Lawsuit claims camera hidden in shower at Cape Breton Buddhist monastery
Two Nova Scotia-based Buddhist organizations are being sued after a high-ranking monk allegedly installed a video camera in a communal shower at a Cape Breton monastery.
In a lawsuit filed Thursday in Nova Scotia Supreme Court, Christopher Longoria of Texas alleges he was filmed while taking a shower in November 2021 at Gampo Abbey monastery, where he was living and working.
The lawsuit alleges the monastery and its umbrella organization -- Shambhala Canada Society -- were negligent in failing to protect residents' privacy and are liable for the privacy violations.
The claim alleges the video camera belonged to head monk Jack Hillie, who did not have "a valid lawful justification for this invasion of privacy."
Hillie was criminally charged with voyeurism on April 4, 2022, relating to alleged offences between December 2020 and November 2021, according to court records. He is scheduled to enter a plea in Port Hawkesbury provincial court on July 4.
The civil lawsuit says Longoria arrived at the remote monastery in November 2021, planning to stay until he was ordained as a monk. About a week later, he was showering when he saw a camera attached to the wall. The suit alleges he took the camera to Hillie, who said the camera belonged to him.
Longoria allegedly used the monastery's landline to call police, who told him to report it in the morning as "he was in no immediate danger." Longoria reported the incident to local police the following day, handing over the video camera, including a memory card that contained footage.
"Police later confirmed that the camera contained video footage filmed unknowingly of others in the monastery showers, and that there was further video footage of a similar nature stored at the monastery," the suit alleges.
Basia Sowinski, a lawyer representing Longoria, said other complainants may come forward.
"I'm hoping other residents become aware of the situation, and if they were there at the same time as our client, or perhaps prior, it's possible that they could have been filmed in the showers as well," she said in an interview.
None of the allegations have been proven in court. Attempts to reach Hillie and the Gampo Abbey monastery were not immediately successful. Deborah Luscomb, director of community and culture for the Halifax Shambhala Centre, said by email that she was "not interested or available to comment."
The civil suit seeks general damages for pain and suffering, describing the intrusion as "highly offensive due to the inherently private nature of showering." It says the incident caused Longoria "severe distress, humiliation and anguish."
This report by The Canadian Press was first published June 15, 2023.

Hello everyone!
Recently we at FSW have come into ownership of some official wyngro documents. (Relevant ask here) . The documents include the following:
-magic class trackers for classes # 12, 14, 15, 16, 18 and 19. This is not the official magic tracker! Only some individual classes.
-the sheriff’s office google sheet
-the retired/grandfathered upgrades list document
-an unreleased(?) list of “easy peasy” upgrades (upgrades that are very easy to get compiled in one doc) edit: actually this looks more like an early version of retired upgrades sheet?
-the nova bank google sheet
We plan on making no new changes to these documents.
Edit: we will not be releasing any previously private document either!
We have made the decision to remove all editing access from outside sources on these docs. We didn’t want any ex or current staff editing things on the docs. We believe we should keep everything the same as when wyngro closed to preserve it’s history.
If those in charge of wyngro wish, they are very welcome to contact me via my discord (freespeechwyngro#7445, but please leave an ask here first so I know to check the discord) or email ([email protected]) or even DA (freespeechwyngro but you will have to leave an ask here to ask me to check that account). I don’t wish to keep these documents from you. I’m very happy to transfer ownership to the proper authority!

Six Drink Sara (Pt. 3)
(Yet ANOTHER installment handcrafted by the ever-brilliant @pathfindersemail and myself, featuring Sarianna Ryder, Puck, and a whole lot of nausea and exhaustion.  It’s long, ~2800 words, but it’s cute, and there’s no puking this time.)
Pathfinder, the morning shift is beginning.
Sara’s half-embarrassed realization that SAM had never needed to say those words to her before was quickly overtaken by intense throbbing pressure in her head.  No amount of burying her face in pillows would alleviate the intense pain she should have expected, if she was being completely honest with herself, from last night’s attempt to escape an entirely different kind of pain.  With the sort of heavy groan one gives when their body fully refuses to cooperate, Sara managed to spill off of the bed like a viscous fluid.  She jammed the heels of both hands into her forehead as she rose to her feet far more quickly than she should have, sucking the air around her in through gritted teeth.
The decently low lighting of the Tempest’s lower deck felt garishly bright as Sara staggered out of her quarters, still groaning, hugging the wall and using one hand as a visor.  Someone already had coffee on in the galley; a straight walk there and back was all the pathfinding she felt up to in her current condition.
“Well.  You look like hell.”
Normally, the silken flange of Vetra Nyx’s voice was a comfort - a relief, even.  Now, it served only to increase the tempo of the pulsing ache in her head, and it didn't help that Sara knew the turian’s observation was an objective truth.
“Thanks,” she huffed, carefully turning to face her friend and forcing her eyes into a glower she hoped appeared more unamused than completely miserable.
“Rough night?”
“You could say that.”
Vetra breathed an amused chuckle, and offered Sara a cup of coffee.  “How much did you drink?”
“Too much.”  The aroma swept into her nose as she cradled the Initiative-branded mug in her hands, and for just a moment she felt a bit of the shifting in her stomach ease.  Just a bit, though.
“Ugh, I don't ever want to even see alcohol again.”
“I'll tell Liam to hide his beer stash, then.”
The laughter came before Sara was ready for it, and the lingering queasiness returned soon after.  A quick sip of coffee quelled the waves in her stomach for the moment, but the calm was short lived.  Soon after taking in the soothing warmth of the caffeinated beverage, a throbbing gnawed at her temples, as if to remind her of a very obstinate headache.
“How'd I get back here, anyway?”
“Guy from the docks brought you up.  Said someone else walked off the lift from the slums with you over their shoulders and dropped you off in the bay.”
Vetra’s narration, however sparse, prompted enough of a recollection that seemed to worsen the lingering headache.  The sound of a strange yet coaxing voice and the burning in her throat flashed through her head in incomprehensible episodes.
“You...really don't remember?”
Sara let her eyelids rest briefly while she slowly turned her head ever so slightly from side to side, confirming Vetra’s suspicions in the least nauseating way possible.
“I must've blacked out.  But…”
She scrunched her nose in that telltale sign of focused contemplation, mulling over the strewn about pieces of her memory.
“What?”
“It's probably nothing,” she said, punctuating her dismissal with a cautious sip, “but I had the weirdest dream.”
