What are the key steps a company should take when preparing for trademark litigation to ensure a strong case against an alleged infringer?
When preparing for trademark litigation, a company should take the following key steps to ensure a strong case against an alleged infringer:
Evaluate the Strength of the Trademark: Ensure the trademark is registered and has a strong, distinctive character. Generic or descriptive marks are harder to defend.
Gather Evidence of Use: Collect comprehensive evidence showing the continuous and consistent use of the trademark. This includes advertising materials, sales records, and product packaging that demonstrates the trademark's presence in the market.
Document Infringement: Obtain and preserve evidence of the alleged infringement. This can include photos of the infringing products, copies of advertisements, and samples of the infringing goods or services.
Prove Likelihood of Confusion: Prepare evidence to demonstrate the likelihood of consumer confusion. This may involve surveys, expert testimony, and comparisons of the trademarks in question, focusing on similarities in appearance, sound, meaning, and commercial impression.
Assess Damages: Quantify the financial impact of the infringement. This involves calculating lost sales, damage to brand reputation, and other economic losses attributable to the infringer's actions.
Seek Legal Counsel: Engage an experienced intellectual property attorney who specializes in trademark law. They can provide strategic guidance, handle legal procedures, and represent the company in court.
Send a Cease and Desist Letter: Before proceeding to litigation, send a cease and desist letter to the alleged infringer. This demonstrates a good-faith effort to resolve the issue without court intervention and can sometimes lead to a settlement.
File a Complaint: If the cease and desist letter does not yield a satisfactory response, prepare and file a detailed complaint with the appropriate court. The complaint should outline the trademark's validity, the nature of the infringement, and the relief sought.
Prepare for Discovery: Be ready for the discovery phase by organizing all relevant documents and evidence. This includes responding to the infringer's discovery requests and preparing for depositions.
Maintain Public Relations: Manage public communications carefully to protect the company's reputation during the litigation process.
By following these steps, a company can build a robust case and improve its chances of successfully enforcing its trademark rights against an infringer.

Iowa Lawsuit = More Bad News for Assisted Living
In January of 2022, a resident with dementia wandered out of her Assisted Living Memory Care facility in Iowa and ultimately, froze to death. The State of Iowa investigation uncovered that the resident wandered outside of the building at 9:30 p.m. the previous night. Her absence went unnoticed for eight hours plus even though the alarm system for the facility used to deter or prevent wandering,…

the team meeting aaron's lawyer!wife who's personality is similar to his + she's the best in her field
Langston & Bell | [A.H]
Tumblr media
Pairing: Aaron Hotchner x Lawyer wife!reader | WC: 1.2k | CW: Not really anything except for a little law jargon and mentions of a case the BAU is working on.
A/N: My brain hurts from looking up law terminology, and I'm not even sure if I used all the words correctly
Tumblr media
The glass doors of Langston & Bell opened as Hotch led the rest of his team inside. The air felt heavy—as they entered—from the scent of freshly brewed coffee and a faint lemony aroma.
The firm itself was one of the most prestigious ones in all of Virginia, and its reputation suited it. Everything about the space was designed to impress—shining marble floors in the lobby, towering bookshelves filled with thick leather-bound volumes of law books and journals, and abstract art that screamed of a space aimed to do business with rich and pretentious people.
Emily glanced around, clearly trying to process how they’d ended up here. “Langston & Bell?” she muttered under her breath. “Isn’t this place out of our league?”
“They’re not dealing with criminal justice,” Spencer pointed out. “They specialize in corporate litigation and high-profile estate law. The firm is known for taking on cases that require absolute discretion.” Emily tried her best not to roll her eyes at Spencer's outburst of knowledge but failed.
Hotch didn’t respond, he kept his pace steady as he approached the front desk. His usual stone-faced demeanor was on full display, his features—although set not completely in a frown—were unreadable. He seemed unbothered by the hushed stares they received from the staff as they had entered with their badges held out in front of them.
The receptionist, a young woman with a straight posture and a sharp smile, greeted them. “Good afternoon. How may I assist you?”
Hotch stepped forward, his voice even. “We’re with the FBI. We’re looking for the attorney who handled the probate case for Samuel Larkin.”
