"Teacher's Plea to Quash FIR Under POCSO Act Rejected: Court Emphasizes Need for Thorough Investigation"
The High Court dismissed the petition praying for the quashing of the FIR.
The Court noted that the complaint is more than horrendous, for the reason that the petitioner is a teacher; being a teacher it is indecorous on the part of the petitioner to have allegedly shot the videos and taken pictures of girl children at the time when they are changing their dress, the alleged offence is unpardonable, albeit prima facie. If this cannot become a crime, it is ununderstandable as to what else can be. It is for the petitioner to come out clean in a full blown trial, as any entertainment of the petition at this juncture, at the stage of registration of crime, would be putting a premium on the illegal activities of the petitioner/ teacher.
Background:
Muniyappa was employed as a drawing teacher at Morarji Desai Residential School. On December 15, 2023, the Joint Director of the Social Welfare Department received a complaint through the control room, alleging that Muniyappa had recorded videos and taken photographs of minor girls at the school while they were changing clothes. This led to the registration of FIR No. 209/2023 under Section 12 of the Protection of Children from Sexual Offences (POCSO) Act by the Masthi Police Station.
Legal Issue
Whether the FIR against Muniyappa under Section 12 of the POCSO Act should be quashed on the grounds of procedural irregularities and alleged malice.
Argument of the Parties
Petitioner's Argument
The investigation began unlawfully before the FIR was registered, violating legal procedures.
The complaint was motivated by personal vendetta because Muniyappa had earlier reported the misuse of school children for cleaning water and sewerage tanks.
The complaint contained corrections, indicating that it was fabricated to malign Muniyappa.
Respondents (State of Karnataka and the Joint Director, Social Welfare Department):
Muniyappa's actions constituted a clear offense under Section 12 of the POCSO Act.
The evidence, including videos and photographs on the seized mobile phones, confirmed the allegations.
The Petitioner-Muniyappa was not cooperating with the investigation, as he refused to unlock one of his mobile phones, which likely contained incriminating evidence.
Muniyappa recorded inappropriate videos and took photographs of the girls, which was substantiated by evidence from his mobile devices.
Court's Observation
The court noted the procedural concerns raised by Muniyappa but emphasized the seriousness of the allegations under the POCSO Act and the need for a thorough investigation to determine the truth.
It examined the sequence of events, including the timing of the complaint, the seizure of the mobile phones, and the registration of the FIR. The court considered the arguments regarding the tampering of the complaint and the handling of electronic evidence.
The court was cautious in considering the petitioner's argument about the complaint being fabricated, given the sensitive nature of the allegations involving minor students.

Morarji Desai, Prime Minister of India (March 1977 to July 1979), was President of Ramana Kendra, Delhi, 1968-70.
I had the privilege of seeing Ramana Maharshi in August 1935 in the hall in which he usually sat. He was sitting on a sofa and wore only a loincloth. I could see an aura on his face, which was glowing with peace and joy. I sat opposite to him but did not ask him anything. He too did not say anything to me. I sat just over an hour and just looked at his face. Till today I have not seen that aura, that joy or peace on anybody else’s face. That hour of perfect stillness in that silent presence has been a precious memory ever since.
While I sat there, no questions arose in my mind, nor did I feel any desire to ask anything. I was at complete peace with myself. It was this experience that convinced me that Ramana Maharshi had realized God or Truth. Some of his disciples who were present asked him some questions, which he answered. He, however, said nothing of his own accord.
I had to leave the place next day by train at about twelve. About an hour-and-a half before the time of departure, I approached Ramana Maharshi for permission to leave. He told me that I should go after I had eaten. We sat down for lunch along with the Maharshi, at about eleven O’clock. After lunch, I bowed down to him and left.
The visit left an abiding impression on me and convinced me that Ramana Maharshi was a realized soul and that the ideal of ‘action in inaction’ as propounded in the Gita is really attainable.
Presiding over the 99th Jayanti celebrations of Ramana Maharshi at Ramana Kendra, New Delhi, on 13th January 1979, Morarji Desai as Prime Minister, said:
The Maharshi seemed to know everything. He knew the language of the animals. He listened to their complaints. He treated every being in the same way, whether it was a cow or a dog, a crow or a monkey. All were equal in his eyes, the beggar and the millionaire. He never went out of Tiruvannamalai. He refused to go out and preach. He said, “If I am a jnani, I consider everybody else a jnani too. What is there to give?” He regarded everybody as himself. He made no attempt to convert anybody. One got transformed by his very presence.
Many civilizations have flourished and then disappeared. But in this country, you find our old culture and the ancient religion still alive. And it is this that keeps the country alive. It is persons like the Maharshi who keep it alive...All learning should come from within. That is the way the Maharshi showed. He did not criticize others way of life. He said, “Stick to your own religion and follow it properly.” Ramana Maharshi taught that one could do sadhana in one’s chosen way and reach the goal.