Puck kept herself busy while waiting for the Pathfinder to come to by rehearsing all of the most vulgar ways she could think of to tell Reyes to deal with his own spurned lovers from now on.  Although, ‘spurned lovers’ wasn’t that accurate of a term, now that she thought about it, especially not in this case.  Truthfully - and the breadth of knowledge she possessed regarding her friend’s personal life nearly caused Puck to start dry heaving herself - almost none could be considered ‘lovers’ at all; Reyes had mastered the art of honeyed words and bedroom eyes, but most of his famed ‘trysts’ involved little more than a few drinks and some god awful lines, and never made it past Umi’s door.
Not her, though.  Of course, it had to be Sara Ryder that actually got to him.
Propped in a heap against the wall next to her, Sara let out a lazy groan in her sleep.  It was a faint but nonetheless sure sign she was alive, but Puck had to make sure of more than that.  She lodged a forefinger against the Pathfinder’s cheek, letting her head fall limply to the side.
Out like a candle.
As far as Puck was concerned, there was only good news to be had from the “mission.”  For one, if Sara came back to her crew in less than “safe” conditions, it wasn’t anyone but the alcohol’s fault - least of all hers.  And two, taking her back at that moment was as safe as it was going to get.
With a gruff sigh, Puck shifted in preparation to carry all that dead weight over her shoulder.
“Well, Beans, it’s now or never.”
She wasn’t quite sure where the ultimatum came from, nor did she have the slightest idea in hell why, in the most opportune moment she’d had in a shitshow of an evening, she stalled.  What was certain, however, was the hint of relief - a slow, liberating weightlessness of being able to say the name out loud.  It was enough to distract her, and she held fast, even for just another moment, to that intensely satisfying rush of being able to talk to her cousin again.
Standing there before her unconscious figure, Puck realized hauling her to the docks in this condition would be much easier than having to drag Sara back to her ship kicking and screaming. Now, their ill-gotten moments of quiet afforded her some time to think, and thinking always led to dangerous things.
“Shit, if you hate him,” Puck began with an aloof shrug of her shoulder, “then you must hate me.” The last word faded off with the drone of her helmet’s voice changer.
Sara answered with a yawn, a move that nearly wrought havoc in Puck’s otherwise calmly aloof demeanor. To her relief, Sara merely shifted to her side as her mouth hung slightly agape - sure signs that she remained ever so deeply asleep.
Patience never was Puck’s strong suit.  Especially not when she had an itch, as was often the case when one was constantly covered head to toe in armor, and a perfect way to scratch it stared her right in the face.
“Lot of shit’s going on right now.  You probably wouldn't believe me, but I’d tell you everything right now if I could.”  Ever incapable of taking anything too seriously, her head hung low in a soft chuckle.  “I bet you'd have the most ridiculous dumbass look on your face when you see it's me.”
She would end the speech there, but the caveat of such a reality quickly caught up with her.
“Well, if you don't try to kick my ass first.”
Now that they - or at least she - started, it proved harder to stop.  Whatever tension was there eased with the breeze that so rarely swept through a quiet evening in the slums, and she added an abrupt grunt to the wind as she unceremoniously plopped down on the ground.  Sitting next to her cousin, Puck couldn’t miss the irony of it all.  It was always Sara who needed a good listener, and it was her cousin who would lend an ear.  Now, she relished the reprieve granted by their reversed roles.  Puck, the inexplicably open book; and Sara, the good, albeit unconscious, listener.
“Remember that spot in the Wards on the Citadel where I used to smoke?  Where we used to go watch the ships and talk shit all night when shit got rough?  When your dad was being a colossal dick,” - she ended the last question with a bit of a grunt, nudging Sara with another brush of her knuckle as if it would help her remember - “or when the boy you liked didn't like you back?”
Puck laughed quietly to herself, forcing the corners of her mouth apart and the air out of it, as if doing so would make enough space to keep the supremely annoying welling of tears from escaping as well.
“You always cried too fucking much.”
The lack of an answer bought her time to ponder the dingy if not altogether lackluster beige of the alleyway.  Wedged in the second level between a shanty store and Tartarus itself, their platform overlooked much of the slums’ squalor.  Sure enough, Puck was used to much greater heights; the kind that only two scrawny kids with the requisite agility and stubbornness could climb.  And instead of the beige blah of the poverty surrounding them, there was the sleek black neon of Zakera Ward.  Tall enough to watch the transporters whistle by with barely a care, and dark enough so no one would see where they hid past curfew.  Yet even in their more modest setting, she couldn’t help but feel just as invisible - invincible, even.  In Kadara, they had nothing but drunkards staggering home and the still-burning glow of a red giant in their horizons.  Somehow that felt safe enough, if not just as safe as being home again.
“Reyes...he told me what you said to Zia about him, that he's a better man than she thought.”  “Heh, well coming from her that's not really saying shit, but you…”
Puck inched closer to her ever-dreaming listener out of the sudden concern that, perhaps, Sara might fall over without the support of her shoulder.   Looking over the damsel in question, she couldn’t help but glance askance over the formidable Pathfinder. Fast asleep, she looked almost calm if not for the twitchy wrinkle of her nose.  Sara’s face contorted as a result, and with that Puck suppressed what would normally have been a bellowing guffaw.  It was precisely the sort of forbidden moment she planned on remembering for herself, if only to allow herself the luxury of a secret.
Reyes must enjoy these moments with her, too - not this precisely, or so she hoped, but similar little things.  Sara made some pretty entertaining faces when flustered or nervous, and Puck felt a sharp pang of resentment at her friend for missing this.
“I don't know if he really loves you or not, Beans, but...I think he wants to.  You're something to him.  He's never gonna say it, that's...not his style.  With him, it's all about the little things.  He’s always got that shit-eating grin on his face, but it's softer when he talks about you.  He asks me to drag a lot of people out of bars for him, but he's only ever asked me to keep you safe.”
“So...don't hate him, okay?”
A reply would've been nice.  For fuck’s sake, the one time Puck wanted Sara to talk to her...
“And please don't hate me either.”
A groan answered her this time.  “Nnng… who…?”  Sara turned her head before she had the strength to lift the lid of her eyes.
Shit.  Shit, shit, shit.
A heavy furrowing of her brows brought a distorted crease over Sara’s features.  She woke with a bellow of a moan, barely able to stretch her still comatose limbs.  A quick turn of her head, and the languid expression of her face very quickly turned to that of exasperation.
“Hey. Drink this.”
The Pathfinder’s eyes narrowed into tiny slits, and she put forth her best effort into a wobbly, skeptical backwards lean of her head.  Instead, a nagging migraine tipped the weight of her head over, sending it gently down onto Puck’s armor-clad shoulder.   “Where am I?”
“Same place.”  Through pitiful moans of protest, Puck shifted her shoulder so that Sara’s head was as close to upright as it was going to get.  She offered the flask again, with a bit less compromise this time.  “Drink some water.”
