A new rule to increment discrimination

Context:

Public healthcare is one of the places where the most Catalanophobic interactions are reported. In 4 years, more than 100 Catalan speakers have reported that they have been denied healthcare or otherwise discriminated against for speaking Catalan, or were unable to access any healthcare in Catalan in a Catalan-speaking territory.

From disabled people who only speak Catalan being refused any medical attention unless they speak Spanish (which they don't know how to speak), to a man calling the ambulance but the healthcare worker who answers the phone spends the time scolding the caller for not speaking Spanish instead of calling for the urgently-needed ambulance, to many, many, many, many, many, many doctors telling patients "either you speak in Spanish or you leave", and many others given choices that link their language to shame: "would you rather speak Catalan or your son get cured?", "do you want to speak Catalan or do you want a vaccine appointment?", or being told "[derrogatory/infantilizing word for "woman"], you're making me waste time" for seeking medical attention as a Catalan-speaker.

Lack of access to healthcare is a systemic problem for Catalan people, who are often forced to use Spanish if we want medical treatment in our own country.

People should have the right to access public services (that they pay for with their own tax money) in the language of the country. Can you imagine an English speaker in England not being able to see any doctor or nurse who can attend them in English? Or in French in France, or German in Germany? It doesn't happen because speakers of the dominant language have the State on their side, but Catalan speakers have the Spanish (and French, in the case of Northern Catalonia) Government actively working against us.

And, more than anywhere else, in a moment of great vulnerability like the medical setting, it's very important that patients can speak their own language and not have to worry about translating concepts, they need to have the confidence to speak clearly on what happens to them and be focused on the issue, not on word choice or accent of this second language. Even less be worried about possibly facing discrimination for it.

The new rule:

The new Government of the Valencian Country (a coalition of the right-wing party PP and the fascist party Vox, both Spanish supremacist parties who make the hatred against Catalan/Valencian one of their main campaign points) has announced yet another way to increment that discrimination.

Until now, to decide who to hire for public jobs, there was a system of points, where each kind of certificate and qualification gave you some points. Speaking the local language (Valencian/Catalan) was already not a requisite —legally creating the situation where doctors and nurses can not know any of the language spoken in the place where they work. But, until now, speaking the local language at least gave some extra points.

Now, this new Spanish supremacist regional government has decided that knowing Valencian in the Valencian Country to work in a job with public interaction is worth less than speaking any language of an independent EU state. This means that you get more points for speaking, for example, Latvian, Swedish, Maltese, Slovak or Lithuanian, than for speaking the language of the place where you will be working and where you will be talking to people.

My full respect for speakers of all these languages, but (as an example) a hypothetical Estonian speaker who you might never even encounter in a Valencian town should not be worth more than the very real Valencian speakers that you will surely encounter working in the Valencian Country.

This rule is another step to legally protect systemic discrimination and to make it continue in the future.

Note: Valencian and Catalan are two names for the same language. They're being used interchangeably.

unfortunately, asking a native language speaker for this kind of advice is kinda awful bc of course i cant suggest media i watch since it's like, fully blown maltese for people who already know it, and when learning in school it was always about grammar and literature rather then learning the actual language. although, a learning children's book that is in every maltese person's heart at this point is "id-denfil" which iirc they are now making like short episodes out of the stories. googling "id-denfil episodes" maybe might help?

There are a lot Naoto likes, but listing them all out would take forever, so I'm only putting a few choice ones here, but my point is, if there's a detective, there's a good chance Naoto knows and likes them. Anyway:

Sherlock Holmes — It would be remiss of me to not mention the deduction king himself. While she does judge a little (a lot) if you say you like mystery and only know him, she admires him a great deal. Sure, you can't actually piece together any of the mysteries before he does, but it's more fun reading him solve it. She even has a legally generic Holmes costume. If you were to ask, her favorite stories are The Hound of the Baskervilles and A Scandal in Bohemia.

(I have to mention Sherlock Hound, or Meitantei Holmes as it's known in Japan. Sherlock Holmes but everyone is a dog.)

Sam Spade — He's actually mentioned in P4 during one of Naoto's night time conversations and she happened to admire him. She says P4-kun reminds her of him, but we know that's a lie and the only correct option during this scene is to say she's more like Sam. The star of The Maltese Falcon.

Father Brown — This guy isn't a detective and Naoto isn't religious (she checked these out of the library rather than finding them in her grandfather's study), but Naoto found the contrast in methods fascinating. Compared to Sherlock, his reasoning falls under intuition, and as the famous quote goes: "You see, I had murdered them all myself... I had planned out each of the crimes very carefully. I had thought out exactly how a thing like that could be done, and in what style or state of mind a man could really do it. And when I was quite sure that I felt exactly like the murderer myself, of course I knew who he was."

