The hospital in germany didn't reply to the final letter within the time limit set by my lawyer, so no settlement. We're suing them :/

in honor of how many clones he xuan has running around the various realms at any given time, i’ve decided that a modern au he xuan should be engaged in absolutely msscribe and/or jordan wood/andy thanfiction levels of batshit ridiculous sock-puppetry on the internet
like, modern au he xuan should make msscribe and thanfiction seem like amateurs with their legion of sockpuppet accounts and how much chaos they can cause with said sockpuppets

I've seen the 1899 plagiarism accusations on Twitter and thankfully being a brazilian lawyer has helped me understand the claims better... Twitter can be too rageful and reddit too cynical.
While the imagery is very similar (pyramid, close up on triangle pupils), I cannot say that these symbols are rare in science fiction. Honestly, I could find a black pyramid on History Channel right now.
The plots seem to be very different. The comic is sci fi from the front, is about exploring a new planet, and does not touch much on the "reality" aspect the same way that 1899 does. The only things that could be claimed are common sci fi/mistery tropes (people dying, people going insane and others). It could get similar depending on how season 2 would expand the backstory, but I doubt they'd do similar plot bits after this scandal.
In truth, the comic author can try to sue, but I don't think it'll be fruitful. Plagiarism cases are very difficult to prove and brazilian law does not have much set in stone either (at least from what I've studied as a lawyer), especially in a case that involves people from different countries. If I base my opinion only around brazilian law, best case scenario would be winning in court, getting credited and being compensated financially (alongside a nice fraction of the money the series make). Worst case scenario would be losing in court and getting to pay fees or more. The more realistic scenario, imo: nothing judicial happening. Definitely a note from Netflix. Maybe a settlement. Something like "inspired by so and so", and a small cut of the money *if* they're lucky.
That said, it pains me that some few people are trying to flip this story and are being rude/xenophobic to the comic author. I do not claim to know their ulterior motives for the accusation (or even if there are ulterior motives to begin with), but it could be shocking to see such similar designs of a unknown brazilian comic novel in a Netflix production.
Alas, I just hope that we get a season 2 at this point. The stories are not the same plotwise and it's not a case of just choosing to keep up through the comic. It would be a shame to not keep the series because of marketing desicions.

So it's been /checks watch/ 3 days since I got hit with a medical lawsuit that I'm taking to court because oh boy it's a load of bull that will take a good paragraph to explain, 2 days since I got hit with an absurdly massive tax fee to register my car, that I only had to buy because I was, yanno, hit by a semi truck and this morning this asshole tries to scam me through selling my old mattress for gas money and starts threatening me cause I called out the bullshit
Which, as a warning to yall, if you try to sell something online and the person wants to use Zelle, DO NOT use it. Each and every time I've had a person ask to use Zelle for money transfers, it's been a scam. This particular one works like this:
The 'buyer' sends you the payment amount but you get an email saying that the payment is on hold and that the buyer will have to send an additional $250 to 'upgrade' your account, then you send that money back to them. Only guess what? That's not how Zelle works and the Zelle emails come from a fake email, not through any offical app. And these assholes are only getting more convincing in their setup. They send screenshots, talk pleasantly until you call them out. Then you get death threats
Tumblr media Tumblr media
So yeah. Watch out for this if you do any online selling. I think I'm gonna put on a face mask and stare up at the ceiling for a bit

High-five to Monotasker
Today is Monotasker’s comp Friday (Friday off) and I have an all-morning to mid-afternoon CLE webinar and then am going to see Wakanda Forever this afternoon with @alaric-greyson (my first movie in over two years) and he’s just been the best taking care of Peanut all day! Peanut woke up at 3:30am (which is rare, she usually sleeps through the night) and he quietly read to her and gave her a bottle and she went back to sleep until 7am! And then he took us out to breakfast!! And then he’s been taking Peanut all day so that I can watch this boring Webinar - while still managing to do some yardwork and run errands (Peanut loves running errands)!!! And totally was cool with me ditching him to go to a movie!!!! I realize that none of these things seem like THAT big a deal but it’s a huge load off my back for the day and this is HIS day off.  Anyway, he’s not even on Tumblr anymore but consider this a virtual high-give to him. I have also thanked him in real life too but sometimes celebrating even the small things is important. ETA: I really cannot emphasize enough how boring this CLE is because, among other things, it is an “annual update of the law” but it covers ALL areas of law including many areas of law I just do not practice. In my *secondary* state of practice. Bar Associations are such a freaking racket y’all. My secondary Bar requires you register for the Bar AND with the State separately AND complete CLEs most of which, of course, are run by the Bar, which charges you for the CLEs they require you to take. It’s not that I’m opposed to continuing legal education but it would be nice if at least it felt like I didn’t spend all my time in CLEs learning things I will *never* use in my own practice. And since my secondary Bar is a small state, most CLEs in other states don’t bother getting approved as an official CLE for said state, so that would be even more paperwork I have to do to get credit. So, of course, instead I just end up doing THEIR CLEs.  As I said, such a racket.

