"Maryland Gov. Wes Moore issued a mass pardon of more than 175,000 marijuana convictions Monday morning [June 17, 2024], one of the nation’s most sweeping acts of clemency involving a drug now in widespread recreational use.

The pardons forgive low-level marijuana possession charges for an estimated 100,000 people in what the Democratic governor said is a step to heal decades of social and economic injustice that disproportionately harms Black and Brown people. Moore noted criminal records have been used to deny housing, employment and education, holding people and their families back long after their sentences have been served.

A Sweeping Act

“We aren’t nibbling around the edges. We are taking actions that are intentional, that are sweeping and unapologetic,” Moore said at an Annapolis event interrupted three times by standing ovations. “Policymaking is powerful. And if you look at the past, you see how policies have been intentionally deployed to hold back entire communities.”

Moore called the scope of his pardons “the most far-reaching and aggressive” executive action among officials nationwide who have sought to unwind criminal justice inequities with the growing legalization of marijuana. Nine other states and multiple cities have pardoned hundreds of thousands of old marijuana convictions in recent years, according to the National Organization for the Reform of Marijuana Laws. Legalized marijuana markets reap billions in revenue for state governments each year, and polls show public sentiment on the drug has also turned — with more people both embracing cannabis use and repudiating racial disparities exacerbated by the War on Drugs.

The pardons, timed to coincide with Wednesday’s Juneteenth holiday, a day that has come to symbolize the end of slavery in the United States, come from a rising star in the Democratic Party and the lone Black governor of a U.S. state whose ascent is built on the promise to “leave no one behind.”

The Pardons and Demographics

Derek Liggins, 57, will be among those pardoned Monday, more than 16 years after his last day in prison for possessing and dealing marijuana in the late 1990s. Despite working hard to build a new life after serving time, Liggins said he still loses out on job opportunities and potential income.

“You can’t hold people accountable for possession of marijuana when you’ve got a dispensary on almost every corner,” he said.

Nationwide, according to the ACLU, Black people were more than three times more likely than White people to be arrested for marijuana possession. President Biden in 2022 issued a mass pardon of federal marijuana convictions — a reprieve for roughly 6,500 people — and urged governors to follow suit in states, where the vast majority of marijuana prosecutions take place.

Maryland’s pardon action rivals only Massachusetts, where the governor and an executive council together issued a blanket pardon in March expected to affect hundreds of thousands of people.

But Moore’s pardons appear to stand alone in the impact to communities of color in a state known for having one of the nation’s worst records for disproportionately incarcerating Black people for any crimes. More than 70 percent of the state’s male incarcerated population is Black, according to state data, more than double their proportion in society.

Maryland, the most diverse state on the East Coast, has a dramatically higher concentration of Black people compared with other states that have issued broad pardons for marijuana: 33 percent of Maryland’s population is Black, while the next highest is Illinois, with 15 percent...

Reducing the state’s mass incarceration disparity has been a chief goal of Moore, Brown and Maryland Public Defender Natasha Dartigue, who are all the first Black people to hold their offices in the state. Brown and Dartigue have launched a prosecutor-defender partnership to study the “the entire continuum of the criminal system,” from stops with law enforcement to reentry, trying to detect all junctures where discretion or bias could influence how justice is applied, and ultimately reform it.

How It Will Work

Maryland officials said the pardons, which would also apply to people who are dead, will not result in releasing anyone from incarceration because none are imprisoned. Misdemeanor cannabis charges yield short sentences and prosecutions for misdemeanor criminal possession have stopped, as possessing small amounts of the drug is legal statewide.

Moore’s pardon action will automatically forgive every misdemeanor marijuana possession charge the Maryland judiciary could locate in the state’s electronic court records system, along with every misdemeanor paraphernalia charge tied to use or possession of marijuana. Maryland is the only state to pardon such paraphernalia charges, state officials said...

People who benefit from the mass pardon will see the charges marked in state court records within two weeks, and they will be eliminated from criminal background check databases within 10 months."

Louisiana public schools are now required to display the Ten Commandments in all classrooms, after Republican Gov. Jeff Landry signed the requirement into law Wednesday.

