Ok, as requested, ending to yesterday’s fic, The Vendor, The Teacher and The Roses. And I would also like to thank everyone for putting up and liking my crazy fics, last night I hit 100 followers and I was surprised. 🫶🏻
I love dancing to music, it helps my brain relax and process thoughts, so you’ll likely see it pop up in my fics here and there. Ok, I’ll stop talking cause I know there was people who were wanting to know the ending. Not edited in the slightest and I hope you like it!
The Vendor, The Teacher and The Roses - Ending
Warnings: like one swear word, Mel singing and dancing 😍
Words: 1.14
She knows if she goes left to her place then that means she’s choosing Gary, and if she goes right that means she’s choosing you.
She then takes a few deep breaths and closes her eyes. She thinks about it for a good minute, weighing the pros and cons, she then turns her brain off and lets her heart decide. Then she opens her eyes again when she made her decision. She flicks the stick to put on her turn signal and turns.
Melisss is wondering the entire ride if she made the right decision. Should she have turned the other way or did she turn the right way? She drives the car in the driveway and gets out. She closes the door and locks the car then walks to the door, keys in hand. Once she gets to the door, she knocks on it and you open the door a few seconds later. She takes a look at you and sees you’ve been crying and her heart breaks a bit.
“Melissa?” you say quietly and she looks at you with a small smile
“Hi hon.” She says.
“Do I even want to know how you got into the building?” You ask her and her smile grew a bit.
“Someone who lives here was entering the same time I was and they let me in.” She says and you nod your head.
“What are you doing here?” You ask her.
“I saw your card, and the flowers.” She tells you and you widen your eyes.
“Melissa, you don’t have to say anything ok. It was a stupid idea and I know you’re with Gary and you love each other ok. I saw when you told each other.” You tell her and she thinks that that explains why the trash can was on the floor and why the flowers were thrown out right outside the break room.
“Y/n, why didn’t you tell me about your feelings before?” She asks and you look at your feet.
“Cause I didn’t want to ruin our friendship, because I value it so much. But then I saw you got mad from Gary ignoring you all day so I decided to go for it.” You tell her and she sighs.
“I should have realised it but I guess I was so blind.” She says and you look at her.
“I guess I’ll see you tomorrow then?” You tell her and she looks at you confused.
“Are you saying you want me to leave?” She asks and you tilt your head.
“Well the reason you came here, was it not to ask the questions you asked me already?”
“No, well, not the main reason.” She says. “I have feelings for you too. And I have feelings for Gary as well. When I got in my car I could have gone home or I could have come to see you. And I chose you.” She tells you and you step aside to let her in your apartment. She walks in and you both go sit on the couch.
“You have feelings for me?” You ask and she nods. “Well why didn’t you say anything?” You ask her and she looks at her lap.
“Well like you said, I’m with Gary. I thought my feelings for you might go away if I ignore them but they only grew.”
“What do you mean when you said you chose me?” You ask her.
“I mean if I went home then I would be choosing Gary, and I know I would lose you. If I came here then I would be choosing you and lose Gary.” She tells you. “And I can’t lose you.” She adds on and you look at her shocked.
“But you can lose Gary?” You ask her and she nods.
“He’s not as important as you.” She tells you and you look down at your fingers and twiddle your thumbs. Melissa takes your hand with hers and interlace your fingers and brings her other hand to your chin and gets you to look up at her. “I want to be with you.” She tells you and a tear rolls down your cheek. She wipes the tear and cups your cheek.
“I want to be with you too.” You tell her and you lean forward to kiss her but she puts a hand to your lips to stop you and you open your eyes and look at her confused.
“Believe me, I want to kiss you badly too. But I need to break up with Gary first, I’ll do it tomorrow after school.” She says and you nod.
“Sorry, I got excited.” You say and blush.
“Hey don’t be sorry, like I said, I really want to kiss you too, but I’m not a cheater.” She said and you nod.
“Can we at least hug?” You ask and she giggles. She nods and holds her arms out, and you lean in and put your arms around her. You two stay in the hug for a few minutes.
You then open your eyes when Melissa starts humming a song and you pull away to look at her. “I found myself dreaming in silver and gold, like a scene from a movie that every broken heart knows.” She starts singing and stands up and pulls you with her, she starts walking to the middle of the living room. “We were walking on moonlight, and you pulled me close.” She continues and pulls you close to her then continues it and looks in your eyes. “Split second and you disappeared and then I was all alone.” She starts swaying with you slowly. “I woke up in tears, with you by my side, a breath of relief and I realised.” She says and stops swaying to look at you. “No, we’re not promised tomorrow.” and she starts dancing with you as you both sing the chorus.