Basically. I got screwed.
I am very sorry for how relatively quiet this blog has been but I've been dealing with a very unpleasant situation the last few months, and now I need help.
Essentially, I tried to help someone out, and she took advantage of me, and I have no way to recoup my losses.
Earlier this year, I moved into a new house. Before we sold the old house, a Now-Former friend ran into some trouble and was about to become homeless with pets and a small child. Not wanting them to be on the street, we offered to hold off selling the old house so she could stay there for a little while, if she could pay the cost of the mortgage on that house (because I could afford one mortgage but not two) while we helped her find somewhere more permanent.
I was not making money from this- since I was still paying the utilities and property taxes, I was actually losing money, but willing to soak that in order to help her save up and get her on her feet.
Instead, she:
Never Paid a Dime towards covering the mortgage costs like she agreed ($12,000 for the nine months she was there)
Trashed the house ($500 dump fees for the trash alone)
Let her pets piss and shit all over the house ($1,500 bio hazard cleanup, $4000 to replace the carpet and other damaged flooring)
Caused an electrical issue in the garage ($900 to repair)
Broke the washer, dryer and refrigerator ($2500 to replace)
Broke the fence ($1000 to repair)
When I told her I could no longer financially support her and that I needed to sell the old house, she illegally squatted there for a solid three months and I had to hire a lawyer and actually take her to court to get her to leave ($2,500)
The resulting stress has been, as you can imagine, stressful.
So stressful, in fact, that it aggravated a the medical conditions my husband had and made him extremely sick. He had to go to the hospital and take time off work to recover. Now the health insurance is trying to weasel out of paying his short-term disability claim.
So net, this woman has managed to cost me around $25,000 and that's not taking into account the missed paychecks and medical expenses. I do not have $25,000, and until at least $13,000 of that is spent to repair the damage she did, I legally cannot sell the house to even begin to recoup my losses.
Theoretically, I could sue this woman, but she doesn't have any money and it would be me paying even more money I don't have to get... Nothing. So I'm asking for help to cover the costs of getting the old house ready to sell, my husband's medical expenses, and other expenses incurred by this debacle:
If you can help out in any way-share, donate spare change, anything- I'd be extremely grateful.
Thank you.

Random thought!
But just imagine 35 years old CEO Gojo Satoru falling in love with the young woman whom he hired to be his surrogate.
Desperate at this point to fulfill his role as CEO and the heir of his family clan, he knew he had no other choice but to find someone who would be willing to give birth to his child.
He thought his ex-wife was the one. After all, she was pregnant when they were still together. When the due date came around and Satoru heard that she gave birth to a healthy baby boy, he was over the moon until he saw the baby for himself.
He knew that that wasn't his baby. Blonde hair and green eyes? No one in his family had blonde hair and green eyes. So he asked for a DNA test. His ex-wife refused at first, but then she gave in, and when the test came back, the baby was 99.99%, not his child.
He was broken. He served her divorce papers the following day, and after everything he had done for her, this is how she chose to repay him. As if cheating wasn't enough, she had to get pregnant and gave birth to another man’s child.
So now here he is sitting in a cafe waiting for the surrogate.
...
You didn't have much of a choice. 26 years of age and still struggling to get your bachelor's degree just so that you could live a comfortable life and be financially stable.
But with the way things are right now, you knew that it was an impossible task to complete your final year. You could hardly manage to pay your school fee. You kept on getting rejection letters from student loans, and let's face it, you barely had time to study to even try to get a scholarship.
So now you're stuck looking for a quick and easy way to make money. You had little options, and prostitution just so happened to be one of them. And you almost turned to it, that's until you heard that a "rich" CEO was looking for a woman who was willing to give birth to his heir.
So now that's how you ended up in the situation to you're in currently. Nervously playing with your fingers as sat across from no other than Gojo Satoru.
"Your name is Y/N?"
"Yes, and you're Mr. Gojo Satoru."
He shook his head yes while taking a sip of his coffee. "I hope you don't mind meeting like this. I thought it would be better to meet in a more casual setting instead of my office. I don't want to intimidate you."
"That's fine, Mr. Gojo."
"Before we get started, are you sure you want to do this? I want you to be absolutely sure because once you sign the contract, there is no backing out of it."
You shook your head yes before responding, "it's something that I've thought about deeply, Mr. Gojo, and after reading through the contract a few times, I came to the conclusion that I would rather have a baby for a stranger who is willing pay to me more than what my school fee is worth than go and become a prostitute."
He was shocked by your words but said nothing of it. It wasn't his place to say anything or have any comment about your personal life.
"Well then, I guess we can go ahead and meet with our lawyers and sign the contract."
"Lawyers? I thought... I can't afford a lawyer right now," you said to him.
He chuckled, "I figured that that would be the case. No worries, I had already hired a lawyer for you."
"You did?" You asked. Just then, the door to the cafe burst opened, and in came a man and a woman dressed in suits.
"Ah, there they are. Right on time."
Gojo stood up and greeted the lawyers before he introduced you to them. The man, Mr. Nanami Kento is his lawyer, and the woman Tetsu Akari is your lawyer. First impression she has a kind and calm aura around her.
But let's move down the line.
You four all sat and discussed what was on the contract, and before you signed it, Gojo asked, "Is there anything that you need to clarify before signing the contract."
"Yes, uhm, it's about the procedure. Are we going to uhm... have... uhm intercourse to conceive the baby?"
"We could since it's the safe way to go about this, but no," he answered with a small smile on his face.
"Ok then, where do I sign."
This is the beginning of how Gojo Satoru fell in love with the woman he hired to be his surrogate.