House Bill 71, approved by state lawmakers last month, mandates that a poster-size display of the Ten Commandments with “large, easily readable font” be in every classroom at schools that receive state funding, from kindergarten through the university level.

The legislation specifies the exact language that must be printed on the classroom displays and outlines that the text of the Ten Commandments must be the central focus of the poster or framed document.

Before signing the bill, Landry called it “one of (his) favorites.”

“If you want to respect the rule of law, you gotta start from the original law given which was Moses. … He got his commandments from God,” Landry said.

Opponents of the bill have argued that a state requiring a religious text in all classrooms would violate the establishment clause of the US Constitution, which says that Congress can “make no law respecting an establishment of religion.”

Civil liberties groups swiftly vowed to challenge the law – which makes Louisiana the first in the nation to require the Ten Commandments be displayed in every classroom that receives state funding – in court.

The American Civil Liberties Union, the American Civil Liberties Union of Louisiana, Americans United for Separation of Church and State and the Freedom from Religion Foundation said that the law violates longstanding Supreme Court precedent and the First Amendment and would result in “unconstitutional religious coercion of students.”

“The First Amendment promises that we all get to decide for ourselves what religious beliefs, if any, to hold and practice, without pressure from the government. Politicians have no business imposing their preferred religious doctrine on students and families in public schools,” the groups said in a joint statement.

Supporters of the law, in defending the measure, have leaned on the 2022 US Supreme Court decision in Kennedy v. Bremerton School District, which gave a high school football coach his job back after he was disciplined over a controversy involving prayer on the field. The Supreme Court ruled that the coach’s prayers amounted to private speech, protected by the First Amendment, and could not be restricted by the school district.

The decision lowered the bar between church and state in an opinion that legal experts predicted would allow more religious expression in public spaces. At the time, the court clarified that a government entity does not necessarily violate the establishment clause by permitting religious expression in public.

Louisiana state Rep. Bailey was first appointed to the attorney general position by Missouri Gov. Mike Parson (R) in January 2023. Since then, he has launched investigations against a children’s hospital, gym and retailer that provide services or a safe and affirming space for transgender Missourians. One of the first actions Bailey took as attorney general was to attempt to investigate the Washington University Pediatric Transgender Center at St. Louis Children’s Hospital after a former caseworker, Jamie Reed, accused the center of malpractice. Bailey gave Reed whistleblower protection and began asking the hospital for patient medical records; later, he also asked for information on therapists and social workers across the state who worked with trans youth. A Missouri judge eventually found that Bailey’s office had no right to private medical information. Last year, Bailey also signed an emergency rule that created a burdensome set of requirements for trans people of all ages seeking gender-affirming care. He withdrew the emergency order only when the Republican-led legislature passed its own ban on gender-affirming care for minors, Medicaid recipients and incarcerated people.

A new Louisiana law that makes it a crime to approach within 25 feet (7.6 meters) of a police officer under certain circumstances is an affront to the movement for racial justice and violates the First Amendment, civil rights attorneys say.

Critics have said the law — signed this week by Republican Gov. Jeff Landry — could hinder the public’s ability to film officers. Bystander cellphone videos are largely credited with revealing police misconduct such as the 2020 killing of George Floyd by a white Minneapolis police officer.

“When you enact a law that prevents people from seeing for themselves whether injustice is being done, that is the biggest thing against civil rights you can ever do,” said Shean Williams, an attorney with The Cochran Firm in Atlanta.

Williams said images of police attacking demonstrators during the civil rights movement were instrumental to its success in advancing racial justice.

Proponents argue the new law will create a buffer zone to help ensure the safety of officers and that bystanders would still be close enough to film police interactions. Florida Gov. Ron DeSantis, also a Republican, signed a similar measure into law in April, saying it would help ensure law enforcement officers in his state can “do their jobs without the threat of harassment.”

In a statement at the time, DeSantis drew a distinction with “blue states,” saying Florida would continue to be “the friendliest state in the nation towards our law enforcement community.”

