Blood Relatives should avoid taking case of blood relatives

The Bench comprising Hon’ble Mr. Justice Saumitra Dayal Singh J and Hon’ble Mr. Justice Rajendra Kumar IV J closed on 12.10.2023 the proceedings initiated by the Additional Principal Judge Family Court Aligarh-1, as the apology tendered by the contemnors were not found to be genuine and hearing them further would waste the time of the meaty litigants.

Facts giving rise to Contempt Petition

Allegation against the Litigant Subhash Kumar is that he misbehaved with the Additional Principal Judge Family Court on 09.05.2022 while hearing of another case was going on. As his case was not called off, he started shouting when he was asked to wait he continued misbehaving with the Court giving rise to Contempt proceedings.

Allegation against the Advocate son is that he continued unruly and loud behavior and threatened the court by seeking transfer of proceedings. On being required to act in a civilized manner, he refused to abide by the advice.

Shubham Kumar- Advocate shouted saying he is a practitioner of the Allahabad High Court and he knows how to deal with petty courts & threatened to lodge a complaint against the Presiding Officer.

During hearing of the contempt proceedings Allahabad High Court asked the contemnors Father & Son are they seeking forgiveness?

Both answered yes.

When asked for what?

They answered “humney jo kara nahi”

Litigant-father Subhash Kumar even denied the occurrence.

Subhash Kumar in the post lunch session filed an application on 09.05.2022 @3pm for hearing of his case & @ 3.30pm his advocate son filed another application for hearing of his case. This is mentioned on the order sheet of their case by the Additional Principal Judge.

Observation of the Court

Any grievance that any litigant or lawyer may have may be addressed in due course. Any order that may be passed by a court to which any lawyer or litigant may have a grievance may be addressed by filing appropriate application or appeal or by making appropriate mention at the appropriate time.

What is more disastrous is that a son (lawyer) appearing for his father (litigant) that too in a matrimonial case with his mother. It cannot be for Courts to advise lawyers to choose their clients. It has always been left to the wisdom of the learned members of the bar.

The basic learning that any member of the bar imbibes at the initial years of practice is to tell him to not appear for his blood relatives. However, this wisdom and nuance has not touched Subham Kumar by a mile. He not only took up the matter of his father but that too against his mother, by his act, he became a party to the dispute itself.

It indeed would be sad if statutory law were to provide for restrains on who’s brief to take and who’s not. Yet, the father - son duo before us would appear to take no less. Thats the tragic part of this case.

We find that the present case is not a case that the Court may have the luxury to deal with, in the present state of its overburdened board.

To voice our opinion differently, we may note that in a matter such as this where the lawyer and the litigant both claimed (though not convincingly), utmost regard for the Court but their behavior and conduct is found wholly unacceptable and objectionable, we say, enough time has been wasted over those who are already wasted.

We do not have time to take our gaze away from the cause of justice and to devote the same to punish the contemnors as per the rules of law.

Our time would be better utilized and is needed to address the cry for justice by genuine litigants. It does not merit to be wasted on the jesters and/or deviant lawyer and litigant that these contemnors are. They are far too less deserving of that. Thus, such contemnors may sometimes waste Courts' time yet, they may be allowed to get away, in the interest of the other, genuine litigants and meaty matters.

We also make it clear that

We refused to exercise our jurisdiction and have not absolved either Subhash Kumar and Shubham Kumar of their conduct.

It is only on account of wastage of time that we seek to prevent, we choose not to give them any further audience. They are thoroughly undeserving of that. Thus consigned.

Heehee thank youu!!! She's kind of both and neither haha 👉🏻👈🏻 Her Granny (named Elfriede) inherited the farm. Elfriede is the baby sister of the granpa that died in the intro (in this version the granpa was a recluse and had no remaining family other than his little sister in the city). Although Dorothea isn't bloodrelated to them, she was raised by the granny in Zuzu-city. They moved to the farm after Dorothea suffered an injury to her leg (I'll get into that later when i have more time I think it'll be lost if it's just in a text answer hehe, so i'll keep it short to the best of my abilities)

I could also see it working alongside a canonical other farmer if i structure just a few details differently. Since here the farm they inherit is an alpine farm and it's like. If i ever have the skills to mod her in then it could also be a new area maybe somewhere extra in the mountain area since none of the canon farm layouts really match my vision 100% (I'm playing Dorothea on like, the wilderness farm without monsters since to the side there's a visible incline the closest i could get to some friggin height UU)

Also I'm still working on her relationships indepth. For now I can see Emily the most as a close friend. I'm debating on wether or not to make her a trio package like abigail, sebastian, sam but it's either emily, sandy and dorothea (would be the passion for fashion gang) or elliott, leah and dorothea (wine girlies <3). I can see both working really well with her :/

DILUC RAGNVINDR - he's your stepbrother. the public doesn't know anything other than the fact that you and him have the same name and some similar features. you're teased about being siblings with him which you don't outright deny, but don't outright confirm either. he's the first son of your father, crepus, with his first wife. dotes on you. busy man. rarely speaks with you, but if you call, he answers immediately no matter what. soft, loving, stepbrother!

DUNYARZAD - your newly found bestfriend (of four months!) after you got partnered with her for a practical exam, you both hit it off. she's in the same year and course as you in the same darshan. she loves traveling. she is also a sickly person since she was a child. she is demure and soft hearted as she's from a wealthy sumerian family. she is alhaitham's forbidden first love.