“So I’m gonna love you like I’m gonna lose you, I’m gonna hold you like I’m saying goodbye, wherever we’re standing, I won’t take you for granted, cause we’ll never know when, when we’ll run out of time, so I’m gonna love you like I’m gonna lose you, I’m gonna love you like I’m gonna lose you.” You end the dancing and singing and look at each other then put your foreheads together. She then pulls away and kisses your forehead.
“Do you want to come over to my place after I break up with Gary? I might need a kiss then.” She tells you and places a lock of hair behind your ear and you nod. She smiles at you then pulls away and leaves your place to go to her house.
You take a deep breath. What the fuck just happened? You think and you have a smile on your face for the rest of the evening.

you had long deleted genshin, since you had other things to do. you had wanted to go back to the game for a while now, now that you were less busy, but there was just one little problem.
it was now taking up nearly triple the amount of space that it was when you uninstalled it. around 300 whole gigabytes.
jesus christ, what phone can even handle this???
your phone, apparently. because as you opened the game to see if maybe a miracle would happen and that if maybe they would just, like, remove half of the things in the game, it just… kinda loaded?
no installing new files, no checking for anything, no nothing…. just an immediate pan to the gates of celestia.
you decided to check if it was the right genshin since this was just way too weird, but countering your judgement, every link you found led you to the same game, leading you to believe it not to be a bootleg or an illegal version.
guess i’ll trust it then.
you clicked on the gates which opened smoothly, and your screen turned white. then, the symbols of the seven elements appeared in gray.
and then the game just… opened. no loading time, once again. no getting stuck on the geo symbol, nothing. nada. just a smooth entrance into what you had to assume to be teyvat — but your surroundings didn't really support that claim.
the grass was brown and just looked off, the sky was gray. a darker shade than, say, mond’s walls, but it was like one of those game crashes.
well, except you could still move around.
you moved your current character around (the traveller? since when were they the only one in your team?) and decided to open the map after not figuring out where you could possibly be.
hold on, this is springvale? since when?
eveything looked dead, like it had been rotting for a century. you tried to ignore it though, and teleported to the inside of mondstadt. surely this was just some glitch, right? one that would fix itself if you teleported?
maybe the world loaded incorrectly, maybe the fact that nothing took time to load meant that it couldn't load, maybe this or that, maybe…
maybe this really was how the game looked normally. you hadn't done any quests though, so you wondered if it could be restored.
you took a screenshot of the your surroundings — the stone, worn down and dirty. the houses which looked to be in a horrible state, and… the npcs, all sickly and pale, like they were starving.
you went to reddit (yes, reddit), and posted the screenshot, asking if it was normal.
you closed the game and decided to take a nap, too tired to really deal with this shit any further.
while you slumbered, people replied to your post.
╰┈➤ lol me too anon, me too
╰┈➤ isn't the game closed or wtv? how'd you get this wtf
╰┈➤ they're trolling
╰┈➤ o makes sense oops
╰┈➤ So we’re all still mourning huh
╰┈➤ jokes aside that's a super impressive edit ngl
you remained unaware of the truth, but you'd find out soon enough.
actually, you'd find out now, apparently…
what the fuck?? why is my bed so hard now?
you groaned and forced your eyes open, seeing a dark, nearly black sky.
the only light was a single star, lingering right above you.
“since when was i outside...?"
a voice spoke to you, answering your question.
“you always have been, have you not? but would you like to head inside, my lord?”
... huh? i recognize that voice...
—
p.s. place your bets on who it is, i’m thinking of one specific character but if there's a fan fav i'll make it them instead since i haven't written anything beyond this point (・_・;)
p.s.s. don't expect updates to this series too quickly, i wish i could write as quick as i think of ideas but sadly that's not the case orz

Lallybroch: copyright vs. trademark
An excellent question was asked by our friend @rosfrank in the comments thread to 'The door faces North' post and given the cosmic amount of uninformed bullshit being ventilated for almost ten years in this fandom, I think it's time to answer it once and for all:
Whenever we are informally talking about 'owning the rights to something', I think it's very important to bear in mind a fundamental distinction between two different categories of ownership rights: copyright and trademark.
The copyright is the most familiar one to many of you. It is what you usually find on those annoying and apparently useless first or last pages of all the printed or digital editions on this planet. Something like this:
In the US, copyright issues are regulated by the Copyright Act of 1976, as included in Title 17 of the US Code. The US public authority competent for registering and managing copyright is, as predictable, the US Copyright Office.
