A federal judge dismissed in its entirety the classified documents case against former President Donald J. Trump on Monday, ruling that the appointment of the special counsel, Jack Smith, had violated the Constitution.

In a stunning ruling, the judge, Aileen M. Cannon, found that because Mr. Smith had not been named to the post of special counsel by the president or confirmed by the Senate, his appointment was in violation of the appointments clause of the Constitution.

The ruling by Judge Cannon, who was put on the bench by Mr. Trump, flew in the face of previous court decisions reaching back to the Watergate era that upheld the legality of the ways in which independent prosecutors have been named. And in a single swoop, it removed a major legal threat against Mr. Trump on the first day of the Republican National Convention, where he is set to formally become the party’s nominee for president.

Mr. Smith’s team will almost certainly appeal the ruling by Judge Cannon throwing out the classified documents indictment, which charges Mr. Trump with illegally holding onto a trove of highly sensitive state secrets after he left office and then obstructing the government’s repeated efforts to retrieve them."

Hannibal looked at the bottle again. He had indeed grabbed the wrong one while meaning to reach for the Cabernet.

"Long day. Difficult patients." Hannibal said and fixed his previous mistake then headed towards the fridge to grab the wagyu steaks.

"Wine will fix it." Will declared. "Maybe let me take care of those. I'm not sure you can be trusted with the oven tonight."

"I love you but hands off. While I can admit that your peanut butter and jelly sandwiches are superior, I believe my wagyu beef skills are a little bit better than yours."

"Fine. But do tell me about your day. I don't care about your patients, you don't let these things get to you. Tell me strictly about what messed you up."

Hannibal looked at Will and gave in.

"And then I brushed it off. If you allow yourself to fall for these kinds of delusions you do nothing but harm yourself more. Even if it is just for a second." Hannibal said. "Hope is poisonous just as much as it is healing."

Former president Trump appears to have slid further since last night’s news about a new grand jury’s superseding indictment of him on charges of trying to overthrow the 2020 presidential election. Over the course of about four hours this morning, Trump posted 50 times on his social media platform, mostly reposting material that was associated with QAnon, violent, authoritarian, or conspiratorial. 

He suggested he is “100% INNOCENT,” and that the indictment is a “Witch Hunt.” He called for trials and jail for special counsel Jack Smith, former president Barack Obama, and the members of Congress who investigated the January 6, 2021, attack on the U.S. Capitol. And he reposted a sexual insult about the political careers of both Vice President Kamala Harris and former Secretary of State Hillary Clinton.

Meanwhile, Trump’s campaign has today escalated the fight about Trump’s photo op Monday at Arlington National Cemetery, where campaign staff took photos and videos in Section 60, the burial ground of recent veterans, apparently over the strong objections of cemetery officials. Then the campaign released photos and a video from the visit attacking Harris. 

Arlington National Cemetery was established on the former property of General Robert E. Lee in 1864, after the Lee family did not pay their property taxes. At the time, Lee was leading Confederate forces against the United States government, and those buried in the cemetery in its early years were those killed in the Civil War. The cemetery is one of two in the United States that is under the jurisdiction of the U.S. Army, and it is widely considered hallowed ground.  

A statement from the Arlington National Cemetery reiterated: “Federal law prohibits political campaign or election-related activities within Army National Military Cemeteries, to include photographers, content creators or any other persons attending for purposes, or in direct support of a partisan political candidate's campaign. Arlington National Cemetery reinforced and widely shared this law and its prohibitions with all participants. We can confirm there was an incident, and a report was filed.”

Republican vice presidential candidate Senator J.D. Vance of Ohio first said there was a “little disagreement” at the cemetery, but in Erie, Pennsylvania, today he tried to turn the incident into an attack on Harris. “She wants to yell at Donald Trump because he showed up?” Vance said. “She can go to hell.” Harris has not, in fact, commented on the controversy. 

VoteVets, a progressive organization that works to elect veterans to office, called the Arlington episode “sickening.”

In an interview with television personality Dr. Phil that aired last night, Trump suggested that Democrats in California each got seven ballots and that he would win in the state if Jesus Christ counted the votes. As Philip Bump of the Washington Post pointed out today, Trump has always said he could not lose elections unless there was fraud; last night he suggested repeatedly that God wants him to win the 2024 election.  