Kogoro Akechi — I don't know what to say other than this guy is best described as the Japanese equivalent to Sherlock. The stories even have its own version of Arsène in the form of The Fiend with Twenty Faces. I can't say much about the stories themselves because it's in... Japanese and not much as been translated.

Kosuke Kindaichi — I also do not really have much to say on the actual stories because it's in Japanese and not much as been translated (again). The Wikipedia entry for him in English is laughably short, at least compared to how long it is on Japanese Wikipedia. He first appeared in The Honjin Murders, which is a locked room mystery. But the more interesting part may come from something in P4's Japanese script. In the King's Game, Chie compares Naoto to the Kindaichi family rather than the Kuzunohas. There's a manga/anime series that follows his fictional grandson and I don't think I need to explain any further why she made the comparison. I wonder how many people thought Naoto said corny things like "In my grandfather's name, I'll solve this case" lol.

Kyosuke Kozu — This guy, along with the previous two, are known as Japan's three greatest detectives. Naturally, I can't find shit about him in English, although two of the books related to him have been translated to English. He is fluent in six languages, can play the piano and his main job is assistant professor in the Department of Forensic Medicine, according to what google translate says but yeah. I mention him here, because he's, you know, one of the three greatest detectives.

Conan/Shinichi — Detective Conan is obscenely popular in Japan. It is also very long and still going. I really don't think I need to explain why, do I.....

Zenigata Heiji — He's more of a policeman during the Edo period than a detective, but he counts. He caught criminals by throwing coins, however that works. Of course, the name Zenigata may be familiar to some and indeed, Inspector Zenigata is his fictional descendant. While his competency varies depending on the writer, anyone who can come this close to capturing Lupin earns Naoto's approval. And the Lupin series happens to be a show she grew up watching.

Furuhata Ninzaburō — This guy is best described as the Japanese equivalent to Columbo. She also likes Columbo, but for sanity's sake, I'm combining these two together in one entry.

Ram Tumuluri hopes the natives are dumber in Malta than they were in British Columbia

After slipping and sliding away from what they clearly consider to be media intrusion into their plots and schemes to wrest a sinecure of hundreds of millions of euros a year for 30 years, from the Maltese government, the shady and mysterious people who lurk in the shadows of Vitals Global Healthcare pushed their stooge, Ram Tumuluri, out front on Friday to face journalists. Oh, hang on, they didn’t quite do that. Tumuluri was scheduled to speak at a half-day seminar on healthcare, newsrooms got hold of the programme and went there and nabbed him. The most we can say for him at this stage is that unlike Prime Minister Muscat, he didn’t leave by the backdoor to give them the slip.

Tumuluri was asked what his outfit – well, the outfit he fronts – is up to in Montenegro, a country not known for its transparency and fair play. The news portals in Montenegro were plastered with stories about how its public hospitals are going to be handed over to Vitals Global Healthcare and how Ram Tumuluri has been making presentations to that effect. Despite the rather difficult language barrier, those stories made it back home to Malta – the internet and Google Translate make the lives of the crooked a little more difficult these days – and journalists in Malta and Montenegro have begun exchanging information.

Vitals Global Healthcare has not yet signed on a deal in Montenegro, Tumuluri said to the journalists who cornered him at the seminar. “We just gave a presentation,” he said. You know, for the sheer hell of it. And then he said, very oddly, “We have done our due diligence on Montenegro, and we felt the country requires investment in healthcare, which is no secret.” There are plenty of countries which require more investment in healthcare. In fact, every country in the world does, including the fabled United States of America. But they’re not all on the list of the world’s most corrupt, and nor are their governments led by men who have had the dubious accolade of being named Organised Crime and Corruption Reporting Project’s Man of the Year 2015. As for Tumuluri, of all people, talking about the due diligence his outfit carries out on others, and completely without irony, it makes you wonder whether he spends his days marvelling at his extraordinary luck in falling straight from Canadian lawsuit and creditor hell onto an island where the natives regard all incoming foreign scammers as though they were Captain Cook bearing trunks full of glass beads and cheap bolts of cloth to exchange for their territory.

As I sit here and write this piece, I struggle with the words VITALS GLOBAL HEALTHCARE. I feel ridiculous even spelling them out, and I’m not even responsible for the name. How in heaven do those people – yes, even the supposedly serious doctors and surgeons who have nailed their colours to Ram Tumuluri’s mast – say VITALIS GLOBAL HEALTHCARE with a straight face? This is the equivalent of somebody deciding to start a newspaper or radio station in Malta and, before they even have the one newspaper or radio station on this toenail island, incorporating a suitcase company and calling it MERCURY GLOBAL MEDIA CORPORATION.

I mean, really – that bunch of denizens of the shadowlands have never managed a single hospital, clinic or pharmacy waiting-room, ever, and already they’re calling themselves Vitalis Global Healthcare, and we’re all expected to say it too and not laugh.

