Page 20. --- Evidence Given in Support of Charge is Quite Clear in Spite of His Denial ---- This morning Herbert Scarce was declared by Magistrate Jay to be guilty of being in possession of a wood cart belonging to Sohan Singh, which he knew to be stolen, and he will be sentenced on this charge to-morrow. The evidence connecting him with the case was very clear, but in spite of this he went in the witness box, and denied the whole of the circumstances, persisting in his denial, although he was given every chance to tell the truth.

Scarce, who had been in the middle of his own story when the case was adjourned on Saturday, was again put in the box by Mr. Lowe, He stated that his first horse he bought from a white man on Old Esquimalt road, and the express wagon from a Chinese. He had been working at the market, but found it did not pay, and decided to go into the wood business. On Tuesday last he left home with the old horse and wagon with the intention of getting a heavier horse and a wood wagon. At the top of Hillside avenue a Hindu and a white man were standing beside a horse in a field. To the white man he sold the horse for $35, and left his wagon there in the field.

From there he went out towards Tolmie road, and after hunting for a horse elsewhere he met, near where he left the wagon, a Hindu with a horse. He purchased this animal for $39 odd, all the meney he had with him. He took the horse back to where he had left the wagon and hitched up. With the Hindu he went back to the latter's barn and exchanged his express wagon for a wood cart. With this outfit he began on Wednesday to haul wood.

Chief Langley, who was conducting the prosecution, warned the young fellow of the penalty of committing perjury, but the witness stuck to his story, and denied that he had made any exchange of horses near the University school or that he had been near that spot for three weeks.

Scarce informed his counsel that a Hindu who had been in court on a charge of drunkenness, was the man with whom he had made the exchange of the wagon.

Esa Singh was brought in from the celis, and stated that early this morning the young fellow had accused him of stealing his wagon. Esa denied categorically that he had ever done anything of the kind, that he had ever seen the accused before, that there were any wagons or carts about the house where he lived, that there was any barn attached to the house, or that any of the dozen Hindus living there drove wood carts.

William McCully was called by the prosecution in rebuttal, and retold how he had seen Scrace exchange his old bay horse for a black horse in a field on the Lansdowne subdivision. He positively identified Scrace, who had driven towards him full face to within a distance of seventy feet.

Rev. E. G. Miller gave character evidence. He said he had never had occasion at any time to accuse him of doing anything wrong.

Magistrate Jay expressed his conviction that the accused was guilty of the offence of retaining possession of Sohan Singh's wood cart, knowing it to have been stolen, and reserved sentence. On the charge of retaining a horse, the property of the University school, Scrace stands committed for trial. There is a third charge of being in possession of a set of harness, which may or may not be proceeded with.

The KOSA bill, what it's going to do if passed, and how you can help prevent it from taking effect

KOSA will essentially erase anonymity from the internet by requiring people to upload their government ID or other form of identification to any social media site, as well as restricting resources and information on LGBT rights, history, racism, and more. This bill will censor the entire internet and destroy privacy while violating First Amendment rights and potentially putting minors in danger.

This also could very well mean the end of Tumblr, and I'm not exaggerating here.

Tomorrow KOSA could be passed in Senate, and from there it will need to pass in the House of Representatives before being signed into law by the president. It's not doomsday yet, but it is a dangerous situation-- and here's what you can do.

StopKOSA.org provides you with a template email to send to your representatives. You can leave it how it is or edit it to say what you want, and then send it from their website.

The website also allows you to call your representatives and gives you a template of what to say.

BadInternetBills.org, run by the same people, takes action against KOSA as well as other bills like EARN IT. At the time of posting this, over 356,000 people have signed this petition.

One last thing-- The evolution of AI images and video.

I don't really have anything good to say. AI is evolving fast and changing the world as we know it. We are adapting, but nobody knows how this really is going to end up.

A few quick points:

AI images are not art. That's all. AI "artists" who genuinely claim to have made something of their own just by typing a prompt into a generator will be blocked. (Which has been in my rules for a while, but I still think it needs to be said.)

I recommend Glaze for artists who don't want their art being scraped and used for data training. Especially with the recent rumors of an upcoming deal between Tumblr and Midjourney. There's also a similar program called Nightshade (haha, earthspark reference? anyone?🦉) that I haven't tested myself but have heard good things about.

He and a man named [William] Stevens, [pictured, bottom] who was recently given a five year sentence on the same charge, were accused of having led a man out from a bar of one of the local hotels on September 17 and latter attempted to rob him. Plainclothesman Fortune, having been called in by the clerk Rhose when his suspicions had been aroused, followed the men from the hotel and saw the attempt. The intended victim was a Frenchman who has not been heard of since and whose name is not known.

[Switzer or Sweitzer was 21, with scars and burns on his palms, back of neck, and across his nose. He was convict #F-468 at Kingston Penitentiary and worked in the stone shed. He was reported for idling his time, impertinence and violent language to officer, contraband and talking. His first report was for an act of violence against another prisoner in December 1912, and put in solitary for 48 hours. he was reported again in April and October 1913, losing remission and being put on bread and water diet for 3 days. He was reported twice more in 1915, once in October and again in November, losing remission both times. In 1916 he was put in solitary for 3 days on bread and water in January, hen again in March and May, finally getting a week in solitary in July 1916. He would be released soon after that. Stevens or Stephen was 23, a boiler operator on a laker, and also covered in scars. He was convict #F-463 and worked a number of jobs in prison until put in the boiler house. He was 'well behaved', reported only once in 1913 and put in solitary for 48 hours. He was released early in 1916.]

Nice try, but I am a disabled artist.

Hiding behind the tired argument that rejecting AI art harms disabled artists is not only false, but it also perpetuates the idea that disabled people cannot be artists at all, that we can only do it if someone else does it for us.

If you actually cared about disabled folks, you'd know we have always been making art in spite of our disabilities, and you wouldn't be trying to speak in our "defense" of AI. And if you yourself are disabled, then you need to do some unpacking and understand why your argument hurts more than it helps.

AI art is not art, period. And you throwing disabled people under the bus so you can justify your use of stolen art? To use your own words, 'That'll sure make you look good.'