After staring back for an awkwardly long time with a slight curl of her upper lip, Sara reluctantly complied.
“Heh,” she mused as she lowered the flask from her face, “my sixth drink for the night.”
“Finally.”
“What?”
“Nothing. Anyway, can you walk, or am I gonna have to carry you?”
A slow roll of laughter rumbled from her lips.
“What’s so funny?”
The laughter devolved into something of a choking sob. “I don’t… I don’t think I can.”
Puck’s eyebrow twitched in a suppressed groan beneath her mask.
The earlier forebodings of her tears came out in full force, as if Sara had suddenly remembered the very crux of her woes.  “He was supposed to come back. It’s been days!”
Her compassionate savior answered with a protracted silence.  “Tough shit. He isn’t here.”
“Yeah,” Sara shrugged.  “But you are.”
Even in that salt-soaked sardonic tone, even if Sara didn't know who she was really saying them to, those words from her lips pulled a reluctant but wide smile across Puck’s face.
“Trust me, it’s good that he sent me.  It's not like he couldn't have gotten someone else to do it.  I only get called in for the really important shit, so, you know...take that however you want.”
Sara took the confession with a bemused sigh and a slight roll of her eyes.  Puck would have said more, but the Pathfinder seemed to take to her own guarded reticence as she withdrew further into herself.  With knees pressed firmly against her chest, a wistfulness overtook her temperament in the moments that followed.
“I’m really tired.”
Having known Sara a bit more than most, Puck was more than tempted to offer up one last-ditch effort to be done with it all: to fling her cousin back over her shoulders and plop her back down on her ship.  But it was precisely the sort of indignity a Ryder would never suffer (much less someone as proud as Sara), so she settled instead to play at being therapist, if only for a moment.
“You know, if he’s such an asshole… why sit around waiting for him?  Why bother with him at all?”
The question struck something of a chord.
“I don’t know,” she continued. “He just doesn’t seem your type.”
Puck risked the observation, and she was met with what at least seemed like Sara’s tacit acceptance.  Much to her surprise, the question didn’t come up:  how could she know what was her type, if she had one?  It didn’t matter anyway. She was still in love with Reyes, and he was still not there.
“Maybe,” she countered with an unexpected hint of resignation. “But I know he needs me.”  If Sara had been less tired, no doubt a smile would have followed those words.  Instead she lifted her head enough to stare directly through Puck’s helmet with a newfound air of haughty resolve. “And I like feeling needed.”
“Don’t we all.”
Another yawn rolled from her lungs - wide and seemingly unending with the way she stretched her head back against the wall.  The heaviness in the air seemed to weigh down on her, for soon her face relaxed back into a dreamlike calm before her eyes slowly fluttered to a close.  It only took a few moments before the slowed rhythm of her unconscious breathing motioned the rise and fall of her shoulders.
“You're right, though, Beans.  He does need you.”
Puck shifted ever so slightly, careful not to wake her tired cousin.  With her arms freed, she released the airlock keeping her face safe behind its previously impenetrable facade, and wrestled her head from the cracked confines of her helmet.  The chill of the air and the lingering waft of Kadara’s detritus made the very prospect of breathing less worthy of the effort.  Still, she was with family now, and the impulse to leave something of a memento, however transient, presented itself.  Regina May Park, finally exposed to the full scrutiny of her cousin's presence and Kadara’s night air, planted a slight and ever so careful kiss between Sara’s brows.
“And so do I.”
Six hundred years and a new galaxy was all it took, apparently, to feel at home again.
“That's...hmm.”  Vetra propped her hand over her waist, letting her eyes wander off to the floor in piqued contemplation.
“Yeah,” Sara replied.  She ran a timid hand over the back of her neck.  “It’s stupid.”
She tried to ponder the blurry pieces left in her headache-ridden mind, but by the way the very veins in her head throbbed, it proved too much of an ordeal.  Sara let out a tired breath.  Somehow, she’d have to find a way to shake off all of last night’s aches.
“Let’s...let’s just get out of here.  I think...I’ve had enough of Kadara for a while.”

The Miꞌkmaq people are facing hostility and threats in Eastern Canada over the right to fish to sustain themselves.
This has included:
“In response to Mi’kmaq fishers setting up 150 out of their 350 allowed traps, non-Indigenous fishers gathered at the wharf in Digby to protest.”
“One of the ways Nova Scotian fishers have found it appropriate to protest Mi’kmaq harvesting practices has been to chase down boats and fire flares directly at them. There have also been attempts to ram small boats with much larger vessels.”
Two people being arrested and charged with assault.
“Lobster traps in St. Mary’s Bay were vandalized, their lines were cut, and the traps were left on the shore.”
“Some fishers have posted calls on social media to reimplement the Canadian residential school system, and for other harsh treatment of Indigenous peoples and their children.”
A lobster boat belonging to a Mi’kmaq fisher has been destroyed by a suspicious fire at a wharf in southwestern Nova Scotia.
These people have the right to sustainably fish on their own land and support their livelihoods. Megan Bailey, professor at Dalhousie University’s Marine Affairs program, an expert, has said that there is no conservation concern as has otherwise been claimed. “The scale of the livelihood fishery as it exists right now with 350 traps is not a conservation concern.”
Ways you can support the Mi’kmaq people (both on this front + other issues):
Treaty Truckhouse Legal Fund - Grassroots Grandmothers, Mi'kmaw Rights Holders and others continue to stand united as water protectors of the Shubenacadie River in the Sipekne'katik District of Mi'kma'ki, where Alton Gas intends to dump salt brine equivalent to 3000 tonnes of hard salt every day.
Another donation link is here, or e-transfers can be sent to [email protected]
Support for our Eskasoni Mi’kmaq Fishers - Supplying resources for the fishers to continue the battle to have access to moderate livelihood fishery.
Mi’kmaq Fishers: To show support you can donate funds via e-transfer to the following emails with the message “donation”:
If you have any useful additions, please let me know, and I will add anything that I find. Also please spread this around, awareness is also important so that these issues do not fly under the radar and get a pass.

More than 20,000 Nova Scotians have registered for wildfire financial aid
The fires in Halifax and Shelburne County have been devastating for the province of Nova Scotia. So far, 8,200 households and more than 20,000 people have registered for aid.
“To date, we have raised $1.7 million through our specific forest fire appeal,” says Bill Lawler of the Canadian Red Cross.
There are a myriad of needs and a number of aid organizations stepping in to help as quickly as they can.
A week after the fires became a concern, the process of distributing funds is still being coordinated. A lot of charities are raising money and dispersing those funds effectively takes time.
“The impact will be quite different from household to household and that’s what we will be working to do. Before we start to provide further assistance, we need to connect with those who have been impacted and we will be doing so via an email survey to all of those households who have registered with us,” Lawler says.