David Thake pulled off a scoop for his fledgling radio station the day before yesterday when he tracked down and got a telephone interview with a director of one of the mortgage companies that had to foreclose on Ram Tumuluri’s assets. “I wouldn’t trust that man as far as I can throw him,” Bill Walker said. “I wouldn’t touch him. Every business he’s been involved in around here has failed. He created a mess and just walked away from it. I think you may be right in suspecting he’s involved in shady business out in Malta. That’s exactly the sort of guy he is.”

But he’s good enough for Konrad Mizzi, Keith Schembri, Joseph Muscat and, I’ll bet, John Dalli, to do business with. In fact, he’s exactly what they want.

We can’t ignore what’s staring us in the face; journalists above all should not miss the obvious, because the obvious is the starting-point and the sticking-point. And the obvious is this: exactly what is Ram Tumuluri doing in this set-up, given that he has no money to invest (that much we have established), no experience in healthcare, and a track record of insolvency, debt and failed businesses in British Columbia? Why, in a world full of experienced and reputable executives looking for a job, did Mark Pawley, the financial operator who is supposed to be the sole owner of this fishy bandwagon, pick him? There’s the rub.

Tumuluri has finally been forced to admit that he met with the Maltese government before the whole thing went out to tender. I had reported as early as March last year that not only had he actually reached an agreement with the government ahead of the tender, and not just held meetings, but that he was also meeting potential suppliers and telling them quite definitely that he would be running the public hospitals. This was way ahead of the (fake) tender.

Tumuluri told journalists on Friday: “The Maltese government approached us in New York.” Unfortunately, nobody thought to ask the follow-up questions that burned unspoken: “Who from the Maltese government did you meet with in New York? And when you say ‘us’, who do you mean? Who is ‘us’?” There was no company for the Maltese government to approach back then. Vitals Global Healthcare (swallow your laughter) was incorporated after they fixed things with Konrad Mizzi and the rest of the gang.

And why would our government approach a loser with an abysmal track record, who had fled Canada because of a mountain of debts and business failure, and a lone British financial operator out of Singapore – who hasn’t, and this point should be made, even bothered to show his face here – to run public hospitals in Malta? Why didn’t the Maltese government approach a hospital management corporation - one that actually specialises in the work?

Occam’s Razor, my dears, Occam’s Razor: Konrad, Keith and Joseph (and perhaps John) are not interested in having the best and most experienced management company possible to run Malta’s public hospitals. They’re interested in the best deal they can get. And I’ll stop there.

THE ‘DANGERS’ OF TRANSLATION

It may be sometimes difficult to distinguish between localisation and the translation of cultural concepts since the two may overlap. Generally, localisation includes the adaptation of details such as currencies, date/time formats or addresses/phone numbers according to the location. It is often applied in the marketing of products and services. Cultural adaptation is more commonly associated to the written translation process and it means recognising local sensitivities and thus paying attention to respecting local culture, customs, and common habits.

Localisation errors during the process of translation, or more specifically cultural adaptation errors, refer to words or passages in the original text which are translated in a culturally inappropriate way. When this happens, such content may be construed as offensive. As seasoned translators would know, individual words do not always map word-for-word into another language. Some words do not have an equivalent in another language, while others have multiple meanings. A word that may be harmless in one language might be offensive in another. Translators need to fully understand the context in order to translate faithfully to the original text but sticking to what is culturally appropriate for the target audience.

Localisation may also be requested in the translation of content in different languages, where each language corresponds to a particular country or culture. Here it must be kept in mind that the two may not be one and the same: a country is not necessarily equivalent to one language or culture, while the same language may be used in different countries, hence different cultures. In several countries there is a direct relationship between the language and the country intended as a political entity, however even in these instances, there are often multiple cultures and multiple minority languages. Let us take an example for the sake of clarity: Japan's national language is Japanese and 99% of the population speak the language, but there are 11 officially recognised languages, while other languages are spoken as second or other languages. This means that a translator needs to familiarise him/herself not only with the target language, but also the target audience with their own specific culture and customs. This is also required when a translators or a team of translators are tasked with the translation and localisation of country-specific websites of the same company, or in literary translations where a book is published in different languages and/or countries. From the point of view of the author or script writer, one way to make sure the text can eventually be uniquivocally translated is by keeping international readers in mind from the start. This means that the text needs to be written in a manner that is unambiguous for people in different locales.

Cross-cultural communication can be tricky business. During the process of translation, linguistic limitations can truly become a barrier to proper localisation. In today’s globalised and fast-paced word, a language provider or a translations company may easily overlook cultural sensitivities especially when they need to meet tight deadlines. Clients may sometimes only make money and time considerations when choosing their language services provider. Even translation companies having a team of multicultural linguists may not always take the time or have the necessary understanding of cultural sensitivities not to fall into the traps of cultural nuances.