Rukmini Devi Arundale
Rukmini Devi Arundale, born on February 29, 1904, in Madurai, Tamil Nadu, served as a catalyst in revitalising the traditional Indian dance form of Bharatanatyam and establishing its prominence. Born into a Brahmin family with deep connections to the Theosophical Society, Rukmini was exposed to humanist ideals from an early age. Her marriage to George Arundale, a theosophist and educator, further fuelled her interest in theosophy and dance. While travelling with her husband and Annie Besant, Rukmini learned of Western ballet and began studying ballet at the suggestion of the famous ballerina Anna Pavlova. Pavlova also encouraged her to explore classical Indian dance forms, which allowed Rukmini to pursue Bharatanatyam To challenge the norms and re-establish the artistic integrity of the dance, Rukmini undertook formal education at the Bharatnatyam master Pandanalur Meenakshi Sundaram Pillai. In 1935, at the age of 31, Rukmini made her debut in Bharatanatyam, defying societal expectations and setting a precedent for upper-class women to participate in the dance form. Witnessing the transformative power of Bharatanatyam, she established the International Academy of the Arts in Adyar in 1936, later renamed Kalakshetra. Through Kalakshetra, Rukmini aimed to teach and popularise Bharatanatyam through this institution, saying that she felt she had been "ushered into a new world of rhythmic beauty and meaning." Rukmini Devi Arundale's contributions extended beyond dance. In 1934, she founded educational institutions that blended theosophy and traditional Hindu values. Her vision for Kalakshetra went beyond preserving Bharatanatyam; it became a hub for various Indian traditions and the propagation of theosophical ideals. Her efforts earned her accolades, including the Padma Bhushan in 1956 and the Sangeet Natak Akademi Award in 1967. As an animal lover, she chaired the Animal Welfare Board and played a key role in passing the Prevention of Cruelty to Animals Act in 1952. In the same year, she made history as the first ever woman in Indian history to be nominated as the Rajya Sabha member In 1977, she declined the offer to become the President of India from Prime Minister Morarji Desai post the death of President Fakhruddin Ali Ahmed. In a 2013 speech at Kalakshetra, President Pranab Mukherjee delivered the first Rukmini Devi Memorial Lecture, emphasising on the significance she has had on the revival of classical dance and her commitment to the cultural renaissance of India.

*WHAT A TERRIBLE CONSPIRACY!!!*
1) Pakistan was formed, under Congress rule!
2) Bangladesh became, under Congress rule!
3) 370 came into force, in Congress rule!
4) Minorities Bill came, in Congress rule!
5) Muslim Personal Law Board was formed, under Congress rule!
6) Minorities Ministry was formed, in Congress rule!
7) Minority University became, in Congress rule!
All these works were done by 'Congress', only for 'Muslims', that too, when the "partition" of the country happened on the basis of 'religion'! So, wasn't this preparation of Congress for "Gajwa-e-Hind"??
There was a preparation to make the country an Islamic country “quietly”. Congress gave only "reservation" for "Hindus", so that the "Hindu society" always fights with each other and never understands "Gajwa-e-Hind".
Former Prime Minister Morarji Desai, in his book "My Life Account" has written at p.456, that: don't know why Nehru's "Hinduism" has a prejudice?
Nehru had tried hard to bring "Hindu Code Bill" to make Hindus Second Class Citizens". But Sardar Patel had warned Nehru that: If during my lifetime, you bring "Hindu Code Bill" or thought about it, then I shall resign from Congress
and against this bill will come down on the streets. Due to Patel's threat, Nehru was scared. After Sardar Patel's death, the "Hindu Code Bill" was passed in the Parliament!
During the discussion on this bill, Acharya J B Kripalani had called Nehru a Communist and Muslim supporter! He said: You wear "Janeu" just to cheat the Hindus. Otherwise, Hindus have 'no matter' in you. If you really were "secular," then instead of "Hindu Code Bill", you would have brought "Common Code" Bill for all religions. Sometimes, I feel like not posting at all! Then the thought comes that India will read.
[Released in the interest of the country.]
BBC's famous journalist Mark Tully has given a statement, that "Modi is uprooting that big banyan of this country, which has been infested with poisonous insects for years! For this, he will have to fight continuously!"
Modi has put his hands together in the bills of all the poisonous snakes hidden in the country; that's why these snakes are hissing. Congress had hidden all kinds of snakes including Congress, Leftist, Jihadi, Naxalite, Missionary to ruin the land. It is good that Modi came to power and made the country aware of these poisonous snakes and exposed them. Otherwise, these poisonous snakes would have swallowed this Indian land and Hindus in the coming times. Our future generations would have nothing left except to cry and wail.
Modi will have to struggle a lot, and Modi will also struggle, but the people of this country, especially the Hindus, will have to stand firm with Modi.
Modi did not take this war for himself, but it is a war waged for the children of our countrymen, for the coming generations and for the bright future of India.
Please do the work of awakening our countrymen by forwarding this post in the public interest.