The United Way of Halifax is another group putting in long hours to help. In addition to accepting donations, they are proactively raising money.
Their big event is a benefit concert taking place Friday night at the Scotiabank Centre in Halifax, featuring a number of well-known artists, including Matt Mays, Joel Plaskett, Classified and Jenn Grant.
“We will be providing funds to service providers in the community who can work them directly with individuals to help them meet their needs, so we work with a vast number of service providers,” says the organization’s strategy director, Sue LaPierre.
“It’s important to note that this money will also support the community of Shelburne where the other fires are happening. We may be United Way Halifax but we’re going to be able to respond to any areas of the province where there is impact from the fire.”
Smaller scale efforts are also underway. Sandra Drover owns a clothing store and she is offering last year’s stock free of charge to anyone directly affected by the fires.
“I honestly can’t believe what these people have to be going through. It’s completely devastating,” Drover says. The fact that we can help in a small way and maybe put a smile on somebody’s face because these articles are new and not worn and we can help,” she said, holding back tears.
Rounding out a true community effort to help others in their time of need.
The federal government will be matching all funds donated to the Canadian Red Cross dollar-for-dollar until June 29.

Hi, I’m not trying to troll here and am legit asking because I don’t have much reading comprehension
How are Lily’s statements about the recent stalker contradictory? Like I’ve read them all, and the only thing that read as off to me was the fact that there was no public police record on the incident, but that’s it.
Idk, the stuff people were pointing out just felt like Lily was distressed and unable to give out the full story at the time, which would make sense.
Alright, so, the first oddity happened between her twitter and her tumblr, and this has been jotted down by hypocrisyofandrewdobson, so here's the link:
https://hypocrisyofandrewdobson.tumblr.com/post/672316383653134336/lily-orchards-official-tumblr-for-those-curious
But to quickly sum it up, on tumblr, Lily claimed that she was sent an image of her apartment and then an "altercation" happened that involved the police.
Now, Lily claiming that the guy was charged with criminal harassments (aka stalking) and making threats. The first issue is that, in Nova Scotia, someone can only be charged with criminal harassments if this has been a repeated offence that is carried over a period of time.
She's also rather vague on what kind of altercation happened. But it's fine if it's vague, because we don't need to know.
But then when you look at her twitter, she claims that someone came to her building and threatened her and then got arrested.
So already, eyebrows are shooting up, because the stories don't follow each other very neatly. Someone coming to her building threatening her conjures up different idea's then someone sending an email with an altercation at a presumed later date.
But trauma could play a role in this, so while it's a bit sketchy, it's nothing definitive. But this does stir her fan up to try an take a stand against those who criticized her.
But again, that could easily be hand waved away but her being shaken up.
Now, you already know about how it's weird that there isn't a police incident report, and Lily specifically name dropped the RCMP, who have no record of this.
Though, she never dropped their name on twitter, only on tumblr, where they don't operate.
So now more eyebrows are raising up, but again, maybe she meant the local police.
What is, in my opinion more definitive proof that this is smoke and mirrors, is what she said about the incident in her stream.
Now, Cypher linked it, but I'll do one better, because someone was lovely enough to actually isolate the clip in question, so here it is:
Now, here's the notable things about this clip:
1- Not only did the stalker send her a photo of her apartment building with a "This you?", but apparently the guy decided to send by using his data, standing outside that very same building.
Right, no.
Unless this is the worlds dumbest stalker/harasser, they would have taken that photo, and left the premises before sending it to her, because the point is to freak her out from a distance. Terrorize her mentally. While stalkers do show up around the premises, it's usually not to automatically send a creepy email, especially when this is the first time they've done that.
And this sounds like it was the first time.
2- We are asked to believe that Lily, upon receiving this email, decided to leave her apartment and confront this person, and that turned into a fight.
Questions I have from this: How did she know that the person she confronted was the stalker?
Did she ask? Why would he tell her? Even if, in some weird chance on earth, she was right, the guy would have lied and denied all of it and try to leave, not try to attack her.
So did she throw the first punch? It sounds like she did, but maybe he threw the first punch. But then why did he bother sending an email, if the goal was to hurt her? Why didn't he just attack her on the streets if that's the case?
It raises to many questions.
3- She won the fight and sent the guy to the hospital, and he's going to be arrested and she's pressing charges for Criminal harassments.
Yeah no. That's a fantasy.
Why do I say that?
Because the police would have arrested her, not him. For Lily to have beat someone in the streets to the point where hospitalization was required, and not be arrested, the guy would have had to show clear intent to harm.
And he didn't.
Lily got an email, left the premises, found someone she suspected sent the email and beat him up to the point of hospitalization.
And image being a cop, hearing all of that, and going "Welp, sounds like you had a good reason to beat him up. Let's arrest him."
NO!
The police don't care why you punched someone, if you put that person in the hospital, you are liable. Unless that person began shooting at her and stabbed someone, Lily would have been charged with aggravated assault.
But here she is, proudly boasting about how she got to beat someone up and get away with it.
If you need something more, I can see about maybe making a timeline with her tumblr posts, but that's the major run down of this story, basically.
I hope it helps you better understand where people are coming from, and thank you for asking about it. I really do appreciate the good faith being given here.

Assessment of Mental Health Care in Nova Scotia
CW/TW: This letter refers to mental health related issues including self harm, suicidal ideation and assault.
I emailed the following letter to Tim Houston, Premier of Nova Scotia; Michelle Thompson, Minister of Health & Wellness, Nova Scotia & Hon. Brian Comer, Minister, Office of Mental Health & Addictions, Nova Scotia; concerning the poor state of mental health care in the province. The Premier has announced additional funding to be put forward to support the system, however I do not believe that the Premier and Ministers in charge of this area of the government have enough training and understanding to put into action true change that will improve the system and what is offered.
To date I have not received a response. As such I am publishing this letter outlining the major fissures in the system publicly. Please share as you see fit.
Dear Mr. Houston, Ms. Thompson and Mr. Comer
I am writing to with great concern regarding the state of mental health care in Nova Scotia. As heads of state, government and mental health care in particular, it is imperative that you understand the failings in the system as it exists now, before you begin to start attempting to repair a broken system through means that will not create lasting change. I hope you will take this letter seriously as it pertains to the health and well being of all members of society in Nova Scotia in particular those most vulnerable: Indigenous, Black and people of colour, women, 2SLGBTQIA+ individuals and those experiencing homelessness and poverty.
I am 38, a lesbian, white settler and present as a cis-het woman*. I have many privileges & I live with chronic mental illness and historical trauma. Because of my health I have been unable to work full time in a job as society stipulates one should (9-5pm Monday-Friday for a fixed salary) since 2015. I have lost incomparable income because of this as well as the pandemic. My financial situation is now critical. I live with my mom because I have not been able to find a way to support myself monetarily and continue to live a healthy life.
