How an abuse scandal devastated the Buddhist faith community, July 1, 2023

In August 2017, the Dalai Lama’s Buddhist faith community was left reeling by allegations of abuse. It was claimed that the world-famous Lama Sogyal Rinpoche had sexually abused students over many years. 

According to the allegations, the Lama Sogyal Rinpoche had been sexually and physically abusing his students for decades. But how could Tibetan Buddhist authorities allow such things to happen? This documentary brings to light crimes long concealed by silence - rapes, psychological manipulation and the embezzlement of funds. Although it enjoys an excellent reputation in the West, Tibetan Buddhism has been rocked by a number of serious scandals. Through the story of Ricardo, abused from childhood and now on a personal quest for justice, this documentary gives a voice to the many victims. 

The filmmakers explore the reasons why these scandals were not properly investigated and how the alleged perpetrators, protected by stoic silence, were able to evade justice. Their research takes them to Buddhist centers in France, Belgium, Britain and Spain. And to the northern Indian city of Dharamshala, headquarters of the Tibetan government in exile, which still remains stubbornly silent over these known cases of abuse. Casting all the clichés aside, this investigation takes a deeper look at Buddhist milieus that sometimes manage to dazzle people with their exotic spirituality. The documentary lifts the veil of silence and shows what goes on behind the scenes in some Buddhist faith communities.

letters, or: objects that let

Im Zettelkasten ist der Zettel eine der Unterlagen und damit dasjenige, was zu klein und zu niedrig, zu kurz und zu knapp, zu leicht, zu schwach und noch zu wenig ist, um als Lage wahrnehmbar und bestimmbar zu sein. Zettel sind nicht in Zentimetern, Quadratmetern oder aber in der Anzahl von Kilogramm klein. Sie sind klein, weil sie nur innerhalb einer kleinen Anzahl von Operationen etwas assoziieren und trennen, bis sie sich verkehren und dann andere Zettel, andere Objekte oder überhaupt etwas anderes als Zettel und Objekt sind.

Zettel sind im Sinne der Lettristen und Situationisten Situationen, die kurz sind und nach einer kleinen Anzahl von Operationen schon andere und anderes als Situationen sind. In dem Sinne sind Unterlagen: Trennungen und Assoziationen in und durch eine kleine Anzahl von Operationen. Sie zählen und man kann sie zählen, dank und durch sie kann man zählen, zum Beispiel Schafe oder jemandem etwas bedeuten.

Vier Leute haben eingeladen, und wir vier unterstellen, das vier eine kleine Zahl ist (str). Wir haben acht Leute eingeladen und gehen zügig davon aus, dass auch das noch eine kleine Zahl ist.