The Louisiana measure’s author, state Rep. Bryan Fontenot, said the legislation was drafted to provide officers “peace of mind and safe distance to do their job.”

“At 25 feet, that person can’t spit in my face when I’m making an arrest,” Fontenot said while presenting his bill in a committee earlier this year. “The chances of him hitting me in the back of the head with a beer bottle at 25 feet — it sure is a lot more difficult than if he’s sitting right here.”

But attorneys say states, including Florida and Louisiana, already have laws that criminalize efforts to obstruct police.

“The key in every other state is, ‘Are you disrupting the conduct of the officer?’" said Gerry Weber, a constitutional law expert in Atlanta who has represented numerous people in lawsuits over filming police misconduct. “One of the problems with the Louisiana law is it creates a presumption that one is interfering if they’re within 25 feet and they have been given a warning.”

Weber helped reach a settlement more than a decade ago that required Atlanta police to stop interfering with people who record officers performing their duties in public.

At least one other state created a law similar to the ones in Louisiana and Florida. In 2022, Arizona made it illegal to knowingly film a police officer from 8 feet (2.5 meters) or closer if the officer told the person to stop.

U.S. District Judge John J. Tuchi in Phoenix last year blocked enforcement of that statute, saying it “prohibits or chills a substantial amount of First Amendment protected activity and is unnecessary to prevent interference with police officers given other Arizona laws in effect.”

The Louisiana law does not specifically mention filming. It prohibits “knowingly or intentionally” approaching an officer who is “lawfully engaged in the execution of his official duties” after being ordered to “stop approaching or retreat.” Violators face up to a $500 fine, up to 60 days in jail, or both. It goes into effect on Aug. 1.

But even without an explicit reference to filming, the First Amendment concerns remain, said Susan Meyers, a senior staff attorney at the Southern Poverty Law Center.

Courts have been clear that people have a right to observe and film police doing their jobs in public, she said.

“What are they saying? How are they conducting themselves?” she said. “There are in fact very few ways for the public to hold these public servants accountable for their actions.”

Alanah Odoms, executive director of the ACLU of Louisiana, said she experienced the importance of filming police first-hand last year when she and some colleagues were pulled over by an officer who said he suspected the vehicle they were in was stolen.

The car wasn’t stolen, and Odoms, who has denounced the new Louisiana law, said she believes the justification was pretextual. On a dark, deserted road, she said filming the encounter gave her comfort.

“I’m probably within 8 to 10 feet of the officer and then two or three feet,” she recalled. “I would not be able to do any of that.”

A few minutes earlier, Walz had been onstage in Washington at a Center for American Progress event, chiding a crowd of engaged but worried Democrats, “Everybody who says, ‘I wish he was younger.’ I wish I was skinnier! San Francisco closed the lid Sunday on the saga of a $1.7 million public restroom. To commemorate the commode’s installation, residents celebrated at a “potty party” they called the Toilet Bowl.

Lookie-loos lined up in the Noe Valley Town Square to give the loo a whirl. A band played songs including “Sloop John B” by the Beach Boys. (“This is a song about a john!” the band leader explained.) Children sipped lemonade and ate chocolate cupcakes while they tossed bean bags into plastic training potties on the ground.

San Francisco may have been a laughingstock over the news that it planned to spend $1.7 million to construct a single public restroom with a sink and toilet, getting skewered by late-night comedians and inspiring the “it” costume at Halloween parties.

But on Sunday, the city got the last laugh.

“We wanted to, you know, really roll with it,” said Zach D’Angelo, dressed as a giant roll of toilet paper with a red plunger as his hat. D’Angelo, the host of Tuesday night trivia at a pub down the street, served as the Toilet Bowl’s emcee — or, as he put it, the Grand Poobah.

“I am flush with excitement!” he exclaimed before he started telling toilet jokes that he said he had gotten from his 7-year-old nephew.

The mood wasn’t quite so lighthearted in October 2022 when city officials announced a news conference in the Noe Valley Town Square to celebrate securing $1.7 million in state funds to build the 150-square-foot restroom — enough money to buy a whole single-family house in the city.