I have been seeking therapy through the public health care system in Canada since I was a child in many different provinces (Ontario, Quebec, British Columbia, Alberta and now Nova Scotia). Each province’s system works differently and has pros and cons. The system in Nova Scotia is the weakest I have experienced.
In Nova Scotia, if you need to seek mental health treatment you must complete a telephone intake. Anyone who has sought mental health treatment will be familiar with this: the phone call where you reveal all your deepest and darkest truths: whether you’ve been assaulted, whether you experience suicidal ideation, whether you have or continue to self harm, etc. Once you are placed with a clinician you have 8 sessions with them. When I found out my therapist was leaving (for other reasons) I was distraught as I wanted to deal with traumas in order to live a healthy fulfilling life, and I don’t believe this is something that can be accomplished in 8 sessions.
My therapist at the time explained that the mental health care system in Nova Scotia provides care for 8 sessions because they do not want patients becoming dependent on talk therapy. This is because (according to my therapist & presumably the government putting this system in place) ongoing therapy DOES NOT WORK. I have seen this at work before: the revolving door, the patients who come, leave & come back again in crisis. This is not a cycle that I want to live in or repeat. With the help of a well rounded mental health system and clinicians who can provide optimal care this would not be the case or would not need to be the approach.
I am tired of repeating a cycle where I receive inconsistent care simply because I can’t afford to pay for private care.
I am tired of entering the mental health care system in crisis only to be leave several months later with no support.
I am tired of & I do not want to be a patient who needs to return over and over again in that manner. That is not healthy or a holistic approach to health and care.
My therapists response was: That sounds like the way mental health care works. My therapist, paid by tax payers, believes that going to therapy in crisis, leaving a few months later and reentering in crisis mode is the way therapy works.
This form of mental health care makes capital the most important tenet for offering care. Making patients into capital is not a health care system focused on health but on making money.
When I said I wanted consistent mental health care & to leave when I felt ready. My therapists response was that is unrealistic because that will never happen in the public health care system. She furthered that if that were the case (that I left when I was ready) would mean I would be healed of all mental health issues, which is not just unrealistic but impossible.
In essence a government employed health care worker admitted to a patient that the system they work for & that I am seeking help from does not and will never work for its patients.
This therapist then furthered that if I indeed wanted consistent care I would need to go into private therapy. Again I find this really problematic, that a government employed health care worker would a) redirect a patient out of the public system because they are indicating it is insufficient but also b) assuming that I have the means to support that.
If I was able to pay for private therapy I would never waste my time on the public system. The reason I am seeking mental health care in the public system is because I don’t have the means to support paying for private mental health care.
This statement is insulting, ignorant, disrespectful, privileged, tone deaf and ableist. This was said to me - as I stated, a white, cis-het presenting woman. Imagine what that would feel like, how demeaning and invalidating it would be, to someone facing even more barriers than I am.
The major flaws I see in the system is that it is upheld within a patriarchal, white supremacist, hetero-normative, cis-centred system & culture. The mental health care system requires workers with trauma training, clinicians who are Black, Indigenous and other people of colour, 2SLGBTQIA+,  clinicians who are disability activists, who respect self-care advocation & who are able to see beyond their own privilege.
I’m invoking the words of Johanna Hedva’s SICK WOMAN THEORY [https:// www.topicalcream.org/features/sick-woman-theory/] which you must read if you have not.
I am raising my sick fist in solidarity, in protest with all the other sick fists raised in protest.
I expect to hear from you.
Colleary.
[* cis-het presenting means I present as a woman and I am a woman and appear to be heterosexual; being white, cis and hetero-presenting are all privileges].

I do not have time for this.
Vernon swung through the air, landing nimbly on the road just a few feet behind the newest menace that had decided to grace his neighborhood with its presence. The self-proclaimed Rhino—basically a guy in a rhinoceros suit, as the name suggested—was tearing down 108th street at breakneck speed, which was almost as fast as Vernon mid-swing. Almost.
“Hey, slow down!” he called as he launched himself towards the suited man, and a little kid with a lollipop gaped as Spider-Man swung right towards the Rhino, legs stretched straight before him. “Tsk, how are we supposed to tango if I can’t even keep up?”
Rhino roared when Vernon dropkicked him right in the middle of his back, but the kick didn’t put him out of commission like Vernon had hoped it would. The villain (and Vernon used the term loosely) swung his fist towards him, but he flipped backwards, landing on top of a car, which dented under the force.
“Why is it always Queens?” Vernon asked, annoyed, as Rhino charged towards him. He pushed off the car to avoid Rhino, who crashed headfirst into the vehicle, sending shards of glass flying everywhere. Right next to it, a yellow Kia’s alarm went off. Vernon, now hanging from the building behind it, huffed. “And why is it always right before school?”
And a Monday, too. Vernon usually allowed for supervillains busting down his metaphorical door on mornings, but Mondays were usually off-limits. Honestly, what kind of villain gets up at seven a.m. on a Monday?
Vernon scaled the brick wall of the building, looking for a high vantage point he could drop down from, but even the little effort seemed to tire him out more than usual. Having studied until late night the day before, right after stopping a third try at a robbery on seventy-third (honestly, do these people never learn?), he had only managed to catch about three hours of sleep. It was normal by Spidey standards, but not by Vernon standards. Especially when he was supposed to have a test in first period biology.
“Spider-Man!” Rhino bellowed from three storeys below, snapping Vernon back to the present. He sighed as man demolished another car, no doubt to show off his might or strength or whatever it was villains loved to show off these days. “Face me!”
Vernon looked down. In the morning, everything was awash with sunlight, including Rhino. The suit was a dark gray but didn’t seem to be made of metal, looking about three to four inches thick like some kind of hide-like body armor, and light glinted off the visor that only half-showed his adversary’s face. If he hadn’t been about to be pummeled to death by the guy in rhinoceros suit, he would have appreciated the beautiful workmanship more. The horn was a nice touch.
“If you just wanted to see me, an email would have been fine!” Vernon called, letting go of the wall and righting himself in free-fall as he hurtled towards the Rhino. “No need to put on a show for little ol’ me—”
Okay. Maybe he had miscalculated the distance or maybe Rhino was less distracted than he thought, because instead of him dropping in on the villain like a ton of bricks, Rhino swung his suited arm, catching Vernon in the chest with bone-shattering force, and sent him flying.
