As of December 2023, the Federal Election Commission (FEC) has received 59 allegations that Donald Trump or his committees violated the Federal Election Campaign Act. In 29 of those cases, nonpartisan staff in the FEC’s Office of General Counsel (OGC) recommended the FEC investigate Trump. Yet not once has a Republican FEC commissioner voted to approve any such investigation or enforcement of the law against Trump.
Tumblr media
Democratic Vice Chair Ellen Weintraub pointed this out in her December 5, 2023 statement of reasons after the FEC once again failed to garner the votes to enforce the law against Trump after he allegedly violated the law by illegally soliciting or directing money to a pro-Trump super PAC that spent millions on ads opposing Joe Biden in 2020.
Because at least four of the six FEC Commissioners need to approve any FEC investigation, and because only three of those seats can be filled by Democrats, Republicans hold a veto over the agency’s enforcement and have repeatedly used it to shoot down any recommended enforcement of campaign finance law against Trump—and thus successfully shielded him from accountability over and over. Instead of fostering bipartisanship, the split FEC has often become gridlocked and, in cases involving Trump, its ability to pursue action is constrained by the members of one party.
Tumblr media
The FEC’s enabling statute, the Federal Election Campaign Act, specifically subjects the Commission’s non-enforcement to review to prevent it from blocking meritorious enforcement. In June 2018, however, two Republican-appointed judges of the D.C. Circuit—including now-Supreme Court Justice Brett Kavanaugh—largely gutted that rule, giving commissioners the authority to block enforcement of the law without judicial review if the commissioners claimed that they did so as an exercise of prosecutorial discretion or under Heckler v. Chaney.
So, in 21 of the 29 cases where the FEC received recommendations to enforce the law against Trump, Republican commissioners justified non-enforcement by invoking prudential or discretionary factors in attempts to circumvent review.
Tumblr media
When dismissing the recommendations to investigate Trump—and to kill further inquiries into his actions—the Republican commissioners have at times claimed that the FEC should not take any action because “proceeding further would not be an appropriate use of Commission resources” or that the resources would be “best spent elsewhere.” Trump has even falsely declared that the FEC “dropped” one of its investigations into him “because they found no evidence of problems.” As Commissioner Weintraub wrote in a statement of reasons in November 2023, “the data is clear: At the FEC, Mr. Trump is in a category by himself.”
Unless courts restore their check on partisan vetoes on enforcement, the commissioners will continue to fail to enforce federal campaign finance law against the powerful figures they are trying to protect.

pacrim au yuuta: why let your boyfriend stop you from finding your husband?
LOLLL yes exactly…. your boyfriend is of no consequence to yuuta. he became a pilot to save people, and he saved you—he and rika were the ones who pulled your body out the rubble and brought you back to life. you’re his little miracle, how could he leave your care up to anybody else? 😇
let me say tho that reader having a boyfriend who isn’t yuuta is intentional in the grand scheme of things—it’s supposed to be a point of conflict for yuuta being a pilot, not necessarily because of his romantic feelings. pilots are supposed to be the good people, the ones who sacrifice everything and risk their lives to save others, who are given the great responsibility of controlling expensive mega-robots because the average person can’t. they’re the heros, the good guys, the angels—they’re not supposed to lust after civilians, much less those who are already taken, but yuuta’s starting to wonder why he should follow what’s right when there’s something better in front of him
it’s not just yuuta that takes to you, though. rika has always been an usual mech—hushed whispers about how it’s haunted, how it was cruel of her family to build and name a mech after their deceased daughter and ask her crush to be its pilot—but she seems alive more than ever lately. inexplainable auto-pilot movements when you’re around, her core chamber lighting up and powering when you touch it, her hand moving to catch you when you trip near the edge of a lift on the hangar, despite no pilot being inside, sudden steam and crying pipes when you’re too close to your boyfriend and not yuuta. it makes the other pilots wonder—is yuuta possessive over you because of rika, or is rika seemingly possessive over you because of yuuta?
yuuta would never say it out loud, but part of him likes how helpless you are during your recovery. he wants you to get better, to feel better, of course, but the less innocent part of him likes that you need him; that you have a wide, doe-eyed admiration of him for being the brave pilot who saved your life. he likes spoon-feeding you while you’re too weak to do it yourself, likes you calling him to have him help you walk three feet to the bathroom, likes that you wait for him to have lunch and sit pretty watching him during his sparring training. he’s grown awful fond of having you wait on him, he wouldn’t mind if it took a little longer for you to get better. he knows that his job as a pilot is meant to be obsolete—that the goal is the rid the world of its dangerous, so make it a safe space so that humanity isn’t dependent on giant robots and pilots, so maybe having you here like this is the remedy to that. he’d do whatever it takes to rid the world of its monsters if it meant taking care of you for the rest of his life

omg the counseling au!!!! i loved how anakin was making banthashit arguments about 'how inevitable it is for him to constantly worry for his master (as if he was his spouse) and padme not understanding it even though she was also constantly worrying for her husband (which he actually is)'. as much as I love how unhinged the boys are for each other, I'm still so sad for padme because she's so... kind and nice and loving. I hope she will be able to find her own happiness after her slightly-idiotic-husabnd-who-did-not-even-realize-he's-been-in-insane-love-with-his-master-since-he-was-like-13 finally gets his head together. wonderful update as always!
i think for the couples counseling au and the anidala in the fic, i'm really trying to balance the line of having this relationship fall apart in some pretty spectacular/dramatic ways, but without having either of them come off as bad. i don't necessarily feel bad for padmé in any of my recent fics that deal with anidala crumbling post (mostly couples counseling au and a more perfect union) cause she's wholly in and crazy about anakin and she must understand on some level that he is alos wholly in and crazy about his master first and foremost.
there's a line in a more perfect union that i really like where padmé admits that she knew anakin was in love with obi-wan but thought that as long as he never realized, she could marry him and be in love with him and that it would be enough and i feel like there are aspects of that in the couples counseling au - not that she knows that anakin is in love with obi-wan, but she certainly understands that obi-wan is Anakin's Most Important Person and she's just starting to realize what that means for her and for their relationship because she keeps coming in second, even for something as simple as where anakin spends the night
like in general i think in these fics and also in canon padmé knowingly married a ticking bomb of a man and we're just watching the relationship itself explode - it doesn't make her a bad person or anything, it just makes her sort of willfully blind. i don't think either of them are bad people, but they're just not like. good together or meant to be together and anakin's chapters in couples counseling definitely detail the falling apart of that relationship because they're just not right for each other anymore