The receptionist’s fingers danced quickly over her keyboard, her expression unchanged. “That would be Attorney Hotchner.”
Dead silence.
Emily blinked. “I’m sorry, did you say Hotchner?”
“Yes,” the receptionist replied, unfazed, almost on the brink of annoyance. “Would you like me to see if she’s available?”
“She,” Morgan echoed, his brows furrowing a little as his gaze flipped from the receptionist to Hotch.
Before anyone could recover from their shock, the sound of sharp heal clicks echoed through the lobby.
“Aaron,” came a clear voice from behind. “If this is your idea of surprising me, I’ll admit it’s more creative than flowers. But I have a deposition in thirty minutes.”
The team turned as one, their collective gazes landing on the woman who had just entered the room. You were dressed in a tailored navy suit that emphasized your poised demeanor. Your expression was both curious and faintly amused as your eyes locked on Hotch.
“Counselor,” he greeted smoothly, his tone carrying a subtle warmth that the team rarely heard.
“Counselor?” Rossi asked, a slow grin forming as his gaze flicked between you and Hotch.
Your lips quirked up in a small smile as you approached, your heels clicking against the marble with each step. “I assume this is your team?”
“It is,” Hotch confirmed.
You turned your attention to the group, giving them a brief once-over with an expression that wasn’t unkind but clearly measured. “Well, where are my manners? I’m Y/N Hotchner, senior litigation partner here at Langston & Bell. And yes, I can see the wheels turning in all your heads.”
Morgan crossed his arms, already grinning. “Oh, I’ve got a lot of questions right now.”
You raised an eyebrow, unfazed. “Feel free to ask them, Agent Morgan. I’ve been cross-examined by some of the sharpest minds in the country—I’m sure I can handle you.”
JJ stepped forward, clearly trying to keep her surprise in check. “Wait, you’re married?”
You tilted your head toward Hotch, your expression softening just a fraction. “You didn’t tell them?”
“It never came up,” Hotch replied with a shrug, though the faint glimmer of amusement in his eyes didn’t escape you.
You shook your head, exhaling a soft laugh. “Aaron’s great at compartmentalizing, isn’t he? Well, to officially answer your question—yes, I’m his wife. And judging by your expressions, this is news to you.”
“Big news,” Emily muttered, still processing.
Hotch cleared his throat, subtly redirecting the conversation. “We need access to the probate records for Samuel Larkin. Anything that might help us build our case.”
Your demeanor shifted instantly, professionalism overtaking the playful edge. “Aaron, you know I can’t just hand over client information without a court order.”
“We’re only asking for publicly available records,” he clarified.
You studied him for a moment, a silent exchange passing between you. Then you turned to your assistant, who stood nearby. “Jane, pull the Larkin docket and bring me all publicly filed documents. Annotate them if you have time, and leave them on my desk before your shift ends.”
“Yes, ma’am,” Jane replied, already moving toward the elevator.
“You always find a way around the rules,” Hotch said, his voice was low but carrying a note of fondness.
“And you love that about me,” you shot back with a wink, your eyes glinting with mischief.
Morgan leaned closer to Emily, his voice just loud enough for her to hear. “I don’t know what’s more surprising—the fact that he’s married, the fact that she's a lawyer, or the fact that she might be scarier than him.”
Although Jane hadn't gone through the records yet, she sent you a digital copy as soon as she had found them. You walked the team through them with ease. Every legal term you used was calculated, giving away as little about your client as you could, while still helping your husband and his team. You made sure to translate every dense legal jargon into actionable insights every time you saw one of their faces pull an expression.
“Here,” you said, pointing to a transaction on the financial statement. “These wire transfers are from an offshore account linked to Larkin. It’s not evidence of criminal activity, but it raises enough red flags to warrant further investigation.” If Larkin found out you had helped the feds, you could be in big trouble, you thought as you revealed the account.
Spencer leaned in, his eyes lighting up with understanding. “If we trace the accounts, we might uncover a connection to our unsub.”
“Precisely,” you replied, offering him a small nod of approval.
By the time the team wrapped up, they had everything they needed to move forward. As they gathered their materials, you leaned against the edge of the table, folding your arms as you looked at Hotch.
“Dinner at seven?” you asked, your voice softer, the edge of professionalism giving way to something more personal.