Wir haben unter anderem Ino Augsberg eingeladen, der über Übersetzungen sprechen wird. Dabei spielen Letter eine Rolle, Unterlagen, die man auf Deutsch teilweise Fleisch/ Sitz, im englischen flesh/chair und im Französischen nur mit einem Wort carne nennt. Durch Letter geht, was Ute Holl die Remanenz der Zeichen im Physischen nennt, ihre Widerständigkeit und ihre Insistenzen im Verhalten der Körper. Wenn solche Unterlagen wie Fleisch/ Sitz Zettel sind, dann eventuell solche Zettel, wie der Zettel, von dem Shakespeare in Midsummernightsdream schreibt oder der Zettel, von dem Arno Schmidt notierte, durch ihn ginge ein Traum. Ino Augsberg ist ein Jurist und Rechtstheoretiker aus Kiel, er wird also im Mai, im wunderschönen Monat Mai, wenn alle Knospen springen, sprechen. Ino Augsberg könnte über Franz Rosenzweig sprechen, eventuell aber auch über Martin Luther oder gar über beide, wir versprechen uns einiges von Augsbergs Kommen, er uns auch. Es gibt einen Letter von Augsberg, der trägt den Titel S/O/L/A scriptura. Luthers Sendbrief vom Dolmetschen. Ob er den oder einen neuen Letter mitbringt, wird sich zeigen, im Mai. Letter sind nicht wie Objekte, von denen man sagt, kenne ich schon, war ich schon, um sie nicht mehr zu nutzen. Letter sind recycelbar, kompostierbar, wiederholbar, uns ist daher nicht so wichtig, ob sie neu oder alt sind. Man muss nicht viel lesen im Leben, ein Letter reicht, aber dann sollte man diesen Letter auch in allen Hinsichten lesen, also auch so, wie einem vorher nicht klar war, dass auch diese Technik ein Lesen ist, so, dass man erfährt, dass Lesen auch dasjenige ist, was andere als Lesen bestreiten, dass also nicht nur ein kanonisches Lesen sondern auch ein häretisches Lesen Lesen ist. Vielleicht liest man einen Letter manchmal am besten so, indem man in fallen lässt oder zerreisst, zerknüllt im Fäustchen, schluckt wie ein Kohlhaas, oder, wie Warburg das macht, auf einer Tafel umkippen und umkehren lässt. Wenn wir schon ausgeschöpft hätten, was Lesen ist, müssten wir zu Kulturtechnik Lesen nicht mehr forschen. Bisher stoßen wir auf Überraschungen, darum gehen wir davon aus, dass die Grenzen des Lesens unbeständig sein können. Das Lesen fängt eventuell am choreographischen Zug N an, an der Bar, der bibliotheca nationale oder einem Nachtlokal und verlangt vielleicht, mit einer Fingerspitze auf und ab und auf zu gehen, nicht wahr?Im Wissenberg der Weinschaft kann das Lesen dem Weinen dienen, nicht dem Verstehen, sondern eher einer forensischen und inquisitorischen Technik, mit der man erfahren will, was und wer nicht lügen soll, auch wenn man nicht versteht, warum nicht gelogen wird, wenn man es doch kann.

Wir haben unter anderem Anna Clara Lehman Martins eingeladen, die über Letter (Buchstaben und Briefe) forscht, die ein Priester aus Süditalienzwischen 1880 und 1890 an den heiligen Stuhl in Rom schrieb um die Erlaubnis zu erhalten, nach Amerika zu emigrieren. Das sind flüchtige Briefe, Fluchtletter.

Anna Clara Lehmann Martins ist eine brasilianische Rechtshistorikerin, die am MPI forscht. 1886 hatte Papst Leo XIII über die Kongregation die Migration von Priestern aus dem Mezzogiornio nach Amerika verboten, die Bischöfe in Amerika hatten sich über mangelnde Disziplin beschwert und der Flut der Flüchtigen sollte mal wieder ein Riegel vorgeschoben werden. Um trotz Verbot flüchten oder, sublimer gesagt, emigrieren zu dürfen, benötigten Priester aus dem mezzogiornio eine Lizenz oder Permission der Kurie in Rom. Der brieflichen Bitte mussten zwei Dokumente, Empfehlungen beigefügt werden, war das nicht möglich, mussten die Briefe auf besondere Weise, höflich, leicht, bescheiden geschrieben werden, Lehmann Martins forscht unter anderem zu der Schreibtechnik dieser Briefe, sie wird also bescheidene Letter, bescheidene Briefe, sie nennt sie "humble objects" mitbringen und uns eine besondere Scheidekunst vorstellen.

Why am I doing this?!

You asked yourself that as you stood outside of Ricardo’s apartment. Unsure of what to do, you were going back and forth on whether you should knock on the door, or just leave. It was nearly midnight, after all. How could you just —

“Y/n?”

Oh shit.

Forcing your neck to turn, despite its reluctance, you saw Ricardo. He was carrying his jacket, the holsters on full display. When he saw your face, his expression changed from one of confusion to one of concern. He quickly walked up to you, wrapping his arms around you.

That’s when you broke. The tears came flooding as you sobbed into his chest. Even the sweetly spiced scent of his cologne did little to calm you.

Ricardo began rubbing your back, attempting to soothe your hurting heart.

“Come on,” he muttered, “let’s go inside.”