The square was built in 2016 with outdoor seating, a playground and plumbing for a public toilet, but no actual toilet, because money for the project had fallen short.

Just as puzzling as the price tag was the timeline. The city said it would take two to three years to install the restroom, even after it secured the state funds.

Neighbors and a local journalist (well, me) began to question the details of the project. City officials explained the toilet would have to be approved by numerous city commissions. It would also be subject to environmental review. All that, plus the high cost of construction in the city, made the project expensive and time-consuming.

Politicians began distancing themselves from the bathroom brouhaha. Gov. Gavin Newsom took back the state money.

Then, Chad Kaufman, president of the Public Restroom Company, offered to donate a modular toilet instead. He and Vaughan Buckley, the chief executive of Volumetric Building Companies, paid for architecture and engineering work to get the site ready. They also paid for a truck to carry the modular toilet to the square, a crane to lift it into place and union labor to install it.

The tab for the city dropped to $200,000, and Mayor London Breed announced legislation that she said would help bring down the cost of other public projects. It would let city departments team up to get group discounts on goods and services for small jobs. The state gave the $1.7 million back to San Francisco again, and the city says it will be used to build more toilets.

In the end, the new red restroom in the Noe Valley Town Square was worthy of celebration. On Sunday, a woman doled out toilet trivia. Local librarians handed out free copies of children’s books entitled “Everyone Poops” and “Time to Use the Potty.” There was a toilet-themed costume contest with whoopee cushions as prizes.

Three San Francisco politicians — Supervisor Rafael Mandelman, State Senator Scott Wiener and Assemblyman Matt Haney — addressed the crowd. Haney posed for a photo in front of the bathroom.

“It’s not gold-plated, but it’s worth its weight in gold,” he said with a laugh.

Debra Niemann, director of the Noe Valley Association, a neighborhood improvement group, said she didn’t think the toilet travails had done much to make city projects, including public restrooms, any cheaper to build.

“But at least we got one,” she said. “It’s beautiful. It’s clean. It’s simple. It’s everything you could want in a public toilet.”

“We are seeing people being fired from their jobs, being investigated by HR over their social media posts or conversations with colleagues, and having job offers rescinded. There is a clear trend that people’s jobs are being targeted right now,” said Dima Khalidi, the founder and director of Palestine Legal, an advocacy organization that seeks to preserve the civil rights of supporters of Palestinian rights in the United States.

Khalidi said that her organization has dealt with roughly 2,200 cases of speech suppression between the years 2014 to 2022. Yet in the last two weeks alone, they have fielded 300 new requests for legal assistance, a figure that usually matches their level of requests during a full year. “There is an exponential increase in the need for legal support,” she said. “It is a direct result right now of the kind of incitement that our own elected officials are engaging in, as well as the failure of universities and employers to push against pressure.”

Due to the obvious religious, cultural, and ideological fault lines, the Israel–Palestine conflict has always been a wedge issue for free speech advocates in the United States. But recent events have exposed a gaping chasm in perspective as a tidal wave of speech suppression has been met with a largely muted reaction, or even active support, from elected officials who normally depict themselves as champions of free speech. Florida Gov. Ron DeSantis earlier this week ordered Students for Justice in Palestine groups to shut down over recent protests in solidarity with Palestinian nationalism that he described as supporting Hamas.

A full accounting of the speech suppression across multiple industries would be difficult given the incredible scope of retaliation, which expands daily. But across the media and technology sectors, the arts, academia, and even generally nonpolitical industries like aviation and public relations, there has been an obvious effort to threaten, ostracize, and remove individuals from jobs based on their stated views on the subject.

In recent weeks, the editor-in-chief of the nonprofit scientific journal eLife, Michael Eisen, was forced to resign after sharing an article from The Onion satirizing public indifference to Palestinian civilian deaths; a top Hollywood talent agent, Maha Dakhil, was removed from the board of her company for suggesting on Instagram that a genocide was taking place in Gaza; and numerous journalists engaged in nonpolitical coverage, as well as ordinary corporate employees both in the United States and beyond, have faced reprimands and dismissals over their statements on the war.