Vernon hit the sidewalk with enough force for his body to skid a few feet before coming to a rest. His backpack (which had somehow not been torn to shreds) absorbed most of the blow, but the impact had knocked the wind out of him, and he lay there for a few seconds, wondering if he should just stay down. His head was already pounding, and a sleepy spider was a grumpy spider.
He changed his mind at the last moment as Rhino’s fist swung towards his face, and he flipped onto his back, jumping out of the way just as the fist came down where he had been lying milliseconds ago. Beneath the mask, Vernon’s eyes widened as he saw the blow break the asphalt.
I really do not have time for this.
“What the heck is that suit even made of?” he muttered as he dodged another blow, trying to work out a way to subdue Rhino as fast as possible. The suit was big and heavy, which usually made for slower reactions, and a good old webbing-down would have been the perfect way to wrap up the show, but if the suit was strong enough, even his web fluid wouldn’t hold. Vernon had to knock him out somehow.
“Wouldn’t you like to know?” Rhino made a throaty, hacking sound like could have been laughter. “Unfortunately, you will be dead before you can even get close enough.”
“You know, it doesn’t have to be this way,” Vernon said, dodging yet another attack, resulting in Rhino’s head getting stuck in the cracked windshield of a car for a moment. God, that guy was like a battering ram. He couldn’t keep this up forever. “We can always sit down and talk about this.”
“Spider-Man, I’ll kill you!”
“I’ll take that as a no, then.” Vernon raised his wrists, aiming at the car. Thwip-thwip, went the fluid from his web shooters, trapping the Rhino against the side of the vehicle. “Shame,” he said, as the man thrashed against his web restraints. “I know a really good taco place around here.”
The Rhino yelled, lifting the entire car bodily. Vernon watched as he raised the car over his head, the webbing breaking from the strain of the suit against them, and threw it directly at him.
Ah, crap.
Vernon would like to think he would have managed to get away from there in time even if someone hadn’t snatched him up into the air, but he doubted it. There was something majestic about watching a villain he’d underestimated lift a whole car up to throw at him.
The person caught him under the arms and lifted him into the air, away from the enraged roar of the Rhino that resounded throughout the street. Vernon’s first reaction to being picked cleanly off the road would be fear, but his spider sense hadn’t gone off yet. He tried to look up at his captor/savior, but the back of his head collided with something hard. “Ow,” he mumbled. “Who the hell are you?”
“The guy who just saved your ass, webhead,” the boy replied derisively. Or at least it sounded like a boy, very much like those guys in the cafeteria who used to drop snide remarks behind Vernon’s back pre-spider bite. The guy dropped him on the roof of a shorter building, and Vernon rolled out of the way, getting to his feet. The boy was dressed in a metallic-looking dark blue-and-gold suit, a bucket-like helmet over his head. The lower of his face was uncovered, exposing lips twisted into a scowl. “I’m not even getting a thank-you?”
“…thanks,” Vernon muttered after scrutinizing the guy for a moment. “Uh, who are you actually?”
“I’m Nova, creep.”
“Nova Creep.” He considered this. “Interesting.”
“Just Nova!” the boy snapped, sounding even more displeased than before. “Now if you’ll excuse me, I have to get back to my team and save the frickin’ neighborhood.”
Saying this, he turned and took off again, no doubt heading for wherever the action was. Vernon watched him go, choosing to take a breather instead of following him back down.
New superheroes in town? It wasn’t unheard of, and Vernon had had his fair share of newbies and oldies both to deal with in his year-long career as Queens’s friendly neighborhood Spider-Man.
He looked down over the edge of the roof. Sure enough, there were three of them—a girl in a white suit, moving around the wreckage like an acrobat and slashing at the Rhino’s suit, Nova Creep shooting fist lasers (Flight powers and fist lasers? Unfair.) at him, and—was that Iceman?
Vernon hesitated. He could join the fight and help finish it more quickly, but if Iceman was here, the X-Men couldn’t be farther away. He could leave the three to it and get to school in time to catch forty winks before class, no harm done. Was he even needed?
Unfortunately, he knew he was only giving himself the illusion of choice. Spider-Man never walked away from a fight, even if someone more capable was dealing with it.
He shot webs at the metal post hanging out from the opposing building and swung back down, joining the fight just as Rhino caught the girl around the middle like he had Vernon, sending her flying back into an already wrecked car. Vernon cushioned her landing with webs, managing to protect her body from the broken metal chassis, and she was back on her feet in seconds, joining his side.
“Thanks,” she said, which surprised him. Most superheroes didn’t take the time out to thank him, but that was usually unnecessary, since they evened out the score by saving his life. “You know this guy?”
“Nah, he’s new in town,” he replied, watching Nova and Iceman fight the Rhino. Iceman froze him from the legs to his waist, but it didn’t hold for long before Rhino broke through the ice. “Strong, though, I’ll give him that.”
“It’s the suit,” the girl told him. Now that they were up close, Vernon could see that her costume somewhat resembled a white tiger, with the pointed ears and yellow eyes. He wondered if she’d been bitten by a radioactive white tiger. “It’s made of some kind of polymer.”
“Polymer?” he echoed, even more surprised. He’d assumed metal.
“Self-regenerating,” she affirmed. “It’s not indestructible—I slashed through the hide with my claws, but—”
“Your claws?”
She raised her hand. Under the white glove, her nails extended into wicked, claw-like tips. “Cool,” he said, voice cracking halfway through the word. He cleared his throat. “Very Woverine-ish.”
“He’s a mutant,” she said dismissively. What was he supposed to call her? Tigerwoman? Tigergirl? “Rhino’s suit regenerates. We have to knock him out.”
“Yeah, I figured that one out,” Vernon muttered.
“A little help here?!” Nova yelled, zipping through the air in a zigzag manner to avoid the Rhino’s hits. “Or are you two going to stand around and chat all day?”
Vernon’s lips twitched into an unintentional smile. “I’ll web him up,” he told tiger lady. “You think Nova can pull him up?”
Tiger inclined her head. “Not on his own, but with a little frosty boost…”
“Great.” He sprinted towards the group, shooting webs at the Rhino’s head to get his attention and distract him from the others. “Hey, Hippo! Over here!”
The Rhino ripped off the webbing from his visor, not wasting a moment before charging him. Vernon lunged, wrapping the Rhino suit up in webs as he scaled the wall, trapping him in the web fluid. It wouldn’t hold for long, he knew—but he only needed a few seconds. And some blind faith.
The excessive webbing wrapped around Rhino like a net trap, and Vernon pulled, lifting him into the air with as much strength as he could muster. Below him, Iceman froze a column of ice under the Rhino’s butt, giving him a little extra height. Ten feet…twenty feet…
“Tiger!” Vernon yelled.