Perhaps the most seminal US Supreme Court decision, as far as copyright is concerned, is the 1991 Feist Publications, Inc., v. Rural Telephone Service Co. In it, the Court ruled that mere compilations of information or facts (such as, for example, telephone books) are not protected by copyright, according to US law. In other words, the ancient legal concept of 'sweat of the brow' (which simply means the amount of work required to gather and compile those facts/information) is not enough to qualify a work for copyright protection, if no creative effort is added to enhance its content. This is why I have always considered absolutely ridiculous Marple's efforts to watermark public information screenshots: it is useless (to the extent that it legally protects her from nothing) and, as her timelines, a mere compilation of facts (legally ditto). A similar approach is preferred by the UK and also by many Roman law legal systems, such as the French one - just making things clearer, here, by the way.
See how 'Erself is roughly doing, right now, in this department:
But I am rambling. In my view, Lallybroch, as a pivotal concept used in Diana Gabaldon's books, is protected by the copyright granted to each and every of her books mentioning it, according to the Roman law principle 'accessorium sequitur principale' (the accessory follows the principal). So it will remain protected for at least 70 years since the last of her books mentioning it would have been published under copyright. Unless she chooses to separately protect the entire finished cycle as a whole, once Book Ten (fingers crossed) is published, preferably during our foreseeable lifetimes.
That being said, that goes only for one copyright category: (published) text - you cannot copyright that secret diary in your drawer, LOL. This is why, the current US Copyright Office records concerning Lallybroch look like this:
Sony Pictures Television Inc owns the copyright to the fictional name Lallybroch in the motion pictures category, as it is the title of the Episode 12, in Season 1 - DG has been handsomely compensated for this, no worries. And someone I have no idea about owns the rights to an original musical score she has written and titled Lallybroch in the music category, since October 2013.
Onwards to the trademark. This is something different and this is all about making your name/concept/idea profitable. It is all about branding it, putting it on a product and selling it under that brand. It includes all the graphic elements and the logo of the brand (accessorium...) - in short, its visual identity to the consumers. In the US, trademark issues are regulated by the 1946 Lanham Act and the public competent authority is the good old US Patent and Trade Office (USPTO).
Right now, the situation for the Lallybroch trademark is as follows:
So, we see three different trademarks: two of them, owned by Diana Gabaldon, are classified as 'dead' (cancelled and/or abandoned) and the third, Lallybroch Spirits, owned by S's Great Glen Company is pending approval - he will not be able to label any booze bottle Lallybroch Drink Me before permission is granted by the USPTO.
Let's unpack:
Both Lallybroch trademarks formerly owned by Diana Gabaldon were filed at the USPTO on February 21, 2000 and granted on December 12, 2000. The first was aimed at producing 'tartan fabrics for the manufacturer of clothing' and it was abandoned in December 2003:
The reason is that the owner did not file in any Statement of Use after the trademark was granted. She had three years to do so, and since she chose not to do anything about it, the trademark was deemed abandoned (Stacy K. Smith is the attorney hired by Herself, btw). That means she specifically implied not to intend using it in the future. As such, she may claim NO rights on a now free to use mark:
The second trademark was aimed at producing 'clothing, namely, t-shirts, dresses and headwear' and also 'jewelry, namely, rings, pins and necklaces'- to cut the story short: OL merchandise - and it was cancelled on March 1st, 2013:
The reason is that the owner did not file the Section 8 declaration (of continuous use for five years) within the allowed legal timeframe (6 months after the fifth anniversary of the trademark granting renewal). Her trademark federal rights are now deemed canceled (but not her state law and/or common law rights!) and if she wants to ever use that name again, she would have to start the whole process over, bearing in mind the trademark could have been granted to someone else, in the meanwhile (not her case).
And for anyone who might ask, 'Erself does not own any other trademarks whatsoever:
The other (Doll Lab - LOL for ages) Diana Gabaldon is a pharmacist from Albuquerque, NM. Chill. 🤣🤣🤣
The owner of the copyright to the fictional toponym Lallybroch, as far as published text is concerned, is Diana Galabdon.
The owner of the copyright to the fictional toponym Lallybroch, as far as motion pictures are concerned, is Sony Pictures Television Inc.
The owner of the copyright to the fictional toponym Lallybroch, as a personal work of music, is Mrs. Kelly Ruth Davis, of Pennsylvania, USA.
The owner of the Lallybroch Spirits trademark will be Sam Roland Heughan, when that trademark is granted by the USPTO.
I hope this answers your question, @rosfrank. Thank you for asking.