Ricardo had thrown his sweatshirt and pants in the dryer, warm them up before giving them to you. As you changed, he made some of your favorite tea and sat some cookies on the table. They were small gestures, but ones that began to mend your heart.

Sitting down on the couch first, Ricky patted the spot next to him. You sat beside him, curling up against his chest. Feeling cozy and safe, you finally began to relax.

Ricky kissed your forehead, and quietly asked, “What’s got you so upset, sweetheart?”

You sighed, and replied, “I just… I feel like I’m at a breaking point. I’m trying so hard to be independent, but when I get *another* surprise bill on top of everything else… I don’t know.”

Ricky wrapped his arm around you, pulling you closer. His hand came up and gently held your chin.

“Listen to me,” he began, speaking softly, “You are the strongest woman I’ve ever met.”

“Ricky —“

“No,” he said, cutting you off, “I’m serious, you’re incredibly strong, you’re brave, and you’re not alone. I know you want to be independent, but I’ll always be there for you. I’m in this for the long haul.”

You smiled, a tear running down your cheek, “You are the sweetest man I’ve ever met, Ricardo Morales.”

“But never as sweet as you,” he replied, and gave you a kiss.

Operative Praxis

Am Max-Planck-Institut für Rechtsgeschichte und Rechtstheorie hat sich eine informelle Gruppe gebildet, die Vismann-Studien aufgreift und weiterführt. Vismann-Studien nennen wir Studien zu den juridischen und juristischen Kulturtechniken, das heißt zur normativen, kooperativen und rekursiven Anlage des Rechts. Was Karl-Heinz Ladeur die "operative Praxis des Rechts" nennt (und auf die historischen Forschungen von Yan Thomas und Bruno Latour bezieht ), das beziehen wir weiter noch auf zeitgenössische Forschungen von Cornelia Vismann und diejenigen, die sich von ihr haben inspirieren lassen.

Diese informelle Gruppe ist Teil der Theoriemosaik, der Marietta Auer in der Abteilung für Rechtstheorie mit Mitteln des Leibnizpreises den Boden bereitet hat. Im letzten Jahr startete die Gruppe mit einem von Ricardo Spindola, Panu Minkinnen und mir organsisierten Workshop zu Recht und Anthropophagie, in dem es um Techniken vaguer Assoziation und ihr Verhältnis zur brasilianischen Moderne ging. Panu Minkinnen hat im Januar eine Tagung zu Cornelia Vismann in Helsinki organisiert. Nun greifen wir das Projekt der Vismann-Studien wieder und größer in Frankfurt auf.

Im Mai findet die nächste Tagung statt, die nun von Nathaly Mancilla Ordenes (Helsinki), Ricardo Spindola (Frankfurt am Main), João Tiago Freitas Mendes (Bruxelles) und mir, Fabian Steinhauer, organisiert wird.

Diese Tagung widmen wir Lettern, also unter anderem Buchstaben, Briefen und anderen kurzen oder knappen Unterlagen. Letter definieren wir als minore Objekte, die etwas lassen, indem sie gelassen sind. Letter sind Objekte einer Rekursion, durch sie und dank ihrer geht ein Lassen, das aktive und passive Züge hat und diese Objekte auch als Medien der Rekursion erscheinen lässt.

Wir interessieren uns auf der Tagung für alle Weisen des Lassens (auch das Hinterlassen, Überlassen, Entlassen, Auslassen, Unterlassen, Verlassen) und damit auch für alle Weisen der Lässigkeit (auch die Nachlässigkeit, Zulässigkeit oder Verlässlichkeit). Letter wollen wir als ermöglichende Objekte begreifen. Als minore Objekte sind Letter Unterlagen oder Situierungen. Ein phänomenologischer oder ontologischer Zugriff auf Letter wäre also gleichzeitig Zugriff einer situativen Phänomenologie und Ontologie.

Ein minores Objekt ist ein kleines, niedriges, schwaches, kurzes, unteres oder leichtes Objekt. Der CfP zu dieser Tagung wurde im Hinblick auf die normative, kooperative und rekursive Anlage der Forschung selbst als Letter versendet - und reagiert wurde deutlich, implizit und explizit.

