Human Resources Integration (EHRI) system. Contained within the EHRI are the Social Security numbers, dates of birth, salaries, home addresses, and job descriptions of all civil government workers, along with any disciplinary actions they have faced. “They’re looking through all the position descriptions… to remove folks,” one of the OPM staffers said of Musk’s team. “This is how they found all these DEI offices and had them removed — [by] reviewing position description level data.” Other databases Musk’s team has access to include USA Staffing, an onboarding system; USA Performance, a job performance review site; and HI, which the government uses to manage employee health care. “The health insurance one scares me because it's HIPAA [protected] information, but they have access to all this stuff,” the OPM staffer noted.
[...] A new server being used to control these databases has been placed in a conference room that Musk’s team is using as their command center, according to an OPM staffer. The staffer described the server as a piece of commercial hardware they believed was not obtained through the proper federal procurement process. There is a legal requirement that the installation of a new server undergo a Privacy Impact Assessment (PIA), a formal process to ensure the change would not create any security vulnerabilities. But in this instance, the staff believes there was no PIA. “So this application and corresponding hardware are illegally operating,” they added. On Friday, Reuters reported that some senior civil servants have been blocked from accessing the EHRI and other OPM systems, making it difficult for career OPM employees to know what Musk’s team has been examining or modifying. In the same report, the outlet revealed the team had moved sofa beds into the agency's headquarters to continue their work around the clock.
This should be a major national news scandal.

By design, the details of how "freedom cities" would be established are laden with legalese like "federal enclaves with special economic and jurisdictional zones" or "interstate compacts." In practice, the plan is straightforward. Advocates want the federal government to set aside land to build cities exempt from federal and state laws. Instead, the cities would function as mini-dictatorships, where the CEO of each town runs everything, and the people who live and work there are subject to the boss's whims. It would be like being an employee of a controlling company, except you don't clock out at the end of the day or have a life — or rights — outside of what the boss allows you.
Along the way, DOGE also gained access to untold terabytes of data. Trump had given Musk and his operatives carte blanche to tap any unclassified system they pleased. One of their first stops: a database previously breached more than a decade ago by alleged Chinese cyberspies that contained investigative files on tens of millions of US government employees. Other storehouses thrown open to DOGE may have included federal workers’ tax records, biometric data, and private medical histories, such as treatment for drug and alcohol abuse; the cryptographic keys for restricted areas at federal facilities across the country; the personal testimonies of low-income-housing recipients; and granular detail on the locations of particularly vulnerable children.
What did DOGE want with this kind of information? None of it seemed relevant to Musk’s stated aim of identifying waste and fraud, multiple government finance, IT, and security specialists told WIRED. But in treating the US government itself as a giant dataset, the experts said, DOGE could help the Trump administration accomplish another goal: to gather much of what the government knows about a given individual, whether a civil servant or an undocumented immigrant, in one easily searchable place.
WIRED spoke with more than 150 current and former federal employees, experts, and Musk supporters across more than 20 agencies to expose the inner workings of DOGE. Many of these sources requested anonymity to speak candidly about what DOGE has done—and what it might do next.

Soon afterward, as WIRED first reported on February 4, a 25-year-old former X engineer named Marko Elez was granted the ability not only to read the code in the Treasury systems but also to write—or change—it. With that level of access, he (or anyone he reported to) could potentially have cut off congressionally authorized payments, effectively allowing Trump or Musk to exercise a line-item veto. More immediately ominous to people familiar with the systems was the possibility that, by tampering with the code, Elez could cause the systems, in whole or in part, to simply stop working. “It’s like knowing you have hackers on your network, but nobody lets you do anything about it,” a Treasury employee told WIRED.

Initially, Flick and officials from the CIO’s office determined that Bobba would be given anonymized, read-only access to records in the Numerical Identification System, which contains information on everyone who has ever applied for a Social Security number. On February 15, Bobba reported that there were issues with the dataset he’d been provided. Russo demanded that Bobba be given full access to “everything, including source code,” Flick recalled. This included the SSA’s Enterprise Data Warehouse, which contains the “names of spouses and dependents, work history, financial and banking information, immigration or citizenship status, and marital status,” according to Flick’s affidavit.
Later that day, the chief information officer for the whole federal government—a political appointee working out of the Office of Management and Budget—issued an opinion to Russo granting Bobba the access. Flick retired. In her affidavit, she expressed serious concerns about the potential for SSA records to be “inadvertently transferred to bad actors” and about “incredibly complex web of systems” being “broken by inadvertent user error.”

Later that month, DOGE imposed a $1 spending limit on federal employee credit cards. The move instantly roiled agencies from the National Park Service to the National Institutes of Health as employees scrambled to buy basic necessities to do their jobs. Yet again, DOGE’s move-fast ethos would put Americans’ personal data at risk.
At one SSA office, a manager confirmed to his staff that he could no longer pay the company that shreds sensitive documents. “We print a lot of shit daily,” one SSA employee told WIRED. “Stuff with people’s names, addresses, phone numbers, SSNs, bank accounts, you name it. We have giant locking trash bins we put it in, and we pay a shredding company to empty them every month.” With the new $1 limit, the employee said, a “stockpile” of sensitive data was growing, leaving workers with two options: “Shred it ourselves on regular office shredders—of which we have two, I think, and so it would take forever—or just sit on it while it piles up.”