She lunged, pushing off the hood of a dented car to give her extra height, and ripped through the thin web holding him up with her claws. Rhino plummeted to the ground, crashing into a car and through it, the fall only broken by the ground, the asphalt cracking beneath the force.
Vernon watched him anxiously. The suit should have been heavy enough to render the man inside unconscious, unless he had a really good cushioning system in place.
He counted to ten in his head. Rhino didn’t move.
Thank god for bad cushioning, Vernon thought, swinging back down to the ground. “You guys think you could carry him?” he asked the three. Iceman didn’t even look over, broodily watching the unconscious villain’s body. Oh well. “He’s a heavy hitter.”
“We could make it back to S.H.I.E.L.D. with him,” Tiger said. Then she glanced at him, cocking her head in a perplexed manner. “Wait, why do you—”
“I gotta run.” He shrugged sheepishly, adjusting the straps of his bag, which had only undergone minimal damage. The wonders never ceased. “You see, I’m late to first period biology.”
Tumblr media
Vernon crashed through the doors of his school so fast he almost ploughed down Joshua, who had been standing just before the entrance, probably waiting for him.
The journey hadn’t taken more than a few minutes—he tried not to change clothes in suspicious-smelling service alleys as much as possible, but some situations left him no choice—but he only had a few minutes to get to class, and detention was something he couldn’t afford to get. He hated disappointing Aunt May more than he hated getting his ass beat by some B-list villain.
“Hey, hey, hey, relax,” Joshua said, righting him. The hallways were almost empty, but not quite, indicating that he wasn’t too late to the not-party. The boy fixed his glasses, giving Vernon a look. “Did you get into a fight?”
Vernon blinked at him. “What? No. This guy called Rhino—”
“Shh.” Joshua dragged him to one side, away from earshot of the general populace of Midtown High, and gave him a concerned look. “Dude, your face is bleeding.”
Joshua was one of the only few individuals in the world who knew about Vernon’s identity as Spider-Man, which was just as well, because if it hadn’t been for his blue-haired best friend he would have walked into a test with his nose gushing like a bloody geyser. “Thanks,” he mumbled, when Joshua handed him a clean-looking handkerchief. He raised it to his face. “Did you wipe your nose on this?”
Joshua made a face. “Not that I remember.”
“Good enough.” He cleaned off the blood as well as he could, which was hard, because he was feeling jittery and apparently his hands agreed. “Do I look fine?”
“You never look fine, my friend,” his friend said sagely. “But you look like you always do, so I guess, yes.”
Vernon shot him a grim smile, and started down the corridor towards 12-B, which was where he was supposed to be in ten minutes. He wasn’t even late, actually, but Mr. Malkin didn’t need a big excuse to give someone a C+ for a tardy warning. Joshua followed close behind. “So, which guy beat you up this time?”
“I didn’t get beat up.” Vernon rolled his eyes. “Well, not entirely—”
“Vernon Parker, report to room 10-A.” Both the boys’ heads whipped up towards the source of the sound, which came as an announcement from the speakers. “Vernon Parker, room 10-A, please.”
“What?” Vernon whirled on Joshua, panicked. The blue-haired boy’s eyes were wide behind his glasses, but he only shrugged in response. “But the test!”
He tried to think back to anything wrong he might have done in the past few weeks to get called aside like this, but he couldn’t think of anything. Plus, he hadn’t been summoned to the principal’s office, which confused him even more. Why room 10-A?
“Now you’ve had it, Parker,” Flash Thompson said as he passed them, grinning.
Vernon scowled at his retreating back, his grip tightening around the bag strap. “Whatever,” he muttered, then threw Joshua his bag. “Take it to the class, won’t you? I’ll try to get back as soon as I can.”
Without waiting for affirmation, he jogged off to find room 10-A, wanting to get whatever it was over with so he would get back on time. When he got there, the room was empty except for a lady in a pencil skirt and jacket, holding a clipboard in her hand. Upon his entry, she smiled at him in a friendly way, which only served to tick him off further.
“Whatever this is, couldn’t I do it some other time?” he pleaded. He hadn’t seen this staff member before, but he didn’t seem to be in trouble, and his grades had enough pull to get him out of some random appointment before classes. “I have a test in like, five minutes.”
“Don’t worry, I’ve already talked to your teacher about this,” the woman said, continuing to smile. She gestured to one of the seats. “Take a seat.”
Reluctantly, he obliged, not really having an excuse not to now. “What is this, exactly?” he asked. Now that panic had taken a backseat, doubt was beginning to creep in. Why only him? And how had he never seen this woman before?
“In light of recent events, the school has decided to start counselling sessions for all of the students to help them cope,” she said. She had a really nice smile, her skin tan and unblemished, cheeks dimpled. “I’m Melia Fox,” she said. “I just need to ask you a few questions, and you can be on your way.”
He stared back at her, miffed. A year of incidents, and they suddenly decided to have counselling sessions now? “Why just me?” he asked slowly. “I’m sorry, but isn’t there some kind of rule or protocol for—”
“There is,” said a new voice. Vernon whipped around, and there at the end of the classroom, where moments ago had been nothing but air, stood a tall black man with an eyepatch. “And Agent Fox is following it.”
Vernon gaped. “I—what?”
“Spider-Man,” Nicky Fury said, with a note of muted resolution in his voice, “we need to have a little chat.”

The Lionsgate 88 Portal
The Lionsgate 88 Portal
By Tanaaz
The Lionsgate 88 Portal is activated by the numerology of 8/8, the Sun in Leo Season, and the rising of the star, Sirius. This combination of energy opens a galactic portal that allows high vibrational energy to be sent to Earth, which we can all tune in and connect with.
The Lionsgate 88 Portal peaks on the 8th day of the 8th month, but we are likely to feel the current of its energy before and after this date too.
In numerology, the 8th day of the 8th month is a highly spiritual and charged time.
The number 8 represents infinity – the infinite soul that we are and the infinite journey that we take. It represents the “forever conscious” part of our soul; the soul that has lived and will continue to live long after this incarnation.
8 is also the number associated with DNA activation, abundance, power, and higher realms of consciousness, making 8/8 a super potent time to charge and clear our energy for receiving.
Lionsgate is not just about numerology but also astrology, and involves the Sun in its ruling sign of Leo and the rising of the star Sirius.
Sirius is one of the brightest stars in the sky and is known as our Spiritual Sun. While our earthly Sun illuminates our physical world which is an illusion, our Spiritual Sun illuminates the truth of our timeless soul.
The ancients were very in tune with the star Sirus, as they believed it was the gateway to heaven and the home of higher vibrational beings. They believed the energy of Sirius carried highly advanced wisdom that we could tap into and utilize whenever Sirius was strong in the sky.
Sirius Rising at this time of year was a special and sacred occasion and marked the start of the new year. The ancients would also observe things happening to Mother Earth as well.
