I was speaking with a friend in the medical field about topics we learned during our respective educations and how we don't always utilize all the generalized information to the fullest extent in our specialized work. In an effort to relate to me in conversation while having no substantive understanding of law, he said the following:

"It’s like telling a malpractice lawyer to recite tort law."

Let's take a moment to appreciate the hilarity.

I replied with, "I'd sure hope a malpractice lawyer would be able to recite tort law since malpractice, aka professional negligence, is a tort." Of course, a chuckle was uttered in there, too. Any lawyers who deal with civil casework have to have a thorough understanding of tort law. Our personal injury friends continue to be the butt of the joke; I'll always defend you, though!

To my friends in the medical profession: Please make sure your understanding of the law and your legal duty of care responsibilities are in order. Otherwise, you may face malpractice, or negligence, suits, as well as come into your own harm if you don't know your legal right to refuse unsafe working conditions. Stay smart and safe!

Camp Lejeune and the Ford F-150 brake litigation: What do these torts have in common?

Both have been the subject of general advertising by competing interests. People submitted a litany of leads to my firm despite us having scarcely more than a page on our website for each.

Camp Lejeune commercials were utterly inescapable for a few months. The hype has died down a bit and I'm generally insulated from cable and Internet ads, so I haven't seen many lately. But we got so many leads without spending a dime on advertising.

Regarding the F-150, a potential client had written us saying they received a mailer about the litigation and were curious if they had a case. Several more had written us without mentioning the mailer.

We did not send out a mailer, and we aren't even interested in those cases at this time. Some other firm must have sent out a mail campaign and one of their recipients contacted us instead of the sender.

The moral of the story:

Make sure your call to action is specific and your ad is clearly branded. Your target audience may simply take your ad as a pretext to Google "x lawsuit" or "y class action" and wind up at your competitor's doorstep instead, if you don't have a strong search presence.

Consider telling your audience to search a unique keyphrase for which you've optimized a page on your site.

I really wish people would stop reducing lawyers to "being good in arguing" bc why did my mom told me that I'll be a good lawyer just bc I can speak very well to someone? 😭 law was one of the courses I had to take during my previous sem and (I'm getting war flashbacks just thinking about this) it is WAY MORE than being good at arguing. way. more.

I've started making ChatGPT come up with practice law school exam questions using my favorite characters so I can focus enough to keep studying.

It gives me the scenarios and I use my own work to answer the question and legally analyze the situation.