When asked his opinion of Vice President Harris, Trump once again called her “a Marxist,” a reference that would normally be used to refer to someone who agrees with the basic principles outlined by nineteenth-century philosopher Karl Marx in his theory of how society works. In Marx’s era, people in the U.S. and Europe were grappling with what industrialization would mean for the relationship between individual workers, employers, resources, and society. Marx believed that there was a growing conflict between workers and capitalists that would eventually lead to a revolution in which workers would take over the means of production—factories, farms, and so on—and end economic inequality.

Harris has shown no signs of embracing this philosophy, and on August 15, when Trump talked at reporters for more than an hour at his Bedminster property in front of a table with coffee and breakfast cereal at what was supposed to be a press conference on the economy, he said of his campaign strategy: “All we have to do is define our opponent as being a communist or a socialist or somebody that’s going to destroy our country.” 

Trump uses “Marxist,” “communist,” and “socialist” interchangeably, and when he and his allies accuse Democrats of being one of those things, they are not talking about an economic system in which the people, represented by the government, take control of the means of production. They are using a peculiarly American adaptation of the term “socialist.”

True socialism has never been popular in America. The best it has ever done in a national election was in 1912, when labor organizer Eugene V. Debs, running for president as a Socialist, won 6% of the vote, coming in behind Woodrow Wilson, Theodore Roosevelt, and William Howard Taft. 

What Republicans mean by "socialism" in America is a product of the years immediately after the Civil War, when African American men first got the right to vote. Eager to join the economic system from which they had previously been excluded, these men voted for leaders who promised to rebuild the South, provide schools and hospitals (as well as prosthetics for veterans, a vital need in the post-war U.S.), and develop the economy with railroads to provide an equal opportunity for all men to rise to prosperity. 

Former Confederates loathed the idea of Black men voting almost as much as they hated the idea of equal rights. They insisted that the public programs poorer voters wanted were simply a redistribution of wealth from prosperous white men to undeserving Black Americans who wanted a handout, although white people would also benefit from such programs. Improvements could be paid for only with tax levies, and white men were the only ones with property in the Reconstruction South. Thus, public investments in roads and schools and hospitals would redistribute wealth from propertied men to poor people, from white men to Black people. It was, opponents said, “socialism.” Poor black voters were instituting, one popular magazine wrote, "Socialism in South Carolina" and should be kept from the polls.

This idea that it was dangerous for working people to participate in government caught on in the North as immigrants moved into growing cities to work in the developing factories. Like their counterparts in the South, they voted for roads and schools, and wealthy men insisted these programs meant a redistribution of wealth through tax dollars. They got more concerned still when a majority of Americans began to call for regulation to keep businessmen from gouging consumers, polluting the environment, and poisoning the food supply (the reason you needed to worry about strangers and candy in that era was that candy was often painted with lead paint).

Any attempt to regulate business would impinge on a man's liberty, wealthy men argued, and it would cost tax dollars to hire inspectors. Thus, they said, it was a redistribution of wealth. Long before the Bolshevik Revolution in Russia brought the fears of a workers' government to life, Americans argued that their economy was under siege by socialists. Their conviction did indeed lead to a redistribution of wealth, but as regular Americans were kept from voting, the wealth went dramatically upward, not down.

The powerful formula linking racism to the idea of an active government and arguing that a government that promotes infrastructure, provides a basic social safety net, and regulates business is socialism has shaped American history since Reconstruction. In the modern era the Brown v. Board of Education Supreme Court decision of 1954 enabled wealthy men to convince voters that their tax dollars were being taken from them to promote the interests of Black Americans. President Ronald Reagan made that formula central to the Republican Party, and it has lived there ever since, as Republicans call any policy designed to help ordinary Americans “socialism.”

Vice President Harris recently said she would continue the work of the Biden administration and crack down on the price-fixing, price gouging, and corporate mergers that drove high grocery prices in the wake of the pandemic. Such plans have been on the table for a while: Senator Bob Casey (D-PA) noted last year that from July 2020 through July 2022, inflation rose by 14% and corporate profits rose by 75%. He backed a measure introduced by Senator Elizabeth Warren (D-MA)—who came up with the idea of the Consumer Financial Protection Bureau—that would set standards to prevent large corporations from price gouging during an “exceptional market shock” like a power grid failure, a public health emergency, a natural disaster, and so on. Harris’s proposal was met with pushback from opponents saying that such a law would do more harm than good and that post-pandemic high inflation was driven by the market.