YANFEI - another one of your friends. she is all about girl power, women empowerment, and upholding what is right. almost like a moral compass of the group whenever someone goes off the rails and does shitty things which she usually has to fix for them. she's the group mediator. she's a first year vahumana student majoring in law. she lived in liyue until last year until she decided to permanently live in sumeru.

KAEYA - not much is known about him. he's rarely seen around. but whenever he's around though, he's the origin of all chaos and any off the rail decision making. not a good adviser, but a good friend nonetheless. he's your adoptive brother on diluc's side. strangely, he's more similar to you than diluc and ironically you're not bloodrelated.

I'm watching Blood Relatives (1978)

I’m gonna try and keep this short, but I have to make a point about why the title “Brothers in Blood” fucking slaps and is soo freaking good for Jason and Dick’s dynamic and frankly it’s a pity it was abused by that super weird comic I shall not speak of again in this post. This isn’t about that, this is just about the three words “Brothers in Blood”

Usually when we talk about blood and family we mean that someone is actually, biologicaly, genetically related. And people justify weird things using blood relations. The weirdest to me is how you supposedly have a duty to your blood family. How you are not allowed to truly seperate yourself from them. And despite the batfamily only having one single bloodrelation among them, that is what they are, they can not unbind themselves from the family they have become. Jason and Dick are kind of forever going to be brothers, for ever going to mean that to each other no matter what else happens, they’re brothers. 

Second thing that drives me crazy, the Blood. Brothers in Blood, yes sure, but whose blood? Is it theirs? Is it only from one of them? Who is bleeding out for the other and are they cutting themselves open to keep this bond or are they cutting eachother up? Have you ever become blood brothers with someone and pressed bloody palm to bloody palm? Who cut whose palm? Each their own, or one another. Why can this bond only be sustained in blood anymore, what about the love and the time it took to build it? 

Or is the blood only what has been beaten out of them by the rest of the world and they are brothers in that they both bled and are bleeding for the same man on his doomed mission? Perhaps they are brothers bound by the blood they lost in Batman’s name as Robin, are still losing after Robin. 

Maybe the blood is of the world and they are brothers in that they see this blood of the suffering and helpless and reach out to a bleeding wold to make it stop. Brothers by their shared mission, despite different approaches. 

And finally back to the blood family thing. When we need to go all the way back to blood to still justify family, then everything else must have failed. Everything else we put into this, all our time and effort, all our love and good intentions were not enough anymore and all we have to cling to is our blood that binds us. But Jason and Dick do not actually have that blood relation. It is like they are trying to fool themselves, maybe grasping at thin air, not understanding that their brotherhood rests on the fact that they are both still grasping at this nothing. Found Family is no more fragile than any family. You can not lose each other that simply. It’s your new blood now. Think of it like a blood transfusion, like a new organ that has become part of your system. Blood as the source of life, as the rawest of all elements. It marks the giving and the taking of life. Nothing matters more.

Even though I do think Flapjack used to belong to the og Caleb Wittebane (heck the finale pretty much confirmed it), and I also think Caleb married a Clawthorne, at least in the latter case I absolutely do not want the characters to find out about it (specifically Hunter and Eda).

Because as cute and wholesome these connections are for Caleb to be living on in some way, considering where Hunter is currently at, these are the worst pieces of information he could possibly receive right now.

Hunter literally just came to terms with the legacy of the Golden Guard, and more importantly, has just started to rid himself of the mask and the expectations that come with it.

Hunter wants to figure out his own future, and I don't think increasing reminders that he's wearing someone else's face, that he's essentially someone's replacement, are going to help with that.

And whether or not that is true for these characters (I don't think Flapjack chose Hunter for Caleb's sake, but suggesting the name Caleb to him sure leaves that impression), it's always going to be the background noise of whatever relationship Hunter has with these characters. Now that they've canonised it with Flapjack, I really want them to explore what it means for the both of them (Hunter would be justified to think Flapjack is here for Caleb's replacement, not Hunter, and depending on how much the bird knew about Caleb/the Grimwalker situation, Hunter would be right to be hurt by Flapjack not telling him beforehand). But with Eda and Lilith? Unless they have the time to build a bit of a positive relationship with Hunter beforehand, the fact that they are, technically bloodrelated and should be family would hang over any platonic relationship they might develop.

I do think Hunter learning things about Caleb and eventually coming to terms with his origin and maybe even treating/honouring him like a distant relative is a thing that could happen and could help him, but considering he's just coming off the worst week? Two weeks? of his life, I doubt throwing more legacy at him would help. It's a whole bag of even more existential angst waiting to happen. (Does it make for cool angst tho? absolutely)

I don't even necessarily think any form of platonic relationship between Eda and Hunter is going to become important or a focus, but I'd rather they both don't know and Hunter just happens to get along with the Owl House residents better at some point. Full circle, but without the expectations that would set on the characters.

(However. Lilith finding out Hunter is technically her great great great great (how many greats) father but nothing else about the situation so she's desperately trying to figure out what branch of time travel bullfuckery made that happen, conspiracy board and all, is ultra funny. So would be Hunter playing that up to mess with Lilith, and only to mess with Lilith. I do think he used to be a little shit while they worked together. Either way. Wait til Lilith finds out about the whole Philip-Belos thing. Someone please tell her she punched the Emperor in the face omg)