In Ancient Egypt, the rising of Sirius coincided with the flooding of the Nile. They viewed this as a gift of prosperity and fertility and revered Sirius so much, they even aligned their pyramids with its rising as well.
There are also theories that the pyramids would act as transmitters, helping to amplify the energy of Sirius in order to channel and download its messages with greater ease.
The Great Sphinx with its lion-like qualities, also aligns with the Leo zodiac during this time of year. This alignment is believed to aid in the receiving of Divine messages from both Isis and Anubis, the Gods connected to Sirius.
It wasn’t just the Egyptians that revered Sirius, all across the world from the Mayans, to the Sumerians, Babylonians, and the Dogon tribe, there is a strong connection with this bright blue star.
While our Sun is responsible for beaming down life for our physical bodies, especially when it’s in its ruling sign of Leo, Sirius is responsible for beaming down life for our spiritual bodies.
This is why the opening of the Lionsgate Portal can bring awakenings and lift our consciousness to new heights.
Here are a few things we can set an intention to experience under Lionsgate:
Heart healings: the Lionsgate portal activates the heart chakra. Old or even current wounds of the heart may rise up for healing. We may finally feel free from any grief or sadness that has burdened our hearts. For more guidance with this, read How to Open and Clear Blocks in your Heart Chakra.
Third eye awakenings: the Lionsgate portal also activates the third eye chakra. We may feel more intuitive or learn something new about the way our intuition speaks to us. Our intuition is likely to be strong and if this is something we want to work with more, the Lionsgate portal is a great time to begin. For more, read how to Open and Activate your Third Eye Chakra.
Higher Chakra Openings: while we have seven main chakras or energy centers in our body, we also have hundreds of smaller, more sensitive chakras that can be activated and awakened during the Lionsgate Portal. This helps us to tap into new wisdom and higher spiritual knowledge.
Psychic downloads: with the high vibrational energy from Sirus beaming our way, we are more likely to receive psychic downloads. These can come through our dreams, visions, spirit guides and angels, or through simply hearing things while in a state of relaxation. Meditation and automatic writing are great ways to open to this energy and to receive guidance.
Visitations: the ancients believed that Sirius was home to heaven, angels, and other worldly beings. Under the Lionsgate Portal energy, we are more likely to receive messages, dreams, signs, and visits from our loved ones who have passed and from our spirit guides and guardian angels. Encountering alien beings may also be more likely too.
Freedom: one of the strongest vibrations from Sirius is this energy of freedom. The idea is that our earthly Sun illuminates this physical world which is an illusion. But Sirius illuminates our soul and spiritual bodies, which is the truth. By understanding this, we gain a sense of freedom.
Peace: Sirius has very peaceful vibrations too, so spending time in nature and meditation is a great way to tap into this peaceful energy and use it for healing and restoring your mind, body, and soul.
Technology: Sirius is also associated with highly advanced technology. If you have a new tech innovation or would like to start a website, blog, app, or anything else related to technology, this would be great energy to use to your advantage.
Creativity: Lionsgate is also a highly creative time and the perfect opportunity to try a new creative project or to take action on a creative project you have been looking to get off the ground.
The energy of Lionsgate can connect us with the cosmic skies, galactic frequencies, higher dimensional beings, and our own intuition.
It can also activate heart healings, the expansion of spiritual wisdom, and help us awaken to our true potential.
On Lionsgate 88 set an intention of how you wish to use this energy, and then create a ritual or practice that allows you to harness and work with it.

Nova Scotia Power among companies in court facing labour charges in 2020 workplace death
Twenty-six year-old Andrew Gnazdowsky’s obituary from October of 2020 describes a vibrant young man, building a life for himself with a new job and plans to get engaged.
But Gnazdowsky drowned while working for a subcontractor at the site of Nova Scotia Power's hydroelectric dam at Marshall Falls, near Sheet Harbour, before those plans were realized.
Ever since, his sister has been on her own quest for answers.
“It's disheartening that it took me to put my grief on the side,” says Nicole Gnazdowsky, “to try to fix this problem, that nobody else was looking at.”
Almost three years after his death, three companies -- Nova Scotia Power, along with Brunswick Engineering and Consulting and Gemtec Consulting Engineers And Scientists Ltd. -- are all in provincial court facing multiple Occupational Health and Safety Act charges, for “failing to comply with a code of practice.”
The question is whether proper company safety protocols were presented and followed when a floating sonar rig operated by remote control, known as an ARV, malfunctioned while surveying waters near the Marshall Falls dam.
Monday’s testimony included a former employee with Brunswick Engineering, the same company Gnazdowsky was working for at the time of his death.
Caleb Parker described to the court the safety procedures and equipment used in similar work he did for the company at other sites, including N.S. Power’s Ruth Falls dam in 2019.
Parker testified life jackets were typically worn by staff when working on or near water while deploying the ARV, along with insulated boots.
He also described the typical plan for recovering the unit should it malfunction away from shore, which he said involved having another vessel such as a boat (with a licensed operator) or a kayak available nearby to use if the need arose.
Gnazdowsky has spent the past several years doing her own digging into her brother’s death and believes the investigation immediately after her brother's death there, and since, is flawed.
For example, she says she believes the RCMP released the scene of the incident over to Nova Scotia Power prematurely.
She believes the Westray law, the federal amendment to the Criminal Code which sets the rules for assigning criminal liability in workplace injuries or death, isn't being applied enough in Nova Scotia.
“We've never used the right laws, we've never used Westray, besides one time,” she says, “having that lack of safety standards and that lack of enforcement has just created this culture that's not good.”
According to the Canadian Centre for Occupational Health and Safety, the only use of the law so far in the province was in the 2013 death of a mechanic killed while removing a gas tank from a van at a Cole Harbour garage. The owner of the garage was ultimately found not guilty of criminal negligence causing death by the Nova Scotia Supreme Court in 2019.
The province's special workplace safety prosecutor – Alex Keaveny - didn't want to comment on the Gznazdowsky case today.
Neither did Nova Scotia Power, which would only say in a statement by email:
“On behalf of the team at Nova Scotia Power we extend our sincere condolences to Andrew Gnazdowsky’s family. Safety is at the core of everything we do,” wrote Jacqueline Foster, N.S. Power’s senior communications advisor.
“Out of respect for the court process, we won’t be commenting further at this time,” Foster added.
The OH&S charges faced the companies carry a fine of up to $500,000 dollars.
Nine days have been set aside for the trial.
Gnazdowsky says she hopes her fight leads to change in how workplace fatalities in the province are investigated.
“I don't think there's anybody else in this world that I would put up a fight for like I put up a fight for Andrew,” she says.