Yesterday, during testimony for an antitrust case, an email from the senior director for pricing at the grocery giant Kroger, Andy Groff, to other Kroger executives seemed to prove that those calling out price gouging were at least in part right. In it, Groff wrote: “On milk and eggs, retail inflation has been significantly higher than cost inflation.”

One state prosecutor and one civilian plaintiff have already won huge fines and damages from Donald Trump that may, with legal costs, exceed $500 million.

Trump awaits further civil and criminal liability in three other federal, state, and local indictments.

There are eerie commonalities in all these five court cases involving plaintiff E. Jean Carroll, Manhattan district attorney Alvin Bragg, New York Attorney General Letitia James, federal special counsel Jack Smith, and Fulton County district attorney Fani Willis.

One, they are either unapologetically left-wing or associated with liberal causes. They filed their legal writs in big-city, left-wing America—Atlanta, New York, Washington—where liberal judges and jury pools predominate in a manner not characteristic of the country at large.

Two, they are overtly political. Bragg, James, and Willis have either campaigned for office or raised campaign funds by promising to get or even destroy Donald Trump.

Carroll’s suit was funded by left-wing billionaire Reid Hoffman.

Smith sued to rush his court schedule in hopes of putting Trump on trial before the November election.

Three, there would not be any of these cases had Donald Trump not run for the presidency or not been a conservative.

Carroll’s suit bypassed statute of limitation restrictions by prompting the intervention of a left-wing New York legislator. He passed a special bill, allowing a one-year window to waive the statute of limitations for sexual assault claims from decades past.

Until Trump, no New York prosecutor like James had ever filed a civil suit against a business for allegedly overvaluing real estate assets to obtain loans that bank auditors approved and were paid back in full, on time, and with sizable interest profits to the lending institutions.

Alvin Bragg bootstrapped a Trump private non-disclosure agreement into a federal campaign violation in a desperate effort to find something on Trump.

Smith is also charging Trump with insurrectionary activity. But Trump had never been so charged with insurrection, much less convicted of it.

Willis strained to find a way to criminalize Trump’s complaints about his loss of Georgia in the 2020 national election. She finally came up with a racketeering charge, usually more applicable to mafiosi and drug cartels.

Four, in all these cases, the charges could have been equally applicable to fellow left-wing public figures and officials.

Joe Biden, like Trump, was accused of sexual assault decades earlier by former staffer Tara Reade. Yet Reade was torn apart by the media and the left for inconsistencies in her memory. By contrast, the wildly inconsistent and amnesiac E. Jean Carroll won $83 million from Trump.

Jack Smith created the precedent of charging former president Trump for unlawfully removing classified files to his private residence.

But the government simultaneously did not charge Joe Biden for similar offenses. Yet Biden had removed files not for two years but for more than 30. He stored them not in one location but several.

His rickety garage was a mess, not a secure family compound like Trump’s estate. Moreover, Biden did so while a senator and vice president, without any presidential authority to declassify almost any presidential document he wished.

Biden never came forward to report the crime for over thirty years—until Trump was charged. Indeed, he was caught on tape six years ago, admitting to his ghostwriter that he possessed classified files but never reported it.

Bragg might have noticed that both Hillary Clinton (fined $113,000) and Barack Obama (fined $350,000) broke campaign financing laws. Neither was subject to federal criminal charges by local prosecutors.

An array of left-wing celebrities, politicians, 2004 House Members, former Senator Barbara Boxer (D-CA), and failed Georgia gubernatorial candidate Stacey Abrams have all recently challenged elections. They sought either to delay or redo ballot counting or, on the federal level, to sidetrack electors to ignore popular votes in their respective states.

These lawfare cases are part of other efforts that were highly partisan and without merit. Recall the Trump “Russian collusion” hoax and the “Russian disinformation” laptop farce.

In another first, some blue states are suing to take Trump’s name off the ballot for “insurrection,” a crime for which he has never been charged.

Total up the deaths, damage, and length of the summer 2020 Antifa/BLM riots. Then compare the tally to the one-day January 6 riot.