“Seven,” he confirmed, his tone lighter than usual.
You smiled, leaning in just enough to lower your voice. “Try not to scare anyone off before then, okay?”
“No promises,” he replied, his lips twitching upward in the faintest of smiles.
As the team exited the building, Morgan shook his head in disbelief. “She is definitely scarier than Hotch”
Emily grinned. “I think I like her better.”
“I like her too,” Rossi added with a chuckle.
Hotch walked ahead, the faint smile still playing on his lips, but he didn’t say a word. He didn’t have to. The team had seen enough to know he’d married his perfect match—an equal who could still challenge him enough to keep him on his toes.

"The vision
“Every lawyer has skills that can help the climate. We’ve just gotta make the connections.” — Environmental lawyer and advocate Matthew Karmel
The spotlight
“How many lawyers does it take to break a Guinness World Record?”
Matthew Karmel posed this question on LinkedIn in February, adding, “No, this isn’t a bad lawyer joke; it’s a reason for climate optimism.”
Karmel, a principal at the law firm Offit Kurman and the chair of its environmental and sustainability law practice group, is one of the organizers of the Climate Pro Bono Bootcamp, a two-day virtual conference dedicated to helping more lawyers and legal professionals figure out how to donate their time and skills to advance climate work.
When people — including lawyers themselves — think of the intersection between climate and law, their minds may go straight to high-profile climate lawsuits or other legal action aimed at holding big polluters and inactive governments accountable. But there are many other forms of legal support that climate causes might need, from simple contracts to forming a new business or nonprofit to legal defense. “There are so many attorneys working at large law firms, small law firms — attorneys everywhere who just don’t do litigation, but are still very passionate about climate change and want to apply their skills in that way,” said Stephanie Demetry, the executive director of Green Pro Bono, an organization that matches attorneys with companies, nonprofits, grassroots leaders, and others who need legal assistance to advance climate solutions.
Karmel had the idea for the conference in late 2023, after he had been working with Green Pro Bono for a few years. “I was sitting there thinking, Why isn’t everyone doing this?” he recalled. “The things I’m doing aren’t unique. It doesn’t require specialized legal skills. It requires passion, and the general legal knowledge that every lawyer has.” He approached Demetry with the idea of hosting a training to help demystify what climate-related pro bono work can entail and build up the network of attorneys interested in offering it.
They held the first bootcamp in January of 2024 and had around 700 attendees — far exceeding their expectations. After the event, Demetry said, Green Pro Bono more than doubled the number of attorneys in its network and also saw a 53 percent increase in the number of projects that got picked up.
But for this year’s bootcamp, planned for late April, they’re aiming to increase that attendance — and setting the ambitious goal of growing it a hundredfold. That’s the number that would break a Guinness World Record for the largest attendance at a virtual law conference in one week (yes, this entry truly does exist). It might be a longer-term goal, but it’s one they’re serious about. Breaking the record, Karmel said, would be a powerful way to demonstrate the growing interest in climate action among the legal community, and also an opportunity to reach thousands more attorneys, students, and others with the event’s key message: that you don’t have to choose between your day job and working for the causes you care about."
You can find out more about the climate pro bono bootcamp, which is FREE, right here. It's April 22 & 23, 2025 at 12:00pm – 5:00pm EDT

Residents of Jersey have been recommended bloodletting to reduce high concentrations of “forever chemicals” in their blood after tests showed some islanders have levels that can lead to health problems. Private drinking water supplies in Jersey were polluted by the use of firefighting foams containing PFAS (per- and polyfluoroalkyl substances) at the island’s airport, which were manufactured by the US multinational 3M. PFAS, a family of more than 10,000 chemicals, can build up in the body and are linked to conditions such as kidney and bladder cancer, thyroid disease and immune deficiency.
you read that correctly. bloodletting. like leeches.
before you freak out, if you are an American, this is the island of Jersey in the United Kingdom. i wanted to get that out of the way first so i can address this fucking travesty.
since the 1950s, 3M and Dupont have concealed information about the harmful effects of PFAS. the movie Dark Waters with Mark Ruffalo is specifically about Dupont and it's rampant pollution. 3M has been dumping PFAS in rivers and waterways not just in the United States, but across the globe for decades despite knowing with full detail the risks involved to the public. they even managed to intimidate a 3M scientist into staying quiet and pulled her off research into the toxicity of their products when she made the discovery.