Once in a leaping blue moon: Leap day babies don birthday hats after four-year wait
Tumblr media
Birthdays are special, and what when they come only once in four years? Well, the day then just takes on that extra sparkle. As it has this Thursday, when ‘leaplings', the special few born on February 29 the world over are celebrating – and being celebrated -- just that little bit more.
Every four years, the world receives an extra day from the calendar gods. The rarest of the days to be born on has given India its former prime minister Morarji Desai and Bharatanatyam dancer Rukmini Devi. Adding that edge of cool is a bit of fiction too – Superman, the Man of Steel, was born on this day, according to DC comics.
Jigyasa Pant is no Superman, or Superwoman either, but she has been waiting four years for this day and feels as special as the superheroes. Celebrations, she said, start early for the ‘leap day baby'.
Pant, a placement executive at Indraprastha Engineering College in Ghaziabad, usually celebrates her birthday on February 28 and/or March 1. But if it's a leap year, it begins right from January 1.
“Each day is kind of a celebration in a leap year. People start texting me from January 1 that this is my birthday year. It is extra special to keep receiving wishes and blessings for two whole months,” Pant told PTI.
The 32-year-old will be turning eight this year, a few more years before she enters her teenage years at the age of 52!
Supreme Court lawyer Prachiti Behere was born the same day – and year. Behere said she uses her birthdays to break ice and reach out to new people.
“It used to be a great way of making friends as everyone would get excited about it,” the 32-year-old said on the eve of her eighth birthday. No one forgets your birthday and everyone makes it a point to wish you.
Even though she gets to celebrate her birthday twice, on February 28 and March 1, in an ordinary year, it's the grand celebration and enthusiastic family members that make Behere's actual birthday all the more memorable.

‘Osho, allow me to ask a few more esoteric questions. Please don’t laugh at them. It is a question of life and death to me!’
Almasto, I know it is a question of life and death for you—not only for you but for everybody else too—because unless you know the art of screwing in a light bulb rightly you will never become enlightened! So I take your questions really seriously!’
The first question: How many Scotsmen does it take to screw in a light bulb? Almasto, ten. One to screw in the bulb and nine to share the expense.
Second: How many Englishmen does it take to screw in a light bulb? Almasto, two. One to screw in the bulb and one to make the introductions.
Third: How many Germans does it take to screw in a light bulb? Almasto, two. One to screw in the bulb and one to read the instructions.
Fourth: How many Frenchmen does it take to screw in a light bulb? Almasto, seven. One to screw the bulb and six to screw anything else that happens to come by.
Fifth: How many nuns does it take to screw in a light bulb? Almasto, two. One to screw in the bulb and one to make sure that that’s the only thing she’s screwing.
Sixth: How many astronauts does it take to screw in a light bulb? Almasto, two. One to screw in the bulb and one to give him a countdown.
Seventh: How many Russians does it take to screw in a light bulb? Almasto, fifty thousand. One to screw it in and 49,999 to occupy the country the house is in.
Eighth: How many drunks does it take to screw in a light bulb? Almasto, four. One to try to screw it in and three to keep the pink elephants away.
Ninth: How many Morarji Desais does it take to screw in a light bulb? Almasto, one. But first he needs to be utterly drunk on his own heroin—ordinarily called urine—so that he can be convinced that he will save India by doing so.
Tenth: How many people does it take to screw in an Indian light bulb? Almasto, none. If it’s Indian it’s most likely screwed up already.
Eleventh: How many Gautam Buddhas does it take to screw in a light bulb? Almasto, none. Gautam the Buddha said to be a light unto yourself.
Twelfth: How many niggers does it take to screw in a light bulb? Almasto, none. Black is beautiful.
Thirteenth: How many Oshos does it take to screw in a light bulb? Almasto, none. He persuades the bulb to screw itself in.