The former proved far more lethal, long-lasting, and destructive. Yet very few of the 14,000 arrested rioters in 2020 were ever prosecuted, much less convicted.

By contrast, the Biden administration sought to jail hundreds for crimes allegedly committed on January 6, such as “illegal parading.”

We are entering a dangerous era in America.

Ideology and party affiliations increasingly determine guilt and punishment. Opponents are first targeted, and then laws are twisted and redefined to convict them.

The left is waging lawfare with the implicit message to political opponents: either keep quiet or suffer the consequences.

4) 7 Minute Drill (J Cole)

J Cole decides to beef with Kendrick after being called out in Like That. He quickly disowned 7 Minute Drill and days later apologized to Kendrick Lamar during a live show. Allegedly, after hearing that the beef between Kendrick and Drake was serious, J Cole bowed out of the beef because he thought it was a friendly competition.

5) Push Ups (Drake)

While J Cole ducks for cover, Drake moves forward with the beef, though it's also a collective diss to Rick Ross, and Metro Boomin. This is also where he drops Kendrick's fiancee's name, Whitney and makes fun of his height. You won't ever take no chain off of us How the fuck you big steppin' with a size-seven men's on? 6) Taylor Made Freestyle (Drake ft. Tupac AI and Snoop Dogg AI)

Second shot at Kendrick, this was released on IG. Drake uses AI for this track, using Snoop Dogg and 2Pac to taunt Kendrick. 2Pac's estate demanded that the track be taken down as it was an unauthorized use of 2Pac's voice. Drake eventually took the track down, but the damage was already done.

7) Euphoria (Kendrick Lamar)

Kendrick officially warns Drake that he has dirt on him. Euphoria is also a hit show about troubled girls, which Drake is a producer of. This is also the infamous track where KDot demands Drake lose his N-word privileges.

8) 6:16 in LA (Kendrick Lamar)

While waiting for Drake's response, Kendrick shocks the hip hop world with a second shot a couple days after Euphoria, exactly on 6:16am (PST). This track is meant to spook Drake. Kendrick gloats of how he got his hands on a mole in Drake's entourage and they're feeding him scandalous information about Drake.

9) Family Matters (Drake)

A few hours after 6:16, Drake finally responds to the beef. He ups the ante by taking shots at Kendrick's family and drops that Kendrick beats his wife. Drake also threatens other artists who may be siding against him. This is also the most he's said the N-word in his song, taunting Kendrick for revoking his N-word privileges in Euphoria.

Is it 'cause you livin' that bachelor life? Proposed in 2015, but don't wanna make her your actual wife I'm guessin' this wedding ain't happenin', right?

EDIT: This post on reddit believes that Family Matters was the whole reason for the Euphoria drop. This is pure speculation, however, so decide for yourself the validity of these receipts!

10) Meet the Grahams (Kendrick Lamar)

Not even 45 MINUTES after Drake drops Family Matters, Kendrick responds, robbing Drake of his temporary triumph. He straight up lays waste to Drake's entire family, offering to be Adonis' mentor because Drake's a deadbeat dad, calling out Drake's parents for raising him terribly, and revealing that Drake has another illegitimate child, this time a daughter he's been hiding for eleven years. He also warns the female listeners that if they like Drake, they're exposing themselves to a predator.

24 hours after Meet the Grahams, Kendrick drops a new diss track, this time actively calling for Drake's life, saying he has fake street cred, called the people in his entourage pedophiles, and releasing the track just before everybody hits the club on a Saturday night just to rub salt in the wound. He calls out Drake on behalf of 2Pac and promises he has at least five more diss tracks waiting, knowing that Drake hasn't had the chance to respond yet. He also mentions Family Matters, which meant he wrote his responding diss in less than 24 hours.

Also 24 hours after Kendrick's last diss track, Drake finally drops a response. He addresses some of the allegations, including purposefully feeding info from the mole to Kendrick about a daughter that doesn't exist. He takes a few more shots at Kendrick's relationships, implying that his partner Whitney hasn't denied the accusations of domestic violence. He also clowns on Kendrick's sexual abuse as a child and blames that on his witch hunt to prove Drake was a pedophile. He ends the diss saying that he was tired of the whole beef and he didn't want to fight with an alleged woman beater. As of 5/9/24, THP6 has more dislikes than likes on Youtube.