A plane flipped upside-down on landing at Toronto Pearson International airport on Monday. At least eight people are injured, according to paramedics. All flights were suspended, the Toronto Star wrote. Videos posted on X show a Delta Air Lines plane overturned on a snow-covered tarmac, with people walking away from it. Much of the IT and cybersecurity infrastructure underpinning the US health system is in danger of a possible collapse following a purge of IT staff and leadership at the Department of Health and Human Services (HHS), four current and former agency workers tell WIRED. This could put vast troves of public health data, including the sensitive health records of hundreds of millions of Americans, clinical trial data, and more, at risk of exposure.
As a result of a reduction in force, or RIF, in the Office of the Chief Information Officer (OCIO), the sources say, staff who oversee and renew contracts for critical enterprise services are no longer there. The same staff oversaw hundreds of contractors, some of whom play a crucial role in keeping systems and data safe from cyberattacks. And a void of leadership means that efforts to draw attention to what the sources believe to be a looming catastrophe have allegedly been ignored.
Thousands of researchers, scientists, and doctors lost their jobs earlier this month at HHS agencies critical to ensuring America’s health, such as the Centers for Disease Control and and Prevention (CDC) and the Food and Drug Administration (FDA). Hundreds of administrative staff were also subjected to a reduction in force. Many of these staffers were responsible for helping ensure that the mass of highly personal and sensitive information these agencies collect is kept secure.
Employees who were subject to the RIF, as well as some who remain at the agency, tell WIRED that without intervention, they believe the systems they managed could go dark, potentially putting the entire health care system at risk.
“Pretty soon, within the next couple of weeks, everything regarding IT and cyber at the department will start to operationally reach a point of no return,” one source, who was part of a team that managed these systems at HHS for a decade before being part of the RIF, alleges to WIRED.
Like many across the agency, administrative staff found out they were part of the RIF on April 1 in an email sent at 5 am Eastern, though a number of employees only realized they had been let go when their badges no longer worked when trying to access HHS buildings.
Among those impacted were half of the staff working at the OCIO—around 150 people, including the entire workforce at the Immediate Office of the CIO, which includes senior figures like the chief of staff, HR director, acquisition director, and budget director, sources tell WIRED. The CIO, Jennifer Wendel, who has worked in the federal government for almost three decades, is also departing, sources say, and will end her tenure next month. Wendel did not respond to a request for comment from WIRED.
“The suggestion that critical IT and cybersecurity functions at HHS are being left unsecured is simply untrue,” an HHS spokesperson tells WIRED. “Essential operations at HHS, including contract management and cybersecurity oversight—remain staffed and functional. It’s unfortunate that some former employees are spreading unfounded rumors. HHS remains committed to a secure, modernized HHS that serves the American people, not internal bureaucracy.”
One team that was purged from HHS managed over a hundred contracts worth hundreds of millions of dollars, including crucial cybersecurity licenses. It also managed the renewal of contracts for hundreds of specialized contractors who perform critical tasks for the department, including a dozen cybersecurity contractors who work at the Computer Security Incident Response Center (CSIRC)—the primary component of the department’s overall cybersecurity program which is overseen by the chief information security officer.
While all of HHS’s agencies have their own cybersecurity and IT teams, the CSIRC is the only one that has visibility across the entire network of the department. This center, based in Atlanta, monitors the entire HHS network and is tasked with preventing, detecting, reporting, and responding to cybersecurity incidents at HHS.
“It is the department’s nerve center,” the source says. “It has direct links to DHS, CISA, Defense Health Agency, and the intelligence community.”
The contractors provide round-the-clock coverage on three eight-hour shifts every single day, monitoring the network for any possible outages or attacks from inside or outside the network. Those contracts are set to expire on June 21; while there is time to renew them, it’s not clear who is authorized to do so or knows how, since the entire office that oversees the process is no longer working at HHS.
Adding to the threat is the decision by the General Service Administration to terminate the lease for the CSIRC in Atlanta, effective December 31, 2025.
Many of the cybersecurity and monitoring tools the contractors use to monitor the networks are also due for renewal in the coming months.
If the situation is not addressed, “pretty soon, the department will be completely open to external actors to get at the largest databases in the world that have all of our public health information in them, our sensitive drug testing clinical trial information at the NIH or FDA or different organizations’ mental health records,” the source claims, echoing the opinions of other sources who spoke to WIRED.
In the weeks leading up to the RIF, some administrative staff did have interactions with Elon Musk’s so-called Department of Government Efficiency (DOGE) operatives, including Clark Minor, a software engineer who worked at Palantir for over a decade and was recently installed as the department’s chief information officer.
As one employee was detailing the work they did at the OCIO, they said, they got the sense that Minor—whose online résumé does not detail any experience in the federal government—seemed overwhelmed by the sheer scale of HHS, an agency that accounted for over a quarter of federal spending in 2024 and consists of an almost innumerable amount of offices and staff and operating divisions.
Minor has not provided guidance to the remaining HHS staff on the transition, according to two sources still at the agency.
Minor did not respond to a request for comment from WIRED.
Some internal systems are already breaking down, according to sources still working at HHS. One employee, who facilitates travel for HHS employees, says the RIF “set federal travel back to processes that were in place prior to the first Electronic Travel System contract in 2004.”
While sources who spoke to WIRED differed on exactly when and how the IT and cybersecurity infrastructure at the department might collapse, they all agreed that without a radical intervention in the coming weeks, the fallout could be catastrophic.
"If the US health system lost CMS, FDA, NIH, and CDC functionality indefinitely without warning, and no backup systems were available, this would be an unprecedented systemic shock," one source at the OCIO tells WIRED.
Current HHS workers say they have not been presented with a plan to remedy the looming crisis, and have seen no leadership from either the political appointees or DOGE operatives who have been installed at HHS.
“There is no transition, and those in charge are AWOL,” one person currently working at HHS tells WIRED, echoing the sense of “chaos” found in an in-depth investigation into HHS by Stat. “I’m doing nothing productive. I’m answering emails stating we cannot help, we cannot process, we have no guidance, we cannot operate. This ship has no captain whatsoever, and I’m playing in the band while the Titanic sinks.”