at the same time, Jersey authorities were aware of this problem as early as the 1990s but didn’t switch the water source for the affected areas until 2006. they continued using contaminated storage tanks for foam until 2022 despite knowing the risks. this is blatant criminal negligence all around.
this part of the article in particular is so disgusting:
Despite the growing evidence of health effects, compensation remains unlikely. Jersey’s government signed a confidential deal with 3M in 2005, agreeing not to pursue legal claims for £2.6m towards cleanup. Jersey must also assist 3M in defending any future claims. A source who asked not to be identified said Jersey needed 3M’s permission to proceed with blood tests to avoid corporate backlash. “The state got an agreement to do individual blood tests, but not screening, as that could be the first step towards a possible class action lawsuit.”
3M’s gross profits in 2023 totaled over $14 billion and they can’t spend $3 million to clean up a mess that is quite literally responsible for killing people because by doing so, it opens them up to litigation involving every other mess around the globe where they’ve directly poisoned people with PFAS (or continue to poison).
but by far the most prescient part of this is the fact that Jersey's government had to obtain permission from 3M, a US corporation and the suspected perpetrator of a crime that has left at least one of their citizens terminally ill, if they could even do blood tests to check if they were responsible. the oligarchy truly knows nothing of borders.

2025 Supported Org: Disability Law United
Nearly all of America’s systems – from education to healthcare to public transit – are more difficult to navigate for persons with disabilities. Although the passage of the Americans with Disabilities Act (ADA) in 1990 established a new standard of protection and support for disabled people in many spheres of public and civic life, the harsh reality is that most of these systems fall far short of what the law requires of them in terms of accommodating and supporting disabled people. The existing problems have been compounded by the United States’ widespread return to pre-COVID protocols and practices, leaving anyone who is unusually vulnerable to COVID or its aftereffects with fewer pathways through public life.
Tumblr media
Disability Law United (formerly The Civil Rights Education and Enforcement Center) is a nonprofit legal organization that fights for liberation and equity through the lens of intersectional disability justice. Their work is informed by grassroots movements for systemic change and centers the concerns and goals of people with disabilities who are confronting barriers to accessing programs and services and resisting oppressive legal systems in the United States.
Disability Law United’s legal expertise in the disability-rights frameworks of the ADA and the Rehabilitation Act allows them to move the dial for intersectional disability justice across a variety of systems that deny the humanity, dignity, and agency of disabled people. They further their aims through a combination of public education, coalition and policy work, systemic-change litigation, direct legal services, and technical assistance to movement leaders and community-based partners, strengthening social movements and upholding human rights.
They focus on supporting and defending disabled people who are experiencing discrimination and exclusion at the intersection of other systems of harm. Their work encompasses improving access to public services and spaces, disaster and environmental justice, immigration, and incarceration and policing.
You can support Disability Law United as a creator in the 2025 FTH auction (or as a bidder, when the time comes to donate for the auctions you’ve won.)

What is Licensing? and how can I obtain it?
Trademark Licensing is an official contract where the registered trademark owner grants permission to another party to use the TM symbol under particular conditions. Basically TM Licensing permits the licensee to sell the product or services by using the licensor’s trademark. It helps in expanding a brand reach, enhancing market value and generating revenue without the licensor directly engaging in production or distribution.
To obtain a Trademark License, follow these steps:
Step 1- Identify potential licensors: Research and identify trademark owners whose brands align with the goals and target markets of your business.
Step 2- Negotiate Terms: Talk with the trademark owner about the scope of use, duration, territory, quality control standards, and financial arrangements, such as royalties.
Step 3- Draft and Sign Agreement: Create a comprehensive trademark licensing agreement that clearly outlines the terms and conditions of the agreement with the help of legal professionals. The document should be reviewed and signed by both parties.
Step 4- Comply with Agreement: Ensure compliance with the terms of the agreement, including quality control, usage guidelines, and royalty payments.
When dealing with trademark licensing, it is advisable to consult a legal expert who specializes in intellectual property law.