Als Gäste der Tagung begrüßen wir Anna Polze (Bochum) mit ihrer Forschung zu forensic architecture und Tischeffekten, Stefanie Rüther (Frankfurt) mit ihrer Forschug zu Passierscheinen, Anna Clara Lehmann Martins (Frankfurt) mit ihrer Forschung zum kanonischen Recht, Migration und Bescheidenheit , Claas Oberstadt (Berlin) mit seiner Forschung zum transatlantischen Sklavenhandel und Listen, Friedrich Weber-Steinhaus (Berlin) mit seiner Forschung zu Karl Krauss' Akten, , Ari Marcelo Solon (Sao Paulo) mit seiner Forschung zu Carl Schmitt und Hieronymus Bosch, Arthur Barrêtto de Almeida Costa (Frankfurt) mit seiner Forschung zu Assessment Centern und Wissenschaft, Andityas Soares de Moura Costa Matos (Coimbra) mit seiner Forschug zu Andreas Alciatus und Alchemie, und Ino Augsberg (Kiel) mit seiner Forschung zu Luthers Sendbriefen

Die Organisatoren ergänzen das Programm, João Tiago Freitas Mendes (Bruxelles) mit seiner Forschung zum Sozialbaren, SimpliCity und Fluginstruktionen, Ricardo Spindola mit seiner Forschung zu den flatterhaften Anfängen des Bundesverfassungsgerichtes, Nathaly Mancilla Ordenes zu Eigenheiten der Briefe und ich zu zwei Lettern auf Aby Warburgs Staatstafeln (nämlich einem Kardinal und einem Scharnier).

Die Gäste und Gastgeber werden also ihre historischen und theoretischen Forschungen zu Lettern vorstellen, das sind in dem Fall teilweise Briefe, teilweise Buchstaben und Satzzeichen, teilweise Bilder. Die Tagung ist babylonisch, mehrsprachig, unter anderem wird dort englisch, portugiesisch und deutsch gesprochen - als übersetzende Basslinie werden englische Passagen mitgeliefert.

Wir gehen davon aus, dass Vismanns Arbeiten zu den Akten bereits Arbeiten zu minoren Objekten sind, sprich: dass auch die Akte als ein Letter in Betracht kommt. In den letzten Jahren ist in der internationalen Rezeption der Arbeiten unserer ehemaligen Kollegin eine 'kreative Praxis' der Grundlagenforschung zu Geschichte und Theorie des Rechts deutlich geworden: Die Leute experimentieren, ohne sich wechselseitig Geltung zu versichern. Mehr noch als die Arbeiten von Yan Thomas zeigen die Arbeiten von Marta Madero (die methodisch allerdings an Yan Thomas anschließt), dass die operative Praxis des Rechts eine kooperative Praxis und diese Kooperation ein Händeln oder Bestreiten ist, das mit einem Verkehr oder einer Verkehrung von oberen und unteren Schichten einhergeht. Marta Madero hat die kooperative Praxis des Rechts anhand eines Objektes mit zwei Lagen oder Schichten untersucht, nämlich anhand des Objektes, das lateinisch tabula picta (angepinnte Tafel; englisch painTing) und mit deutschem Schmelz einfältig 'Bild' genannt wird. Madero zeigt in ihren Arbeiten zum 'Bildrecht', dass dasjenige, was Anspruch auf Systembildung erheben könnte, eine Verkehrbarkeit und Verkehrsfähigkeit von Lagen ist, eine situative Mobilität, die durch Objekte läuft, die wiederum wie von einem Scharnier durchzogen sind, anders gesagt: von einer Falte, die das Objekt nicht nur zu einem Grenzobjekt (boundary object) macht, an dem das rechtliche Wissen mit anderem Wissen und anderem als Wissen geteilt wird, sondern auch zu einem diplomatischen Objekt, an dem verhandelt und in kontrahierenden und distrahierenden Details alles bestritten werden kann.
